ACSNA Project Site Improvements

Attached to this memorandum is a professional service contract from DJ Construction for
construction services to be performed on the interior and exterior of the ACSNA CBOC Project Site.
The improvements are necessary to facilitate the construction and rehabilitation of the 61 year old
Gates facility for the CBOC VA project. The improvements listed in this agreement consist of
environmental remediation, exterior and interior building improvements and improvements that
relate and coordinate with the improvements made to the structure by ACS, the building tenant.
As part of the reuse plan for the building, all environmental remediation of the building was done at
the beginning of the project to eliminate future conflicts when removing asbestos materials.
Although only a portion of the building is in use, the entire structure has been remediated to allow
for future occupancy.
The exterior building improvements consist of aesthetic and functional project components. To
meet current code, all of the windows along the alley or east side of the building needed to be
blocked in to meet code for building spacing. All of the remaining windows on the second floor were
covered over or modified to present a uniform appearance for the south and west faces of the
building. The windows are not being replaced or filled in because of the uncertainty with the reuse
of the second floor space in the future. Additionally, masonry work was needed to repair loose
section of the facade and parapet of the building. Once the exterior work was done, the entire
building was painted a two -tone paint format.
The improvements of the interior of the building related to demolition and clean up of spaces that
would cease to be easily accessible once the clinic space was established on the first floor. Also, in
an effort to better secure the building, a couple of doors require replacement and modification.
The total project budget for all exterior work to be performed at the site was $432,000 as approved
by the Commission earlier in the year (Res 3005). The total scope of work provided by DJ
Construction is $156,700 and an itemized listing is attached to this memo.
Staff requests approval of this professional service proposal with DJ Construction.

Contracted Building Related Items for VA Clinic — Gates Building
Basis of Work
These contract items are presented as changes or modifications to the specifications dated
December 6, 2011 and are based on the preliminary Floor Plan H dated May 13, 2011 as
designed by DJ Construction Co., Inc. We agree to furnish labor, materials and equipment to
execute any of the following alternates as selected by the City of South Bend related to the
VA Clinic build out at the former Gates Toyota building in South Bend, Indiana as per the
following bullet specifications.
Please note that the base bid portion of the original proposal for the building renovation
has been incorporated into a contract between GMS Realty, Inc. (the Gates entity),
Ambulatory Care Solutions, LLC (ACS is the Earnest's company) and DJ Construction, Inc.
However, the alternates to the Building Renovation proposal (City to make initial selections
here below and contract work with DJ directly) or the Sitework proposal (being managed by
the City independently) are not included in the aforementioned contract.
Sitework: (this is the wording from our 12/6/2011 proposal for building renovation)
• For simplicity, all the exterior sitework (earthwork, concrete and asphalt) has now
been included with the parking lot improvements because only about ten percent of
the total sitework cost was at the building.
Miscellaneous
All costs and utility fees associated with temporary electric, heat (gas, natural or
LP) and water are not included in this proposal. Typically these utility accounts will
be setup in the client's name (ACS) and billed directly. If billing directly is not
possible, DJ will track the costs separately and be reimbursed by ACS. Either DJ or
ACS will pay the City of South Bend for temporary water or electricity consumed at
the former Shillings Building.
The following items are not included in these proposed alternates:
Bonds of any kind
Utility extensions or relocations (see site options)
Work at grade outside the exterior walls of the building except at new entrance
Demo or new work related to the parking lot improvements and new sidewalks
New roof on the building
Landscaping

DJ Construction is not responsible for unforeseen circumstances, which may arise
above or below grade during construction including the handling or removing any
hazardous materials (see Alternates #9, #10 and #11).
The alternate prices presented below are good for 15 days, but prompt decisions
and selections are critical due to the overall completion date of May 15Y, 2012. DJ
understands that either the City or ACS may pay for certain options, or the cost of
certain items may be shared in some manner. We are fine with that arrangement
and will process the paperwork accordingly. At this point we simply need
authorization. Progress Payments will be due monthly. Invoices will be prepared by
the 25th of each month for work actually completed and materials stored on site or
in insured warehouses. Payments will be due by the 5th of the following month.
ALTERNATES
ALTERNATE #1— REMOVE TWO PAINT BOOTHS
Demolish and remove from site, two automotive paint booths located on the second
floor of the existing building.
Alternate #1 Add: $2,800.00
ALTERNATE #2 — REMOVE HEATING UNIT
Disconnect and remove from site, one large heating unit located above the upper
portion of the ramp to the second floor.
Alternate #2 Add: $600.00
ALTERNATE #3 — DEMOLISH LOWER THREE BAYS OF EXISTING RAMP
We propose to demolish and remove the lower three bays of the existing ramp. This
will allow the area (approximately) 1,450 sq. ft. to be utilized as first floor space either
now if desired by ACS or in the future as one possible means to access the second floor.
The remaining two bays of the ramp are high enough to not affect the floor plan of the
first floor, and could always be built over level with the second floor if a future user of
the building so desires. The gap left by the demolition will be filled with metal floor
joists and deck to secure the first floor area and prevent air infiltration from the
unfinished second floor.
• Note: The raised section of the second floor that is located mostly over the second
and third bays of the ramp (from the bottom, between column lines 7 and 5) will
remain. This floor is about 3' above the second floor, but could provide ancillary
space (mechanical, IT, storage) for future second floor development. Due to the way
this raised section of floor is constructed, it will be nearly impossible to remove it
without damaging the exterior wall of the building. A revised concept for a possible
future elevator and stairway to the second floor has been created that does not
require the removal of this raised floor section.

ALTERNATE #3 — DEMOLISH LOWER THREE BAYS OF EXISTING RAMP (continued)
• Saw cut, jackhammer and remove the lower three bays of the concrete ramp,
approximately 22' x 62' in area. The first section is slab on grade and the next two
are cast in place concrete.
• Demolish and fill in the existing recessed floor area below the second and third bays
of the ramp, approximately 22'x 25' in area.
• Grade and prep first floor level and pour approximately 1,050 sq. ft. of new 4"
concrete slab on grade to match existing floor elevation.
• Provide and install approximately. 630 sq. ft. of 10 gauge 14" steel CEE joists at 24"
o.c. to span the 21' gap between column lines. Install web stiffeners and bridging as
required. These joist have been sized to carry a future 3" concrete slab plus an
additional live floor loading of 100 psf.
• Provide and install 6" steel stud wall approximately 21' x 6' tall at bottom of
remaining section of ramp, extending up to CEE joist.
• Provide and install 6" steel stud wall approximately 21' x 2' tall at bottom of raised
section of second floor, extending from the CEE joist up to existing concrete.
• Provide and install 1.5" B steel deck on top of CEE joists.
• Provide and install 1.5" B steel deck as wall panels on south side of stud wall.
• Provide and install 9" of fiberglass insulation (R -27) in between CEE joists.
• Provide and install 6" of fiberglass insulation (R -19) in between studs.
• Provide and install 5/8" drywall on bottom face of CEE joist.
• Provide and install 5/8" drywall on sides of stud walls exposed to the second floor.
(Alternate #3 Total Cost Add: $29,150.00 is to be Split 50/50 with ACS)

ALTERNATE #3X — NOT USED (DEMOLISH ADDITIONAL 16'X20' SECTION OF EXISTING RAMP)
NOTE: This additional work would ONLY be required to accommodate a future elevator
to the second floor at the new Vestibule. This would be for the City's future benefit.
This price was $6,500, but item was deferred and can be done in the future if needed.
ALTERNATE #4 — CLEANUP SECOND FLOOR OF EXISTING ORIGINAL BUILDING
NOTE: Part of this work has already been done. Cleanup and remove from the site all
the miscellaneous debris and items that are not attached to the building. This will result
in a nicer appearance throughout. Floors will be broom swept. Conclusion of this work
will be finished after second floor asbestos abatement is finished (if performed).

ALTERNATE #5 — FILL IN SECOND LEVEL WINDOWS AT ALLEY WITH SMOOTH BLOCK
This is at the alley and may be required to meet code depending on local inspector.
• Remove existing glazing and window frames from nine openings along the alley and
dispose of off site. Note: Earlier price for this item was based on only eight
openings.
• Provide and install 8" smooth face concrete masonry units.
• Price now includes tenting of area and temporary heat for winter construction.
• Paint new concrete block masonry units to match existing walls. Provide one (1)
coat of block filler and one (1) coat of latex exterior paint. (This section of building
will get another coat of paint in Alternate #8.
Alternate #5 Add: $18,890.00
ALTERNATE #6 — FILL IN SECOND LEVEL WINDOWS WITH METAL
This is for JUST the South and West walls of the original building AND the south two
windows along the East wall most visible from Western Avenue. We will not put metal
and trim on the remaining windows along the alley which are behind the power lines.
• Existing glazing and window frames to remain in place at typical openings except at
the alley where they will be removed so that those two openings can be filled with
smooth concrete masonry units.
• Provide and install horizontal channels attached to either the existing vertical
mullions or the new smooth concrete masonry units (along the alley only).
• Provide and install treated 2x6 trim piece attached to the face of the existing brick at
window openings that do not already have a stucco trim border.
• Provide and install trim metal (in color selected by City and ACS) to wrap the 2x6 or
stucco border at each window opening.
• Provide and install new metal siding (in color selected by City and ACS) fastened to
the channels to fill in the window openings.
Alternate #6 Add: $32,500.00
ALTERNATE #7 — NOT USED
ALTERNATE #8 — PAINT THREE SIDES OF VA CLINIC PORTION OF BUILDING
This is for the East (adjacent to the alley), South and West (as far North as the original
building goes) walls of the building.

ALTERNATE #9 — ASBESTOS AND OTHER ABATEMENT — MAIN FLOOR
NOTE: On February 1, 2012, JC Schrock told Bill Schalliol that DJ was including this part
of the abatement in our contract with GMS & ACS. That was true at the time, but as a
part of the change order for the larger floor plan, that the VA has now decided against
implementing. Per the original proposal, DJ was not responsible for handling or
removing hazardous materials. After receiving the authorization from ACS (via the VA)
DJ solicited a proposal from Diamond Environmental Services, which is the basis for the
abatement alternates. The main floor abatement is required for the VA project and is
currently underway.
All abatement work to be performed by Diamond Environmental Services:
• Removal of approximately 1,317 Lin. Ft. of asbestos pipe insulation in front offices,
east bay area.
• Removal of approximately 97 Sq. Ft. of Transite board material in back offices under
windows.
• IDEM State Notification fees.
• Provide scissor lifts as needed.
• Disposal fees.
• OSHA required air monitoring.
• Standard Insurance Certificate.
• Final Air Clearances.
Alternate #9 Add: $17,750.00
ALTERNATE #10 — ASBESTOS AND OTHER ABATEMENT — SECOND FLOOR

ALTERNATE #12 — DEMOLISH AND REMOVE RAISED PLATFORM AT SOUTHEAST CORNER
Demolish and remove from site, the raised platform attached to the southeast corner of
the building. The platform has already been removed by DJ Construction to facilitate
the exterior renovations of the south wall. This platform was located above an
abandoned fuel oil tank that remains and will be removed as part of the City sitework
project (cleanup and removal of the tank is not included in this revised alternate price).

ALTERNATE #13 — REPAIR CRACKS IN BRICK ABOVE NEW MAIN ENTRANCE
Repair area of brick between two second floor windows on the west face of the building
above the new main entrance.

Repair area of brick at the first floor on the far north end of the west face of the original
building. This area is just north of the two overhead doors being closed with brick and

ALTERNATE #15 — INSTALL NEW 3'X7' H.M. DOOR AT S.E. STAIRWELL AND ALLEY
Install new 3'x7' insulated flush hollow metal door in existing masonry opening at the
alley wall of SE stairway (alternate does not include a new concrete stoop in the alley).
Includes lockset, theft - shield, threshold and weatherstripping.
Alternate #15 Add: $1,600.00
ALTERNATE #16b — INSTALL NEW 9'6 "X12'10" O.H. DOOR AT NORTH WALL AND ALLEY
Install new 9' -6" x 12' -10" 591 series "Thermacore" sectional door, as manufactured by
the Overhead Door Corporation at the one remaining OH door facing the North (closest
to the alley on the East). Pricing includes removal and hauling away of the existing door
and electric operator. Leave existing tracks in place for use with new door. Haul away
all sections, springs, and related hardware. We are proposing to reuse the existing track
which is in good shape and relocate the best existing (working) overhead door operator.
This price does not include getting working electricity to the operator, but that can be
addressed as directed by Jeff Young. The proposed door is solid - no lights with side,
top, & bottom weather seals, 10,000 cycle torsion spring counter - balance with 1" solid
door shafts, baked on exterior white paint and inside slide lock. Door standard features
to include the following: .016" thick roll- formed hot - dipped galvanized, ribbed face
steel sections, with metal /foam /metal sandwich, foamed -in -place homogeneous
CFC /HCFC free polyurethane insulation. Insulating values: R = 14.86, U = .067. Section
thickness 15/8 ", all sections to be fitted with tube seals to weather strip each joint. Air
infiltration of .08 cfm per sq. ft. of door at 15 mph, and class 26 sound transmission.
End stiles will be 16 ga. steel; hinges and fixtures will be galvanized steel. EPDM thermal
break to be provided between interior and exterior skins to prevent thermal

transmission. Patented water channel is provided for a drip free opening. The
polyurethane foam insulation is fully encapsulated in non - permeable materials for no
loss of thermal efficiency. Limited 10 -year warranty against panel delamination of foam
and steel skins.

Paint the remainder of the overall building (the North addition) not included in
Alternate #8 above. This includes painting over the window glass above the car wash
addition facing the alley.

ALTERNATE #20 — REPAIR BRICK PARAPET ALONG THE ALLEY
On Thursday 4/5/2012 the overhead power lines were shut off by AEP and we started
scraping the loose paint and brick on the east wall of the building in preparation for
painting. The top 9 courses of brick are in a considerable state of disrepair. After much
discussion and evaluation, it is my opinion that the brick used at the parapet on the alley
side are softer than those used on the other faces and they tend to absorb water more.
This has resulted in the faces of many brick spalling off and significant deterioration of
the mortar joints. While we do not feel this location justifies the expense of replacing
the damaged brick and tuck pointing the mortar joints, we do have considerable
concern about how well the new paint will adhere to this area and how long it will hold
up. We propose to improve the face of the parapet by the following method: The area
to be treated is the top 2' of brick by 176' long. Power wash with rotary tip to remove
all the loose particles. Pre -wet wall with Tammsweld liquid bonding agent. In -fill
mortar joints and missing brick faces with Tamms Thin Patch polymer- modified, cement
based mortar formulated for repairing defects in concrete and masonry surfaces from
featheredge up to 1 ". This will result in a relatively smooth surface (similar in
appearance to the cast -in -place concrete beam directly below the brick parapet) that
will encapsulate the existing brick and mortar joints into a significantly more stable
surface for the paint to adhere to. This should prevent or minimize future spalling of
brick as long as the back side of the parapet is properly flashed to the roof of the
building.

Provide and install seven pieces of 13 gauge steel metal panels to cover the damaged
glass at the H.M. frames of the former auto parts entrance, prior to painting Alt. #17.

here below and contract work with DJ directly) or the Sitework proposal (being managed by
the City independently) are not included in the aforementioned contract.
Sitework: (this is the wording from our 12/6/2011 proposal for building renovation)
• For simplicity, all the exterior sitework (earthwork, concrete and asphalt) has now
been included with the parking lot improvements because only about ten percent of
the total sitework cost was at the building.
Miscellaneous
All costs and utility fees associated with temporary electric, heat (gas, natural or
LP) and water are not included in this proposal. Typically these utility accounts will
be setup in the client's name (ACS) and billed directly. If billing directly is not
possible, DJ will track the costs separately and be reimbursed by ACS. Either DJ or
ACS will pay the City of South Bend for temporary water or electricity consumed at
the former Shillings Building.
The following items are not included in these proposed alternates:
Bonds of any kind
Utility extensions or relocations (see site options)
Work at grade outside the exterior walls of the building except at new entrance
Demo or new work related to the parking lot improvements and new sidewalks
New roof on the building

D1 Construction is not responsible for unforeseen circumstances, which may arise
above or below grade during construction including the handling or removing any
hazardous materials (see Alternates #9, #10 and #11).
The alternate prices presented below are good for 15 days, but prompt decisions
and selections are critical due to the overall completion date of May 1St, 2012. DJ
understands that either the City or ACS may pay for certain options, or the cost of
certain items may be shared in some manner. We are fine with that arrangement
and will process the paperwork accordingly. At this point we simply need
authorization. Progress Payments will be due monthly. Invoices will be prepared by
the 25th of each month for work actually completed and materials stored on site or
in insured warehouses. Payments will be due by the 5th of the following month.
ALTERNATES
ALTERNATE #1— REMOVE TWO PAINT BOOTHS
Demolish and remove from site, two automotive paint booths located on the second
floor of the existing building.
Alternate #1 Add: $2,800.00
ALTERNATE #2 — REMOVE HEATING UNIT
Disconnect and remove from site, one large heating unit located above the upper
portion of the ramp to the second floor.
Alternate #2 Add: $600.00
ALTERNATE #3 — DEMOLISH LOWER THREE BAYS OF EXISTING RAMP
We propose to demolish and remove the lower three bays of the existing ramp. This
will allow the area (approximately) 1,450 sq. ft. to be utilized as first floor space either
now if desired by ACS or in the future as one possible means to access the second floor.
The remaining two bays of the ramp are high enough to not affect the floor plan of the
first floor, and could always be built over level with the second floor if a future user of
the building so desires. The gap left by the demolition will be filled with metal floor
joists and deck to secure the first floor area and prevent air infiltration from the
unfinished second floor.
• Note: The raised section of the second floor that is located mostly over the second
and third bays of the ramp (from the bottom, between column lines 7 and 5) will
remain. This floor is about 3' above the second floor, but could provide ancillary
space (mechanical, IT, storage) for future second floor development. Due to the way
this raised section of floor is constructed, it will be nearly impossible to remove it
without damaging the exterior wall of the building. A revised concept for a possible
future elevator and stairway to the second floor has been created that does not
require the removal of this raised floor section.

ALTERNATE #3 — DEMOLISH LOWER THREE BAYS OF EXISTING RAMP (continued)
• Saw cut, jackhammer and remove the lower three bays of the concrete ramp,
approximately 22'x 62' in area. The first section is slab on grade and the next two
are cast in place concrete.
• Demolish and fill in the existing recessed floor area below the second and third bays
of the ramp, approximately 22'x 25' in area.
• Grade and prep first floor level and pour approximately 1,050 sq. ft. of new 4"
concrete slab on grade to match existing floor elevation.
• Provide and install approximately 630 sq. ft. of 10 gauge 14" steel CEE joists at 24"
o.c. to span the 21' gap between column lines. Install web stiffeners and bridging as
required. These joist have been sized to carry a future 3" concrete slab plus an
additional live floor loading of 100 psf.
• Provide and install 6" steel stud wall approximately 21'x 6' tall at bottom of
remaining section of ramp, extending up to CEE joist.
• Provide and install 6" steel stud wall approximately 21'x 2' tall at bottom of raised
section of second floor, extending from the CEE joist up to existing concrete.
• Provide and install 1.5" B steel deck on top of CEE joists.
• Provide and install 1.5" B steel deck as wall panels on south side of stud wall.
• Provide and install 9" of fiberglass insulation (R -27) in between CEE joists.
• Provide and install 6" of fiberglass insulation (R -19) in between studs.
• Provide and install 5/8" drywall on bottom face of CEE joist.

ALTERNATE #4 — CLEANUP SECOND FLOOR OF EXISTING ORIGINAL BUILDING
NOTE: Part of this work has already been done. Cleanup and remove from the site all
the miscellaneous debris and items that are not attached to the building. This will result
in a nicer appearance throughout. Floors will be broom swept. Conclusion of this work
will be finished after second floor asbestos abatement is finished (if performed).

ALTERNATE #5 — FILL IN SECOND LEVEL WINDOWS AT ALLEY WITH SMOOTH BLOCK
This is at the alley and may be required to meet code depending on local inspector.
• Remove existing glazing and window frames from nine openings along the alley and
dispose of off site. Note: Earlier price for this item was based on only eight
openings.
• Provide and install 8" smooth face concrete masonry units.
Price now includes tenting of area and temporary heat for winter construction.
Paint new concrete block masonry units to match existing walls. Provide one (1)
coat of block filler and one (1) coat of latex exterior paint. (This section of building
will get another coat of paint in Alternate #8.
Alternate #5 Add: $18,890.00
ALTERNATE #6 — FILL IN SECOND LEVEL WINDOWS WITH METAL
This is for JUST the South and West walls of the original building AND the south two
windows along the East wall most visible from Western Avenue. We will not put metal
and trim on the remaining windows along the alley which are behind the power lines.
• Existing glazing and window frames to remain in place at typical openings except at
the alley where they will be removed so that those two openings can be filled with
smooth concrete masonry units.
• Provide and install horizontal channels attached to either the existing vertical
mullions or the new smooth concrete masonry units (along the alley only).
• Provide and install treated 2x6 trim piece attached to the face of the existing brick at
window openings that do not already have a stucco trim border.
• Provide and install trim metal (in color selected by City and ACS) to wrap the 2x6 or
stucco border at each window opening.
• Provide and install new metal siding (in color selected by City and ACS) fastened to
the channels to fill in the window openings.

NOTE: On February 1, 2012, JC Schrock told Bill Schalliol that DJ was including this part
of the abatement in our contract with GMS & ACS. That was true at the time, but as a
part of the change order for the larger floor plan, that the VA has now decided against
implementing. Per the original proposal, DJ was not responsible for handling or
removing hazardous materials. After receiving the authorization from ACS (via the VA)
DJ solicited a proposal from Diamond Environmental Services, which is the basis for the
abatement alternates. The main floor abatement is required for the VA project and is
currently underway.
All abatement work to be performed by Diamond Environmental Services:
• Removal of approximately 1,317 Lin. Ft. of asbestos pipe insulation in front offices,
east bay area.
• Removal of approximately 97 Sq. Ft. of Transite board material in back offices under
windows.

Install new 9' -6" x 12' -10" 591 series "Thermacore" sectional door, as manufactured by
the Overhead Door Corporation at the one remaining OH door facing the North (closest
to the alley on the East). Pricing includes removal and hauling away of the existing door
and electric operator. Leave existing tracks in place for use with new door. Haul away
all sections, springs, and related hardware. We are proposing to reuse the existing track
which is in good shape and relocate the best existing (working) overhead door operator.
This price does not include getting working electricity to the operator, but that can be
addressed as directed by Jeff Young. The proposed door is solid - no lights with side,
top, & bottom weather seals, 10,000 cycle torsion spring counter - balance with 1" solid
door shafts, baked on exterior white paint and inside slide lock. Door standard features
to include the following: .016" thick roll- formed hot - dipped galvanized, ribbed face
steel sections, with metal /foam /metal sandwich, foamed -in -place homogeneous
CFC /HCFC free polyurethane insulation. Insulating values: R = 14.86, U = .067. Section
thickness 15/8 ", all sections to be fitted with tube seals to weather strip each joint. Air
infiltration of .08 cfm per sq. ft. of door at 15 mph, and class 26 sound transmission.
End stiles will be 16 ga. steel; hinges and fixtures will be galvanized steel. EPDM thermal
break to be provided between interior and exterior skins to prevent thermal

ALTERNATE #20 — REPAIR BRICK PARAPET ALONG THE ALLEY
On Thursday 4/5/2012 the overhead power lines were shut off by AEP and we started
scraping the loose paint and brick on the east wall of the building in preparation for
painting. The top 9 courses of brick are in a considerable state of disrepair. After much
discussion and evaluation, it is my opinion that the brick used at the parapet on the alley
side are softer than those used on the other faces and they tend to absorb water more.
This has resulted in the faces of many brick spalling off and significant deterioration of
the mortar joints. While we do not feel this location justifies the expense of replacing
the damaged brick and tuck pointing the mortar joints, we do have considerable
concern about how well the new paint will adhere to this area and how long it will hold
up. We propose to improve the face of the parapet by the following method: The area
to be treated is the top 2' of brick by 176' long. Power wash with rotary tip to remove
all the loose particles. Pre -wet wall with Tammsweld liquid bonding agent. In -fill
mortar joints and missing brick faces with Tamms Thin Patch polymer- modified, cement
based mortar formulated for repairing defects in concrete and masonry surfaces from
featheredge up to 1 ". This will result in a relatively smooth surface (similar in
appearance to the cast -in -place concrete beam directly below the brick parapet) that
will encapsulate the existing brick and mortar joints into a significantly more stable
surface for the paint to adhere to. This should prevent or minimize future spalling of
brick as long as the back side of the parapet is properly flashed to the roof of the
building.

Provide and install seven pieces of 13 gauge steel metal panels to cover the damaged
