The contract for ,lighting River ,Park, this, ,City was approved by the Board and referred to the Common Council their ratification: - A G R E E M E N T THIS AGREELONT, Made this 23rd. day of April .1917 by and between the City of South Bend, Indiana, by and thourhg its Bayard of Public Works, party df the first part, and the Welsbaeh Street Lighting Company . of America, aa, corporation, party of the second part, - WITNESSETH: -- That the parties hereto, for and in consideration of their mutual ;promises and agremenents hereinafter contained, do, for themselves, their successors and assigns, agree and bind themselves, as follows: That the party of the second part agrees to furnish to the party of the firs-t part improved We°lsbaeh Street Lights along the mains of gas company as they now exist, or may be extended during the term of this agreement, in that part of the City of South Bend, Indiana known as River Park , and the party of the second part agrees to maintain the same in accordance with the agreements herein.contained for the period of five yeare commencing May 1,1918, and ending at Midnight on April 30,,1923. EQUIP&ENT AND SERVICE. The party of the second part further agrees to furnish and erect, at its own cost and expense, and at such points and places as may designated by the Board. of Public Works of said City, first-class iron lamp pasts and boulevard lights, equipped` with the improved attachments for the Welsbi6eh System of Street lighting.. The lights to be furnished for and used upon Mishawaka Avenue, and furnished by the party or-- the second part shall be No. 62 Boulevard lamp with the round Alba Globe. And the party of the second part further ' agrees to furnish, at its awn cost and expense, all Kluminant mantles and material necessary for properly lighting, extinguishing, cleaning and repairing said lamps and equipement. It is understood and agteed than, all posts, lanterns and equipment furnished by the said Party of the second part under and a_ursuant to the terms of this agreement shall; at.all times, be and remain the property of the party of the second part, and may be reinoved br- it at the termination of this contract. The party 6f' the second part agrees to furnish name signs for all corner lamps,' Excepting the new number sixty--twe boulevard lamps. L IGHT ING SCHEDULES., The lamps shall be ',lighted every.night in each month, and shall burn from dusk to twelve o clock midnight; but the Board of Public Works reserves the right to require said lights, or any of them, to burn until one O'clock A.M., or during the entire night time, under the terms and conditions hereinafter stated. COMPENSATION. In cord iderat ion of the furnishing of said lights and equipment, and for the faithful oerfornance f and compliance with all the terms and conditions of this contract by the party of the second part, the party of the first part agrees and binds itself to pay fei all lights furnished by the party of the second part at the fallowing rates: Uidn ight service per annum. 60 candle power single upright mantle burner, per lamp................................14.64 150 candle power double inverted mantle burner, each....................................23.04 One O'elock service per annum. 60 candle power single upright mantle burner, each.....................................0 15.64 150 candle power double inverted mantle burner, each ............. *so ... ...............$ 24.79 All night service per ae,nnum. 60 candle power, single upright mantle burner, each....... .......................... 20.04 150 candle power double inverted mantle burner, each ..................... ...............32.04 The party of the first part further binds itself to pay for all iiaars furnished and used at the above rates, and at the pro ran:-t:a part thereff at the end of each month for which service has been rendered. The party of the first pa rtb binds itself to take and use at least sixty in number of the 60 candle power laamps as above described; and said party ofh the first part may order and place any of the additional lamps as above described andwill pay for the same at the prices as above stated; and;the party of the second part hereby -agrees properly to place and equip any and all of such lights within a reasonable time after receiving an order so to do from said City, it being understood. that all lamps so installed shall remain in service until the termination of this agreement-. Said party of the first part shall furnish and pay a man to light, extinguish, clean and care for all sai4 lamps, said man ahall be under the supervision of the party of the second part. This agreement shall not be binding until ratified by ordinance of the Comma>ri Council of the City of South Bend, Indiana. Executed .in duplicate on the date first above hamed. Prey ident. .ate
