HomeMy WebLinkAboutNo. 0817 confirming Resolution No. 810 redeclaring the Rum Village Industrial Park to the blighted and amending tax allocation provisions thereinRESOLUTION NO. 817 RESOLUTION OF THE SOUTH BEND REDEVELOPMENT COMMISSION CONFIRMING RESOLUTION NO. 810, REDECLARING THE RUM VILLAGE INDUSTRIAL PARK TO BE BLIGHTED AND AMENDING TAX ALLOCATION PROVISIONS THEREIN. WHEREAS, the South Bend Redevelopment Commission (Commission), governing body of the City of South Bend Department of Redevelopment (Department), on August 28, 1987 adopted Resolution No. 810, redeclaring the Rum Village Industrial Park (Area) to be blighted and amending tax allocation provisions in the Area (Declaratory Resolution); and WHEREAS, the Declaratory Resolution found and determined that an area within the City of South Bend, Indiana (City) designated by the Commission as the Rum Village Industrial Park (Area) continues to be blighted within the meaning of I.C. 36 -7 -14 (Act); and WHEREAS, the Declaratory Resolution readopted the Rum Village Industrial Park Development Plan (Development Plan); and WHEREAS, certain Findings of Fact have been presented to the Commission and the Commission now desires to adopt and confirm the Findings of Fact for the Area; and WHEREAS, the Area Plan Commission of St. Joseph County, Indiana (Plan Commission) at its regular meeting on the 15th day of September, 1987, adopted and approved its Resolution No. 95 determining that the Declaratory Resolution and �� c ,- Development Plan for the Area conform to the plan of development for the City and approving, ratifying and confirming the Development Plan; and C3 cy r 2 -c; WHEREAS, the Common Council of the City of South BeAa, �" . - == Indiana, at its meeting on the 28th day of September, 19'87 adopted Resolution No. 1535 -87, which approved the resol tior6g of the Plan Commission; and _ WHEREAS, the Commission caused to be published a Notice of Public Hearing concerning the Area on the 2nd day of October, 1987, and filed by hand delivery a copy of that notice in the offices of the Plan Commission, the Board of Zoning Appeals, the Board of Public Works, the Park Board and the Building Commissioner; and WHEREAS, at the hearing held by the Commission on the 23rd day of October, 1987, at 10:00 o'clock a.m., Eastern Standard Time, at 1200 County -City Building, South Bend, Indiana, the Commission he d all persons interested in the proceedings and received written remonstrances and objections that had been filed, and considered those remonstrances and objections, if any, and such other evidence presented. NOW, THEREFORE, BE IT RESOLVED BY THE SOUTH BEND REDEVELOPMENT COMMISSION, the governing body of the City of South Bend Department of Redevelopment and the Redevelopment District of the City of South Bend, Indiana, as follows: 1. After considering the evidence presented at the hearing on the 23rd day of October, 1987, the Commission hereby confirms the findings and determinations of blight and all other findings and determinations, designations, and approving and adopting actions contained in the Declaratory Resolution. i A 1� 2. The Commission adopts and confirms the Findings of Fact for the Area, a copy of which Findings of Fact are attached hereto as Exhibit A and incorporated fully herein. 3. The Commission finds and determines that it will be of public utility and benefit to proceed with the Development Plan. 4. The Declaratory Resolution is in all respects confirmed. 5. The Secretary is directed to record this resolution pursuant to the requirements of I.C. 36- 7- 14- 17(c). 6. This resolution constitutes final action, pursuant to I.C. 36- 7- 14- 17(c), by the Commission determining the public utility and benefit of the proposed project and confirming the Declaratory Resolution for the Area. ADOPTED at a regular meeting of the South Bend Redevelopment Commission held on the 23rd day of October, 1987, at the office of the Commission, 1200 County -City Building, South Bend, Indiana, 46601. Jay N tz, President EXHIBIT A to Resolution No. 817 Rum Village Industrial Park Findings of Fact October 23, 1987 In 1981, the South Bend Redevelopment Commission declared the Rum Village Industrial Park :to be blighted and on February 19, 1982, conducted a public hearing,.and adopted its Findings of Fact based on evidence of blight present -at that time. In 1986 the boundaries of the Rum Village Industrial Park were expanded and on October 10, 1986, the South Bend Redevelopment Commission conducted a public hearing and adopted its Findings of Fact based on evidence of blight present at that time. The South Bend Redevelopment Commission has today reviewed that evidence of blight and finds that the Area continues to be blighted. Blight is found in the Area based on the following facts: 1. The Commission finds that the Area designated as the Rum Village Industrial Park continues to be blighted due to the continued existence of the unstable soil conditions which was the original blighting condition. The high cost of removing and replacing the unstable soil has been a deterrent to private business operations that cannot be overcome by the normal development process.
