RESOLUTION NO. 822
A RESOLUTION APPROVING AN APPLICATION FOR
REAL PROPERTY TAX DEDUCTION
WHEREAS, I >C> 6 -1.1- 12.1 -2(j) provides that an application
for property tax deduction may not be approved when the property is
located in an allocation area as defined in I.C. 36- 7- 14 -39, unless
the Redevelopment Commission approving that application; and
WHEREAS, the South Bend Common Council has received a
petition for ten years of real property tax abatement consideration
from Kieffer /Zimpelman Partnership for real property located at
402 -404 E. South Street in the South Bend Central Development Area,
the legal description of which is attached hereto, marked Exhibit
"A" and incorporated herein; and
WHEREAS, this Commission declared the South Bend Central
Development Area by Resolution No. 737 adopted May 10, 1985, and in
the same resolution declared the South Bend Central Allocation Area
(South Bend Allocation Area No. 1A); and
WHEREAS, the property located at 402 -404 E. South Street
is located within the South Bend Central Allocation Area (South
Bend Allocation Area No. 1A);
NOW, THEREFORE, BE IT RESOLVED by the South Bend
Redevelopment Commission as follows:
1.) The Commission finds that the application of
Kieffer /Zimpelman Partnership for ten years of real property
tax abatement consideration located at 402 -404 E. South Street
in the South Bend Central Allocation Area (South Bend
Allocation Area No. 1A) is hereby approved.
2.) That a copy of this resolution be forwarded to the
South Bend Common Council to indicate the Commission's approval
of the Kieffer /Zimpelman Partnership petition for real property
tax abatement.
Approved this 27th day of November, 1987, at the regularly
scheduled meeting of the South Bend Redevelopment Commission.

Exhibit "A"
A parcel of land being a part of Lots One (1), Two (2), and Three
(3) in the City's subdivision of the east half (1/2) of Lot
Twenty -three (23) in Denniston and Fellows Addition, South Bend,
Indiana, and being more particularly described as follows:
Beginning at the southwest corner of said Lot One (1), thence north
0 °- 09' -37" west along the west line of said Lot One (1), a measured
distance of 99.28 feet to a point of 16.5 feet south of the
northwest corner of said Lot One (1); thence south 89 °- 49140" east,
a measured distance of 90.70 feet; thence south 00- 03' -03" east, a
measured distance of 99.28 feet to the north line of "a 14' -foot
alley; thence north 890- 49' -46" west along the said north line a
measured distance of 90.52 feet to the place of beginning.
