i Board met in regular session at'10:00 A:M. All members present. Mr. J. R. Cole with hair. H. A. Wood appeared before the Board in regard s' t o hav ing a trunk sewer ys�em placed in the Samuel Good Addition. This muter was referred to the City -Engineer for a report by 4: 30 P.M. Saturday March 10th. ,1917. Mr. Horace L. Greene appeared before the Board and requested permission for the Lexingtoft Tea. IZQom proprietors to place a sign on post in front of J. M. S. v Bldg, on sidewalk advertising Tea rooms located on 8th. floor of said building. This matter was referred to the Building Commissioner. PW of Del C._Leerfs 3rd. Addition presented by Del. C. Leer was approved by the Board. Mr. Isaac Van Trump appeared before -the Board, in regard to inspection of Asphalt pavement on Eddy Street and Mishawaka Avenue. The Board informed Mr `Van Trump that bids would be received March 20th. ,1917 at 10: 00 A.M. for inspection of asphalt is pavement in this C ityl this - year. The Board instructed the Clerk to notify different Engineers of the bids to be received March 20th. ,1917 at 10: 00 A.M for inspect ion of a�talt ie pavements min the City this year. - Permission granted to the Central Union:Telephone Company to set poles and anchors in the City on various streets, and alleys.. The Board ordered that the case of S. D. Moran placing a showcase on public property referred to them by the Building Department, be referred to the City attorney for enforcement of the law regarding the same. The following resolution was approved by the Board. and referred to the City Controller. RESOLUTION OF THE B O,,_RD OF PUBLIC WORDS OF THE CITY OF SOUTH BEND IND IIM . WHEREAS, the City of Sonth Bend, Indiana, by and through its Board of Public Works, heretofore, by improvement Resolution No. 415, caused Michigan Street , from the North line of La Salle Avenue to the south line of South Street in the City to be improved by paving the same; And, WHEREAS, the Chicago, South Bend & Northern Indiana Railway Company occupies a portion of sadd street for the operation of its electric railway, and by the t and cond it ions of its franchise is required to pave a portion of said street; And, WHEREAS, Said Railway Company is also -the owner of real estate abutting upon said improvement: And, WHEREAS, the portion of said street required to be paved by said Railway Company was paved by the Western C onstruct ionC ompany, a corporation organized under the State of Indiaaa, as contractor for such work, and same was completed by it as such contractor and accepted by th City of South Bend on the 6th. day of February,1917; And, WHEREAS, on the 3rd. day of March 1917, said Railway Company executed and filed with the said City of South Bend, its stipulation and agreement waiving objections on account of any illegality or irregularity in the proceedings had for such improvement of said street and requested the Gity to issue bonds -to procure. funds with which to pay that portion of the cost of said improvement chargeable against said Railway Company both as n abutting property owner and under its franchise obligations in the manner provided by an °Act ,ent itledv" An Act Concerning kunic ipal Corporations, " approved March 6, 1905, and all amendatory and supplemental acts thereto; And, -WHEREAS.—It-appears that the amount chargeable to and payable by said Railway Company as an abutting property owner by reason of said improvement amounts to the sum of One hundred Twenty-nine and 661100 ($129.66) Dollars, and under the terms of its franchise by oreason of said improvement, the sum of Twenty-seven Thousand Thirty five and 8�J00 (27,035.8) Dollsrs, with interest on each of said sums from the 6th. day of Fbbruary, 1917, to the first day of June ,1917. 394 March 6t.h_ 1917_ Continued ,. NOW, THEREFORE,, BE IT RESOLVED that as to said assessment in the sum of one Hundred Twentynine and 661100 ($129.66) Dollars against said Railway Company as an abutting property owner, that ten bonds be issued in accordance with the powers vested in said City by the provisions. of, said Acts, the foirst of which bonds shall Ve in the gum of Thirteen and 56/100 ($13.56) Dollars, due May 7th.. 1917, and the balance of said bonds shall be due and payable respectively one (1), two (2) Three .(3), Four (4), five (5), six (6). Seven (7), eight (8)1, and nine (9) years after the said first day of June,1917 and each of said 'bonds, except said first bond, shall be in the sum of Twelve and 90/100 ($12.90) Dollars and all of said bonds shall be numbered consecutively from one to ten inclusive. BE IT FURTHER RESOLVED, that as to said assessment made against said railway Company underits franchise in the -sum of Twenty-seven Thousand thirty- five and 83/100 ($27,035.83) Dollars that ten bonds be issued in accordance with the powers vested in said City by virtue of the provisions of said Act 9 the first of which bonds shall be in the sum of Twenty-seven hundred four and 33f1a0 ($2764.33) Dollars, dueMay 7,1917, and the balance of said bonds shall be due and payable respectively one (1) tiro(2), three (3),' four (4), five (5), six (6), seven (7), eight (8) and nine (91, years after the said first; -day of June,1917. and each of said bonds, except said first bond, shall be in the sum of twenty- seven hundred three and 50/100 ($2703.50) Dollars,.�and,all of said bonds shall be numbered' consecutively from one to ten inclusive.. Thai' each of the bonds mentioned in this resolution shall be payable by the City 'of -'South Bend to w Bea,rer",,thereof at the Treasurer's office out of funds actually paid in, or collected by -:it from, the Chicago, South Bend,& Northern Indiana Railway Company, upon each of the accounts respectively on account of said improvement and the agreement of .said Company to pay for the same'. , Said bonds shall be payable in lawful money of the United State, with- out relief from valuation of anpraisement laws and attorneys fees. `,Each of said bonds shall bear interest at the rate of Six percent Gaza (6%) per ann.um from the first day of June,1917, payable semi- annually on presentation and surrender of of the coupons attached to said bonds as they severally' mature. Said. bonds shall have the same priority over other liens as have assessments for other street improvements and shall be a first lien on all the ,property, assets and franchises--, of said Railway Company in the manner and to the extent provided by lair. Resotved by the Board Of Public Works of the City .of South Bend, County of -St. Jose -ph County, State of ind Tana, That the construction of a local sewer, intended' and adapted only for local use by the -property holders whose property abuts thereon, and not intended,or adapted for receiving sewerage from collateral drains, be and.the same is, hereby ordered in and along Olive Street from Linden Avenue East to Washington Avenue as follows, to -wit: Beginning at the intersection of the center line of Olive Street and Linden' Avenue east; thence south along the center line of Olive Street to the center of - Orange Street with a 12 inch vitrified pipe sewer; thence still south on the center line of Olive Street to the center Tine of Washington Avenue with a 10 inch v,itr if ied pipe sewer`. Together with the necessary manholes, storm wager inlets, conduits and house connections to the curb line along the line of said improvement. The above report approved by the Board. 4,11 The c itengineer submitted the list of property owners in Vie -matter of the a ppr opr iat ion. of certain property under C ondemnat ion Res glut ion No. 7 for the Widening of Leer Street from Lincoln Way East to L. S. & U. S. Ry. as per resolution on page 355 of this record.. Which list includes the names f the owners and holders of property and of interests therein sought to be taken or beneficially or i.n jur ioulsy affected, and the description of the several pieces of property which is affected by the ' sa id appr qpr iat ion proceedings. Thereupon the Board proceeded to -award the damages sustained and to assess* the benefits accruing .to each piece of property upon said list. It was thereupon, upon motion duly.made and seconded and unanimously adopted, resolved that said list, •toge°ther with the amounts of benefits and damages and net benefits nd net damages therein set forth as to the several ' parcels of ' land be adoted and that the respective amount of benefits contained in. said list be and are hereby assessed against the several tracts of land as specifically set forth in said list, and that the respective; amounts of damages contained in the said list be and are hereby awarded to the several tracts of land as specifically set forth in said list, and that the net benefits and net damages, as the cost may be as to the respective °tracts- of land, contained in said list are hereby awarded or assessed, as the case may be as to the said several tracts of land. The Board hereby further 'sets off the benefits and damages each .aga inst the other where nboth benefits and damages are assessed, the same against the same piece of property, tract of land far interest, and hereby fixes said respective net benefits as `the amount than shall be na id. by the respective owners as benefits, and further hereby fixes the r°espe ctive het damages as to the several tracts as the. amount that shall be paid to the owners of the respective tracts as damages. Thereupon, upon motion duly made and seconded and unanimously adopted the twenty fuutbh day of April 1917 at 7:45 P.M was fixed as the day on which this Board will receive -or hear remonstrances frompersons with regard to the amount of their respective awards or assessments, and the Clerk of this Board was instructed u to prepare and case to be duly and legally given, notices to the owners of each pparcel of property showing the amount of the assessments or award, with a descripw lion of the property affected, and thep date of said hearing.
