WHEREAS, the Board of Public Works on the 27th. day of February 1917 did adopt a resolution ordering and requiring the permanent impaovemant of Harrison -Avenue from Fuertz° inner Street to L-incoln Way West, by paving the roadway of the same, and QWHEREAS, the City Civil Engineer . has prepared and filed in the office of this Board a report showing the number and location of the service pipes, mains, conduits and laterals, and connections which are, or will be necessary to accommodate the abutting property owners thereof with gas, -water, sewer and other convenicnes and necessaries; and also said City Civil Engineer has prepared and filed in said office specifications showing the material to be used and the mnerr of laying said service pipes, mains, conduits, laterals and connectins from the mains to the points inside of the curb lines. l THEREFORE, be •it resolved by the Board of Public Works of the City of South Bend, Indiana, that the report of the City Civil Eng iner is adopted, and said report and the spec if icat idns prepared and filed by hime are a p rt of this resolution as fully and effectually as if copied herein at dull length; and it is further ordered that all of such private connections with the sewer, gas and water mains be made in said street by b e ing ing them inside the curb lines thereof. The contractor further expressly covenants and agrees that in the pres- ecution of said work all proper skill and care will be exercised ; that he will properly guard and protect all excavations and dangerous places, and will use all due and proper precaution to prevent injury to any person or property, that in the event of any injury or damage resulting from the work or resulting from any matter or thing.conneeted therewith or arising therefrom, to any person or property, he will pay and liquidate the same: at his o own expense, and assume the liability therefor; and in the event of any claim or claims, bei being made or any action being brought against the city by reason or on account +6f or :growing out of said work or its construction, the said contractor, the said contracto will at iis own expense defend. the -same, and will pay any judgement recovered therein, and will in all respects fully indemnify and save harmless said City, its officers, agents or representatives from all cost, expeace, payment or judgement and save harmless said -City its officers, agents or reprsentatives from all cost, expense, payment or judgement receovered in connection with such -claim or claims, action or actions. And if within ten days :after any such action is begds, the City shall notify the contractor of the pendency thereof, then any judgement rendered against the City will be conclusive against the con- tractor and against the surety on his construction bond, as to the amount, liability, and other matters pertainibg thereto. And the contractor'agrees to mantain said improve ant and made such repairs as may be necessary for the period and in the manner as fixed by the specifications and to secure=the•maintenancenand repair thereof to file wit the Board of Public Works a bond with sufficient surety thereon and in an.�amount as fixed .by the specifications And in doing such repair work the contractor andthe surety.en his guarantee bond.shall b e subject to the same liability to the City and any other person for any injury or damage to any person or property -in the -same manner and to -the same extent as `is fixed in the last preceding paragraph covering the construction work. And it is further agreed by and between said parties that the acceptance of the work provided for in this contract, or the payment thereof, shall not constitute a waiver on the part of the City of aV of the provislvns of this contract, zor shall ' it release said contractor or 'the parties on his bond for the faithful performance thereof; nor shall .the acceptance be prima dacie evidence of the performance -of any , provisdon of this contract, except to the extent of entitling the contractor to the contract price therefor._ The contractor :agrees to pay for ;all labor and materials used or furnished .to be used in the making :of, such improvement and in the performance of this contract whether done or furnished for him, or his agents,., assignees, successor or subcontractor and the City may reserve out of any allowance made on any estimate in favor of the contractor or his assigns, or out of the amount due him or'his assigns upon the com- pletion of the work, s.o much as may be necessary to pay all laborers or material men for the amounts due them for -work done dr materials used or furnished to be used ,in the performance of this contract and the doing of said work, and the county treasure acting as City treasurer, may.retain money collected from property ownera assessed for said improvement to pay such debts or until the contractor shows that they have been paid or satisfied.. The contractor.agrees to remove all rubbish, earth, and unused material in the streets or sides thereof upon the completion of the improvement or the repairing thereof. The work- of making such improvements shall be completed according touthe terms of the contract on or before the 18th. day of July 1917 unless the time for the completion of the same shall be extended in writting by the Board of Public Works ,And it is agreed that Any such extension of time, _o,r any alteration of; this contract or for'the manner or method of doing such work shall in no way affect the duties obligations or -liabilities of the contractor or his sureties.
