RESOLUTION OF THE SOUTH BEND REDEVELOPMENT
COMMISSION RATIFYING AND CONFIRMING RESOLUTION NO.
818, DESIGNATING THE WEST WASHINGTON - CHAPIN
DEVELOPMENT AREA, DECLARING THE WEST
WASHINGTON - CHAPIN DEVELOPMENT AREA TO BE BLIGHTED,
APPROVING A DEVELOPMENT PLAN AND CONDITIONS UNDER
WHICH RELOCATION PAYMENTS WILL BE MADE, AND
ESTABLISHING AN ALLOCATION AREA FOR PURPOSES OF TAX
INCREMENTAL FINANCING.
WHEREAS, the City of South Bend, Indiana, Redevelopment
Commission (Commission) at its regular meeting October 23, 1987
approved and adopted Resolution No. 818, designating the area
described below as the West Washington- Chapin Development Area
(Area), declaring the West Washington- Chapin Development Area to be
blighted, approving the West Washington- Chapin Development Plan
(Development Plan) and the South Bend Central Relocation Policy
(Relocation Policy), which specifies conditions under which
relocation payments will be made, and establishing an allocation
area for purposes of tax incremental financing:
A PARCEL of land being a part of the City of
South Bend, Portage Township, St. Joseph County,
Indiana, and being more particularly described
as follows:
COMMENCING at the point of intersection of
Western Avenue and William Street; thence North
along the centerline of William Street to the
Easterly projection of the Southerly
right -of -way of the first 14 foot alley; of
which BEING the Point of Beginning; BEGINNING at

Westerly along the South right -of -way line to
the intersection of the West right -of -way line

of Kuespert & Sommer's Addition (now noted as
Block W44- Parcel 7); thence Northeasterly along
a projected line to the intersection of the
centerline of LaPorte Avenue; thence
Northwesterly along the centerline of LaPorte
Avenue, to the intersection of the projected
centerline of the first East -West alley lying
North of LaSalle Court; thence East along the
centerline of said alley, to the intersection of
the West property line of Lot 1, of Horatio
Chapin Subdivision; thence South along the West
property line of said Lot 1, to the Northwest
corner of Lot 3, of Horatio Chapin Subdivision
(now noted as Block W52- Parcel 6); thence
Southeasterly along the North Property lines of
Lots 3, 5, 7, 9, and 11 (now noted as Block
W52 - Parcels 6, 7, 8, 9, and 10); to the
intersection of the centerline of William
Street; thence South along the centerline of
William Street to the Point of Beginning.
WHEREAS, the Commission submitted its Resolution No. 818 and
the Development Plan to the Area Plan Commission of St. Joseph
County for approval pursuant to the provisions of I.C. 36- 7- 14 -16;
and
WHEREAS, the Area Plan Commission of St. Joseph County at its
regular meeting November 17, 1987, approved its Resolution No. 96,
which Resolution constituted the written order of the Area Plan
Commission of St. Joseph County approving Resolution No. 818 and
the Development Plan pursuant to I.C. 36- 7- 14 -16; and
WHEREAS, the Commission submitted to the South Bend Common
Council, legislative body for the City of South Bend, St. Joseph
County, Indiana, Resolution No. 96 of the Area Plan Commission of
St. Joseph County, constituting the Area Plan Commission's written
order approving Resolution No. 818 and the Development Plan and its
certification that the Development Plan conforms to the master plan
of development for the City of South Bend; and
WHEREAS, the South Bend Common Council, at its regular meeting,
November 23, 1987, adopted its Resolution No. 1554 -87 approving the
order of the Area Plan Commission of St. Joseph County with regard
to the West Washington- Chapin Development Area and finding and
determining that the Area is blighted; and
WHEREAS, after receipt of the written order of approval of the
Area Plan Commission of St. Joseph County, Indiana, and approval of
the South Bend Common Council, the Commission caused to be
published notice of the adoption and substance of Resolution No.
818, in accordance with I.C. 5 -3 -1, with such notice also stating
that maps and plats have been prepared and can be inspected at the
office of the Redevelopment Department and naming December 11, 1987
at 10:00 a.m., at 1200 County -City Bldg., South Bend, Indiana as
the date, time and place of the Commission's receipt and hearing of
remonstrances and objections from persons interested in or affected
by the proceedings pertaining to the proposed project and to
determine the public utility and benefit of the proposed project
for the West Washington- Chapin Development Area; and
WHEREAS, the Commission caused to be filed a copy of the notice
of the hearing on the proposed project for the West
Washington- Chapin Development Area in the office of the Area Plan
Commission of St. Joseph County, Indiana, the Board of Zoning
Appeals, the Board of Public Works, the South Bend Board of Park
Commissioners, and the South Bend Building Commissioner, as well as
any other departments, bodies, or offices of the City of South Bend
having to do with unit planning, variances from zoning ordinances,
land use, or the issuance of building permits; and
WHEREAS at the hearing held by the Commission December 11,
1987, at 10:00 a.m., at 1200 County -City Bldg., South Bend,
Indiana, the Commission heard all persons interested in the
proceedings and received_ 6 written remonstrances and objections
that had been filed, and considered those remonstrances and
objections, if any; and
WHEREAS, the Commission is cognizant of the conditions that are
imposed under Title VI of the Civil Rights Act of 1964 as amended,
providing that no person shall, on the grounds of race, age, sex,
color, religion, or national origin, be excluded from participation
in, be denied the benefits of, or be subjected to discrimination in
the undertaking and carrying out of any federally- assisted project.
NOW, THEREFORE, BE IT RESOLVED BY THE SOUTH BEND REDEVELOPMENT
COMMISSION, as follows:
1. After considering the evidence presented at its hearing
December 11, 1987, the Commission confirms the blight found and
declared by it in its Resolution No. 818, within the West
Washington- Chapin Development Area, and adopts and confirms the
Findings of Fact for that Area, Exhibit A, attached to this
resolution and made a part thereof.
2. The Commission finds and determines that it will be of public
utility and benefit to proceed with the Development Plan for the
West Washington- Chapin Development Area, as set forth in Resolution
No. 818, adopted by the Commission on October 23, 1987.
3. Resolution No. 818 is hereby approved, ratified, and confirmed
without change.
4. This Resolution constitutes final action, pursuant to
I.C.36- 7- 14- 17(c), by the Commission determining the public utility
and benefit of the proposed project and confirming Resolution No.
818, pertaining to the West Washington- Chapin Development Area.
5. The Commission hereby recognizes the need to solicit frequently
and accept for consideration the views of residents, taxpayers and
merchants of the Near West Side Neighborhood in the ongoing
redevelopment process.
6. The Secretary is directed to record this resolution pursuant to
the requirements of I.C. 36- 7- 14- 17(c).

EXHIBIT "A" TO
RESOLUTION NO. 824
WEST WASHINGTON - CHAPIN DEVELOPMENT AREA
FINDING OF FACTS
DECEMBER 11, 1987
The South Bend Redevelopment Commission has conducted a study
of the West Washington- Chapin Development Area ( "Area "). Based
upon that study and following the other procedures required by I.C.
36 -7 -14 (the "Act ") including public hearing conducted this day,
pursuant to I.C. 36- 7 -14 -17 and after notice published as requested
thereby, the Redevelopment Commission hereby finds that the Area
has become blighted to such an extent that such conditions cannot
be corrected by the regulatory process or by ordinary operations of
private enterprise without resort to the provisions of the Act and
that the public health and welfare will be benefitted by the
acquisition and redevelopment of the Area under the provision of
the Act. This finding is based on the following facts found by the
Redevelopment Commission in its study and hearing:
1. Of the 900 structures in the Area, 167 (19 %) of them are
vacant.
2. Thirty -seven percent (37 %) of the properties within the
Area are vacant lots.
3. Twenty -two of the thirty -two structures (69 %) identified
in a 1987 survey of structures within the current "C"
Commercial zoning along West Washington Street in the Area
are vacant. Over 50% of these are substandard structures.
4. Six of the fifteen structures (40 %) identified in a 1987
survey of structures within the current "C" Commercial
zoning along South Chapin Street in the Area are vacant.
Over 50% of these are substandard structures.
5. Betweem 1970 and 1980 the population of the Area has
declined 39% from approximately 4,155 to 2,537 residents.
6. The vacancy rate for dwelling units in the Area has
increased from 13% in 1970 to 15% in 1980. As of 1987,
the vacancy rate for dwelling units in the Area is
estimated to be over 16 %.
7. Over 50% of the dwelling units in the area are
substandard.
