AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND,
INDIANA MAHING TECHNICAL CORRECTIONS TO
ORDINANCES 9450-03 AND 9527-04 -FIXING MAXIMUM SALARIES OF
APPOINTED OFFICERS AND NON-BARGAINING EMPLOYEES IN THE YEARS
2004 AND 2005
STATEMENT OF PURPOSE AND INTENT
The purpose of this Ordinance is to make technical corrections to Ordinance Numbers 9450-
03 and 9527-04 fixing the maximum salaries of appointed officers and non-bargaining employees
of the City of South Bend, Indiana for the calendar years 2004 and 2005 by adding inadvertent
omissions.
NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCII. OF THE CITY
OF SOUTH BEND, IlVDIANA, AS FOLLOWS:
Section I. Ordinance No. 9450-03 and 9527-04 is amended to include the following:
Section II.
The Mayor, at his or her discretion, may offer to a City department head , as
part of such person's emnloyment benefits and in lieu of a City-owned
vehicle, a sum equal to the reasonable commercial lease value of a
comparable City owned vehicle. This benefit may range from one ($1.00) to
five hundred dollars ($500.00) per month.
All other provisions of Ordinance No. 9450-03 and 9527-04 are hereby reaffirmed, ratified
and continued in full force and effect.
Section II. This Ordinance shall be retroactive for years 2004 and 2005 and be in full force
and effect from and after the time it has been adopted by the Common Council and approval by the
Mayor.

is being recommended to the full Council with a favorable recommendation as
substituted by adding a new section 2-123.1 to define "Key Employee" and amended by
deleting the phrase or other key employee having specialized expertise.

Re: Substitute Versions of Bills 46-OS and 57-OS

Attached are substitute versions of Common Council Bills 46-OS and 57-05. These two bills
contain similar provisions authorizing a car allowance upon hire of a City Department Head or key
employee. The proposed changes involve those provisions. Following is an explanation for the
change to each bill:
1. Bill46-O5.
The change is at Section II of the Ordinance which amends Article 2, Chapter 8, to add a new
Section 2-123.1. A definition of "key employee" has been added to that new Section as suggested
by certain members of the Council at the last Committee hearing on Bill 46-05.
2. Bi1157-05.
This bill amends retroactively the 2004 and 2005 salary ordinances to authorize a car
allowance for Department Heads and key employees. This ordinance was suggested by the State
Board of Accounts and the new language specifies the dollar range of the car allowance, i.e., from
$1.00 to $500.00 per month, consistent with the 2006 salary ordinance.
