Mattes of Wilson Brothers with a petition gor grade, clean out gutters and surface with cinders on West Kerr Street from South Chapin Street to rear entrance of Wilson Brothers Factory. The Board referred the V same to the Street Commissioner and ordered him to repair said street that is dedicated to the City. Contractors bond for the sum of One Thousand 0$1,000.00)Dollars signed. by Hugh Anderson and the United States Fidelity Company of Bal itmore -Ud . was approved by the Board. The City Engineer filed the estimated cost of the pipe sewer improvement on Donald Street from Miami Street to Dale Avenue at ......................$12115.00 Also the -estimated cost of the pips sewer improvement on Fox Street from Miami Street toDale Avenue at ........................................................$ 1,160.00 SIDEWALK IMPROVEMENT RESOLUTION NO. 508.1917.. Resolved by the Board Ef Public Works of the City of South Bend, St. J Joseph County, State of Indiana, That it is desired and deemed necessary to im- prove Donald. Street from Miami Street to the East line of High Street as follows, t owit: - By grading said street from property line to property lines to the established grade,•curbing the roadway with cement curb and constructing cement sidewalk on both sides of said Donald Street. All an sho.�T on the plans, and in accordance with thA prof ikes, detail drawings and specifications on file in the Office of the Department of Public Works, of the City of South Bend, Indiana, in accordance with the profile, details, drawings and specifications on file . in the office of the Depa r mtht of Public Works of said City; and such improvement is now ordered. The cost of said improvement, including the cost of street and alley intersections, shall be'.a.ssessed upon the real estate abutting on said Donald Str�,t all according to the method and manner provided for in an Act of the General Assembly of the State of Indiana,entitled " An Act Concerning Municipal Xorpor- ations," approved March 6,1905, and in a.ccorda.nce with and pursuant to the pro- visions of all amendatory and supplemental act thereto, passed by the General Assembly of the State of Indiana. Assessments., if deferred are to be paid in ten equal annual.instic,llments, with interest at the rate of Six per cent perannum. A bond or bonds, shall be --issued to the contractor in payments of such work, unless the property ocaners pay said assessment before said bond or bonds are issued. Unde Under no circumstances shall the City of South Bend, be, or be held responsible --for any sum or sums due' -from said - property owner or owners for said work or for the collection of the same, or for the payment of any bond, bonds, certificate or certificates, issued to said contractor in payment for such work, except for such moneys as shall have been actually received by the City from the assessments for such improvement, or such moneys as said City is by said above entitled Act required to pay. All proceedings had, and work done in the making of said improvement, assessment of property, collection of assessments and issuaitoe of bonds therefor, shall be as provided ir., said above entitled Act and amendments thereto. Be -It 'Further Resolved, thet the Board of Public Works has approved of a waiver signed by property owners waiving all notice of advertising and hearing on said resolution and Board hereby fixes the 17th. day of April '1917 at 10:00 A.YL. for receiving bids. County, State of Indian,, That it . 1s desired and deemed necessary to improve Ewing Avenue from Miami Street to the west line of. Oak Park Fourth Addition as follows, to -wit: - By grading said Avenue from property line to property line to the established grade, curbing t-_e roadway with cement ourb and constructing ceement didewalk on both sides of said Ewing Avenue. All as shown on the plans, and in accordance with the prof iles , deta it drawings and spec if icat ions on f ile in the Off ice 'of the Department of Pub 1 is Works of the City of South Bend, Indiana, in accordance with the profile, details, drawings and specifications on file in the office of 'the Department of Public Works of said City; and such improvement is now ordered. All as shown 4h the plans, and in accordance with profiles, detail drawiNgs and spec if icat ions " on file in the Office of the Department of Public Works. .And Yaereas, we, the undersigred, are the only persons owning property on said str'eet to be improved, and that we alone are affected in any way by said proposed improvements, That we are the sole owners of the separate parcels of land bordering upon said street proposed to be improved. Therefore, in consideration that said Board of Public Works proceed to improvesaid street as proposed in said resolution, and for the further purpose of saving time and expense„ we, the undersigned, do hereby waive all obections and defense to any defect in said proceedings, and to any violation in procedure for the improvement of said street as fixed by Section 6710 of Burnts Revised Statutues of 1914. We further waive any right to object to the form of said resolution. We further waive any and all objections to the fact that no advertisement for the hearing was publishedas required by law, and that no notice were mailed to the owners of property and that no hearing was held by said Board. We further waive any and all objections to the requirements that in grading said street that a pavement shalo also be laid thereon, and do hereby give our .consent that said irmproveraent be made without such pavement and -waive any and all objections thereto. We also consent that said Board shall proceed to let the contract f or doing said -work in the fol low ing manner; That they shall notify by mail responsible contractors in the City of South Bend, Indiana of said work to be done under said resolution, and that they shall receive bids from said contractors for the doing of said work, and they shall let the contract for the doing of said work to the lowest responsible bidder. And we waive any objection to the action of said Board in letting said contract in a form and manner other than provided by said section 8710: And we further consent that the cost of doing said work shall be. assessedloagainst the different parcels of real estate owned by us as provided by Sections 8710,8711,8714,8715,8716,8717 8718 of Burns's Revised Statutes 'of 1914. And -ve further agree that notice given us by mail shall be suf- ficient notice of -the hearing upon the assessment made for said improvement. WHEREAS, the Board of Public Works of the City of South Bend, Indiana., did, on the 11th. day of April 1917 adopt a preliminary resolution for the improvement of Ewing Avenue Arom Miami Street to west line of Oak Park 4th. Addition, in the City of South Bend, Indianal by the grading the street from property line to property lines, curbing the roadway with cement curb and con- structing cement sidewalk on both sides of said street. All as shown on the plans, and in accordance with profiles, detail drawings and specifications on file in the offices of the Board of Public Forks. And Whereas, we, the undersigned, are the only persons owing property on said street to be improved, and that we alone are affected in any way by said proposed improvements. That we are the sole owners of the seaarate parcels of land bordering upon said street proposed to be improved: i Therefore, in consideration that said Bard of Public Works pro- ceed to imr__ rove said street as proposed in said resolution, and for the further d purpose of saving time and expense, we, the undersigned,, do hereby waive all objections and defense to any defect in said proceedings, and to any violation in procedure for the improvement of said street as fixed by Section 8710 of Burns, Revised Statutes of 1914.
