Martin, Clerk FROM: Sue Ellen Doudrick, P.E., Assistant City Engineer SUBJECT: Project No. 118-093 Sewer & Manhole Rehabilitation DATE: December 20, 2018 On December 11 2018, the Board of Public Works opened and read bids for the above project. The Division of Engineering reviewed the documents and found each bidder failed to submit information required per the standard documents. I worked with each of the low bidders to obtain the required information. Separate from the award memorandum to the Board of Public Works dated December 18, 2018, 1 wanted to document the following information with the Board of Public Works to compile all data. Inland Waters Pollution Control — missing information (See attachment A): a. Contractor's Bid For Public Work, Part II i. Section II — If you intend to sublet any portion of the work, attach the name and address of each subcontractor. A listing must be provided prior to contract approval. The original bid stated that they are unable to provide a listing. I reached out to Inland on 12/14/2018 and requested this. On 12117, Inland Water provided a listing. b. Responsible Bidder— Checklist i. Part 11. a. (iii) Prequalification checklist (for bidders that are not pre -qualified) By checking this box, I hereby acknowledge that copies of applicable certificates or standards for training programs applicable to the work performed don the project may be requested at any time and shall be furnished upon request. The bid package from Inland Waters acknowledged this statement. ii. Part II. b. (vi) — Evidence of participation in apprenticeship and training programs, applicable to the work to be performed on the project, which are approved by and registered with the United States Department of Labor's Office of Apprenticeship, or its successor organization. In their bid, they stated that: Inland Water Pollution control, Inc. does not currently employ apprenticeship programs or training programs registered with the United States Department of Labor's Office of Apprenticeship. On December 14,1 reached out to Sara Grogan (Inland Associate Estimator) informing her that it is critical for them to look closer into their training program as without this said evidence, then we will not be able to award the contract to them. On December 17, 1 spoke with Sara Grogan and Dwight Silva (Inland Business Representative) requesting this information again and to express the criticality. They indicated they would be getting this information submitted. On December 17th, I received an email from Jeremy Recklein (Inland General Manager) with their in-house training guidelines. On December 18th I replied asking if there is evidence of "participation in apprenticeship and training programs". Jeremy responded there is currently not an applicable labor category that is consistent with the type of scope of work we conduct in the field, he also indicated that they are members of various trade organizations all of which do not have an apprentice ship programs applicable to their work. 2. SAK Construction — missing information (see attachment B) a. Contractor's Bid for Public Work, Part II i. Section 1. 3. Attach information regarding any failure to complete work awarded to you and the location thereof. ii. Section 11.2. Attach a listing of the names and addresses that you have used on public works projects during past 5 years along with brief description of the work done by each subcontractor. iii. Section 11.3. If you intend to sublet any portion of work, attach the name and address of each sub, equipment to be used and whether you will require a bond. The missing information that was requested on December 14, 2018. The information was provided on December 1 Ph. b. Responsible Bidder— Checklist i. Bidder was considered pre -qualified during an un-project related submittal on 10/26/2018. However, upon review of the Insituform and Inland Water Pollution Control, Engineering looked closer at the initial submittal on 10/26/2018, and noticed the provided "Evidence of participation in apprenticeship and training programs" was noted to be from the state of Ohio. Furthermore, the memorandum states that the document does not certify any relationship the company has with the mentioned registered sponsors. 3. Insituform — missing information a. Responsible Bidder —Checklist i. Part 11. a. (iii) Prequalification checklist (for bidders that are not pre -qualified) By checking this box, I hereby acknowledge that copies of applicable certificates or standards for training programs applicable to the work performed don the project may be requested at any time and shall be furnished upon request. The bid package from Insituform acknowledged this statement. ii. Part 11. b. (vi) — Evidence of participation in apprenticeship and training programs, applicable to the work to be performed on the project, which are approved by and registered with the United States Department of Labor's Office of Apprenticeship, or its successor organization. In their bid, they stated that. Insituform is full staffed and capable of meeting all of the project requirements to complete this job for the City of South Bend. Bidder pulls trained labor from Locals 120 and 103. Bidder does not have apprenticeships due to the specific skill set for our services. On December 171h, I reached out to Janet Hass, Contract Specialist, requesting that they take a closer look at their apprenticeship and training program. On December 17th, Janet indicated that their "apprentice employees come from Union Halls. They receive training through the Union and move through the apprenticeship program by working hours for a company. They will be paid a rate per each "worked hours" threshold". According to the Responsible Bidder Ordinance, Ordinance No. 10594-18, Submissions deemed inadequate, incomplete, or untimely by the City may result in the automatic disqualification of the bid. The Engineering Division understands that the challenge with this being more specialized construction and that the US Department of Labor of Apprenticeship may not have registered or approved specific training or apprenticeships for this type of work. However, since passing of the Responsible Bidder Ordinance, this will be the first time that we have not been able to award, if that be the case, to the lowest, responsible, responsive bidder due to this new ordinance. It is Engineering's recommendation that the Board of Public Works award to the lowest responsible, responsive bidder, Inland Waters Pollution Control by waiving the requirement of the Responsible Bidder Ordinance Section 11. Part b. Item vi. as there does not appear to be clear evidence that each of these contractors who splecial in Sewer and Manhole Rehabilitation are truly re- ualified and nor shall thpy be dis ualified from bidding due to this strict ordinance. Further research with the National Association Sewer Service Companies states that they are planning to establish an Apprenticeship Program through the US Department of Labor. Encl. The City seeks to enhance its ability to identify responsive and responsible bidders on all City public works projects by institution of comprehensive submission requirements in compliance with State law. Quality workmanship, efficient operation, safety, and timely completion of projects requires that all bidders meet certain minimum requirements to be responsive and responsible bidders. THIS FORM MUST BE SUBMITTED WITH YOUR BID. INSTRUCTIONS: If you are a pre -qualified bidder, complete Section I only. If you are not a pre -qualified bidder, complete Section II only. Section II acts as an application for pre -qualification. Submission of Section II will allow the bidder to be considered for pre -qualification for bids with the City of South Bend Department of Public Works. Pre - qualified bidders will then be exempt from a portion of the submission requirements outlined in Section 6- 63 of The Responsible Bidding Ordinance No. 10594-18 (hereinafter, "Responsible Bidding Ordinance") for a period of twelve (12) months. Thereafter, contractors who are pre -qualified must submit a complete application for continuation of "pre - qualified" standing,on a form provided y y ("Responsible Bidder Checklist (1) Pre -Qualified p Aded b the City Bidders") by December 31"l for the upcoming calendar year, or within twelve (12) months of obtaining pre - qualified standing. If the status of any item changes within the twelve (12) months, it is the responsibility of the contractor to notify the City. Failure by any pre -qualified contractor to submit its complete application for continuation of "pre -qualified" standing within the time prescribed above shall result in automatic removal of the designation, effective January 1 of the following year, or immediately following the twelve (12) months of pre -qualified standing. However, the "removed" contractor or subcontractor shall still be permitted to bid on City public works projects, though the contractor must submit all required documents under 6-63 until "pre -qualified" status is re-established. Please Note: The City reserves the right to request supplemental information from the bidder, additional verification of any information provided by the bidder, and may also conduct random inquiries of the bidder's current and previous customers regardless of pre -qualified standing. It is the sole responsibility of the potential bidder to comply with all submission requirements applicable to the bidder in Section 6-63 of the Responsible Bidding Ordinance no later than the date of the public bid opening. Version 7/20/201 B General Conditions - 6 POST BID SUBMISSIONS: Post -bid submissions must be submitted in accordance with Section 6-64 of the Responsible Bidding Ordinance. The post -bid submission requirements are as follows: 1. All bidders shall collect, maintain, and provide upon request, a current written list that discloses the name, address, licensing status, and type of work for any subcontractor from whom the bidder has accepted a bid and/or intends to hire on any part of the public work project, including individuals performing work as independent contractors. 2. Each subcontractor, whose portion of the project is estimated to be at least one -hundred fifty thousand dollars ($150,000.00), shall be required to adhere to the requirements of Section I of the Responsible Bidder Ordinance as though it were bidding directly to the City, except that the subcontractor shall submit the required information (including the name, address, and type of work) to the successful bidder prior to the commencement of work. 3. Failure of a subcontractor to submit the required information shall not disqualify the successful bidder from performing work on the project and shall not constitute a contractual default and/or breach by the successful bidder. However, the City may withhold all payment otherwise due for work performed by a subcontractor, until the subcontractor submits the required information and the City approves such information. 4. The disclosure of a subcontractor list ("Disclosed Subcontractors)") to the City by a bidder shall not create any rights in the Disclosed Subcontractor(s). Thus, a bidder may substitute another subcontractor for a Disclosed Subcontractor by giving the City, upon request, written notice of the name, address, licensing status, and type of work of the substitute subcontractor. 5. The successful bidder and all subcontractors on a public works project are required to submit certified payroll utilizing the federal form known as WH-347 or a similar form on a bi-weekly basis, submitted within 10 days after the end of each bi-weekly payroll period. Certified payrolls shall identify the job title and craft for each employee. Certified payrolls shall be submitted electronically. Please Note: Submissions deemed inadequate, incomplete, or untimely by the City may result in the automatic disqualification of the bid. The City, after review of complete and timely submissions, shall, in its sole discretion, after taking into account all information in the submission requirements, determine whether a bidder is responsive and responsible, and provide a Pre -Qualification Verification Letter. The City specifically reserves the right to utilize all information provided in the contractor's submission and any information obtained by the City through its own independent verification of the information provided by the contractor. New employees will be provided on-the-job training in the specific CIPP, Spin - Cast Lining, CCTV and Pipe Cleaning in which they are enrolled. Minimum education levels are required. Basic knowledge of materials, methods and the tools of construction is helpful but not necessary. Applicants are required to: 1. Sign a letter stating that they are physically capable of performing the work required; including working from scaffolds and in confined spaces. 2. Possess a valid Driver's License as trainees may be required to operate vehicles owned by IPR. 3. Provide their own reliable transportation to and from the specific IPR office, job site and to all related instruction. 4. As a condition of continued enrollment, pass a drug test and be subject to random drug testing and eVerify. 5. Willing to travel within the designated geographic region for the purpose of successfully completing on the job training through IPR work assignments. 6. Agree to attend related instruction provided in the geographic region in full compliance with IPR's policies. Classroom TrainingZRelated Instruction Classroom training or "related instruction" (RI), is based on OSHA recognized standards for safety. IPR has inhouse trainers who are certified under industry guidelines with various certifications in safety and construction quality management. All trainees must successfully complete a wide range of safety, trade and leadership training, including the OSHA 10 Hour Construction Safety course, standard first aid/CPR and other educational tasks geared toward underground utility repair and rehabilitation specific to pipe lining operations. From their feedback, apparently there seems to benospecific category orprogram. |naddition tucommunicating with the DOLweare affiliated urare active members toavariety of industry trade organizations such as NUCA (National Utility Contractors Association), NASSCO (National Association of Sewer Service Companies), ABC (Association of Building Contractors), and AGC (Association of General Contractors) all of which do not have an apprenticeship programs applicable to our work or specific to the trenchless pipe industry that we service or the type of specialized construction services we provide atthis time. From speaking recently with the U�.Department ofLabor, the closest category would befor operators (excavation equipment operators) and pipe fitter (such as natural gas) which are not involved in lining operations. It was upon recognizing this absence of training within our specialized industry, that we began formulating a training program of our own, which has been submitted to you previously. Within this program, weaneab|etoteach&tmineagerindividua|sthetechno|ogyspecificdu1iesandtasks required to be safe & successful within our specialized line ofwork. If there is any specific information that you may have to assist us with compliance on this front and differ from the U.S. Department of Labor's guidelines, please let us know and we would welcome such information. Jane started her career as a Mechanical Designer, designing mechanical components for pumping stations and treatment plants. She is PACP, MACP, and LACP certified, and logged many hours providing quality control for pipeline and manhole inspections. Her excellent written communication skills earned her the position ofAssistant Marketing Director at URS Corporation, where she ultimately progressed to a Project Management role, assisting in implementing policies & procedures, project administration duties, and daily project controls. Jane is Past Chair of the Chesapeake American Water Works Association and Past President of the Chesapeake Chapter of the Society for Marketing Professional Services. She currently serves as Treasurer of the Chesapeake Water Environment Association (CWEA) and is active in the Collection Systems Committee. At a National level, Jane has won the prestigious Carl John Lauter and the George Warren Fuller Awards from American Water Works Association for her distinguished service to the industry. Jane has almost 30 years in the water and wastewater industry. She graduated from Trinity College with a BS in General Engineering with a concentration in Mechanical Engineering. It seems the venues are becoming larger every year due to the increase in membership participation. We began by remembering several NASSCO members that we lost in 2014 and I'd like to mention them here. David Magill, Norm Sirna, Rod Sutliff and Dick Schantz were all good men who dedicated a great deal to the industry and to NASSCO. They will be missed. The meetings covered what we have been focusing on and working toward since the Annual Conference in February. Some items to note include the update to the Pipeline Assessment Certification Program (PACP), the development of the Inspector Training Certification Program (ITCP), the NASSCO Manual of Practice update and the continuing work on the development of a new user-friendly website which includes back end functionality that will help, not only the staff, but you as member. In the near future, NASSCO Members will also have access to Online Health and Safety Training at a discounted rate. We are always working on ways to help our members save time and money so we hope some of these things will be beneficial to you. The meeting also included a vote, which passed, on proposed By -Law revisions which include making our Professional Member Category a voting category. We also moved Public Municipal Works Employees into this category so they could potentially have a seat on the Board, but he or she must be a Professional Engineer. Since NASSCO is a contractor association, the contractor members must always maintain a majority plus one position on the Board. The Committees continue to do amazing things. They all reported their initiatives, goals and accomplishments to the members. NASSCO appreciates all the committees do for the industry. It is great to see our industry leaders working together to make their areas of expertise even better. If you are not a member of a committee and would be interested in participating, a list is available on our website. I couldn't have been more excited to see a packed house at our Semi -Annual Meeting at WEFTEC. Thank you to those who participated in the September 29th meeting and also to those who attended the networking reception afterwards. For those of you who missed it, I'm happy to report that our committees are fully engaged and NASSCO continues to produce great things for the industry! I'm sure you sometimes wonder, "What is NASSCO Doing?" The following items are currently hot topics at NASSCO and we hope that you can get involved in them! 1. PACP Update, Version 7.0 — This continues to be our highest priority. We are currently undergoing a series of peer reviews, both home and abroad (WRc), to ensure a quality revision. This is an important program, and it is extremely important that we get it right. We are developing training materials and plan to hold a few Beta Classes with trainers over the next several months in order to fine tune the changes. We have high hopes to release the program for training in late spring of 2015. 2. ITCP — Gerry Muenchmeyer, NASSCO Technical Director, has been working hard to successfully grow the inspector training programs for both CIPP and Manhole Rehabilitation. He is also working with the International Pipe Bursting Association (IPBA) in the development of a Pipe Bursting Program for inspectors. 3. Technical Support—NASSCO continues to be a reliable source of technical support to the industry for trenchless rehabilitation and assessment. 4. Annual Conferences — Did you know that the costs of NASSCO Annual Conferences are almost twice the amount that we collect from registration fees? Those that come to our events almost always come back because of the great value we offer with respect to the information provided, the committee participation and the networking opportunities. 5. NASSCO MOP Update — Our Manual of Practice is extremely valuable to the industry and is unfortunately out of date. With the help of staff, consultants and volunteers like you, a focused effort is underway to revise and revitalize this valuable reference. apprenticeship Program In cooperation with the U.S.. Scholarships — In addition to the Jeffrey Ralston and PACP Scholarships, we have recently added the David Magill Scholarship for students at Virginia Tech (Mr. Magill's alma mater). 10. More... We are happy to say that we filled the position with Jane Bayer. Executive Director NOVEMBER `14 EDITION 3 The following is a brief summary and update of the ongoing technical programs at NASSCO. !Allcfifiber Service ` o hnic YAl lrmjulri -; If you are inspecting a CIPP or manhole rehabilitation project and have a question regarding the quality of the installation or have a technical question regarding pipeline rehabilitation it can be directed to director@ nassco.org, jane@nassco.org. or gerry@nassco.org The NASSCO Technical staff will review the request and provide a written recommendation. , I 1_1 r.� To date, nearly 1500 inspectors have been trained as CIPP inspectors in the U.S and Canada. To assure that the delivered product has both the design life and service life expected a certified inspector should be required on the job site, during CIPP installation. This program is not highly technical, but is a common sense approach from the field perspective. It covers field issues directly affecting the installed quality of the product. The inspector is trained on the key inspection requirements during construction that will ensure that a quality product has been installed. The program is intense, interactive and gives the inspector and engineer the knowledge and confidence to perform an effective inspection program for a Cured - In -Place pipe installation project. Inspector training programs can be held your office. A minimum of 8 registered students are required whether they are from your company or not. Typically, the maximum is 25 students to ensure a quality traiining experience for all attendees. The expected life and effectiveness of the applied product is directly related to correct product selection by the owner/ engineer and inspection of the host structure before, during and after application by a trained inspector. NASSCO's Inspector Training & Certification Program for Manhole Rehabilitation (ITCP-MR) includes detailed information on things such as, Manhole Defects - Rehabilitation Requirements, Manhole Preparation, Quality Assurance and Testing Methods, Replacement and Rehabilitation Technologies and a chapter on specifications entitled "The Inspector's Project Instructions". The program is intended to provide an owner, engineer or inspector with sufficient knowledge to inspect and verify when a product has been applied correctly. There are a number of excellent products available for manhole rehabilitation. Scheduled courses are listed on www.nasseo.org. �,J' This program is still in the development stages. With several other programs having a priority, this program is scheduled to be completed in late 2014 or early 2015. We are looking for some additional pipe bursting professionals that would be available to become trainers after the program is launched. Once the draft program is complete, a peer review group will be selected, consisting of IPBA members and any other NASSCO members who wish to participate in the review process. After peer review, a BETA class will be scheduled before the program is launched. Industry Standards Committee Marilyn Shepard, Chair Person Sub -Committees were formed to address the two specifications that the committee was tasked with completeing this year; the CCTV Spec and the Cleaning Spec. Both specifications have been compiled and are being reviewed. They should be ready for a full committee review in Janary 2015 for release to the industry shortly after. Government Relations Committee Jon Sickels, Chair Person There are three items to discuss as they pertain to our industry: • Water Resources Reform and Development Act (WRRDA): This act streamlines permitting for US Army Corp of Engineers port and maritime infrastructure projects by setting cost and time deadlines for studies and streamlining the environmental review. • Water Infrastructure Finance & Innovation Authority (WIFIA): This provision would establish a five-year WIFIA pilot program for low interest loan programs administered by the EPA to fund water and wastewater related infrastructure projects. • New Legislation: Clean Water Affordability Act: This would authorize $1.8 billion in grants to help communities tackle combined sewer and separate sanitary sewer overflows over the next five years. To date, we've increased municipal membership by 15%, lost about 3.2% on the professional membership and increased contractor growth by 2.6%. We have more work to do on this front! This year, we'd like to add more hands-on displays and we also need those expert volunteers to help educate those touring the zone. Please consider helping. Chap Lining Committee Steve Hirtz on behalf of Dave Kozman, Chair Person A new manual of practice (MOP) is under development by an ASCE task group that addresses a new CIPP design approach for gravity flow applications. A second draft is being finalized, with a target publication date of 2015. NASSCO is looking at developing a CIPP design certification course that would reflect the new ASCE MOP. NASSCO will be discussing co -authorship of the MOP with ASCE. NASSCO is performing due diligence on industry demand, pricing structure and delivery of this course (classroom, online or both). Once approved, it will take about 5-6 months to roll out. A Pipe Rehabilitation Standards Subcommittee has been formed to define structural classifications for pressure pipe lining technologies (Class I, II, III and IV) in M28. The subcommittee had its first meeting at ACE in Boston in June and another at WEFTEC on 9/28/14. The committee has developed initial framework for each classification for industry feedback. Final recommendations will be published through AW WA as a white paper. Our goals for 2015 currently include developing a draft NASSCO Guideline Specification for Pressure Pipe Rehabiliation, updating the inspection technology matrix, sponsoring and coordinating another track at UCT, continuing quarterly conference calls, completing the list of rehabiliation technologies for comment, completing a list of pressure pipe rehab projects and presenting case studies and continuing to collaborate with other assocations. Asset Management Committee Ted DeBoda, on behalf of Grant Whittle Chair Person PACP Version 7.0 will include an Asset Management appendix that was developed with the help of the EPA and WERF. Currently, we are developing a presentation to introduce it to the industry. Latin America Committee Luis Leon, Chair Person The Latin America Committee has been very busy these last few months. First, we completed the transition of Committee Chair from Diego Calderon to Luis Leon from CDM Smith, Inc. In addition, Ted DeBoda and Luis Leon gave presentations at the ICTIS congress in Medellin, Colombia: Ted presented on NASSCO and the state of the trenchless industry, the collaboration agreement with ICTIS, and the important of PACP in the industry. Luis gave presentations on How to Utilize Risk Analysis to Plan and Prioritize Cleaning, Inspection and Rehabilitation of a Sewer System, and one on the Importance of Sealing Sewer Laterals when Rehabilitating Main Sewer Lines. Finally, the LAC started the translation of ITCP for CIPP. Seven committee members are participating in the translation, which is a large undertaking, we expect to have the first draft done by the end of October and will be forming a third party group who will review it and provide comments by the end of 2014. The goal is to have the final document ready to print in the first quarter of 2015. Technical Services passed from this world. He leaves a legacy of innovation, and many firsts that helped shape the trenchless technology industry. Reliable single -conductor technology was one of many of the contributions Rod gave to the industry. He considered himself a "tinkerer", and his tinkering frequently produced excellent and innovative results in equipment performance and durability. Often, Rod took an idea and made it better, and more applicable for the industry. As the "RS" in the company name, Rod spent more than thirty years pioneering technology in his chosen specialty, leading his firm to become known as "a company of firsts." Under his leadership, the firm was the first to manufacture a mainline camera with internal lights, a true pan -and -tilt camera with tracking lights, and the first single -conductor panomorphic camera system, among many other pioneering products. Rod leaves behind his loving and devoted wife of 60 years, seven children, 22 grandchildren and 8 great- grandchildren. His legacy lives on in the children and grandchildren who are very much a part of the RST family in Petaluma, CA. Richard N Schantz lost ➢uis battle to cancer on September 6, 2014. The pipeline rehabilitation industry lost a dedicated member. Dick, a civil engineer, began his journey in 1990 with Aries Industries, Inc. His interest in pipeline televising and underground rehabilitation quickly grew to a desire to learn about and educate others in the processes of chemical grouting and underground rehabilitation systems. Dick was a strong advocate for chemical grouting and was an active participant in the development of ASTM standards related to chemical grouting in municipal sewers. Dick was recently inducted as The RST family, however, extends far beyond Petaluma. Rod touched the lives of every person who worked for RST. Each was and is a part of the extended RST family. Perhaps best known for his kind, friendly demeanor, Rod was famous for championing those less fortunate, providing help for people he knew were down on their luck. Over the years, he helped many individuals get their lives back together by providing assistance with housing, money, and/or employment. Rod's outlook on life was contagious. For those of us who knew him well, he will be remembered as a wane, highly intelligent and gentle man with a great sense of humor, and who was a loyal friend. He will be remembered by our industry as a brilliant innovator with an amazing and creative mind who contributed mightily to our industry. R. S.
