539 Board met in regular session at 7:45 P.M. All members present. Attorney Vitus Jones appeared before the Board and filed agreement Hof Harter Realty Company regarding water taps on Struts in Harter 'He i,rghts, requesting the Board es approva 1.of same. Also discussed the width Qf streets in Harter Heights. The matter of agreement on water taps was referred to the Water Dep to be taken up at re _;ulcer sess ion on Wednesday May 9th. ,1917. Hearing had on. Improvement Resolution No. 518 for pipe sewer on you �o. rest from Uiami Street to point 100 feet west of the west line of Leer Street, `the City of South Bend, Indiana. Upon said hearing no remonstrators appeared and no written remon- strance was filed. And the Board being fully advised in the premises, decides that the benefits to property liable to be assess�cd for said improvements are equal to the estimated cost of the same, as reported by the City Civil Engineer, and thereupon takes -final; action on said resolution as originally adopted, and the same is hereby in all things ratified, c onf irmed and approved. Resolved further, that notices. be published on the 9th, day of May 1917 and on the 16th. day of May 1917 in a newspaper of general circulation in said City, starting that this Board will receive bids for the construction of said improve- ment up to 10; 00 A.M. on the 22n.d day of May` 1917. The. Board reserves the right to reject any or allbdds. And the Board being fully advised in the premises, decides that the benefits to property liable to be assessed for said improvements are equal to the estimated cost of the same, as reported by the City Civil Engineer, and thereupon takes final action on said resolution as originally adopted, and the same is hereby in all things ratified, c onf irmed and approved. Resolved farther, that notices be published on the 5th, day of Uay 1917 and on the 16th. day of Uay 1917 in' a newspaper of general sire -nation in said City, stating that this Board will receive bids for the construction of said improvement up to 10:00 A.I. on the 22nd. day of May 1917. Hearing given on Vacation Resolution No. 37 for the purpose of Vecat ing Bowman Street from Leer Street to East line of She South East Addition, in the City of South Bend, Indiana. In the above matter no remonstrators appeared and no written remon- strance was filed, therefore the Board sustain all former action taken and declare the above described property in all things vacated and this resolution in all things ratified, confirmed and approved. Resolved further, that the City Engineer be instructed to prepare a, roll showing awards of damages and assessments of benefits to all parties and pro- perties interested in the above matter, 54U Hearing had or Improvement Resolution No. 506 for Pavement on alley lying between Bank Out Lots 14 and 15 and between lots 3 and 4 in Miller's Sub. Div. og bank out lots 8 and 9 and between Lots 11 and 13 and lots 10 and 12 in Chapin's Sub. Div, of Bank Out lots 1 and 2 from south line of Lincoln Way Test to -north line of Colfax Avenue, In the City of South Bend, - Indiana. Upon said hearing a remonstrator appeared but no written remonstrance was filed. And the Board being fully advised in the premises, decides that -the benefits to property liable to be assessed for chid improvement are equal to the estimated cost cif th 9 same, as reported by the City Civil Eng ineerm and thereupon takes final action on said resolution as originally adopted, and the same is hereby in all things ratified, confirmed and approved. Resolved further, that not•i es be published on the 22nd day of May 1917 and on the 29th. day of Uay 1917 in a newspaper of general circulation in said City; stating that this Board will receive bids for the construction of said improvements, tip to 10:00 A.U. on the 5th. day of June 1917. The Board reser1ges the right to re j'ect any or all bids. ° / Hearing had on assessment roll andf inal est ima,te on pipe sewer on N -Foster Street from Howard Street to St. Vincent Street, under Improvement Resolution No. 476. In the City of South Bend, Indiana. Ira. the above°matter no remonstrators appeared and no written remon- strance wa.s filed. The Board therefore find that the property assessed in said rollsClf fled April 24th. ,1917 is benef itted in the - amount of assessments as shown on said rolls, and the Board further find that the assessment rolls filed April 24th. 1917 and the final estimate allowedApril 24th.°1917 should be and the same is hereby in all things ratified, confir-ed and Approved. ° Hearing given on Vacation' Resolution No. 38 for Vacation of Scott Street from point 30 feet north of the south - line of lot 7 in Raff's First Add. to the northerly line of Raff's 3rd. Addition, in the City of South Bend, Indiana. In the above matterno_.:_r:em.onstra.tors a,ppearea and no written remon- strance' was filed. The Board therefore sustain all former action taken and declare the above described property in all things vacated and this resolution in all things ratified, confirmed and approved. ° Resolved further that the City Engineer be instructed to prepare 4 roll showing awards of damages and assessments of benefits toall parties and properties interested in the above matter. Complaint received from property owners on South kichiga,n, that said street is in bad condition. This matter was referred to the Street Commissioner for invest igat ion. Councilman --Seifert appeared before- the Board in regard to water mains being placed on Foster Street from Howard Street one block. Same referred to the Water . Department for investigation. 'In regard to the hearing on south Main Street from Ewing Avenue to . Jay Street , the vacation of same, The Board decided, to hold up said decision until their made trip to investigation said street. ' Same deferred until Tuesday Uay 15th. ,1917 at 7: 45 P.U. The Width of roadways in. Harter Heights Addition was discussed by the Board, and it was decided to leave said roadwaysat wuidth of Thirty (30) feet as v.-platted. The Board decided to discuss this further at Water Works meeting to be held Wednesday Uay 9th. ,1917, when they would take up the matter of where taps were placed in said stbeets. The Board ordered that the City Attorney be requested to draw up an -notice to be served on the Chicago, South Bend & Northern Indiana Railway Co]ppaay to start work on Mishawaka Avenue within Ten tlO) days after notice is served. v on Ha ` t He i hts C o tray t Assignment of Heber P. The contractor further expressly covenants and agrees that in the prosecution of said work all proper skill and care will be exercised; that he will properly guard and protect all excavations and dangerous places, and will use all due and proper precaution to prevent injury to any person or property; that in the event of any injury or damage resulting from the work or resulting from any matter or thing connected therewith or arising there- from, to any person or property, he will pay and liquidate the same at his own expense, and assume the liability therefor; and in the event of any claim or claims being made or any action or actions being brought against the city by reason or on account of or growing out of said work or its construction, the said contractor will at his own expense defend the same, and will pay any judgment recovered therein, and will in all respects fully indemnify and save harmless said city, its officers, agents or representatives from all cost, expense, payment or judgment recovered in connection with such claim or claims, action or actions. And if within ten days after any such action is begun, the city shall notify the contractor of the pendency thereof, then any judgment rendered against the city shall be conclusive against the contractor and against the surety on his construction bond, as to the amount, liability and other matters pertaining thereto. i' And the contractor agrees to maintain said improvement and make such repairs as may be necessary for the period and in the manner as fixed by the` specifications, and to secure the maintenance and repair thereof to file with the Board of Public Works a bond with sufficient surety thereon and in an amount as fixed by the specifi- cations. And in doing such repair work the contractor and the surety on his guarantee bond shall be subject to the same liability to the city and any other person for any injury or damage to any person or property in the same manner and to the same extent as is fixed in the last preceding paragraph covering the construction work.
