FOR PURPOSES OF COMPLIANCE WITH THE TAX REFORM ACT OF 19 c i iEREAS, the South Bend Redevelopment Commission (xc i� n), governing body of the City of South Bend Department of R vg1 ent (Department), on April 24, 1987, adopted Resolution No. 801, redeclaring the Studebaker Corridor Development Area to be blighted for purposes of compliance with the Tax Reform Act of 1986 (Declaratory Resolution); and WHEREAS, the Declaratory Resolution found and determined that an area within the City of South Bend, Indiana (City) designated by the Commission as the Studebaker Corridor Development Area (Area) continues to be blighted within the meaning of I.C. 36 -7 -14 (Act); and WHEREAS, the Declaratory Resolution further found and determined that there is a substantial presence in the Area of excessive vacant land on which structures were located, abandoned or Cvacant buildings, old buildings, excessive vacancies, substandard structures, and delinquency in payment of real property taxes; and WHEREAS, the Declaratory Resolution readopted the Studebaker Corridor Development Area Development Plan (Development Plan); and WHEREAS, certain Findings of Fact have been presented to the Commission which concern the location, physical condition of the structures, land use, environmental influences and other economic conditions of the Area and the Commission now desires to adopt and. confirm the Findings of Fact for the area; and WHEREAS, the Area Plan Commission of St. Joseph County, Indiana (Plan Commission) at its regular meeting on the 19th day of May, 1987, adopted and approved its Resolution No.93 determining that the Declaratory Resolution and the Development Plan for the area conform to the plan of development for the City and approving, ratifying and confirming the Development Plan; and WHEREAS, the Common Council of the City of South Bend, Indiana, at its meeting on the 26th day of May, 1987 adopted, Resolution No. 1510 -8'1, which approved the resolution of the Plan . Commission, found and determined that the Area continues to be blighted, and adopted the Development Plan for the Area; and WHEREAS, the Commission caused to be published a Notice of Public Hearing concerning the Area on the 5th day of June, 198/, and filed by hand delivery a copy of that notice in the offices of the Plan Commission, the Board of Zoning Appeals, the Board of Public Works, the Park Board and the Building Commissioner; and WHEREAS, at the hearing held by the Commission on the 26th day of June, 198'i, at 10:00 o'clock a.m., Eastern Standard Time, at 1200 County -City Building, South Bend, Indiana, the Commission heard all persons interested in the proceedings and received 0 written remonstrances and objections that had been filed, and considered those remonstrances and objections, if any, and such other evidence presented. NOW, THEREFORE, BE IT RESOLVED BY THE SOUTH BEND. REDEVELOPMENT COMMISSION, the governing body of the City of South Bend Department of Redevelopment and the Redevelopment District of the City of South Bend, Indiana, as follows: 1. After considering the evidence presented at the hearing on the 26th day of June, 1987, the Commission hereby confirms the findings and determinations of blight and all other findings and determinations, designations and approving and adopting actions contained in the Declaratory Resolution. 2. The Commission adopts and confirms the Findings of Fact for the Area, a copy of which Findings of Fact are attached hereto as Exhibit A and incorporated fully herein. 3. The Commission finds and determines that it will be a public utility and benefit to proceed with the Development Plan. 4. The Declaratory Resolution is in all respects confirmed. 5. The Secretary is directed to record this resolution pursuant to the requirements of I.C. 36- 7- 14- 17(c). 6. This resolution constitutes final action, pursuant to I.C. 36- 7- 14- 17(c), by the Commission determining the public utility and benefit of the proposed project and confirming the Declaratory Resolution for the area. ADOPTED at a regular meeting of the South Bend Redevelopment Commission held on the 26th aay of rune, 1987, at the office of the Commission, 1200 County -City Building, South Bend, Indiana, 46601. SOUTH BEND REDEVELOPMENT COMMISSION AT'T'EST: Q 1 J . er n AN Roman Piasecki, Secretary -2- .l� w EXHIBIT A Resolution No. 804 Studebaker Corridor Development Area Findings of Fact June 26, 1987 In 1986, the South Bend Redevelopment Commission declared the Studebaker Corridor Development Area to be blighted and on February 14, 1986, conducted a public hearing and adopted its Findings of Fact based on evidence of blight presented at that time. In order to comply with the Tax Reform Act of 1986, the redevelopment staff re- examined that evidence of blight and presented that evidence to the South Bend Common Council on May 26, 1987. The South Bend Common Council found that the Studebaker Corridor Development Area, which was previously found by the Redevelopment Commission to be blighted, continues to be blighted to an extent that cannot be corrected by regulatory processes or by the ordinary operation of private enterprise without resort to the Indiana Redevelopment Law IC 36- 7 -14 -1, et. seq. The South Bend Redevelopment Commission has today reviewed that evidence of blight and the Findings of Fact adopted by the South Bend Common Council on May 26, 1987, and finds that the Area continues to be blighted. Blight is found in the Area based on the following facts: 1. Forty -nine percent (49 %) of in the Studebaker Plant Com underutilized. 2. Sixty -four percent (64 %) of in the north section (i.e., Studebaker Plant Complex is the total building floor area Alex is vacant or the total building floor area north of Sample Street) of the vacant or underutilized. 3. The condition of buildings in the Studebaker Plant Complex is deteriorating. Almost half (46 %) of these buildings have an exterior condition that is "poor" or "very poor" while about 30% are classified as being in "poor" or "very poor" overall condition. 4. Thirty -two percent (32 %) of the land and buildings in the areas (Sub -Areas A and B) adjacent to the main plant complex are vacant or underutilized. This is especially prevalent in Sub -Area A (i.e., Franklin and Lafayette Streets) where forty -five percent (45 %) of the land and buildings are vacant or underutilized. 5. over twenty -eight percent (28 %) of all buildings in the adjacent area are classified as being in "poor" or "very poor" condition.
