Board instructed the City Engineer to{g.iva lots damaged by..the vacation of.Leon Court, Scott Street and lst. alley north of Leon Court the sum of $10.00..each. The Studebaker Corporation.to pay the damages. The following resolution adopted by the -Board. TRUNK SEWER IMPROVEGENT RESOLUTION NO. 502. RESOLVED BY THE BOARD OF PUBLIC WORKS OF THE CITY OF SOUTH $END COUNTX'OF ST. JOSEPH, STATE OF INDIANA: That it is desired and deemed necessary to construct a sewer across the Wood tract from the St. Joseph River to Portage.Avenue and -Portage Avenue from Keller Street to the north line -of Section 34 Tp. 38 N. R. 2 E, all in said City, which, from its size and characte'r, is not only intended and adapted for use by property owners whose property abuts along the line ofsaid'sewer, bdt is also intended and adapted for receiving,sewage from collateral drains already constructed or whish may be hereafter constructed, and the same is hereby ordered con strutted in and along the following line An said City, tol-wit:- Beginning at a point on the east aide of the St.. Joseph River located south 510,441 ' east a distance of,530.8 feet from a 1-8 stone located°1320 feet more arless east of the northr-st ,corner --of Section ,35 Tp. 38 N.R. 2 E. thence south 700 40' west 675.5 feet; thence to, the left 460 0' on a curve of 50 foot radius a distance_ of 40.2 feet; thence tot.the right 28° 0' on .a 9' 201 curve a distance of 278.5 `feet; thence to the right 32° 0' on a ,.16° .0' curve a distance of 200 feet; thence to th-* left 460401 on a 60' 40' curve a .distance of 700 feet; thence on a .tangent to the 6040' 'curve south 38° 0' west a distance of 175.5 feet; thence t the right 52° 0' on a curve of 50 foot. radius a distance 48. 2 feet; thence west aW distance of 199 feet to a point 1346 feet south of the north line of Section 34 Tp.' 38 N.R. 2 E. rand 76.5 feet east of the center link of Portage Avenue with a ,60 inch circular sewer. Also beginning 1346 feet south of the north line of section 34 Tp. 38 N.R. 2 E. and 76.5 feet east of the center of Portage Avenue; thence west a distance of 76.5 feet to the center of Portage Avenu.a; thence west a distance of 76.5 feet -to the center of Portage Avenue. with a 36 inch circular sewer. R. 2 E. and 76.5 east of the center line of Portage Avenue; thence on a curve to the left with a 50 foot radius a distance 'of 99,1 to the center line of Portage Avenue; thence southeasterly along the center line of Portage Avenue a distance of 1202 feet to a point 139.26 feet north of the east and west center line of Section 35 Tp. 38 N. r. 2 E. with a 54 inch circular sewer. Also beginning at a point on the center line of portage Avenue 1346 feet south of the north line of section 34 Tp. 38 N.R. 2 E. thence northwesterly.on the center line of Portage Avenue a. distance of 147?. x ft. to the rnrt� line of Section 34 Tp. 38 N.R. 2 E. with an 18 inch- circular sewer: Also beginning at 'a point on the center line- `of Portage Avenue 139.26 feet north of the east and west center line of section 35 Tp. 38 N.R. 2 E. thence southerly along the center°of Portage Avenue 788 feet with a 15 inch circular sewer; thence still southerly along the center of Portage Avenue a distance of 350 feet with a 12 inch circular sewer. Together with the necessary manholes,• inlets, conduits, flush tanks and house connections to -the curb line along the line, of said improvement, And to be built in accordance with the profiles, specifications, detail maps and estimates now on file in the bff ice of the Department of Public Works -of-said City., The cost of the construction of said sewer shall be assessed and collected• in the manner prscribed by law, pertaining to the construction of sewers by Cities of the Second Class. All of which said property beneficially affected lies within the ol1ew described territory in the City of South Bend, County of St. Joseph, and State of Indiana, to -wit: -Beginning at the intersection of, a line 25 feet south of the north line of Keller Street and the west line of Anthony Street; thence ±ast on ja line 25 feet south of the north line of Keller Street and parallel there- with to a point 167 feet westerly from the westerly line of Portage Avenue measured at right angles to the.west line of Portage Avenue; thence northwesterly on a line 167 feet' westerly from the westerly line of Portage Avenue measured at right agles to Portage Avenue and parallel therewith a distance of 285.2 feet;.thence easterly at right angles to the west line of Portage Avenue a distance of 167 feet to the west line of Portage Avenue; thence northeasterly to the intersection of the easterly line of. SAID IMPROVEMENT SHALL BE KNOWN AS PORTAGE TRUNK SEWER, Under Improvement Resolution No. 502. In the City of South Bend, Indiana. Under ncr cfrc'umstances shall the City of South Bend be or be held re- sponsible for any sum or sums due from said property owner or owners° for said work; or for the collection of the -same., or for the payment bf any bond, bonds, certificate or certificates issued to said contractor in payment for such work, except for such moneys as shall have been actually received by said City from the assessments for such -improve- ments. All proceedings had and work ,done; in the construction of said main sewer, and its qDppurtenances, manner of assessment of property collection of assessment and issuance of bonds therefor, shall be as provided for in an Act of the General Assembly of the State of Indiana, entitled " An Act Concerning Municipal Corporations," in matters pertain$n.g to the construction and alteration and maintenance of public .drains and sewers, prov id ing for the construction, alteration and maintenance of such sewers and drains in such cities and within four miles thereof, also providiing for the assessment of property specially benef fitted thereby for the payment thereof, in whole or in part, and for the collection of such assessments; repealing all laws and parts of laws in con- flict therewith, and declaring an emergency , approved March 6,1905 and all acts'supple- mentary and amendatory thereto,'passed by the General Assembly of -the State of Indiana. Notice of this resolution shall be published on the 30th. day of March 1917 and on the 6th. day of April _1917 in the South Bend Daily Tr ibune. ' This. JOSEPH, STATE OF INDIANA: That it 'is desired and deemed necessary to construct a sewer in High Street, Ewing Avenue, Miami Street Donald Street, Fox Street, Altgeld Street, Victoria Street and the alley west of Dale Avenue all in said City, which, from its -size and character, is not only intended and adapted for use by property owners whose property abuts along the line of said sewer, but is also intended and adapted for re- ceiving sewage from so•llateral drains already constructed or which may be hereafter con- structed, and the same is hereby ordered constructed in and along the following line of said City , to -wit:- Beginning at.the intersection of High Street and Bowman Street; thence south on the center line of High Street to the center of Ewing Avenue with a 33 $nch circular sewer; thence east on the center line of Ewing Avenue to the center of the first alley -west of Dale Avenue with a 33 inch circular sewer; thence still east on the center line of Ewing Avenue to the center line of Miami Street with a 22 inch circular sewer; thence south along the cefiter line of Miami Street to the center of Altgeld Street with a 15 inch .vitrified pipe sewer; thence still south along the center of Miami Street to the center of Fairview Avenue with a •12 inch vitrified pipe sewer; thence still south along the center of Miami Street to the south City Limits with a 15--inch vitri- f ied . pipe sewers Also; Beginning at the intersection Of the center line of High Street and Donald Street thence east along the center line of Donald Street to the center of Dale Avenue with a 12 inch vitrified pipe sewer. Also, beginning at the intersection of the center line of High Street and Fox Street; thence east along the center line of Fox Street to the center of Dale Avenue with a 12 inch vitrified pipe sewer. Also begin- ning at the intersection of the center line of Altgeld Street and the first alley west of. Weidler's Addition with a 12 inch vitrified pipe sewer. Also, beginning at .the intersection of the centerline of Ewing Avenue and first alley west of Dale Avenue ; thehee south along the center line of said alley to the center of Victoria Street with a.22 inch circular sewer. Together with the necessary manholes, inlets, conduits, flush tanks and house connections along the line of said improvement. And to ,be built : in, accordance with the profiles, specifications detail plank maps and estimates now on -file in , the office of the Department of - Public Works ,.of said City, The cost of the construction of said sewer shall be assessed and collected in the manner prescribed by law, pertaining to the construction of sewers by ::Cities of ..the Second Class. Said Improvement shall be known as.,liiigh Street and Ewing Avenue Sewer System under Improvement Resolution No. 503, in the City of South Bend, Indian Under no circumstances shall the City of South Bend be or be held responsible for any sum or sums due from said proerty owner or owners for said work aer for the collection of the same, or for the payment of any bond or bonds, certi- ficate or certificates issued to said contractor in payment for such -work, except for such moneys as shall have been actually received by said City from the assess- ments for such improvements. All proceedings had and work done in the construction of said main sewer and its appurtancnes , manner of assessment of property collection of assessments and issuance of bonds therefor, shall be provided for in an Act of the General Assembly of the State of Indiana, entitled " An Act Concerning; Municipal Corporations, "'in matters pertaining to the construction alteration and main-. t enane a of public drains and sewers, providing for the constructions alteration aid maintenance of such sewers and drains in such cities and within four miles there*f, also providing for the assessment of property specially benefitted thereby for the payment thereof, in whole or in part, and for the collection of such assessments; repealing all laws in conflict therewith, and declaring an emergency approved March 6,1905,and all acts supplementary and amendatory thereto, passed by the General Assembly of the State of Indiana. Notice of this Resolution shall 'be published on the 30th. day of March 1917 and on the 6th. day of April 1917 in the South Bend Daily Tribune.
