On November 27 2018 the Board of Public Works opened and read bids for the above project.
JW Concrete & Excavation did not provide acknowledgement of an addendum and G.E. Marshall
had a discrepancy in their math. The discrepancies did not affect the conclusion of the lowest bid
submitted by R & R Excavating, Inc. All the other bids were found to be correct.

Dear Mr. Villa
ON November 27, 2018, seven (7) bids were received and publicly opened by the City of South Bend Board of
Public Works (Board) for the Fat Daddy's Building Demolition Project. A certified tabulation has been
completed and it attached. DLZ reviewed the submitted documents and offers the following analysis:
1) The lowest Base Bid was submitted by R&R Excavating, Inc. (R&R) in the amount of $500,000.00.
R&R acknowledged receipt of Addendum No. 1 and provide all required documentation that was
to be submitted with their Bid.
2) JW Concrete & Excavation (JW) did not provide written documentation acknowledging receipt of
Addendum No. 1 with their Bid. A representative of JW was at the November 27, 2018 Board
Meeting and verbally confirmed that they did receive Addendum No. 1. The discrepancy in receipt
of Addendum No.1 did not affect the conclusion that the lowest Base Bid was submitted by R&R.
3) G.E. Marshall, Inc. (G.E. Marshall) provided a Base Bid in the amount of $760,300.00. However,
G.E. Marshall did not calculate their Base Bid properly. Adding up the individual bid items, their
total Base Bid amount equals $754,494.51. The discrepancy in their Base Bid amount does not
affect the conclusion that the lowest Base Bid was submitted by R&R.
It is DLZ's understanding that based on budgetary constraints and the nature of the salvaged items identified
in the mandatory Alternate Bid items, the Board intends to award the base bid plus Alternate No. 1 and
Alternate No. 3. Based on a review of the bid tabulation, the lowest Base Bid amount plus Alternate No. 1 and
Alternate No. 3 was submitted by R&R in the amount of $540,000.00.

Based on a review of the bid tabulation and the documentation required to be submitted with the Bid, R&R is
the lowest, most responsive, and responsible bidder for this project. DLZ recommends that the Board's legal
counsel and engineering department review all the Bids. Upon concurrence by the Board's legal and
engineering staff with DLZ's findings, DLZ recommends that the City of South Bend award the Base Bid plus
Alternate No. 1 and Alternate No. 3 for the Fat Daddy's Building Demolition Project to R&R for a contract
amount of $540,000.00.

"Contractor", and the Board of Public Works herein called the 'Board".
WITNESSETH: That the Contractor covenants and agrees to make the following improvement,
as fully set out in the Notice to Bidders, Standard Specification, Special Provisions, Plans, and Bid
Proposal, all of which are set forth as a part of this Contract, for:

The Contractor further agrees to notify the Engineer when this improvement is completed. This
notification shall be in the form of a Completion Affidavit, signed by the Contractor. Upon final
acceptance of the improvement by the Engineer, the Contractors final estimate will be presented
to the Board for final Payment with one (1) copy of the Completion Affidavit and one (1) copy of
a Waiver of Lien.
