Board met in regular session at 10:00 A.M. Mr. A. H. Rice absent.
Mrs. Jacob Kuntz appeared before the Board and presented remonstrance
from manufaQturers and freeholders remonstrating against asphalt plant now located
on West Calvert Street between Lafayette Street and Franklin Streets on the right of gray
of the P.C.C. and St. L. R.R. also against asphalt plant on the Var_dalia Ry. right of
way. The Board referred these two remonstrances ;to the Building Commissioner for in-
vestigation.
Bids :were received opened and read as follows: for grade, curb, walk

EASE BENT.
J THIS INDENTURE WITNESSETH, That Mabel Treanor Wood and Harry K. Wood
her husband, of'St. Joseph County, State of Indiana, give, grant and convey to the
City of South Bend, Indiana for the sum of One ($1.00� Dollar and other valuable
considerations, the right, privilege and easement of building in the City of South
Bend, Indiana a trunk sewer over the real estate of the grantor herein described,
which trunk sewer shall be ccnstructed over and along the following line: -
Beginning at a point on the east side of the St. Joseph River located
south 51°44jeast a distance of 530.8 feet from a 1-8 stone boca.ted 1320 feet more
or less east of the north west corner of section 35 Township 138 N. range 2 East,
thence south 700 40' west 675.5 feet; thence to the left 46 0 on a curve of 50
foot radius a distance of 40.2 feet; thence to the right 28*0' on a 16°0' curve
a d-istance of 200 feet; thence to the left 46*40' on a 6°40' curve a distance of
700 feet; thence on a tangent to the 6*40' curve south 38*0' west a distance of
175.5 feet; thence to the right 52*0' on a curve of 50 foot radius a distance of
48.2 feet; thence west a distance of 199 feet to a point 1346 feet south of the
north line of section 34 Twwnship 38 N. Range 2 East and 76.5 feet°east of the cents
of Portage Avenue; thence west to the easterly line of Pottage Avenue.
And the said City of South Bend and its contractor shall have the
right and privilege of going upon said land and using the same for a space of ' twenty
five (25) feet eaeb side of the above described line for the purpose of con-
structing such trunk sewer, which right or easement shall be temporary and shall
exist only until such sewer is constructed; but the City shall have a right and
easement to go upon said land to repair the sewer and keep it in good working
order de_�long as it desires to maintain a sewer bullet over said land, and.along
said line as above described.
The above grant or easement is made for the further consideration that
the grantors here are the owners of the lands lying at the western -most terminus
of the above described line on which a sewer is to be constructed, and that the
construction of such trunk sewer will be of great value and benefit to the grantors
and to their real estate, in that it will afford a proper sewer outlet for their
said land; and this grant and easement is made upon the csnsddera,tion and condition
that said city will, during the year 1917, cause such sewer to -be -constructed, all
of which shall be done in good and workmanlike manner, and in the f#mm and manner
that such sewers are usuallycenstructed in said City.

BE IT RESOLVED BY THE BOARD OF PUBLIC FORKS OF THE CITY OF -SOUTH BEND,
ST. JOSEPH COUNTY, STATE OF INDIANA, that ib is desired and deemed necessary to improve
Pokagon Street.from Leeper Avenue to the east line of Harter Heights Addition, Peashway
Street from Leeper Avenue to the east line of Harter Heights Addition, Napoleon Street
from Niles Avenue to the east line of Harter Heights Addition, St. Joseph Street from
the north line of St. Vincent Street to the south line of Angell& Avenue, Foster Street
from the North line of St. Vincent Street to the south line of Angella Avenue and
Stanfield Street from the north line of St. Vincent Street to the south line of Angella
Avenue as follows, to -wit:
By grading and paving the roadways, also grading and paving
the roadways of all intersecting and entering street and alleys lying within the pro-
perty lin.s of said streets not included in tho roadways; by paving said roadways with
either asphalt, Bitulithic, Asphaltic Concrete, Brick or Bitoslag laid on a five (5)
inch Portland cement concrete foundation, by placing the necessary marginal cement -
curb; by placing all inlets and manholes to the proper grade; by constructing cement
curb where same is not already constructed, and the construction of the necessary storm
water inlets and conduits. All as shown on the plans and in accordance with profiles,
detail draw irigs and specifications on file in the office of the Department of Public Works
of the City of South Bend, Indiana.
The cost of the improvement herein provided for, except
street and alley intersections, shall be paid by special assessment to be Bally
assessed therefor, in accordance with An Act of the General Assembly of the :Mate of
Indiana, entitled " An Act Concerning 314unicioal Corporations, " approved March 6,1906-
a,nd in accordance with and pursuant to the provisions of all acts amendatory and supple-
mental thereto.
The cost of all street and alley intersections, including one-
half of the width of the improvement opposite street and alleys which run into, but
do not cross said rea.dway herein proposed to be improved and that portion of such street,
or alley abutting upon property belonging to said City, or upon property.not subject to
such assessment, shall be paid by the City in cash out of its general fund, if able to do
so, or from a fund created by a special assessment to be levied under the provisions of
Section 108 of the above entitled Act.
Assessmentsof t en dollars and more against each lot, if
deferred, are to ne paid in ten equal annual installments, with interest at the rate of
Six per cent per 'annum. A bond or bonds will be issued to the Contractor to the amount
of such deferred assessments in pro rata payment for such improvement.
Under no circumstances shall the City of South Bend be, or be
held res-oons ible for any sum or sums due from said property owner or owners for said
work, or for the collection. of the same, or for t-he payment of any bond, bonds, certi-
ficates or ce-tificates , issued to said contractor in payment for such work, except for
such moneys as shall have actually been r,ec ived by the City from the assessments for
such improvement, or .such moneys as said° City, 13 by said entitled Act and amendments
and supplements thereto required to pay, All proceedings had, and :work done in the
making of said improvement, assessment of property , collection of assessments and issuance
of bonds therefor, shall be as provided for in said above ent itltd Act, and Acts amendatory
thereof and supplemental thereto.
Be It Further Resolved, that the Board of Public Works has:
approved of a waiver signed by the Harter Realty Company waiving all notice of adver-
tising of hearing and notice of same on said resolution, and Board hereby fixes the
27th. day of ,April 1917 at 10: 00 A. U. date for rece iv ing bids.
Be It Further Resolved, That notice of the time and place of
receiving bids shall be published in the manner provided by law+ Notice of these bids
shall be published on the 12th. day of April 1917 and on the 19th. day of April 1917 in the
South Bend Daily Tribune.

Indiana: That it is de3ira4.le to vacate the following Bowman Street from Leer Street
to the east line of the South East Addition, as follows, to--wit:--
Beginning at the
intersection of the west line of Leer Street and the north line of Bowman Street;
thence south 25 feet to the south line of Bowman Street; thence west on the south
line of Bowman Street to the east line of the South East Addition; thence north 25
feet to the'north line of Bo:vman Street; thence east on the north line of Bowman
Street to the west line of Leer Street which point -is the place of beginning.
The following property may be injuriously or benefically effected by
such vacation: Beginning at the intersection of the west line of Leer Street and

The Board irstnucted the Clerk to notift City Attorney Seebirt to
draw an ordinance for more intersect ion money for this year to be presented at the
next regular c ounc it meeting.
Communication from A. G. Uattes of Wilson Brothers with a petition
gor grade, clean out gutters and surface with cinders or. West Kerr Street from South
Chapin Street to rear entrance of Wilson Brothers Factory. The Board referred the
same to the Street Commissioner and ordered him to repair said street that is dedicated
to the City.
Contractors bond for the sum of One Thousand 0011,000.00)Dollyars signed
by Hugh Anderson and the United States Fidelity Company of Balitmore Ud. was approved
v/ by the Board.
The City Enineer filed the estimated cost of the pipe sewer improvement
