02/27/1917 Board of Public Works Minutes
Board met in regular session at 10:00 A.M. All members present. Kennedy Assistant Supt. of Indiana & Michigan Elea. Co. met with the Board at their request to take up the matter of their company not 4-1 taking care of a notice sent August 19th._,1915 to replace a Home Telephone Company pole at the southeast ,corner of Walnut Street and. Division Street by a larger pole . . to be used jointly, instead the Indiana & Michigan Elea. Co. replaced their own pole in the wrong place without asking for a' p'ermit and contrary to the orders of th the Board of Public Works. The Board agreed to go att sometime within a. few days and look over the situation of resetting of the above pole, also Mr. Kennedy was instructed by the Board to file requests with them,for permits to set or nesett poles and anchors in this City Petition received from property owners in regard to ugly, unsigtly and dangerous poles of Public Service Corporations in and on East La Salle Avernue, East Colfax Avenue and North Emer ick Street in said City to be ordered placed under- ,/ ground; as requirwd by the City ordinances of said City. The same was read and placed on file. Paoperty owners aesidingg on Harrison Avenue between Fuerbringer Street and Lincoln Way West appeared before the Board and requested that the petition on file for pavement 'on the above mentioned street be set. for hearing. The Board instnucted the City Engineer to prepare resolution on same* communication received from H. S. Cover in regard to grading of Chippewa Avenue. The same was read and placed on file. The following guarantee bond.was approved by the Board. GUARANTEE BOND KNOW ALL MEN BY THESE PRESENTS, That THE WESTERN CONSTRUCTION COMPANY, as p incipal, and MASSACHUSETTS BONDING AND INSURANCE COMPANY, as Surety are hereby held add firmly bound unto the City of South Bend, Indiana, in the penal sum of Five Thousand , One Hundred Dollars($59100.00) for the payment of which, well �nd truly to be made, they jointly and severally bind themselves, their heirs, exe- cutors, adminstrators and assigns by these presents, THE CONDITIONS O:F THE ABOVE OBLIGATIONS ARE SUCH, that, whereas, the above bound WESTERN CONSTRUCTION COMPANY has this day enteredtnto contract with. the City of South Bend, Indiana for the paving of Michigan Street from the north . line of La Salle Avenue to the South line of South Street with Sheet asphalt, under Improvement Resolution -+o 4i5,.adopted by the Department of Public Works of the City of South Bend, IndIana, en the 26th. day of January ,1916 and WHEREAS, the said contract, plans, profile and specifications provide for the maintenance of said pavement for a period of five(5) years from the date of acceptance. ROUR Attorney in tact 379 The following complaints were reported on by the Pole and Wire Inspector and the said reports approved by the Board. ° Complaint about telephone pole in way of new fence at 1608 Fassnacht . Ave, filed by Micheal Golmbowski. Reported on as follows:- This is a Central Union Tel. pole and it stands -on the mains lot about ten (10) inches. The pole, should be trenched into the alley. This' will do when the frost is out of the ground-. I. & M. Elea Co. is jointly , on the pole No. 11869. poleowned by C. U. Tel. C'o. The following complaint received and filed -'by the -'Board'. - To the Honorable Board of Public Works, The Indiana &- Michigan Electric Company have been setting poles in streets r:nd alleys with out permits. The Light Co. has set a long line of poles on South Franklin, Q_treet. Two poles on Fassancht and Wilber and one pole south Scott.,St. by L. S & M. S. R. R. and this pole at Walnut and Dit. St0 in one place the owner of a new storeroom complained about poles and anchors in front off' his'storeroom where -he wanted to build a sidewalk at the corner of Division and Walnut Street. This Board had given the Light & Home Tel. Co. notice to remove. the pole. and anchors from in front of this plee. TEDS `. H. BEANING. Bond of contractor of Rock S imire for the sum of One Thousand ($1, 000. 00 ) Dollars and signed by London & Lancashire Indemnity Company of America as Surety c� was approved by the Board. ' Petition for a pipe sewer on Olive Street from Washington Avenue to Linden Avenue filed with Board. The same , was referred to the City Engineer for a gyres glut ion, . -Ur. James A. Judie appeared before the Board in regard to what position the said Board was to take in the matter of Opening of William Street from Colfax Avenue `tea Lincoln Way West, before he started to build his garage on Colfax Avenue where said proposed street was t-o start. The Board informed Mr. Judie that after considering the matter and con- sulting with the City. Controller U. G. Manning, find that there will be a shortage of funds in the sum of Eighteen Thousand ($189000.00)Dollars because of Liquor licenseeft. and they ,could not take any funds out of the General Treasury to apply on assessments that City would have to pay and by unanimous consent of the Board does hereby abandon this improvement by said opening. The. foll§wing resolutions were adopted by the Board. LOCAL. SEWER IMPROVEMENT RESOLUTION No. 485. Resolved.by.the Board of Public Works of the City of South Bend, County of St. Joseph, State of Indiana, That the c onstruct ionof a local sewer, intended and adapted only for local use by the property holders whose propertyabuts thereon, and not intended or adapted for receiving sewerage from collateral drains,be and the same is, hereby ordered in and along Ostemo Avenue from Iroquois Street to Lafayette Street as follows, to -wit: - Beginning at the intersection of the center line of Iroquois Street and Ostemo Avenue; thence east along the center line of Ostemo Avenue to the center of the first alley east of Iroquois Street with a 12 inch vitrified pipe sower; thence still east along the center of Ostemo Avenue to the center of Lafayette Street with a 10 inch vitrified pipe sewer. Together with the necessary manholes, storm water inlets, enduits and house connections to the curb 1 ine •along the line of said improvement.
