Gentlemen: In regard to the attached petition for a sewer on Queen Street from Portage Avenue, to Allen Street, I beg toreport that I have investigated the matter and find that a sewer of adequate depth cannot be constructed on Queen Street east of Blaine Avenue for the reason that the outlet is not deep enought. A sewer can be constructed west.of Blaine Avenue by extending the Blaine Ave. sewer from McCartney Street to Queen Street and then west on Queen Street. Respectfully submitted, Frederick J. Anderson, City Engineer. The Board placed the above report on file. Communication received from H. S. Cover in regard to petitions filed for sidewalk, curb and electric lights,on Chippewa Avenue from Donmeyer Avenue to City Limits. Same read and placed on file. Be ;It Resolved by the Board of Public Works of the City of South Bend, "'St. Joseph -County, State of Indiana, That it is desired and deemed necessary to imVrove the alley lying between Bank Out Lots 14,and 15 and between lots 3 and 4 in Diller s Sub-D iv is.ion of Bank out Lots 8 and 9 ,and between lots 11 and 13 and lots 10 and 12 in Chap in's Sub -Division of Bank Out lots 1 and 2 from the south line of L ine oln Way West to the north line of .Colfax Avenue as. follows, towit:- By grading and paving the roadway, also §rad ing and paving the roadways of all intersecting and entering streets and alleys lying within the property lines of said alley not included in the roadways; by paving said roadways with either asphalt, Bitulithic, Aslbhaltic Concrete or Brick laid on a f ive ' (5) inch Portland Cement concrete f oundat ion, or with brick laid on a six (6) inch rolled gravel f oundat ion, or by constructing a Portland cement concrete pavement seven (7) inches in depth; by placing the ,necessary marginal cwment curb; by placing all manholes and inlets to the proper grade; by constructing cement curb where same is not already constructed, and the construction of the necessary storm water inlets` and conduits. All as shown on the plans and in accordance with the profiles detail drawings and specifications on file in the office of the Department of Public Works of the City of South Bend, Indiana. The cost of the itpproveinent herein provided for, ,except street and alley intersect ions, shall be paid by special assessment to be levied upon the property specially benefitted, to the amount that t1le same may be legally assessed, therefor, in accordance with an Act of the General Assembly of the State of Indiana, entitled " An Act Concerning Municia,pl Corporations, approved 1krch 6,1905, and in accordance with and pursuant to the prov is ions of all acts amendatory and; supplemental thereto. The cost of all street and alley intersections, including one-half of the width of the improvement opposite street and alleys which run into , but do not cross said roadway herein proposed to be improved arndthat portion of such street or alley abutting, upon property belonging to said City, or upon property not subject to such assessment, shall be paid by the .City in cash out of its general fund, if able to do so, or from a fund created by a special assessment to be levied under the prov is ions of Section 108 of the above entitled Act. Assessments of ten dollars and more against each lot, if deferred, are to be paid in ten equal annual installments, with interest at the rate of Six per cent per annum. A bond or bonds will be issued to the contractor to the amount of such deferred assessments in pro rata payment for such improvement. Under no circumstances shall the City of South Bend be, or be held re- sponsible for -any sum or sums due from said property owner or owners for said work, or for the collection of the same, or for the - payment of any bond, bonds, cert•if-icate or certi- ficates, issued to said contractor in payment for such work, except for such moneys as shall have actually been received by the City from the assessments for such improvement, or such moneys as said City is - by said entitled Act and amendments and suppbements thereto required to pay. All proceedings had and work done in the making of said improve- ment, assessment of property, collection of assessments and issuance of bonds therefor, shall be as aprovided for in said above entitled Act and Acts amendatory thereof and supplemental thereto. Be It Further Resolved, That the Board of Public Works fix the 8th. day of Uay 1917 at the hour of 7:45 P.M. -at the office of the Board of Public Works, of this City, as the time and place for the public consideration of said proposed improvements, at which said Board of Public Works will hear all persons interested, or whose property is= liable to be assessed for said improvement, and will decide whether the benefits to the property liable to be assessed for aaid improvement will equal the estimated cost thereof. Be It Further Resolved, That notice of the time and of such public con- sideration be published and mailed in the manner provided by law. Notice of this resolu- tion shall be published on the 9th. day of April 1917 and on the 16th. day of April 1917 in the South Bend Daily Tribune. Adopted this 3rd. day of April 1917. Weber, absent. Hearing had on Improvement Resolution No. 494 for the pavement of the alley west of Lafayette Street from Monroe Street to South Street, in the City of • South Bend, Indiana. Upon said hearing a, remonstrator appeared but no written remonstrance was filed. And the Board being fully advised in the premises, decides that the bene fits to property liable to be assessed for said improvements are equal -to the esti- mated cost of the same, as reported by the City Civil Engineer, and thereupon takes final action on said resolution as originally adopted, and the same is hereby in all things ratified, confirmed and approved. Resolved further, that notices be publ ishdd on. the 6th. day of April 1917 and on the 13th� day of Apti1,1917 in a newspaper of general circulation in said Cityip stating that this Board will receive bids for the construction of said improvement up to 10:00 A.M. on the 24th. day of April 1917. The Board reserves the right to reject.any and all bids Hearing had. on Improvement Resolution No. 492. for the pavement on 1st. alley west of Michigan Street from Madison Street to Marion, Street, in the City of South Bend, Indiana. In the -above matter remonstrators appeared and a written remonstrance was filed. The Board having said matter under advisement find that the remonstrance filed this 3rd. day of April 1917 should be sustained and the resolution should be and 'the same is hereby and in all things rescinded. Upon said hearing no remonstrators appeared and no written remon- strance was filed. And the Board being fully advised in the premises, decides that the benefits to property liable to be assessed for said improvements are equal to the estimated cost .of the same, as reported by the City Civil Engineer, and there- -upon takes final action on said resolution as.originally adopted, and the same is Hereby in all things ratified, confirmed and approved. In the above matter remonstrators appeared and a written remonstrance was filed. The Board having said matter under advisement find that the remon- strance filed March 17th.,1917 should be sustained and the resolution should be and the same is hereby acid in all things rescinded. . Upon said hearing a remonstrators appeared and no written remonstrance filed other than one of February 29th. ,191'6 which was over -ruled by the Board. And the Board being fully advised in the premises decides that the benefits to property liable to be. assessed for said improvements are equal to the estimated cost of the same, as reported by the City Civil Engineer, and thereupon takes final action on said resolutions asorginally adopted, and the same is hereby in all things ratified, confirmed and approved. Company., in the City of ,South Bend , Indiana, Upon said hearing remonstrators appeared but no written remonstrance was f iledt And the Board being fully advised in the premises decides that the benefits to property liable to be assessed for said improvements are equal to the estimated cost of the same, as reported by the City Civil Engineer, and thereupon takes final action on said resolution as modified. Said pipe sewer to be on Chestnut Street from Jefferson Blvd. to Napier Street, sewer on Chestnut Street to be out off south of Napier Street to Lake Shore & Michigan Southern_ Ry. Company, and 'the same is hereby in all things ratified, confirmed andapproved. Resolved further, that notices be published on the 6th. day of April 1917 and on the 13th. day of April 1917 in a newspaper of general circulation in said City stating that this Board will receive bids for the construction of said improvement, up to 10:00 A.M. on the 24th. day of April 1917. Hearing had on Improvement Resolution No. 496 for pipe sewer on Olive /Street from Linden Avenue to Washington Avenue, in the City of South Bend, Indiana. Upon said hearing no remonstrators appeared and no written remonstrance was filed. And the Board being fully advised in the premises , decides that the benefits to property liable to be assessed for said improvements are equal to the estimated cost of the same, as reported by the City Civil Engineer, and thereupon takes final action on said resolution as originally adopted, and the same is hereby in all. things ra.f if ied, c onf irmed and approved. Resolved further, that notices be published on the 6th. day of April 1917 and on the 13th. day of April 1917 in'a newspaper of general circulation in said City, stating that this Board will receive bids for the construction of said improvement up to 10:00 A.M. on the 24th. day of April 1917. J Hearing given on Condemnation Resolution No. 48 for the purpose of appropriating. a strip of land for the widening of Leer Street across the Lake Shore & Uichigan Southern Railway Company right of way, in the City of South Bend, Indiana. In the above matter no remonstrators_ appeared and no written remonstrance was filed. ' The Board being fully advised in the matter takes final action on said resolution, c onf irm4ng without modification, all former action taken on the same. The Board therefore declares the above property in all things condemned and appropriated for public use, and the Board now orders that a list or roll be prepared of all the owners or holders of property and of vaulable interests therein sought to be taken or to be injuriously affected, which said list or roll shall also describe the property benefically affected. Councilman Andrew Seifert appeared before the Board -and requested the Board to have cross walks placed on Coquillard Street about half way between Campau ✓ Street and Sorin Street. The same was referred to the Street Commissioner. Also to place a light at the corner of Notre Dame Street and the Grand Trunk Western Ry..Company right of way. This matter was referred to the City Common Council. Also petition for an electric light at Robinson Street and the New York Central Ry. Company right of way. Ur. Samuel Rosenberg of the Vandalia::Ry. Company appeared before the Board and presented blue prints showing proposed tracks into Studebaker tract south of Sample Street and west of Franklin Street and requested permission to lay sidetracks into same. The following resolution was approved by the Board. Resolved by the Board of Public ,Works of the City of South Bend, Indianai: that permission be granted to the Pittsburg,Cleveland, C is innat i & St. Louis Ry. Company to lay side tracks into the Studebaker Tract south of Sample Street and west of Franklin Street • across Kendall Street, alley between Kendall and Scott Streets and across Scott Street all as shown on blue print approved this 3rd. day of April 1917. Clerk instructed to send copy of same to above mentioned Railway Co3, Mr. H. E. Harter appeared before the Board and presented plat of Harter Heights seennd Addition to theCity of South Bend, Indiana with following dedication and the same was approved by the Board.
