DORAU SUPPLEMENTAL AGREEMENT NO. 2 This Supplemental Agreement No. 2 is made and entered into thisOo day of CeC. , 20E—� by and between the City of South Bend, Indiana, acting by and through the Board of Public Works, hereinafter referred to as the "LPA", and DLZ Indiana, LLC, 2211 East Jefferson Blvd., South Bend, IN 46615, hereinafter referred to as the "CONSULTANT". WITNESSETH WHEREAS, the LPA and CONSULTANT did, on February 10, 2015 enter into an agreement for the preparation of construction documents for the construction of the Road Reconstruction on Bendix Drive, Designation Number 1400634. WHEREAS, during the course of design, certain additional services not included in the original contract dated February 10, 2015 and Supplemental Agreement Number 1 dated April 11, 2017, have become necessary; specifically: Subsurface Utility Engineering to verify the elevation of known underground Utilities along the project corridor. NOW THEREFORE, the LPA and the CONSULTANT desire to amend the above referenced Design Contract as follows: Delete Subsection II.C.3J. of A endix A in its ntiretw+,: A. Perform Utility Designating, ASCE Quality Level A. a. The CONSULTANT shall perform up to 25 test holes to locate the elevation of either existing water mains, gas mains and/or fiber optic line along Bendix Drive from north of Lathrop Street to the toll road bridge (approximately 4,900 LFT). b. From the beginning of the project to Boland Drive, the CONSULTANT shall perform a test hole every 200 LFT following the existing water main (14 test holes). C. The CONSULTANT also anticipates an additional 6 text holes near the beginning of the beginning of the project grouped between station 65+50 and 69+00 and 5 more holes at the north end of the project for an existing water main and fiber optic line. d. All holes will be backfilled with native soils and compacted in 6" lifts. e. The CONSULTANT shall patch all holes with bag mix concrete. Perform Utility Designating, ASCE Quality Level B. Utility Designating, ASCE Quality Level B, will utilize surface geophysical methods to interpret the possible presence of underground utilities, both public and private, and then employ electromagnetic equipment to detect and designate the selected utilities. To the extent possible, buried "toneable" utilities shall be located and marked in the field. "Toneable" is 1 of 5 Supplemental Agreement No. 2 defined as any utility capable of carrying an electromagnetic signal. Using the aforementioned technology, the located utilities shall be marked using paint or flags to show the approximate horizontal position of the desired utilities. b. The CONSULTANT shall survey the location and elevation of each of the test hole locations. C. The Designating, or QL-B, listed in the line items is to ONLY mark the location of the specific utility where potholes will be performed. Does not include any other facilities that may be in the area. d. The CONSULTANT shall follow ASCE Standards for Collection and Depiction of Existing Subsurface Utility Data. APPENDIX "C" SCHEDULE: No work under this Contract shall be performed by the CONSULTANT until the CONSULTANT receives a written notice to proceed from the LPA. All work by the CONSULTANT under this Contract for the design of this project shall be completed and delivered to the LPA for review and approval within the approximate time periods shown in the following submission schedule, see Exhibit2: The anticipated letting date for the project is August 7, 2019. IV, Delete Exhibit 2 of Appendix "C" and replace with attached revised Exhibit 2: V. Revise Subsections LA and 1,13 of Appendix "D" as follows: I. Amount of Payment A. The CONSULTANT shall receive as payment for the work performed under this Agreement the total fee not to exceed $535,250.00 unless a modification of this agreement is approved in writing by the LPA. B. The amounts are estimated only, and the final amount shall not exceed their respective amounts, without prior written approval from the LPA, in accordance with Section VI, paragraph 6 of this Agreement and/or a subsequent approved amendment to the Agreement. If a right of way acquisition Subconsultant is utilized, the CONSULTANT shall receive as payment the actual cost incurred by the CONSULTANT. 3 of 5 Supplemental Agreement No. 2 VI. Amendment: Supplement Agreement No. 1 increases the current contract fee of $503,000.00 by $32,250.00 to $535,250.00and incorporates all other terms and conditions as set forth in the original Agreement dated February 10, 2015. The original Agreement, dated February 10, 2015 and Supplemental Agreement Number 1 dated April 11, 2017, shall remain in full force and effect, except as herein modified. The undersigned attests, subject to the penalties for perjury, that he is the contract party, or that he is the representative, agent, member or officer of the CONSULTANT that he has not, nor has any other member, employee, representative, agent or officer of the firm, company, corporation or partnership represented by him, directly or indirectly, to the best of his knowledge, entered into or offered to enter into any combination, collusion of agreement to receive or pay, and that he has not received or paid, any sum of money or other consideration for the execution of this Contract other than that which appears upon the face of the Contract.
