This SUPPLEMENTAL AGREEMENT ("Agreement's is made and entered into on this date -�X by
and between the City of South Bend, acting by and through its proper officials, ("LOCAL PUBLIC AGENCY"
or "LPA') and UNITED CONSULTING, an Indiana corporation ("CONSULTANT'.
WHEREAS, the CONSULTANT did, on April 26, 2016 enter into an Agreement with the LOCAL PUBLIC
AGENCY for Engineering Services and Documents in relation to the following described project:

This supplement is required to add the following new services to the original scope of work:

WHEREAS, in order to provide for completion of the work it is necessary to amend and supplement the
Engineering Agreement.
NOW, THEREFORE, it is agreed by and between the parties as follows:

E.6. PHASE II ENVIRONMENTAL SITE ASSESSMENT
The CONSULTANT shall complete a limited Phase II Environmental Site Assessment along
the Coal Line Trail. The proposed locations and spacing of the borings are based on the
results of the Phase I Environmental Site Assessment.
The CONSULTANT shall complete a total of 14 soil borings to characterize the soils at the
identified locations. The borings shall be advanced to depths ranging from five to eight
feet below the existing ground surface. Soil samples shall be collected on a continuous
basis at approximate 2-foot intervals throughout the depth of each boring. Each recovered
soil sample shall be classified and screened in the field for the presence of volatile organic
vapors using a portable photoionization detector (PID) and visually evaluated for obvious
visible indications of potential impacts. A total of 24 soil samples shall be submitted for
analysis.

Groundwater is not expected to be encountered within the borings. If groundwater is
encountered, temporary 0.75-inch diameter PVC piezometers equipped with five feet of
slotted screen shall be installed in each boring in which groundwater is encountered during
drilling or the conclusion of soil sampling activities. All groundwater samples shall be
submitted for analysis of volatile organic compounds (VOC) including naphthalenes and
lead scavengers per EPA Method 8260. If groundwater samples are collected near areas of
concern with potential petroleum impacts, groundwater samples shall also be analyzed for
lead per EPA Method 6010B.
The CONSULTANT shall prepare a report summarizing the findings. This report shall
include available background information, the results of laboratory testing, a discussion
relative to the presence of detected constituents, conclusions, and if required,
recommendations for further activities. The levels of detected constituents will be
compared to IDEM's updated Remediation Closure Guide (RCG) screening levels to assess
potential regulatory and/or handling/disposal implications.
S. APPRAISAL PROBLEM ANALYSIS
The CONSULTANT shall prepare a parcel -by -parcel examination of the project site to
determine the extent of each taking and the appraisal approach to be utilized by the
appraiser.
The CONSULTANT shall provide Indiana Department of Transportation (INDOT) approved
appraisers to complete the Appraisal Problem Analyses (APA's).
The APA report shall include a summary sheet setting out the following:
1. Parcel Number
2. Owner's Name
3. Size of Property
4. Amount of R/W to be acquired
5. Types of R/W to be acquired
6. Recommended appraisal form
III. Appendix "C"is amended to read as follows;
E.6. PHASE II ENVIRONMENTAL SITE ASSESSMENT
The CONSULTANT shall notify INDOT and the LOCAL PUBLIC AGENCY at least one week in
advance of mobilizing to the site to initiate sampling.
Drilling and sampling activities shall be completed within 2 calendar days following notice to
proceed from the LOCAL PUBLIC AGENCY.
Laboratory analysis will be completed within 14 calendar days following the completion of
sampling.
A draft report shall be provided within 14 calendar days after completion of the laboratory
analyses. A final report shall be provided to INDOT within 3 calendar days following receipt
of the draft report comments from the LOCAL PUBLIC AGENCY.

S. APPRAISAL PROBLEM ANALYSIS
All parcels complete within 45 calendar days after completion of right-of-way engineering.
A.1. The total not to exceed fee in Section A.1 shall be changed from $544,425 to $572,880
representing an increase of $28,455.
A.2. The CONSULTANT will be paid for the work performed under this Agreement on a lump
sum basis in accordance with the following schedule:

Item 1— Phase H Environmental Site Assessment
The Phase I Environmental Site Assessment (ESA) for the project was performed in 2016 and
updated in 2017 and was conducted as a preliminary assessment to identify the potential
presence of hazardous materials within the limits of the project. The findings of the Phase I ESA
identified multiple recognized environmental concerns (RECs) with potential to impact the
subsurface conditions.
Following the approval of the Phase I ESA findings by INDOT, it was determined that a Phase II
ESA is required to further evaluate the RECs identified in the Phase I ESA which may pose a
threat to worker safety or require waste handling. A conference call between UNITED, INDOT
and Civil & Environmental Consultants, Inc. (CEC) on November 1, 2017, concluded the
additional assessment was necessary to prepare a site -specific Phase II ESA work plan. The
need for a Phase II ESA is listed as a firm commitment in the environmental document and is
required to be completed prior to the project letting.
CEC's proposal has been enclosed for reference.

Civil & Environmental Consultants, Inc. (CEC) is pleased to present to United Consulting
Engineers, Inc. (UCE) this proposal to provide environmental consulting services associated with
the Coal Line Trail Project in South Bend, St. Joseph County, Indiana.
Our preparation of this proposal was based on the following:
• The electronic mail Request for Proposal (RFP) and information sent by Devin Stettler of
UCE to Luella Beth Hillen of CEC on October 17, 2017;
• The findings of CEC's Report of Phase I Environmental Site Assessment (ESA) dated
October 9, 2017;
• The conference call on November 1, 2017, between UCE, CEC and the Indiana Department
of Transportation (INDOT);
• INDOT's approval of CEC's Potential Hazardous Material Concerns and Phase II ESA
Scope of Work Planning spreadsheet (the Work Plan) and Proposed Soil Boring Locations
Sketch on February 15, 2018; and,
• CEC's previous experience on similar projects.
1.0 PROJECT UNDERSTANDING
CEC understands UCE has been selected to prepare the National Environmental Policy Act
document and design for the Coal Line Trail Project (the Project) for the City of South Bend,
Indiana. The Project involves the proposed route of a pedestrian trail located along the former
right-of-way (ROW) of the abandoned railroad, beginning west of N. Michigan Street and
extending southwest approximately 2.7 miles to the intersection of Lincoln Way W. (U.S. 20) and

Wilber Street (the Project Area). The Project proposes to redevelop the abandoned railroad line
for use as a recreational public pathway, including construction of an approximately 10 to 12-foot
wide paved walkway, light poles and other amenities.
CEC understands that the environmental services requested are based on the findings of CEC's
Phase I ESA performed in 2016 and updated in 2017, which was conducted as a preliminary
assessment to identify the potential presence of hazardous materials within the Project Area. The
findings of the Phase I ESA identified multiple recognized environmental concerns (RECs) with
potential to impact the subsurface conditions of the Project Area.
Following approval of the Phase I ESA findings by INDOT, it was determined that a Phase II ESA
is required to further evaluate the RECs identified in the Phase I ESA which may pose a threat to
worker safety or require waste handling. A conference call between representatives of UCE,
INDOT and CEC on November 1, 2017, concluded that additional assessment was necessary to
prepare a site -specific Phase II ESA work plan.
CEC, in coordination with UCE, conducted the assessment of the identified RECs via a review of
available documents found on the IDEM's Virtual File Cabinet (VFC) to better understand the
nature and extent of known contamination and current status of the investigation and remediation
efforts at the these facilities, along with their potential to adversely affect the Project Area as it
relates to potential exposure risks during construction activities. CEC summarized the findings in
the attached Work Plan spreadsheet, which, along with an accompanying proposed sampling
locations sketch, was submitted to INDOT for review and approval prior to preparation of this
proposal. INDOT approved CEC's site -specific Work Plan on February 15, 2018.
2.0 PURPOSE
The purpose of our proposed services is to perform soil sampling and associated laboratory analyses
to help understand existing Site conditions and, if needed, to support the preparation of a potential
site -specific Soil Management Plan (SMP) for the area of the proposed trail construction activities.
If encountered, groundwater samples will also be collected for analysis and used to support
preparation of appropriate management strategies, if needed, that will be provided within the SMP in
the event that groundwater is encountered during construction and excavation activities.
3.0 SCOPE OF SERVICES
CEC will perform the following scope of services:
3.1 Task l -- Project Management & Work Plan Develo ment
This task includes the project management services provided to -date, including consultation with
UCE and INDOT personnel, review of historical records for surrounding sites identified as RECs

during the Phase I ESA, and preparation of the INDOT-approved site -specific Work Plan
spreadsheet, which summarized our findings of each potential concern in relation to the Project
Area and provided reasoning for proposed sampling activities. Copies of the INDOT-approved
Work Plan spreadsheet and the accompanying map showing the proposed soil boring locations are
attached.
3.2 Task 2 — Limited Phase II ESA
To assess subsurface conditions at the Project Area via implementation of the INDOT-approved
Work Plan, the following Phase II ESA activities are proposed:
• CEC will advise INDOT of the proposed field schedule at least one week in advance of
mobilizing to the site to initiate sampling.
• CEC will mobilize to the site prior to beginning the invasive activities to mark the proposed
boring locations for utility clearance purposes.
• CEC will contact the Indiana Underground Plant Protection Service (IUPPS) to locate
underground utilities prior to performing invasive activities. If deemed necessary, a third -
party underground utility in the public ROW locating firm can be subcontracted by CEC
for an additional fee to screen the proposed boring locations for possible private subgrade
utilities. CEC assumes no liability for damage to private utilities at the site.
• A site specific Health and Safety Plan will be prepared.
• A pre -qualified subcontractor will be retained to advance the borings at the site under the
direction of CEC.
• CEC has proposed a total of 14 soil borings to characterize the soils at the Project Area.
The proposed locations and spacing of the borings are based on the finalized INDOT-
approved Work Plan prepared as part of Task 1 and are illustrated on the attached figure.
Based on CEC's understanding of the proposed project construction disturbances, the
borings will be advanced to depths ranging from five to eight feet below ground surface
(bgs).
o CEC will provide a qualified environmental professional to conduct the field screening and
sampling, including observation and documentation of the field conditions.
Sampling equipment, including the direct -push rig, the sampling tools, and other down -
hole equipment will be decontaminated prior to arrival on -site and prior to each soil boring
advancement. The sampling tools in direct contact with environmental media will be
washed in laboratory -grade detergent and rinsed with distilled water before and between
sampling intervals. Disposable sampling materials will be used while handling soil
samples. New, disposable plastic liners will be used in the soil sampler for each sample
interval.

Soil samples will be collected on a continuous basis at approximate 2-foot intervals
throughout the depth of each boring. Each recovered soil sample will be classified and
screened in the field for the presence of volatile organic vapors using a portable photo -
ionization detector (PID) and visually evaluated for obvious visible indications of potential
impact.
At borings advanced to eight feet bgs, soil samples will be collected for laboratory analysis
from two depth intervals as requested by INDOT. One shallow soil sample will be selected
from the shallow interval which exhibits the greatest potential for contamination (based on
PID readings, visual and olfactory observations), or approximately two to four feet bgs in
the absence of field indicators of potential impact. One soil sample will also be collected
from the terminus of each boring (approximately six to eight feet bgs).
a At borings advanced to five feet bgs, one soil sample will be selected for analysis from the
interval most likely to be contaminated. In the absence of observable indicators of potential
contamination, the soil sample from approximately three to five feet bgs will be selected
for analysis.
CEC assumes a total of 24 soil samples will be submitted for analysis.
Based on the contaminants of concern (COCs) associated with the sites identified in the in
the attached Work Plan, soil samples selected for analysis will be logged on a chain -of -
custody form and submitted to the laboratory for analysis that will include volatile organic
compounds (VOCs, including naphthalenes and lead scavengers) per United States
Environmental Protection Agency (EPA) Method 8260 and lead per EPA Method 6010B.
Furthermore, as requested by INDOT, if laboratory results indicate that concentrations of
lead in soil exceed 100 milligram per kilograms (mg/Kg) in any soil sample, analysis for
Toxicity Characteristic Leaching Procedure (TCLP) lead will be requested for that sample
in order to assess the Resource Conservation and Recovery Act (RCRA) waste
classification requirements.
Based on the review of groundwater data at nearby sites conducted as part of Task 1,
groundwater is not expected to be encountered within the borings. However, as noted on
the attached INDOT-approved Work Plan spreadsheet, temporary 0.75-inch diameter
polyvinyl chloride (PVC) piezometers equipped with five feet of slotted screen will be
installed in each of the borings in which groundwater is encountered during drilling or the
conclusion of soil sampling activities. If sufficient groundwater is observed, "grab"
groundwater samples will be collected from the piezometers using disposable tubing
equipped with a check valve. After groundwater sampling activities, the temporary
piezometers will be removed and discarded. The groundwater samples will be placed in
laboratory glassware, preserved, placed on ice and submitted for laboratory analysis of
VOCs (including naphthalenes and lead scavengers) per EPA Method 8260. Additionally,
if samples are collected from the borings located near areas of concern with potential
petroleum impacts (see the attached Work Plan spreadsheet), groundwater samples will be
also be analyzed for lead per EPA Method 6010B. Because the proposed groundwater

sampling method involves temporary piezometers, formal well development is not
proposed. As such, the obtained samples may exhibit greater turbidity that could result in
biased high metals concentrations as compared to results if conventional monitoring well
installation, development and sampling methods were used. Therefore, CEC also proposes
the collection of groundwater samples in unpreserved containers to be filtered by the
laboratory prior to analysis to yield dissolved lead levels.
• For quality assurance/quality control (QA/QC) measures, soil samples will be
accompanied by a laboratory -provided trip blank for submittal and analysis of VOCs.
• Soil samples will be submitted to Pace Analytical Services of Indianapolis, Indiana, for
analysis under standard turnaround protocols (10 business days). If an expedited
turnaround is desired, additional laboratory fees will apply.
• Following sample collection, the borings will be abandoned by backfilling with native soil
and bentonite.
• Due to the small diameter and limited depth of the proposed soil borings, it is anticipated
that investigative -derived waste accumulated during drilling activities will be minimal.
Therefore, CEC proposes backfilling the boreholes with the soil cuttings.
3.4 Task 3 — lac pc)rting
After the field activities and receipt of laboratory results, CEC will prepare a draft report
summarizing our environmental findings. The report will include available background
information, the results of laboratory testing, a discussion relative to the presence of detected
constituents, conclusions, and if required, recommendations for further activities. Maps, data
tables and attachments to support our assessment will be included in the report. The levels of
detected constituents will be compared to IDEM's updated Remediation Closure Guide (RCG)
screening levels to assess potential regulatory and/or handling/disposal implications. In the event
constituents are detected in soil exceeding the screening levels for the direct contact pathway, it is
anticipated that excavation spoils meeting this criteria will need to be segregated and transported
off site for proper disposal at an appropriate landfill facility.
The draft report will be provided to UCE in PDF format via email. Upon receipt of mutually -
acceptable comments, the report will be issued to UCE and INDOT in final electronic PDF format.
If requested, hard copies will be prepared and invoiced on a time and materials basis in accordance
with the proposed fees presented in Section 4.0 of this proposal.

Our proposed fee is based on the following assumptions:
• Preparation of a Quality Assurance Project Plan (QAPP) and/or Sampling and Analysis
Plan (SAP) are not required by IDEM. If these items are requested, additional fees will
apply.
• CEC will be granted access to all sampling locations.
• No clearing or grubbing will be necessary to access the boring locations.
o Drilling and sampling activities can be conducted in two business days, with observation,
sampling and documentation provided by one CEC professional.
• Laboratory analysis of up to 24 soil samples for VOCs and 14 soil samples for lead, along
with analysis of two trip blank water samples for VOCs.
• Standard laboratory turnaround time (i.e. 10 business days) is sufficient.
• All deliverables are provided in electronic format.
• The estimated fees described above do not include the costs for the potential laboratory
analysis for TCLP Lead for waste characterization of soil. If this analysis is deemed
necessary based on the soil laboratory results, an additional laboratory fee of $75 per
sample will apply.
m Because it is unlikely that groundwater will be encountered, the estimated fees described
above do not include the associated costs for collection and analysis of groundwater
samples. If groundwater is encountered, groundwater sampling will be necessary;
therefore, additional fees will be accrued per the following rates:
• Temporary piezometers (groundwater sampling point): $60 each
• Laboratory fees:
fib, $70 per sample for VOCs analysis; and,
$20 per sample for lead (total and dissolved) analysis.
• Additional labor hours necessary to perform the groundwater sampling activities will
be charged in accordance with the INDOT labor rates described above.
CEC understands UCE has negotiated a prime agreement with the City of South Bend for this
contract. CEC will serve as a sub -consultant to UCE for the scope of services described above.
CEC understands that the INDOT standard sub -consulting agreement will be the basis for
agreements between CEC and UCE. UCE will provide CEC with a sub -consultant agreement for
review and signature. Until the sub -consultant agreement is signed, neither party is under
obligation.

5.0 SCHEDULE
Upon authorization to proceed, utilities can be notified and field activities scheduled to begin
within five to 10 business days, depending on subcontractor availability. The field activities are
expected to take two business days to conduct. Laboratory results should be obtained within
10 business days after receipt of the samples by the laboratory.
Findings from the assessment will be compiled into a draft Limited Phase II ESA report which can
be provided to UCE within approximately two weeks after the receipt of the laboratory results.
Upon receipt of mutually -agreeable comments, the final draft document can be issued within
two to three business days to INDOT for review. Upon receipt of mutually -agreeable comments
from INDOT, the Limited Phase II ESA report will be finalized and submitted to UCE within
approximately two to three business days.

The original preliminary engineering contract did not include Appraisal Problem Analysis (APA)
services pending the completion of the alignment assessment phase and discussions regarding
ownership of the rail corridor with Norfolk Southern Railroad. Now that the project has been
designed through Stage 2 and a determination of which parcels are needed for the development
of the project, APA's are necessary to determine the extent of each acquisition and the appraisal
approach to be utilized by the appraiser. Phase I has 29 parcels of which 7 parcels are within
the limits of Norfolk and Southern property. Phase II has 24 parcels.
The per parcel cost of the APA's is determined from the current Real Estate Services Fee
Schedule, as found on INDOT's website.
