Attest: ~-~ Presented by me to the Mayor of the City of South Bend, Indiana September 13, 05 20 City Clerk President of Common Council Approved and signed by me S e o t ember 16 20 ~5- Ciry Clerk Mayer ORDINANCE NO. ~ b ~ Z" AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA AMENDING THE SOUTH BEND MUNICIPAL CODE CHAPTER 2, ARTICLE 8, CONCERNING OFFICER AND EMPLOYEE VACATIONS AND OTHER BENEFITS STATEMENT OF PURPOSE AND INTENT It is necessary to amend Chapter 2, Article 8 of the South Bend Municipal Code to clarify that officers and employees of the City shall have vacation schedules pursuant to the Annual Salary Ordinance and to provide for optional benefits to heads of City Departments and to key employees with specialized expertise. NOW, THEREFORE, BE IT ORDAIlVED BY THE COMMON COUNCII. OF THE CITY OF SOUTH BEND as follows: Section I. Chapter 2, Article 8, Section 2-120 shall be amended to read as follows: Sec. 2-120. Annual vacations for officers and employees (a) All officers and employees of the City ,shall be subject to the vacation schedules set forth in the City's Personnel Policies and Procedures as it may be amended from time to time which shall be available for public inspection in the office of the City Clerk, and further as such schedules may be amended in the annual salary ordinances enacted by the Common Council. The annual vacation privileges of officers and employees of the City whose anniversary date falls on or before December 31, 1986 shall be preserved. 8 ~~ar-msre z@ iG ~~ ,~ ,~ {~~ "Years of service" means uninterrupted employment with the City. All references to years indicate a complete year of employment upon the employee's anniversary date rather than fiscal years. {€~ ~ Vacation time is not cumulative, and any days of vacation not actually used during the calendar year in which they accrue shall be lost with no additional compensation paid to employees not using those lost vacation days-, subject to the City's Personnel Policies and Procedures which may allow use durine the first quarter of the calendar year following the year in which the vacation days accrue. {g) ~ This section shall not apply to sworn police officers and firefighters. fie) The Mayor at his or her discretion may alter the vacation schedule for heads of City Departments or for key employees having specialized expertise. Section II. Anew Section 2-123.1 shall be added to Article 2, Chapter 8 of the South Bend Municipal Code which shall read as follows: Section 2-123.1 Discretionary Vehicle Allowance to City Department Head or Key Emplo,~ee. ~ The Mayor at his or her discretion may,offer to a City Department head or key emplo ewe as part of such person's employment benefits, and in lieu of a city-owned vehicle, a sum equal to the reasonable commercial lease value of a comparable city- ownedvehicle. As used herein, key employee means a person who has a hi hgL level of expertise, either by certification, advanced education, licensing, or years of experience, in a field important to City operations. This~rovision shall be retroactive to January 1, 2004. Section III. This Ordinance shall be in full force and effect from and after adoption by the Common Council and approval by the Mayor. These two bills contain similar provisions authorizing a car allowance upon hire of a City Department Head or key employee. The proposed changes involve those provisions. Following is an explanation for the change to each bill: 1. Bill46-O5. The change is at Section II of the Ordinance which amends Article 2, Chapter 8, to add a new Section 2-123.1. A definition of "key employee" has been added to that new Section as suggested by certain members of the Council at the last Committee hearing on Bill 46-05. 2. Bi1157-05. This bill amends retroactively the 2004 and 2005 salary ordinances to authorize a car allowance for Department Heads and key employees. This ordinance was suggested by the State Board of Accounts and the new language specifies the dollar range of the car allowance, i.e., from $1.00 to $500.00 per month, consistent with the 2006 salary ordinance.
