PART II
(For projects of $100,000 or more - IC 36-1-12-4)
These statements to be submitted under oath by each bidder with and as part of his/her/its bid.
Attach additional pages for each section as needed.
SECTION I EXPERIENCE QUESTIONNAIRE
1. Attach information regarding projects your organization has completed for the period of one
(1) year prior to the date of the current bid.
2. Attach a listing of public works projects currently in process of construction by your
organization.
3. Attach information regarding any failure to complete any work awarded to you and the
location thereof.
4. Attach references from private firms for which you have performed work.
SECTION II PLAN AND EQUIPMENT QUESTIONNAIRE
1. Attach an explanation of your plan or layout for performing proposed work. (Examples could
include a narrative of when you could begin work, complete the project, number of workers,
etc. and any other information which you believe would enable the City of South Bend to
consider your bid.)
2. Attach a listing of the names and addresses of all subcontractors (i.e. persons or firms
outside your own firm who have performed part of the work) that you have used on public
works projects during the past five (5) years along with a brief description of the work done
by each subcontractor.
3. If you intend to sublet any portion of the work, attach the name and address of each
subcontractor, equipment to be used by the subcontractor, and whether you will require a
bond. However, if you are unable to currently provide a listing, please understand a listing
must be provided prior to contract approval. Until the completion of the proposed project,
you are under a continuing obligation to immediately notify the City of South Bend in the
event that you subsequently determine that you will use a subcontractor on the proposed
project.
4. Attach a listing of equipment you have available to use for the proposed project.
5. Have you entered into contracts or received offers for all materials which substantiate the
prices used in preparing your proposal? If not, attach an explanation for the rationale used
which would corroborate the prices listed.
SECTION III CONTRACTOR'S FINANCIAL STATEMENT
Attachment of bidder's financial statement is mandatory. Any bid submitted without said
financial statement as required by statute shall thereby be rendered invalid. The financial
statement provided hereunder to the City of South Bend awarding the contract must be specific
enough in detail so that said City of South Bend can make a proper determination of the
bidder's capability for completing the project if awarded.

The undersigned Contractor, being duly sworn upon his/her/its oath, affirms under the penalties of perjury
that:
1. Contractor has not, nor has any other member, representative, or agent of the firm, company,
corporation or partnership represented by him, entered into any combination, collusion or agreement with
any person relative to the price to be bid by anyone at such letting nor to prevent any person from bidding
nor to induce anyone to refrain from bidding, and that this bid is made without reference to any other bid
and without any agreement, understanding or combination with any other person in reference to such
bidding. Contractor further says that no person or persons, firms, or corporation has, have or will receive
directly or indirectly, any rebate, fee, gift, commission or thing of value on account of such sale; and
2. Contractor certifies by submission of this proposal that neither contractor nor any of its principals
are presently debarred, suspended, proposed for debarment, declared ineligible, or voluntarily excluded
from participation in this transaction by any Federal department or agency; and
3. Contractor has not, nor has any successor to, nor an affiliate of, Contractor, engaged in
investment activities in Iran.
a. For purposes of this Certification, "Iran" means the government of Iran and any
agency or instrumentality of Iran, or as otherwise defined at Ind. Code § 5-22-16.5-5,
as amended from time -to -time.
b. As provided by Ind. Code § 5-22-16.5-8, as amended from time -to -time, a Contractor
is engaged in investment activities in Iran if either:
i. Contractor, its successor or its affiliate, provides goods or services of twenty
million dollars ($20,000,000) or more in value in the energy sector of Iran;
or
ii. Contractor, its successor or its affiliate, is a financial institution that extends
twenty million dollars ($20,000,000) or more in credit to another person for
forty-five (45) days or more, if that person will (i) use the credit to provides
goods and services in the energy sector in Iran; and (ii) at the time the
financial institution extends credit, is a person identified on list published by
the Indiana Department of Administration.

4. Contractor does not knowingly employ or contract with an unauthorized alien, nor retain any
employee or contract with a person that the Contractor subsequently learns is an unauthorized alien.
Contractor agrees that he/she/it shall enroll in and verify the work eligibility status of all of Contractor's
newly hired employees through the E-Verify. Program as defined by I.C. 22-5-1.7-3. Contractor's
documentation of enrollment and participation in the E-Verify Program is included and attached as part of
this bid/quote; and
5. Contractor shall require his/her/its subcontractors performing work under this public contract to
certify that the subcontractors do not knowingly employ or contract with an unauthorized alien, nor retain
any employee or contract with a person that the subcontractor subsequently learns is an unauthorized alien,
and that the subcontractor has enrolled in and is participating in the E-Verify Program. The Contractor
agrees to maintain this certification throughout the term of the contract with the City of South Bend, and
understands that the City may terminate the contract for default if the Contractor fails to cure a breach of
this provision no later than thirty (30) days after being notified by the City.
6. Persons, partnerships, corporations, associations, or joint venturers awarded a contract by the City
of South Bend through its agencies, boards, or commissions shall not discriminate against any employee or
applicant for employment in the performance of a City contract with respect to hire, tenure, terms,
conditions, or privileges of employment, or any matter directly or indirectly related to employment because
of race, sex, religion, color, national origin, ancestry, age, gender expression, gender identity, sexual
orientation or disability that does not affect that person's ability to perform the work.
In awarding contracts for the purchase of work, labor, services, supplies, equipment, materials, or any
combination of the foregoing including, but not limited to, public works contracts awarded under public
bidding laws or other contracts in which public bids are not required by law, the City, its agencies, boards,
or commissions may consider the Contractor's good faith efforts to obtain participation by those
Contractors certified by the State of Indiana as a Minority Business ("MBE") or as a Women's Business
Enterprise ("WBE") as a factor in determining the lowest, responsible, responsive bidder.
In no event shall persons or entities seeking the award of a City contract be required to award a subcontract
to an MBE/WBE; however, it may not unlawfully discriminate against said WBE/MBE. A finding of a
discriminatory practice by the City's MBE/WBE Utilization Board shall prohibit that person or entity from
being awarded a City contract for a period of one (1) year from the date of such determination, and such
determination may also be grounds for terminating the contact for which the discriminatory practice or
noncompliance pertains.
7. The undersigned contractor agrees that the following nondiscrimination commitment shall be
made a part of any contract which it may henceforth enter into with the City of South Bend, Indiana or any
of its agencies, boards or commissions.
Contractor agrees not to discriminate against or intimidate any employee or applicant for employment in
the performance of this contract with privileges of employment, or any matter directly or indirectly related
to employment, because of race, religion, color, sex, gender expression, gender identity, sexual orientation,
handicap, national origin or ancestry. Breach of this provision may be regarded as material breach of
contract.
I, the undersigned bidder or agent as contractor on a public works project, understand my statutory
obligations to the use of steel products or foundry products made in the United States (I.C. 5-16-8-1). I
hereby certify that I and all subcontractors employed by me for this project will use steel products or
foundry products made in the United States on this project if awarded. I understand I have an affirmative
duty to notify the City in my bid that my proposal does not include the use of steel products or foundry
products made in the United States. I understand it is my sole obligation and responsibility to provide a
justification to the City, subject to review and approval, why the cost of United States made steel or
foundry products is unreasonable. Prior to award and upon submission of bid which does not use steel
products or foundry products made in the United States, the City, through its director of public works, shall
make a determination if the price of United States made steel or foundry is unreasonable. I understand that

The City seeks to enhance its ability to identify responsive and responsible bidders on all City public
works projects by institution of comprehensive submission requirements in compliance with State law.
Quality workmanship, efficient operation, safety, and timely completion of projects requires that all bidders
meet certain minimum requirements to be responsive and responsible bidders.
THIS FORM MUST BE SUBMITTED WITH YOUR BID.
INSTRUCTIONS:
If you are a pre -qualified bidder, complete Section I only.
If you are not a pre -qualified bidder, complete Section II only.
Section II acts as an application for pre -qualification. Submission of Section II will allow the bidder to be
considered for pre -qualification for bids with the City of South Bend Department of Public Works. Pre -
qualified bidders will then be exempt from a portion of the submission requirements outlined in Section 6-
63 of The Responsible Bidding Ordinance No. 10594-18 (hereinafter, "Responsible Bidding Ordinance")
for a period of twelve (12) months.
Thereafter, contractors who are pre -qualified must submit a complete application for continuation of "pre -
qualified" standing, on a form provided by the City ("Responsible Bidder Checklist (1) Pre -Qualified
Bidders") by December 31" for the upcoming calendar year, or within twelve (12) months of obtaining pre -
qualified standing. If the status of any item changes within the twelve (12) months, it is the responsibility
of the contractor to notify the City. Failure by any pre -qualified contractor to submit its complete
application for continuation of "pre -qualified" standing within the time prescribed above shall result in
automatic removal of the designation, effective January 1 of the following year, or immediately following
the twelve (12) months of pre -qualified standing.
However, the "removed" contractor or subcontractor shall still be permitted to bid on City public works
projects, though the contractor must submit all required documents under 6-63 until "pre -qualified" status
is re-established.
Please Note: The City reserves the right to request supplemental information from the bidder,
additional verification of any information provided by the bidder, and may also conduct random
inquiries of the bidder's current and previous customers regardless of pre -qualified standing.
It is the sole responsibility of the potential bidder to comply with all submission requirements applicable to
the bidder in Section 6-63 of the Responsible Bidding Ordinance no later than the date of the public bid
opening.

POST BID SUBMISSIONS:
Post -bid submissions must be submitted in accordance with Section 6-64 of the Responsible Bidding
Ordinance. The post -bid submission requirements are as follows:
1. All bidders shall collect, maintain, and provide upon request, a current written list that discloses
the name, address, licensing status, and type of work for any subcontractor from whom the bidder
has accepted a bid and/or intends to hire on any part of the public work project, including
individuals performing work as independent contractors.
2. Each subcontractor, whose portion of the project is estimated to be at least one -hundred fifty
thousand dollars ($150,000.00), shall be required to adhere to the requirements of Section I of
the Responsible Bidder Ordinance as though it were bidding directly to the City, except that the
subcontractor shall submit the required information (including the name, address, and type of
work) to the successful bidder prior to the commencement of work.
3. Failure of a subcontractor to submit the required information shall not disqualify the successful
bidder from performing work on the project and shall not constitute a contractual default and/or
breach by the successful bidder. However, the City may withhold all payment otherwise due for
work performed by a subcontractor, until the subcontractor submits the required information and
the City approves such information.
4. The disclosure of a subcontractor list ("Disclosed Subcontractor(s)") to the City by a bidder shall
not create any rights in the Disclosed Subcontractor(s). Thus, a bidder may substitute another
subcontractor for a Disclosed Subcontractor by giving the City, upon request, written notice of the
name, address, licensing status, and type of work of the substitute subcontractor.
5. The successful bidder and all subcontractors on a public works project are required to submit
certified payroll utilizing the federal form known as WH-347 or a similar form on a bi-weekly basis,
submitted within 10 days after the end of each bi-weekly payroll period. Certified payrolls shall
identify the job title and craft for each employee. Certified payrolls shall be submitted
electronically.
Please Note: Submissions deemed inadequate, incomplete, or untimely by the City may result in
the automatic disqualification of the bid.
The City, after review of complete and timely submissions, shall, in its sole discretion, after taking into
account all information in the submission requirements, determine whether a bidder is responsive and
responsible, and provide a Pre -Qualification Verification Letter. The City specifically reserves the right to
utilize all information provided in the contractor's submission and any information obtained by the City
through its own independent verification of the information provided by the contractor.

1. Purpose
The purpose of the Substance Abuse Program is to provide a safe, healthy, and productive work
environment in a workplace that is free from the hazards and effects of drugs and alcohol abuse.
The intent is to protect employees, customers, customer's property and assets and to provide
safe and efficient operations.
This policy applies to all IPR employees in accordance with applicable law.
2. Policy
IPR strictly enforces its drug and alcohol abuse policy. Employees found to be in violation of the
drug and alcohol abuse policy shall be subject to the disciplinary actions stated in this policy.
The health and safety of other employees, subcontractors, customers and the general public will
not be jeopardized or tolerated by any violation of this policy.
Business entertainment is often essential for Corporate, senior management and Business
Development functions to carry out the mission of IPR. Responsible, reasonable and
discretionary consumption of alcoholic beverages during business entertainment, meals and
functions is permissible as long as it is carried out responsibly.
3. Definitions
Employee — shall mean a person, including a contract worker, a leased worker, part-time or
full-time, who is paid by IPR to perform duties, tasks or services for the company.
Illegal or Illicit -- drugs/substances shall include, but not be limited to all forms of alcohol,
narcotics, depressants, amphetamines, hallucinogens and marijuana or any
controlled substances in which the use, possession or sale is prohibited by law.
Reasonable SuggIcion — a belief on objective facts sufficient to lead to a reasonable suspicion of
use of prohibited substances.
Under the h1luence -. (1) the presence of a prohibited substance in body fluids above the cut-off
level established by this policy or by our client's policy (2) the presence of a
prohibited substance that affects an individual in any detectable manner. The
symptoms of influence may be, but not limited to, slurred speech or difficulty in
maintaining balance.

designed for use in testing, packaging, storing, injecting, ingesting, inhaling, or
otherwise introducing into the human body substances covered by this policy.

4. General Requirements
IPR strives to maintain a safe work environment conducive to effective business administration
and operations. The presence of drugs and alcohol in the workplace and the influence of these
substances on employees during working hours are inconsistent with effective business
operations and may be unlawful.
The unlawful manufacture, distribution, dispensation, possession, or use of drugs or
controlled substances while on IPR property or while executing IPR job functions in violation
of this policy is prohibited. Employees may not be under the influence of illegal drugs or
abuse alcohol while on IPR property or performing services for IPR.
Discipline
Employees who violate this Policy will be subject to discipline, up to and including discharge.
Employees who are under the influence of drugs or abuse alcohol on IPR premises or while
performing IPR job functions may be disciplined, Employees who plead guilty to or are
convicted of driving while under the influence of alcohol or drugs in the course of IPR job
duties will be subject to discharge.
B. Searches
IPR reserves the right to conduct reasonable searches of employees' lockers, desks, work
areas, computer(s), vehicles, purses, bags, containers, or personal effects. An employee who
refuses to submit immediately to such a search will be subject to discipline, up to and
including discharge.

Employees are prohibited from bringing drug paraphernalia onto IPR property or worksite on
IPR business. Employees who possess or distribute drug paraphernalia while on IPR
property or on IPR business will be subject to discipline, up to and including discharge.

An employee who voluntarily seeks treatment for an illicit substance and/or alcohol use
problem, which requires a leave of absence for treatment, shall be granted such leave of
absence, and furthermore shall be eligible for benefits under the specifications of the existing
IPR insurance policy. Employees that have been on leave for self -disclosure of substance
abuse shall be required to be tested before returning to work and randomly thereafter under
formal written conditional employment agreement.
Note: Some client and governmental regulations do not allow continued
employment of persons whose substance abuse is discovered by the Company
through testing or other means when the person'sjob is of a certain critical
nature (e„g., DOT work), Therefore, employees that do not self -identify and seek
help for substance abuse problems prior to being discovered may not be
employable by lPRl
Criminal Q1g Activit
Any employee who is involved in off -the -job illegal drug use/or activity will be deemed as
violating this policy.
Records and information obtained by the IPR regarding alcohol and drug testing, test results,
employee substance use, and the treatment of employees for substance abuse will be
maintained confidentially. Ordinarily, access to such records and information will be limited to
IPR employees who have a need to know the information in the course of performing their
jobs or other individuals consistent with applicable law. In appropriate circumstances,
employees may be required, as a condition of continued employment, to consent to the
release of records obtained under this Policy to select customer personnel or government
officials responsible for monitoring compliance with reasonable and lawful alcohol and drug
policies.
5. Drug and Alcohol Testing
Employees and prospective employees will be subject to drug and/or alcohol testing in the
following circumstances and in accordance with procedures established by this policy,
consistent with all applicable laws. Reasonable measures will be undertaken to respect
individual privacy when samples are taken. Drug test results will be released only to the IPR-
designated Medical Review Officer ("MRO") or the MRO"s designee. A written copy of this
Policy shall be provided to all employees at the point of hire and all job applicants subject to
testing. Written notice of the existence of this Policy and of where a. copy of this Policy may
be obtained shall be conspicuously posted at all facilities where testing may take place.

All job offers (including offers to individuals previously employed by IPR) must be contingent
upon satisfactory results of a drug test. The test must occur no more than thirty (0) business
days before the individual's starting date and only after an employment offer is made. IPR
prefers to have test results prior to individual starting work„ however, in cases where this is
impractical„ testing will be conducted as soon as practical, but no longer than one week after
the individuals start date. A positive test or refusal to submit to testing will result in the
withdrawal of the employment offer.
Employees working in positions in which drug testing is mandated or regulated by law -- such
as regulations of the U. S. Department of Transportation (DOT), will be subject to testing in
accordance with the applicable laws and regulations. Employees subject to regulated testing
may also be required to undergo non -regulated reasonable suspicion or post-
accident/incident iccident/incident testing in accordance with this Policy; employment actions resulting from
such non -regulated tests will be governed by this Policy.
Employees assigned to work at customer sites or on specific customer -related projects will be
subject to any additional drug and alcohol abuse policies and testing programs required by
the customer„ provided that the policies and programs are consistent with all applicable
federal, state„ and local laws. Before any testing occurs, employees who are subject to
customer -required testing must sign the Employee Consent to Customer -Required Drug
and/or Alcohol Testing (Appendix I).
A drug and/or alcohol test may be required where there is a reasonable suspicion that an
employee is under the influence of alcohol or drugs while on IPR property or on IPR business
and where there is the reasonable prospect of impaired job performance. Reasonable
suspicion testing must be based on the observation of an impaired condition or other
circumstances by a member of management or a Human Resources representative who has
been trained to make such observations reliably. The referring manager or Human
Resources representative must promptly make documentary record of specific observations
concerning the appearance, behavior, speech, or odors of the employee constituting grounds
for reasonable suspicion. This record shall be maintained and made a part of the employee's
personnel file. A copy of this record shall be provided to the employee upon request.
Employees who have been referred for reasonable suspicion testing should ordinarily be
provided transportation to the testing facility, Employees who appear to be under the
influence should not be permitted to drive.

E. PostAcricigntlIncident Testln
After a serious, work -related accident or incident, the Safety Manager will ordinarily refer the
employees involved for an alcohol and drug test, regardless of any suspicion of alcohol or
drug use. For example, post-accident/incident testing should be conducted as soon as
practicable following:
i. Any personal injury in a IPR workplace or jobsite resulting in a death or immediate
hospitalization or immediate referral to a physician;
ii. Any casualty loss or damage of IPR property with an estimated value of at least $500;
iii. Any environmental release that results in a report to a government agency;
iv. Any accident or incident that is reasonably suspected to be the result of a violation of IPR
safety standards and practices and results in personal injury or property damage;
v. Any accident or incident that results from a violation of a IPR work rule or disciplinary rule
and results in personal injury or property damage.
If, in addition to the accident/incident, there is also a reasonable suspicion of that the
employee is under the influence of drugs or alcohol, the employee should ordinarily be
provided transportation to the testing facility and should not be permitted to drive.
Note: It is a condition of employment for an employee to refrain from reporting to work
or working with the presence of drugs or alcohol in his or her body. Any injured
employee who refuses to submit to a test for drugs or alcohol in accordance
with this Policy is grounds for immediate termination and may forfeit eligibility
for workers' compensation medical and indemnity benefits under the law of the
state in which they work.
F. Random
A percentage of the total IPR employee population will be subject to random drug and alcohol
abuse testing; provided, however, random testing will be not be utilized in any jurisdiction or
location where it is prohibited such as the State of California once a supervisor is notified that
an employee has been selected for random testing, the supervisor shall notify the employee
within 24 hours. Once the employee is notified they have been selected for random testing,
that employee must report to the IPR-designated testing site within 4 hours.
Note: Employees refusing to submit to a random test or fail to meet the 4 hour
requirement shall be viewed as non -compliant with this policy and will be
terminated.

Employees who have been away from work (leave of absence, etc.) for 30 days or more and
where they were not in the random drug and alcohol testing pool, must be tested prior to
returning to work.
6. Positive Test Results
A. Drua Tests
All positive tests shall be verified promptly by retesting the sample using gas
chromatography -mass spectrometry or other equally reliable procedure. For prospective
employees, a confirmed positive drug test of a job applicant will result in the withdrawal of the
employment offer. Employees with a confirmed positive drug test will be subject to
termination. All testing will be conducted by certified laboratories and/or licensed physicians
or other qualified medical personnel. Copies of positive laboratory tests and other pertinent
information will be provided when required by state law or otherwise required or appropriate.
B. Alcohol Test
A confirmed breath alcohol level of .02 or greater will be considered a positive test result. If
the initial test indicates an alcohol concentration of 0.02 or greater, a second test will be
performed to confirm the results of the initial test. The confirmatory test will be observed and
performed between fifteen minutes and no more than 30 minutes from the completion of the
original test. Employees with a confirmed positive alcohol test will be subject to termination.
C. Failure or Refusal to Submit a S ecimen
Applicants who fail or refuse to test will be disqualified from employment and employees who
fail or refuse to test will be subject to discharge, unless the MRO determines that there is a
valid medical reason for failing to submit a specimen.
Applicants who submit adulterated, substituted, or diluted specimens for drug tests will be
disqualified from employment with IPR. Employees who submit adulterated or substituted
specimens drug tests will be terminated.

Prior to test administration, a tested person shall be provided the opportunity to submit
medical information, such as the identification of medications taken, including over-the-
counter and prescription drugs. For drug tests, the MRO will provide tested persons written
notice of any confirmed positive test results, together with a written copy of the test results,
within three (3) days following the IPR's receipt of results.
Depending on the circumstances and performance record, management may at its sole
discretion, consider a former employee for rehire after meeting all the following conditions:
• After 90 days from termination.
• Case reviewed and approved by Corporate VP of Human Resources.
• Individual is not otherwise coded as "ineligible" for rehire.
• Written conditional employment agreement is executed and signed by the
employee.

7. Responsibility of the Medical Review Officer (MRO)
The MRO shall be a physician designated by IPR.
The MRO must review all tests for which there is a laboratory report other than negative and
shall be the final decision maker as to whether a test result is positive. In addition, the MRO
must review 10% of all negative tests. The MRO is responsible for reporting findings to the
appropriate management or Human Resources contact within 24 hours of making the final
determination as to the test result.
The MRO shall be available to all persons subject to testing to provide technical information
regarding prescription and nonprescription medication. The MRO shall have a duty of
confidentiality and shall not disclose to IPR any information obtained about an employee that
is not relevant to the enforcement of this Policy.
B. Consultation with Human Resources
There shall be no discipline or termination of employment resulting from a violation of this
policy without the advance approval of IPR's VP of of Human Resources.

Employee Agreement and Consent to Drug and/or Alcohol Testing
I hereby agree, upon a request made under the drug/alcohol testing policy of Inland Pipe
Rehabilitation LLC and / or Subsidiary Business Unit further referred to as the "IPR," to submit to
a drug or alcohol test and to furnish a sample of my urine, breath, hair follicle and/or blood for
analysis. I understand and agree that if I at any time refuse to submit to a drug or alcohol test under
IPR policy, or if I otherwise fail to cooperate with the testing procedures, I will be subject to immediate
termination. I further authorize and give full permission to have IPR and/or its IPR physician send the
specimen or specimens so collected to a laboratory for a screening test for the presence of any
prohibited substances under the policy, and for the laboratory or other testing facility to release any
and all documentation relating to such test to IPR and/or its designated employee or employees, as
appropriate, and/or to any governmental entity involved in a legal proceeding or investigation
connected with the test. I waive any right to privacy regarding the screening test, its results, and
related documentation. Finally, I authorize the IPR to disclose any documentation relating to such
test to any governmental entity involved in a legal proceeding or investigation connected with the test.

that I will not sue or hold responsible such parties for any alleged harm to me that might result from
such testing, including loss of employment or any other kind of adverse job action that might arise as

IPR, its IPR physician, and any testing laboratory the IPR might use for any alleged harm to me that

test, as long as the release or use of the information is within the scope of this policy and the
procedures as explained in the paragraph above.
This policy and authorization have been explained to me in a language I understand, and I have been
told that if I have any questions about the test or the policy, they will be answered.
I UNDERSTAND THAT THE IPR WILL REQUIRE A DRUG SCREEN TEST UNDER THIS POLICY
WHENEVER I AM INVOLVED IN AN ON-THE-JOB ACCIDENT OR INJURY UNDER
