OF THE SOUTH BEND REDEVELOPMENT COMMISSION
A JOINT RESOLUTION OF THE SOUTH BEND BOARD
OF PUBLIC WORKS AND THE SOUTH BEND
REDEVELOPMENT COMMISSION AGREEING TO THE
CONVEYANCE AND ACCEPTANCE OF CERTAIN REAL
PROPERTY.
WHEREAS, the South Bend Redevelopment Commission (Commission) holds
title in fee simple to certain real property located at the northwest
corner of South St. Joseph Street and East Wayne described hefsouows•
Bend Central Development Area, more particularly •
A part of the Northwest Quarter of Section 12,
Township 37 North, Range 2 East of the Second of
Principal Meridian, Portage Township, City Fifty
South Bend, Indiana being a P two (52) of
(50), and Fifty -one (51) and Fifty -
the Original Plat of South Bend, Indiana more
particularly described as follows: Beginning at
the intersection of the Westerly right

line of St. Joseph Street (85 foot right -of -way)
with the North right-of-way lin of Wayne Street

WHEREAS, at its September 14, 1987 meeting, the South Bend Common
Council approved the use of the above described property for a parking
facility by Resolution No. 1533 -87; and
WHEREAS, after notice and public hearing, the Board adopted
Resolution No. 27 -1987 confirming Resolution No. 24 -1987; and
WHEREAS, I.C. 36- 1 -11 -8 provides that governmental entities may
transfer or exchange property upon terms and conditions mutually agreed
upon and for any amount of consideration as agreed upon, pursuant to
® the adoption of substantially identical resolutions by each entity.
NOW, THEREFORE, BE IT RESOLVED by the South Bend Board of Public
Works and the South Bend Redevelopment Commission, as follows:

Section 1. The South Bend Redevelopment Commission agrees to
convey by quit -claim deed to the South Bend Board of Public Works the
following described real property located in St. Joseph County,
Indiana, for use by the South Bend Board of Public Works for
construction and mainter:ance of a parking garage containing
approximately 440 parking spaces, with construction to begin in early
1988:
A part of the Northwest Quarter of Section 12,
Township 37 North, Range 2 East of the Second
Principal Meridian, Portage Township, City of
South Bend, Indiana be.ng a part of Lots Fifty
(50), and Fifty -one (51) and Fifty -two (52) of
the Original Plat of South Bend, Indiana more
particularly described as follows: Beginning at
the intersection of the Westerly right -of -way
line of St. Joseph Street (85 foot right -of -way)
with the North right -of -way line of Wayne Street
(82.5 foot right -of -way), thence South 89 038112"
West (bearing assumed) along the North
right -of -way line of Wayne Street 148.84 feet;
thence North 00 027100" West, 186.00 feet; thence
North 89 °39134" East, 165.61 feet; thence
Southwesterly 186.99 feet along a segment of a
curve to the right having a radius of 912.43
feet, subtended by a chord having a bearing of
South 04 142'19" West and a length of 186.66 feet
to the point of beginning.
Section 2. The South Bend Board of Public Works agrees to accept
conveyance from the South Bend Redevelopment Commission of the real
property described in Section 1 hereof and to construct and maintain a
parking garage on that property consisting of approximately 440 spaces,
with construction to begin in early 1988.
Adopted at the September 25, 1987, meeting of the South Bend
Redevelopment Commission.
