Attach information regarding projects your organization has completed for the period of one (1) year prior to the date of the current bid. 2. SECTION II PLAN AND EQUIPMENT QUESTIONNAIRE 1. Attach an explanation of your plan or layout for performing proposed work. (Examples could include a narrative of when you could begin work, complete the project, number of workers, etc. and any other information which you believe would enable the City of South Bend to consider your bid.) 2. Attach a listing of the names and addresses of all subcontractors (i.e. persons or firms outside your own firm who have performed part of the work) that you have used on public works projects during the past five (5)-years along with a brief description of the work done by each subcontractor. 3. If you intend to sublet any portion of the work, attach the name and address of each subcontractor, equipment to be used by the subcontractor, and whether you will require a bond. However, if you are unable to currently provide a listing, please understand a listing must be provided prior to contract approval. Until the completion of the proposed project, you are under a continuing obligation to immediately notify the City of South Bend in the event that you subsequently determine that you will use a subcontractor on the proposed project. 4. If not, attach an explanation for the rationale used which would corroborate the prices listed. SECTION III CONTRACTOR'S FINANCIAL STATEMENT Attachment of bidder's financial statement is mandatory. Any bid submitted without said financial statement as required by statute shall thereby be rendered invalid. The financial statement provided hereunder to the City of South Bend awarding the contract must be specific enough in detail so that said City of South Bend can make a proper determination of the bidder's capability for completing the project if awarded. Version 7/20/2018 Contractor's Bid for Public Works - 3 MINORITY AND WOMEN BUSINESS ENTERPRISE DIVERSITY DEVELOPMENT PROGRAM The City of South Bend, Indiana has shown its commitment to addressing Minority Business ("MBE") and Women's Business Enterprise ("WBE") participation in public contracting through the adoption of the City of South Bend Ordinance No. 10081-11. Version 7/20/2018 General Conditions - 5 CITY OF SOUTH BEND, INDIANA CONTRACTOR'S BID FOR PUBLIC WORK RESPONSIBLE BIDDER CHECKLIST Project Name 2018 Demolitions Project No. 118-307 For Bids Due November 13, 2018 Contractor Name The City seeks to enhance its ability to identify responsive and responsible bidders on all City public works projects by institution of comprehensive submission requirements in compliance with State law. Quality workmanship, efficient operation, safety, and timely completion of projects requires that all bidders meet certain minimum requirements to be responsive and responsible bidders. THIS FORM MUST BE SUBMITTED WITH YOUR BID. INSTRUCTIONS: If you are a pre -qualified bidder, complete Section I only. If you are not a pre -qualified bidder, complete Section II only. Section II acts as an application for pre -qualification. Submission of Section II will allow the bidder to be considered for pre -qualification for bids with the City of South Bend Department of Public Works. There will be no direct payment for this item. Version 8/16/2018 Special Provisions - 4 7. The Contractor is responsible to maintain the site which includes but is not limited to; dust control, site security, erosion control, and protecting adjacent properties. 8. Work hours for the Project shall be from 7:00 a.m. through 6:00 p.m., Monday through Friday. No work shall be permitted on weekends, Holidays, or after hours unless approved by the City of South Bend Department of Public Works through the Building Commissioner. XI. LEGAL RELATIONS A. Prevailing Specifications: 2018, INDOT Standard Specifications Section 107 B. Additions: 1. The Owner, where mentioned in these documents, is the City of South Bend. The Engineer, where mentioned in these documents, is the City of South Bend Department of Public Works Division of Engineering. 2. The Contractor shall apply for and obtain any and all required permits for the work from local, state, and federal agencies and shall comply with permit requirements, including the St. Joseph County / City of South Bend Building Department. 3. If the Contractor awarded this contract is not a resident of Indiana, within thirty days, the Contractor shall provide the Owner with proof that the Contractor is duly licensed, qualified and registered with the Secretary of State of Indiana to engage in business within the State of Indiana. 4. The Contractor shall comply with all provisions of Indiana Code 5-16-13, as amended. The Owner reserves the right to immediately terminate the public work project awarded should the Contractor be found to be in violation of any provision of Indiana Code 5-16-13 and such violation shall result in the forfeiture of Contractor's performance bond to the Owner. XII. SUBMITTALS A. Prevailing Specifications: 2018, INDOT Standard Specifications Section 106 B. Additions: 1. Submit four (4) copies or an electronic version of the submittals for all equipment or materials used in this project to the South Bend Department of Public Works for approval. All submittals must be delivered within 7 calendar days from the notice to proceed. 2. The Department of Public Works will review and return two (2) copies or an electronic version of the submittals within five (5) working days. 3. The review of the submittal information by the Department of Public Works is to facilitate the satisfactory acceptance of the equipment. This review shall neither relieve the contractor from the responsibility for deviations from the Specifications, nor from errors and omissions in the shop drawings or literature. Parts found not meeting the requirements of these Specifications shall be removed, repaired or replaced at no cost to the OWNER. 4. Submittals shall include complete manufacturer's descriptive information and shop drawings for all the parts furnished under this contract. Version 8/16/2018 Special Provisions - 5 5. Upon completion of project, the Contractor will supply one (1) conformed set of all submittals to the City of South Bend. XIII. PROSECUTION AND PROGRESS A. Prevailing Specifications: 2018, INDOT Standard Specifications Sec. 108 B. Additions: 1, Contractor must submit Performance Bond, Payment Bond, and insurance submittals to the City within seven (7) working days after notification of award and shall begin work in conformity with these specifications. 2. The Effective Date of this contract shall be the date that the Bidder's proposal is accepted and signed by the City's Board of Public Works. Time for performance shall commence upon the issue of the Notice to Proceed which will be issued after the City's acceptance of the Contractor's Performance Bond, Payment Bond, and insurance submittals. The contract shall remain in effect until all Work has been completed to the satisfaction of the Owner, unless earlier terminated as provided herein. 3. The Contractor will send the "Notification of Demolition and Renovations Operations" to IDEM upon the Owner's notice of contract award. Notice to Proceed will be effective upon the end of the ten (10) working day notification period for the notice of demolition. The Indiana Department of Environmental Management (IDEM) "Notification of Demolition" form and instructions shall be provided as included in these specifications. 4. The Contractor shall submit a proposed detailed Project Schedule for the Work including a utility schedule, permitting, traffic control plan and erosion control plan if necessary. The Project Schedule is subject to the approval of the Owner, and may be modified only by written Change Order after Work commences. If Contractor's progress in performing the Work is less than the agreed upon Project Schedule, the Owner may declare Contractor in default. 5. Within two (2) business days of the City's issuance -of the Notice to Proceed, the Contractor shall secure at least three (3) demolition permits for each Division awarded from the Building Department. Thereafter the Contractor shall secure the remainder of the permits for each Division within two (2) additional business days. The Contractor shall provide the Department of Public Works copies of all permits prior to commencing any demolition activity on each property. 6. The Contractor may commence demolition work at more than one demolition site, provided that the Contractor completes in its entirety Work on not less than four (4) properties within two (2) calendar weeks per each Division awarded including backfill and mulched white dutch seeding. For each additional division awarded to the contractor, a factor of four (4) properties shall be added to the total summation of properties that are to be completed in its entirety of Work within two (2) calendar weeks among the Divisions. For example if the Contractor is awarded two (2) Divisions, an additional four (4) properties shall be added so that eight (8) properties within two (2) calendar weeks are to be completed in its entirety of Work between the two Divisions. Clearing and grubbing of sites may begin in advance of demolition, if desired, provided organic and inorganic debris is promptly removed from the site or fenced as a hazard. Once demolition of a structure commences on a site, progress shall be continuous through removal of all debris. Inspections of the completed demolition sites and Department of Public Works approval is required before Contractor proceeds to the next property or properties to be demolished. There will be no relief of this schedule if the same Contractor is awarded contracts for more than one Division of this project, or other separate contracts for work Version 8/16/2018 Special Provisions - 6 under the City's Vacant and Abandoned Housing Initiative. Multiple contracts to the same Contractor must be performed simultaneously, not consecutively. 7. In the event that a building and/or structure appears to be occupied or to have rehab work performed on it, Contractor shall notify the Department of Public Works and obtain approval to proceed before commencing any demolition work. 8. The Contractor shall work continuously until all site demolitions have been completed in accordance with these specifications. 9. The City has the right to remove any property from the listing of proposed demolitions in the event that such properties require further legal or administrative procedures related to the work to be performed. 10. The total contract time for completing each division is listed below. The contract time will start when the Notice to Proceed is delivered and signed. All sites shall be completed in accordance with the approved Project Schedule: a. Division A shall be twenty-eight (28) calendar days. b. Division B shall be thirty-six (36) calendar days. c. Division C shall be twenty-eight (28) calendar days. 11. A calendar day is every day shown on the calendar. A calendar day includes Saturday, Sunday or State recognized holidays. In addition, a calendar day does not include a day which weather and other conditions not under the Contractor's control prohibits the Contractor's normal working force from working at least 50% of the day. The City of South Bend Board of Public Works shall have the sole discretion to determine what conditions are outside of the Contractor's control. However, if weather is below 20 degrees Fahrenheit at 7:00 a.m., Eastern Standard Time, according to the weather forecast from the United States Department of Commerce, National Oceanic and Atmospheric Administration, or if/when the Mayor declares a Snow Emergency, a time extension may be granted to the Contractor, consistent with Section XIX Change of Contract Time. XIV. CHANGE OF CONTRACT TIME A. Prevailing Specifications: 2018, INDOT Standard Specifications Section 108 B. Additions: The Contract Time may only be changed by Change Order. Any Claim for an extension in the Contract Time shall be based on written notice delivered to the Department of Public Works within seven (7) calendar days of the occurrence of the event giving rise to the claim. Notice of the extent of the claim with supporting data shall be delivered within fourteen (14) calendar days after such occurrence unless an official of the Public Works Department allows an additional period of time to ascertain more accurate data. The Contract Time will be extended in an amount equal to time lost to delays beyond the control of the Contractor if a claim is made in accordance with this provision. Such delays shall include acts of neglect by the Public Works employees, or to fires, flood, labor disputes, epidemics, abnormal weather conditions, governmental procedures, or acts of God. 2. Unless otherwise provided, the Contract time is based upon normal weather conditions. An extension is granted for weather conditions significantly more severe than normal if the Contractor demonstrates to the satisfaction of the City that the delay in the progress of the work was due to such weather. The basis to define normal weather with be the data compiled by the United States Department of Commerce, National Oceanic and Atmospheric Administration (NOAA). Version 8/16/2018 Special Provisions - 7 3. No extension of time will be granted if the Contractor, by his/her/its own action or inaction, including fault or negligence of Contractor's subcontractors, caused the delay, or for which any remedies are provided under any other provision of this agreement. 4. The grant of an extension of time under this Section in no way constitutes a waiver by the City of any rights or remedies existing under this contract at law or in equity. Xv. DEFAULT AND TERMINATION A. Prevailing Specifications: 2018, INDOT Standard Specifications Section 108 B. Additions: 1. Events of Default shall include Contractor's failure to perform any of its obligations under this contract including failure to commence work at the time specified, failure to perform the work in accordance with these specifications, unauthorized discontinuation of the work, failure to carry out the work in a manner acceptable to the City, failure to observe Federal, State, or the local laws or regulations, and failure to comply with any other term of this contract. 2. -If an event of Default occurs, the City shall provide Contractor written notice and may permit Contractor ten (10) calendar days after the date of the notice to cure the default. If the default is not cured within the ten (10) day cure period, the City may at any time thereafter terminate this contract in which case the termination shall be final and effective. Upon an Event of Default, the City may invoke the following remedies in addition to those remedies provided under separate provisions of this contract, the right of set-off against any payments due or to become due to the Contractor against the retainage, the right to take over and complete the Work. If the City notifies the Contractor that the City is invoking its right to complete the Work, all rights that the Contractor has in order under Contractor's subcontracts are assigned to the City, subject to the City's right to take assignment of all or only selected subcontracts at the City's discretion. The sole obligation accepted by the City under such subcontracts is to pay for Work satisfactorily performed after the date of the assignment. In the event a conditional assignment has not been executed, the Contractor shall execute or cause to be executed any assignment, agreement, or other document that may be necessary in the sole opinion of legal counsel to the City's Board of Public Works to evidence compliance with this provision. The Contractor shall promptly deliver such documents upon the City's request. In the case of such assignment, unless otherwise agreed in writing, the Contractor remains liable to subcontractors for any payment already involved, and for any claim, suit or cause of action based upon or resulting from any error, omission, negligence or other breach of contract by the Contractor, its officers, employees, or agents arising prior to the date of assignment to the City. XVI. LIQUIDATED DAMAGES A. Prevailing Specifications: 2018, INDOT Standard Specifications Section 108 B. Additions: 1. The Contractor shall proceed with the work at such rate of progress to insure full completion within the Contract Time. It is expressly understood and agreed, by and between the Contractor and the Owner, that the Contract Time for completion of the work described herein is a reasonable time, taking into consideration the average climatic and economic conditions and other factors prevailing in the locality of the work, and excludes the time for unavoidable delays which were beyond the control and without the fault of the Contractor. If the Contractor shall fail to complete the work within the Contract Time, or extension of time granted by the Owner, then the Contractor will pay to the Owner the amount for liquidated damages a sum of five hundred dollars ($500.00) for each calendar day that the Contractor shall remain in default after the time of completion stipulated in the Contract Documents. 3. The Contractor shall not be charged with liquidated damages or any excess cost when the delay in completion of the work is due to the following and the Contractor has promptly given written notice of such delay to the Owner and Engineer/Architect. a. To any preference, priority, or allocation order duly issued by the Owner,. b. To unforeseeable causes beyond the control and without the fault or negligence of the Contractor, including but not restricted to acts of God, acts of public enemy, acts of the Owner, acts of another Contractor in the performance of a Contract with the Owner, fires, floods, epidemics, quarantine restrictions, strikes, freight embargoes, and abnormal and unforeseeable weather. . -� A. Prevailing Specifications: 2018, INDOT Standard Specifications Section 109 B. Additions: 1. Payments will be made every thirty (30) calendar days. Contractor is required to submit the completed "AIA Document G7027m - 1992" form to the City of South Bend Board of Public Works along with electronic certified payrolls for the billed time period. 2. Consistent with provisions of IC 36-1-12-14, the Board of Public Works shall retain a percentage of payments throughout the duration of the project. 3. Before final payment and retainage are released the Contractor must satisfy the following: a. All parts and labor meet requirements stated in the specifications. b. Provide copies of all of the Manifest Reports and Certificates of Completion for each of the demolition properties. c. One (1) copy of the City of South Bend Completion Affidavit and one (1) copy of a Final Waiver of Lien. XVIII. OTHER UTILITIES A. Prevailing Specifications: None B. Additions: 1. The Contractor shall verify the locations of all utilities by contacting Holey Moley at 1-800- 382-5544 at least two (2) working days, not counting Saturdays, Sundays or federal and state holidays before proceeding with construction. It shall also be the Contractors responsibility to contact any other utility that is not contacted by Holey Moley and verify the utility locations. 2. The Contractor shall be responsible for working with the other utilities, (e.g., gas electric, telephone, etc.) in order to assure that all utilities that need to be replaced or relocated can Version 8/16/2018 Special Provisions - 9 be done with a minimum disturbance to service. The Contractor shall also be responsible for coordinating schedules with the various utilities such that they can proceed with their relocation work as efficiently as possible. 3. If the odor of natural gas is detected in a work area at any time during the course of work, the Contractor shall immediately notify NIPSCO at 1-800-634-3524. The Contractor shall also immediately notify the residents of adjacent properties. The Contractor shall advise the residents to evacuate their homes immediately if the odor is present within the dwelling. XIX. MAINTENANCE OF TRAFFIC A. Prevailing Specifications: 2018, INDOT Standard Specifications Sections 105 & 801 B. Additions: 1. Maintenance of traffic during construction shall conform to the "Indiana Manual on Uniform Traffic Control Devices" and the City of South Bend Design and Construction Standards. 2. The attached "Traffic Closure Request" form is to be used for any lane restrictions or closures and required to be filled out and sent to the Department of Public Works prior to construction. 3. The Contractor shall arrange and prosecute the work specified for this contract in such a manner that traffic on existing streets is unrestricted throughout the Project. The Engineer shall approve the method of traffic control. No construction equipment, vehicles, materials, supplies or temporary facilities shall be left unattended in the right-of-way of any street or left parked overnight without proper marking and lighting. 4. After the award of the contract and before beginning the work, the Contractor shall submit his/her/its proposed schedule of operations for the review of the Engineer. The schedule of operations as reviewed by the Engineer shall be maintained at all times. 5. There will be no direct payment for this work. XX. pESCRIPTION OF WORK A. Prevailing Specifications: None B. Additions: 1. Work to be performed shall include furnishing all labor, services, materials, insurance and equipment to provide demolition services associated with the Vacant and Abandoned Properties Initiative within the City of South Bend. The "Work" to be performed shall include construction engineering, temporary erosion control, safety and site security, asbestos abatement, demolition, clearing and grubbing, backfilling and grading, topsoil and mulched seeding, and concrete approach, sidewalk, and curb. 2. Construction engineering, temporary erosion control, safety and site security, clearing, backfilling and grading, topsoil and mulched seeding, and concrete approach, sidewalk, and curb will not be measured directly and shall be paid and based on the Lump Sum Unit Price established in the pay item "Demolition". 3. The Contractor shall preserve and protect all surrounding property, structures, tenants, visitors and their property from damage caused by the Contractor's operations. Project limits shall be defined as the property boundary for each lot and the area between the property frontage and curb, which includes any sidewalk and/or tree lawn in that area. 5. Contract award(s), if any, will be made to the lowest responsible and responsive bidder in each Division. XXI. DIVISION OF BID A. Prevailing Specifications: None B. Additions: 1. The Work of this project is offered in three (3) Divisions: Division A, Division B, and Division C. a. Division A: 7 Houses, A-01 — A-07 b. Division B: 9 Houses, B-01 — B-09 c. Division C: 7 Houses, C-01 — C-07 2. Bidders may bid on any or all of the Divisions. 3. Bidder must present a unit price for each and every item inieach Division where a bid is made and unit pricing for Asbestos Abatement. On page 2 of the Contractor's Bid for Public Work forms present the total base bid for all Divisions being bid. XXII. SAFETY AND SITE SECURITY A. Prevailing Specifications: None B. Additions: 1. The Contractor(s) and all Sub -Contractors and their personnel onsite shall maintain safe working conditions according to OSHA Regulations and safety plan and policies. 2. The Contractor shall describe the safety plan actions to the Engineer for each site. The safety plan shall include a Maintenance of Traffic Plan which describes the method of protecting the vehicles and pedestrians in the public right-of-way. 3. Use of "snow fencing," prefabricated chain link panels, or other temporary barriers effective in keeping the public and passers-by from contacting hazards shall be allowed. 4. Contractor shall put the barriers in place when leaving each work site if debris piles and/or open excavations or other hazards exist on the site. 5. Existing fences in good condition may be used as part of the security barrier. 6. Except for existing fences marked for preservation, all fencing shall be removed upon completion of demolition and backfill activity. 7. There will be no direct payment for safety and site security. This item will not be measured directly, but shall be included in the Lump Sum Unit Price established in the Pay Items for Demolition. Demolition shall not be paid until this item is 100% completed. XXIII. TEI' PORAR"y ERO SION CONTROL Version 8/16/2018 Special Provisions - 11 A. Prevailing Specifications: 2018, INDOT Standard Specifications Section 205 B. Additions: 1. The Contractor shall be responsible for temporary erosion measures to control erosion on the site and any material leaving the site. All inlets around the site shall be protected from sediment. An erosion plan shall be submitted to the engineer for review prior to construction. The Contractor shall follow IDEM's guidelines. 2. The Contractor shall be responsible to maintain all erosion control measures in place until all "Work" is completed at each demolition site. The Contractor is responsible for obtaining Erosion Control permits for sites larger than one acre. 3. The Contractor shall follow IDEM's guideline for erosion control as shown in the Indiana Stormwater Quality Manual with weekly inspections and inspections following one-half inch or more rainfall. 4. Dirt and sediment from the demolition site shall not to be tracked onto public right-of-way by construction vehicles and any dirt migrating into the public right-of-way due to work on the Project shall be cleaned up daily that is within public right-of-way. 5. The Contractor shall provide construction entrance for access to each of the demolition sites, erosion control measures so that rain or snow will not wash dirt or sediment into public right-of-way, and inlet protection for any inlets that are adjacent or near the site. This item will not be measured directly, but shall be included in the Lump Sum Unit Price established in the Demolition. XXIV. ASBESTOS ABATEMENT A. Prevailing Specifications: 2018, INDOT Standard Specifications Section 202 B. Additions: 1, Asbestos abatement is required for most but not all of the properties. Federal, State, and IDEM guidelines must be followed for abatement. All costs associated with removal and disposal including documentation and disposal fees shall be included in the Lump Sum cost for Asbestos Abatement for each of the identified properties. 2. Any above ground or underground storage tanks found during demolition shall be drained of all contents, disposal and removal of the tanks and any contaminated ground or other products shall follow Federal, State and IDEM guidelines. The cost associated with removal and disposal shall be included in the lump sum prices for each property. 3. The asbestos inspections for each of the affected properties are an indication of what was found and are not to be considered as the only asbestos that may actually exist at those locations. Test results are attached for those properties where asbestos -containing materials were found. The type of material is noted on the Bid Form. The type of material is noted on the Bid Proposed. Contractor shall remove and properly dispose of all asbestos -containing materials. In the event of additional asbestos containing material has been discovered during the demolition process that was not included in the reports, Asbestos Abatement Unit Pricing supplement to the Bid/Proposal may apply for proper abatement and shall be paid from environmental allowance. a. Prior to removal of the additional asbestos material, the Contractor shall notify the City and the City shall inspect the site to verify and quantify the additional asbestos material. Version 8/16/2018 Special Provisions - 12 The Contractor shall not be paid for additional asbestos material removed without prior inspection by the City. 4. The Contractor and any of its subcontractors performing asbestos abatement are expected to inspect the properties to be demolished. No additional allowances will be made for any difficulties that may be encountered in executing the required work due the failure of the Contractor or any of its subcontractors to inspect the site. 5. In the event asbestos reports are not included due to unsafe or unable structures or conditions to obtain samples, the attached documents referring to the Indiana Administrative Code 326; Article 14; Rule 10; Section 1. (b). shall apply. The Contractor shall send all asbestos for disposal to IDEM approved facilities. Proper documentation (manifesting, disposal tickets, etc.) shall be stored and provided to the Engineer for review. 6. Payment for Asbestos Abatement shall be the Lump Sum Unit Price for Asbestos Abatement as set forth in the bid/proposal for each house. XXV. DEMOLITION AND CLEARING A. Prevailing Specifications: ASTM D698 B. Additions;. 1. The Contractor shall remove all the structures indicated on the Bid/Proposal including but not limited to basements and their contents and all walkways, driveways, curbing, steps, slabs, pavements whether concrete or asphalt, retaining walls, signs, and foundations. 2. The Contractor shall remove fences if listed on the bid sheet to be removed. 3. Demolition Procedure: a. All demolition procedures shall be conducted in such a way that non -regulated asbestos containing materials on or within the structures shall remain non friable. b. Arrangements have been made to disconnect utilities and the work has been completed or in the process of completion. If a utility line is found active, notify the Engineer and suspend work on that site. c. The use of explosives on the site shall not be permitted. No open fires or burning shall be permitted. d. Use water sprinkling, temporary enclosures, and other suitable methods to limit the amount of dust and dirt rising and scattering into the air. Do not use water when it may create hazardous or unsafe conditions such as ice, flooding, and pollution. (i) The Contractor shall not draw water from hydrants. e, The Contractor shall remove all the structures including basements and their contents and all walkways, driveways, curbing, steps, slabs, pavements whether concrete or asphalt, fences, retaining walls, signs and foundations, saplings, bushes, shrubs, dead trees and any other such items from within property boundaries. Trees that interfere with the work to be done may be removed from the site for the Contractor's convenience. Trees along the curb may only be removed if permitted by the Parks Department through the City Forester. No additional payments will be made for tree removal. Some sites have garages, fences, walls, and other items that must be Version 8/16/2018 Special Provisions - 13 preserved. The Contractor will take care to note those items and preserve them. In all cases where it is necessary to work on the public right-of-way, including the sidewalks and alleys, the Contractor shall submit a traffic control plan to the Engineering Department using the attached form for approval a minimum of five (5) working days prior to beginning the work at that structure. The Contractor will provide all barricades, warning signs and lights, flaggers, or other methods in compliance with the Indiana Manual for Uniform Traffic Control Devices to control traffic. Alleys shall be used wherever possible for truck and equipment access to the structures. No tracked vehicles shall be operated on public streets or public sidewalks. Loading of debris into trucks located within the right of way will not be approved without proof that there is no other way to accomplish the work without damage to private property. g. The Contractor shall coordinate the termination and removal of the sewer and water services with the Engineer. The Contractor shall cap and mark all existing sewer and water services at the sites at the property line and remove them. Documentation in the form of an as -built sketch is to be provided where the sewer and water lines were capped at the right-of-way (ROW) line. Photo documentation shall also be required. h. All concrete generated from the demolition of the structures and appurtenances shall be removed from the site and disposed of as provided in these Specifications. All demolition debris, rubbish, and all other material removed from the site as part of the work shall be transported in a lawful manner to landfill(s) or other disposal facilities licensed to receive such material. The Contractor shall inform the Owner in writing of the identity of those facilities, the nature of materials disposed there, and a statement from the facility that it is licensed to receive such material prior to any work starting on site. Trucks leaving the work area shall be adequately covered, protected and secured to prevent debris from spilling or blowing from the trucks during transport. Foundation walls and their footings, floors and spread footings are to be removed to their full depth. Under floor water pipe, sewer pipe, electric wire and conduit, ducts, valves, tunnels, and all other constructed appurtenances shall be completely removed. Crushing inorganic materials in place without removal shall not be permitted. It is the Contractor's sole responsibility to complete its due diligence on determining the size of each basement and other characteristics of the property to be demolished. Information available from the Saint Joseph County Assessor is included regarding basement size and other information. In addition, City employees have visited each site and made notes about basements found. Those notes are included in these Specifications. Contractors are advised that the information contained therein is not guaranteed to be 100% accurate. The Contractor is responsible for examining each site prior to demolition. k. Backfill shall be clean sand or sand and gravel free of roots, clay, or other deleterious materials meeting INDOT's borrow specification. Backfill shall be compacted in thin lifts with a vibratory roller compactor using the number of passes recommended by the manufacturer to compact that thickness of lift to ninety five (95) percent of standard proctor maximum dry density, ASTM D698. Backfill shall be approved by the Owner prior to placement. The Owner may disapprove backfill deemed unsuitable at the Owner's discretion. Any unsuitable backfill delivered or placed on the site prior to approval shall be removed at no additional cost to the Owner. I. The Contractor shall follow all federal, state, and local requirements when handling and disposing of lead based paint debris. After backfilling, the ground shall be graded with a .5' to 1' depression sloping towards the middle of the site. The grading shall remove any ruts or holes caused by demolition equipment or procedures on the site. A. Prevailing Specifications: 2018, INDOT, Standard Specifications Section 202 B. Additions: 1. All existing concrete sidewalks, drive approaches, curbing, and curb ramps in the public ROW are to remain in place and be preserved in existing condition. If damaged during demolition beyond a serviceable conditions, it shall be the responsibility of the Contractor to repair the damaged item to its previous condition at the expense of the Contractor. 2. Use of adequate timber ramps and earth fill will be acceptable means of protecting these facilities. Care shall be taken to avoid tracking dirt onto streets. Daily sweeping shall be required at each access location. 3. There will be no direct payment for replacement of damaged concrete. This item will not be measured directly, but shall be based on and incidental to the Lump Sum Unit Price established in the Pay Items for Demolition. Demolition shall not be paid until this item is 100% completed. XXVII. TOPSOIL AND MULCHED WHITE DUTCH SEEDING A. Prevailing Specifications: 2018, INDOT Standard Specification Section 621 B. Additions: 1. The entire Project site shall receive four (4) inches of rich topsoil from an offsite source, approved by the City prior to placement and be graded prior to the placement of seed. 2. A pH test shall be required from a third party testing agency and approved for each topsoil source. 3. Topsoil shall contain no rocks or rubble over '/4" inch diameter, construction debris, or organic waste (e.g. roots, branches, sticks, etc.). 4. The entire project limits shall be made smooth and uniform. The seed bed, if not loose, shall be loosened to a minimum depth of three (3) inches. before seed is applied. 5. Each site is to receive White Dutch seeding. The seeding shall be applied in a mixture of water and mulching material. a. Application shall have a minimum of 95% coverage, with no bare areas greater than eighteen (18) inches in dimension. b. The Contractor is responsible for watering for thirty (30) calendar days after placement of the seed per the schedule set forth in the Prevailing Specifications. 6.
