Calvert, Secretary of the Indiana & Michigan Electric Company appeared before the board and .presented petition for the 'vacation of alley which lies between lots 21 and .22 in the Original Plat of Lowell , in the City of South Bend , Indiana, The Board signed resolution for such vacation proceedings.. The Board ordered that twenty six new 60 candle power gas lights be placed in River Park, the Clerk was instructed to have said list of lights written ✓ up for the regular session of the Board April 3rd.1917 at 10:00 A.M. for their approval. VACATION RESOLUTION NO. 35.1917. Resolved by the Board of Public Works of the City of South Bend, Indiana; That it is desir®Ile to vacate the following: Begin at a point on the south line of Ewing Avenue where the west line of Main Street as -platted in Bwwman's Addition produced south interests the south line of Ewing Avenue; thence south to a point 50 feet north of the northeast corner of lot one (1) Eckmants Oakside Plat in section 24 Tp. 37 N. R. 2 E,, thence east 99 feet to a point 50 feet north of the northwest corner of lot 9 in said.Oakside Plat; thence north to a point on the south line of Ewing Avenue_99 feet east of beginning; thence west 99 feet to the place of beginning. The following property may be injuriously or beneficially effected by such vacation: Beginning at the intersection of the south line of Donald Street and the east line of the right of way of the Terre Haute & Logansport Railway Co. thence south along the east line of, said right of way -to the center line Of the first alley south of Eckman Street; thence east along the center of the first alley south of Eckman Street to the center of the center of the first � lley west of Main Street; thence south along the center of the first alley west of Main Street to the center of the first alley south of Woodside Street; thence east along the center of the first alley .south of. Woodside • Street to the center of the first alley east of Main Street; thence northalong the center of the first alley east of Main Street to the south line of Donald Street; thence west on the south line of Donald Street to the place of beginning. Notice of this resolution shall be published on the 3rd. day of April 1917 and on the loth. day of April 1917 in the South Bend Daily Tribune. This Board at its office in the City Hall on the 1st. day of May 1917 at 7.45 P.M. will hear'and receive remonstrances from all persons interested in or affected by these proceedings. Be It Resolved by the Board of Public Works of the City of South Bend County of St. Joseph, State of Indiana, that it is desired and deemed necessary is improve Niles Avenue from Froward Street to -Lc_eper .Avenue as follows, to -wit: - By grading and paving the roadway, also grading and paving the roadways of all intersecting and entering streets and alleys lying within the property lines of said avenue not included in the roadway, by 'paving said roadways -with either Asphalt,Bitulithic, Asphaltic Concrete or Brick laid on a five (5) in-ch portland cement concrete foundation, or with Brick laid an a six -(6) inch rolled gravel- foundation, or by constructing a portland 4 cement concrete pavement seven inches in depth; by placing the necessary marginal cement curb; by placing all manholes and inlets to the proper grade; by constructing cement curb where same is not already constructed; and the construction of the necessary storm -water inlets and conduits. All as shown on the plans and in accordance with the profiles, detail drawings and spec ifAcat ions on file in the Office of the Department of Public Works of the City of South Bend, Indiana. The cost of the improvement herein provided for, except street and alley in erseoons, shall be paid by special assessment to be levied upon the property specially benef itted, to the amount that ' the same may be legally assessed therefor, in' accordance with an Act of the General Assembly of the State of Indiana, entitled " An Act Concerning Municipal Corporat inns," approved March 6,1905, and in accordance with and pursuant to the provisions of all acts amendatory and supplemental thereto. The cost of all street and alley intersections, including one-half of the width of the improvement opposite street and alleys which run into, but do not.. cross said roadway herein proposed to be improved -and that portion of such street or alley abutting upon property abutting upon property belonging to said City, or upon property not subject to such assessment, shall be paid by the City in cash out of its general fund, if able to do so, or, from a fund created by a special assessment to be levied under the provisions of Section- 108 of the above entitled Act. Assessments of tendollars and more against each lot, if deferred, are to be paid in ten equal annual installments, with interest at the rate of Six per cent per annum. A bond or bonds will be issued to the contractor to the amount of such deferred assessments in'pro rats payment for such improvement. Under no circumstances shall the City of South Bend be, or beheld responsible for any sum or sums due from said property owner or owners for said work. or for the collection of the same, or for the payment of a ny band, bonds, certificate or certificates, issued to said contractor in payment for such work except for such moneys as shall have actually been received by the City from the -assessments for such improve- ment, or such moneys as said City is by said entitled Act and amendments and supplements thereto required to pay. All proceedings had, and .work done in the making of said improve- ut"ent, assessment of property, collection of assessments and issuance of bonds therefor, shall be as provided for in said above entitled Act, and Acts amendatory thereof and supplemental thereU. Be It further resolved, That hhe Board of Public Works fix the 1st. day Of May 1917 at the hour of 7:45 P.M. at the office of the Board of Public Works, of this City, as the time and place for the public consideration of said proposed improvement, at which said Board of Public Works will hear a$d ,persons interested, or whose property is liable to be assessed for said improvement, and will decide whether the benefits to the property liable to be assessed for said improvement will equal the estimated cost thereof. Be It Further Resolved, That notice of the time and place of such public consideration be published and mailed in the manner provided by law. Notice of this resolution shall be published on the 2nd . day of April 1917 and on the 9th. day of April 1917, in the South Bend Daily Tribune. Adopted this 30th. day of March 1917. E. M. STREET OR ALLEY IMPROVEYEi NT RESOLUTION NO. 505. 1917 Be It Resolved by the Board of Public Works of the City of South Bend, St. Joseph County, state of Indiana,• That it is desired and deemed necessary to improve the alley lying between lots 6 and 7 in Burrough's Sub -Division of Bank out lot 115 and between lots 56 and 57 in Henrick's and Grant's Addition from Marion Street Vo Navarre Street as follows, to -wit: - By grading and paving the noa,dway, also grading and Having the roadways of all intersecting and entering streets and alleys lying within the property lins of said alley not included in the roadways; by paving said roadways witY either asphalt, Bitulithic, Asphaltic Concrete or Brick laid an a, .five (5) inch portland cement concretes foundation,- -or by constructing a. portland cement concrete pavement seven (7) inches in depth; or .by constructing a brick pavement laid on a six _inch(6) rolled gravel foundation; by placing the necessary marginal cement curb; by placing all manholes and inlets to the proper grade; by constructing cement curb where same is not already constructed; and the construction of the necessary storm water inlets and conduits. Resolved by the Board of Public Works of the City of South Bend, Indiana: That it is desirable to vacate the following: Beginning at the northwest corner oflot 22 in the Original Plat of Lowell now a ,part of the City of South Bend, Indiana: thence. east on the north line 'of said lot 22 to the northeast corner of said lot 22 thence north to the south east corner of lot ,21 ,in the Original Plat of Lowell; thence west on the south line of said lot 21 to the southwest corner of 'said lot 21 thence south 14. feet to the place of beginning, .
