The Contractor agrees to maintain this certification throughout the term of the contract with the City of South Bend, and understands that the City may terminate the contract for default if the Contractor fails to cure a breach of this provision no later than thirty (30) days after being notified by the City. 6. Persons, partnerships, corporations, associations, or joint venturers awarded a contract by the City of South Bend through its agencies, boards, or commissions shall not discriminate against any employee or applicant for employment in the performance of a City contract with respect to hire, tenure, terms, conditions, or privileges of employment, or any matter directly or indirectly related to employment because of race, sex, religion, color, national origin, ancestry, age, gender expression, gender identity, sexual orientation or disability that does not affect that person's ability to perform the work. In awarding contracts for the purchase of work, labor, services, supplies, equipment, materials, or any combination of the foregoing including, but not limited to, public works contracts awarded under public bidding laws or other contracts in which public bids are not required by law, the City, its agencies, boards, or commissions may consider the Contractor's good faith efforts to obtain participation by those Contractors certified by the State of Indiana as a Minority Business ("MBE") or as a Women's Business Enterprise ("WBE") as a factor in determining the lowest, responsible, responsive bidder. In no event shall persons or entities seeking the award of a City contract be required to award a subcontract to an MBE/WBE; however, it may not unlawfully discriminate against said WBE/MBE. A finding of a discriminatory practice by the City's MBE/WBE Utilization Board shall prohibit that person or entity from being awarded a City contract for a period of one (1) year from the date of such determination, and such determination may also be grounds for terminating the contact for which the discriminatory practice or noncompliance pertains. Jefferson Blvd. Room 1316 South Bend, IN 46601 RE: Edison Production Well #2A Rehabilitation Bid "Or Equal" Substitute Dear Members of the Public Works Board: We wish to provide an equal substitute for the specified 2 stage 14FKH Floway Pump bowl assembly included as line item number 6 in the Edison Production Well #2A Rehabilitation bid. National Pump Company manufactures a 2 stage H14MC bowl assembly that is constructed with the same materials of ASTM A48 Class 30 Enamel Lined Cast Iron bowl castings, a 416 Stainless Steel impeller shaft, ASTM B505-91 Alloy 876 bronze wetted parts, and ASTM B584-90B Alloy 952 bronze impellers. This pump is rated for the same design condition of 2,800 gallons per minute at 132 feet of total dynamic head, and requires the same horsepower motor. National Pump Company operates three testing facilities, and has the capability to conform to Hydraulic Institute 14.6 Grade 1U standards. Enclosed, please find correspondence from the Director of Engineering at National Pump Company confirming this. Peerless Midwest, Inc. is the authorized representative of Floway Pumps in this trading area, and if the City of South Bend wishes to continue to pursue the 2 Stage 14FKH Floway Pump bowl assembly, we can do that. However, in our opinion, due to significant cost increases and lead times exceeding 8 weeks, a Floway Pump bowl assembly is not a valid option at this time. Thank you for your consideration of allowing the National Pump H14MC bowl assembly to be used in place of the Floway Pump 2 Stage 14FKH. We firmly believe that the National Pump option will provide value to the City in up -front cost, as well as provide equal long-term reliability. Each test facility is capable of performing testing in accordance with ANSI/HI 14.6 "Rotodynamic Pumps for Hydraulic Performance Acceptance Tests." This testing can be done to the most stringent level, grade 1 including 1 B, 1 E and 1 U pump test acceptance grades. National Pump Company's standard published performance curves are guaranteed to a 1 B performance acceptance grade.
