JO VOO DE Attest: ~ ~ ~ ~_ Presented by me to the Mayor of the City of South Bend, Indiana _ November 27, 20 07 JOHN VOORDE Approved and signed by me 20 City Clerk Mayer City Clerk President of Common Council ORDINANCE NO. ~ ~~ 7-0 AN ORDINANCE AMENDING THE ZONING ORDINANCE AND ESTABLISHING AN HISTORIC LANDMARK FOR THE PROPERTY LOCATED AT 1905 COLLEGE, IN THE CITY OF SOUTH BEND, INDIANA STATEMENT OF PURPOSE AND INTENT The Historic Preservation Commission of South Bend and St. Joseph County (the "Commission"), has petitioned for the designation of the following described real property, commonly known as Marquette Primary Center aka Marquette School, South Bend, Indiana, as an Historic Landmark under the Ordinance No 5565-73, as amended to wit: Marquette Primary Center 1905 College Tax Key #018-2116-4254 The above-referenced property and the improvements located thereon shall be commonly hereinafter referred to as the "Property". The Commission recommends that the designation of the Property be designated as an historic landmark. NOW THEREFORE BE IT ORDAINED by the Common Council of the City of South Bend, Indiana as follows: Section I. The Property commonly known as Marquette Primary Center aka Marquette School, South Bend, Indiana more particularly described as follows: Marquette Primary Center 1905 College Tax Key #018-2116-4254 Be and hereby is designated and established as an Historic Landmark under Ordinance No. 5565-73, as amended. The zoning rules and regulations applicable to landmarks shall be applicable thereto upon the passage hereof. . This designation shall expire upon the Commission's approval of a demolition permit for all of the improvements thereon. Section II. Hostetler, Director Please find the attached Ordinance Landmarking 1905 College, Marquette Primary Center, for the Common Council's consideration at its next regularly scheduled meeting. It comes to the Common Council with Historic Preservation Commission's unanimous favorable recommendation from its May 21, 2007 meeting. It is also the Historic Preservation Commission's understanding that First District Councilman, Derek Dieter is in support of this Ordinance. At the same Historic Preservation Commission meeting, Marquette School was placed under interim protection because of the South Bend Community School Corporation's objections to the landmark status.
