Layton, Street Commissioner appeared before the Board and discussed the,matteref cleaning Tecumseh Avenue from Angella Avenue to Wakewa Avenue.- N odecision on'same. - Remonstrance received read and placed on file fAX against pavement. f improvement on Freneis'Street from Cedar Street to North Side Blvd. Plat of George Platt's Suv-Division of lots 47,481, 49 and 50 Fisher's South Side Survey, was, approved by the Board. Plat of Geo.A. Platt's Sub -Division of lots 8 and 7 in Fisher's South Side Survey with following agreement were approved by the Beard. A G R E E M E N T In consideration Of the Board of Public Works accepting plat of G. / A.. Platys 1st. Addition to the City of South Bend, being a replat of lots 6 and 7 of the Fisher's South Side Survey of St. Joseoh County, Indiana,, said G. A. Platt agrees to construct a sidewalk three (31) feet in width from Indiana Avenue to a public alley Twelve (12) feet in width lying directly south thereof. Said side- walk -to be constructed on east side of the Twenty.(20') foot alloy lying on the west of said plat of aforesaid. G.A. Platt agrees to construct sidewalk in conformity with said City's specifications and to be completed within Sixty (60) days from date. Dated this 27th, day of march 1917. GEO. A. PLATT. E. corner of Lafayette Street and Navarro Street, also S.-E. corner intersection raised by roots needs repair.. Report of Pole and Wire Inspector approved as follows: - I wish to recommend to the Board that the Light should bb placed on the srputhwest corner of Allen Street and Lincoln Way West and resettthe polo ✓ now stan4ing at the southwest corner of the alley & Allen Street to the northwest corner. Mr. Kennedy has agreed to place the light pole as recommended* Pole and wire inspector reported as follows on compalint about polo v at 711 Forest Avenue which is in way of door of garage. This is a Home Tel Company polo, it will be reset also -the anchors will be replaced out in the.lsws. When the garage is being built. The pole now v stad.d ing should be reset to the north i,ls• set a guy wire and anchor at the' south property line and anchor out in the lawn. Co unication received from Mr. C. S. Kennedy of the Indiana & Mich. Elec. Co. -in regard to changing wires from poles in the alley between Main and Lafayette Streets from Division Street to South Street and that they have placed them on the Bell Telephone Co's poles. Same filed. Petitions received for,pipe sewer on Fox Street from Miami St. to pale Avenue, also pipe sewer on Donald Street from Miami Street to Dale Avenue. Resolutions ordered by the Beard on same. Board met in regular session at 7:45 P.M. All members present. Hearing had on impnovo ment Resolution No. 489 for pavement on- ,/Calvert Street from Miami Street to High Street, in the City of South Bend, Indiana, Upon said Bearing no remonstrators appeared and no written remonstrance was filed. Arid the Board -being fully advised in. the premises, dec ides that the bene- f its to property liable to be assessed for said improvements are equal to the esti- mated cost of the same, as reported by the City Civil Engineer, and thereupon takes final action on said resolution as originally adopted, and the same is hereby in all things ratified, confirmed and approved. Resolved further, that notices be published on the 29th. • day of March 1917 and on th 5th . day of April 1917 in a newspaper of general circulation in said City, stating that this Board will receive bids for the construction of said improvements up to 10:00 A.M. on the 17th. day of April 1917. The Board reserves the right to reject any and all b ids . And the Board being fully advised in the premises, decodes that the bene- fits to property liable -to be assessed for said improvements are equal; to the esti- mated cost of the same, as reported by the City Civil Engineer, and thereupon takes final action on said resolution as originally adopted, and the same is hereby in all things ratified, 'confirmed and approved. The Beard res;rues the right to reject any and all bids. Mr. Geo. Carll of the E. L. Cothrell Realty Company appeared before the Board and took up the matter of the condition of Irvigton Avenue. This matter. ✓ was referred to the Street Commissioner to investigate. Mr. F. I. Hardy. Mgr. of the Chicago, South Bend• & Northern Indiana Ry. Company appared before the Board in regard to plumbers in the City tunneling under their tracks and cutting into pavements and not properly tapping same. The ✓ 'Board took this martter* under advisement. Attorney Vitus Jones appeared before the Board for the Harter Realty Company and made a propos-ft'16nnto-the Board , that they would improve the Streets and alleys in the Harter Heights Addition by paving same. That the Harter Realty Company would pay for all sidewalks and curbs intersections: amounting to $460.30,--also they would pay for ono hail' (�) of the cost df Street -and Alley interseeet'ions, which after due consideration was accepted and approved of by the Board, by unanimous consent. All, Resolved by the Board. of Public Works of the City of South Bend, St. Joseph County, State of Indian,, That it is deemed necessary to improve VARIOUS STREETS IN THE CITY.. That an improvement be made of the kind, size , location and terminal points as follows: - That bids be received for the construction and repairing of cement s idewa lks, curbs and for filling and exe,avat ing for said sidewalks ;and _curbs, on different strut in the City whero the same have already, een tartly constructed or are defective y eonstreutel, - All such work to be done a ter he owners of abutting property have been ordered and notified to construct or repa it such .sidewalks 'and curbs f or a period of 30 days from the dote ofany such notice.. ' All work to be constructed or repaired in accordance with Standa6rd Spec if icst ions on file in the off ice of the City Engineer of said City. All work to be done and assessments made as providdd in section 1 of An Act entitled " Ak Act Concerning Municipal Corporations, " approved 1909, at page " 412 to 413". in accordance The cast o f said improvement, inc lud ing the.. cost of street and alley intersections, shall be assessed upon the real estate abutting on said Varlous Streets, in the CiVy all according to the method and manner provided for in an Act of the General Assembly of the State of Indiana, entitled, " An .Act Concernttgg Municipal Corporations," approved March' 6,1905, and in accordance with and . pursuant to the provisions of ,all amendatory and suppement&l acts thereto, passed by -the General Assembly of the State of Indiana, Assessments, if -deferred, are to be paid in ten equal annual installments with interest at the, rate of Six per cent per annum. A bond or bonds shall beissued to the Eontraetor in payment of such work, unless the ftty Property owners pay said assessment before said bond or bonds are issued. Joseph, State:of`Indifna, That the construction of a local sewer, intended and adapted only for local use by the property holders whose property abuts thereon, and not intended or adapted for receiving sewerage from collateral drains, be and the same is, hereby ordered in and along Donald Street from Uiami Street to Dale Avenue .as follows, to -wit: Beginning at the intersection of the center of Miami Street and'Donald Street; thence west along the center line of Donald Street to the center of Dale Avenue with a 12 inch vitrified .pipe sewer. Together with the necessary manholes, inlets, conduits and house connections to the curb line. along the line of said improvement. All as shown on the plans and in accordance with the profiles detail drawingg and specif icat ions. on file in the Office of the Board of Public .Works of the City of South Bend, Indiana, and said sewer, with all its appurtenances shall be constructed in accordance with the profile abd specifications now on file an .the office of the Department of Public Works of said City. The cost of said improve- ment shall be apportioned against and paid by the property holders whose property abuts thereon, and upon the City of South Bend if the City is benef itted by said improvement, all according to the.method and manner provided for in Act of the General Assembly of the State pf Indiana, entitled " An Act Concerning Municipal Corporations, " approved March 6,1905.
