Indiana April 19th. 1917. To the Beard of Public Works City of South Bend, Indiana. Gentlemea: . . We are pleased to inform you that we have our paving organization on the ground and ex-oect to begin operations within the next fear days: We were in hopes of starting work in Mishawaka Ave. & Eddy Street improvements, but an inspection of these two streets shows that aa, very large amount of preliminary work must be done before we can s tert operaavt ions: These streets are to be increased in width and there are to be found within the new lAaes of these improvements the following obstructions; The Bell , Home, Western. Union and Electric light poles, lamp pests, fire hydrants and the poles of the Traction Co. We presume however that the poles of the letter company will be taken care of as soon as the reconstruction of their tracks are begun. LOCAL SEWER IUIPROVElvENT RESOLUTION NO. 518. v Resoly d by the Board. of Public works of the Citd of South Bend, St, Joseph County, State of Indiana, That the construction of e, local sewer, intended and adapted only for local use -by the property holders whose prap:erty abuts, thereon, and not intended and adapted for receiving sewerage from collateral drains, be and, the same is, hereby ordered in and along Donald Street from k.iemi Street to s. point loo feet west of the west line of Leer` Street as follows:- -to wit: Beginning at the intersection of the center line of Miami Street and Donald Street; thence east along the center line of Donald - ,Street to the center of Y4r ine„ Street with a 12 inch vitrified pipe sewer; thence still east along .the center line of Donald Street to a point 100 feet west of the west line of Leer Street` with a 10 inch vitrified pipe sewer. Together with. the necessary manholes, storm water inlets, conduits and house connections to the curb line along the line of said improvement. All as shown .on the plans and in accordance with the profiles, detail drawing$ and specifications on file in the office of the Department of Public Works of the Cite of South Ben4, Indiana, and said sewer, with all its appur- tenances shall be constructed in accordance with the profiles and specifications now on file in the office of the Department of Public Works ofsaid City. The cost of said improve- ment shall be apportioned against and paid by the property holders whose property abut& thereon., and upon the City of South Bend if th City is benefitted by said improvement, all according to the method and manner prdved for in Act of the General Assembly of the State of %diana, entitled " An Act Concerning Municipal Corporations, ",approved March 6,1905. Assessments, if deferred, are to be paid in ten equal annual installments, with interest 'at the rate of Six per 'cent per annum. A bond or bonds shall be issued to the contractor in payment for s.ubh work, unless the ,property owners pay said assessment's before said bond or bonds are issued.. Under no cirumstances shall the City of South Bend be or be held respn.sible for any sum or sums due from said property owner or owners for saaid work, or for the collection of same, or for the' payment .of any bond or bonds, certi- ficate or certificates, issued to said ccntractor in payment for such work, except -for auch moenys as shall have been actually received by the City from the assessments for such improvement, or such moneys as said City is by said above entitled Act required to pay All proceedings had, and work done in the making of said im-:)rogement, assessment of property, collections of .assessments and issuance of bonds therefor, shall be as provided for in said above entitled. Vander Karr party of the first part, and the City of South Bend, Indians,, by its Beard of Public Works, party of the second pert, WITNESSETH: That for and in consideration of the prices here inaf ter stated; to be paid to the party. of the first part by the party of the second part, the said party of the first part hereby agrees to repair all asphalt pavements in the streets of said City, %nd-to furnish all materials and labor required in doing said work until March l-t., 1918. All of said requiring is to be done at places as directed by the Street Com- missioner of said ` City, or -by -his deputy. Said party of the first part agrees to use first class material in doing said work, and he further agrees to place barricades and red lights at the places where said reapri work is being —done by him, in such manner as to protect all persons, in using said street, from injury. In consideration of the performaancs of said work by the party of the first part, the said party of the second part agrees .to pay him therefor the sum of Two Dollars and twenty cents ($2.20$ per sq. yd. for all resurfacing and repair work, except the grouting or foundation concrete is kaeken through or is in such condition that is cannot be used, in which instance the party of the first part shall receive Two Dallas and sitky five cents ($2.65) per square yard. Said sums are to be paid after said work has been inspected and approved by the Street Commissioner of aid City, or by the City Civil Engineer. The party of the first part f ether agrees that he will do all. of said work in a good and workmanlike manner, and that he hereby gda.rantees all of said r psir work to be and re -main' in good condition for a period of one year fro the time such repair work is done; and if during said year, said repair work so done should be come defective, the party of the first part agrees to replace the same, ;.with good material, or upon Failure to` do so, to refund to said City the amount received by him for such repairing. And said party of the first hart- further - agrees to indemnify and save harmless the said party of the se and part from all damages to any person ot. property by reason 6f the negligent performance of said work by the party of the first part. And said party of thy; first part further' agrees that after repairing any place in any of the streets of said City. -he will immediately thereafter remove all dirt and refuse to the curb of° said street, And it is further agreed tha,tthe party of the first part may use all material taken out of the streets relqaired by hire, which material is in first class condition and suitable to be used in doing said repair work, And said' party of the second part, s a part of the consideration of this contract, agrees to -loan to said party of the first part asohilt plant, all asphalt tools, which it now owns, and said party of the first part agrees to pay for the use of the same at the rate of One and 50/1W($1 50)dollars per day for such fume aEs said tools are actually used or 5 cents . per sq. yd. of asphalt surface laid and said party of the first part agrees to keep said tools and plant in good reair and return the same to said party of the second part in good condition less natural wear and tear. The said party of the firstpart agrees to do and execute said work at tines and. places as designated by the Street Commissioner of said City, and under his direction. And if he should fail and refuse to do the same, as by. the terms of this contract required, then said party of the second part may,at its option terminate this agreement. And if said party of the first ' part should fail to perform this agreement or any of its terms and conditions, or if he should fail -to do any work within one week after he is directed so to do, except where shortage of material is caused by railroad strike_ or. freight embargo, then he agrees to pay said party of the second part the sum of fifty and no/100 Dollars ($50.00) as liquated damages fqr such failure, e-nd said party of the second party may retain said sum out of any money, due said party of the first part, said suer to be paid to said first party under. the completion of the work to be done under this contract. And in addition to said sum above referred to, the said party of the first part further agrees to give `a bond with_ a good and sufficent surety thereon approved by the Board of Public Works of said City for the faithful performance of bliis contract.
