Hammerschmidt appeared before the Board in regard to a- Filing cabinet and roll top desk .for the office of the Probation Officer in the City Court.. It was agr eedL on by the ,Board to have Mr. E. Bids were received for forms for cash books for the Building Department as follows: Bid of Herr anal Herr, 1 special blank book, ruled and printed as your copy, 150 folio pages, �k bound, cubs, flat opening, skeet size 14 X 14 hteke's, and using white Sterling Ledger stock, Book to be letered sit front cover, building Department, South Bend,.at $25,00 p lac ed.. Tie following bids were received on a book for the engineer's office. One book 500 pages aspen sample in office at $20.509 bid of: ✓ The R. W . Gaf ill bindery. One 500 page. improvement record and index. No. 1 ledger for leather binding at ...... $21.00 The Board awarded contract for said book to the R. W. Gafill bindery at the above figures. Mr. Roberts of the Indiana& Michigan Elea. Company appeared before the Board in regard to -cluster lights in front of office buildings. No action taken by the Board. ThelkC ity Egg ineer filed a memorandum of liens and incumbrances affecting the title to Land between Notre Dante Avenue and St. Peter Street condemned for north side boulevard property owned by George Cutter Co. Street, the Complaint of %rmAnArndt in regard Pole and Wiro�'d as follows: - to two poles in front of 1306 Miami These are Central Union Telephone Company poles. The poles are properly placed the best they can be as the cable crosses the New York Central Ry. The Central Union Tel, Company has a permit granted to place these poles. The Pales are already placed. The above report approved by the Board, The following bond and contract was approved by the Board. PUBLIC IMPROVEMENT CONTRACT. THIS AGREEMENT, Made and entered into this 2nd. day of February 1917, by and between Hoban and Roach of the County of St. Joseph and .State of Indiana ( hereinafter referred to as the " Contractor" ) and the City of South Bend, in the County of St. Joseph and State of Indiana, by and through its Board of Public Works, ( hereinafter. referred to as the " City") , under and by v irtu#e of an Act of the General Assembly of the State of Ind Tana, entitled " An Act Concerning Municipal Xorperations," approved March, 6,1905, and all amendatory and supplemental acts thereto. Witnesseth, that the contractor covenants and agrees to constrzot concrete pavement on Portage Court from Portage Avenue to Ashland Avenue at and for the following prices : - . 260 lin. ft. of curbing, @ per'lin. ft.........................$.25 194 cu. yds. of grading, @ per cu. yd........................._.50 357 sq. yds. of %" concrete pavement @ per sq. yd.............I.1.45 and to -perform all work in the prosecution of said im provement under and according to the terms and c and it ions of Improvement Resolution No. 482 adopted by the Board of Public' Works November 14th.11916 and the plans, profiles and specifications on file in the office of -the 'Department of Public Works, which said resolution, plans, profiles and specifications are made a part here6:0 as fully and effectually as if copied and set out herein at full length. 37U e y .PabA uar y_f-:Sth 1.'; . The Contractor f'utther expressly covenants and agrees that in the preose- cution of said work all ..proper skill and care will be exerc ised; that he will preoper3Z guard and protect all excavations and dangerouse places, and will use all due, and proper precaution to prevent injury to any person or property; that- in the event of any injury or damage resulting from the work or resulting from any matter or thing +connected therewith or arising there from, to any person or property, he will pay and ltauidate to same at his own expense, and assume.the liab.iiity therefop and in the event of any claimeor claims being made or any action or actions being broughtagainstthe city by reason ear on account of er growing out of said work or its construction, the said oontracter °will at his own` ex ense defend the same; avid will pay any judgement rece ivered therein, and will in all respects fully indemnify and save harmless said City, its officers, agents or representatives from all costs expenses, payment or judgement recovered.in connection with such claim .or -claims action or actions, And if within ten days after any such action it begun, the -City shall 'notify the c ontracter � of :the pendency thereof, then any judgement rendered against the City shall bt conclusive against the contractor and against, the surety on his construction bond, as to the amount, liability and other matters pertaining 'thereto. And the contractor agrees to maintain said improvements and mast* such repairs as may be necessary for the period and in the manner as fixed by the speci-. f icat ions, anal to secure the maintenances and repair thereof to file with the Board of Pub•l is Works a bond with sufficient surety thereon and is a amount as f ixeed. by the specif. cations.. Anal'. in doing such repair work the contractor and the surety on his gdgrantee bond shall be subject to the sane l iab ilt iy to the City and any ether person for any injury eor,-damagee to any person or property in -the same manner ° and to the same extent as is fixed in the last preceding 'paragraph covering .the construction work. • And ;it' is further agreedby and between :said parties that the acceptance of the work provided` for in this. contract, or the payment there:of, shall not consti- tute a waiver on the: part of_the-City-6f :an of the provisions .of this contract, nor shall it release said contractor or the surties on his bond for the faithful performance thereof; xor:-shall the acceptance be prima facis evidence of the performs• mane of any provisions a this contract, except to the extent of entitling the contractor to the contract price thereof. The- c ontracbeer agrees • to pay.for or all labor and matey ills used or • furn ism c to be used in the making of such improvement and in the performance of this ontract whether done or furnished for him, or his agent, assigneeo, successor or sub- contractor; and the city , may reserve :kkx out of any allowance made on any estimate in favor of the contractor or his ass1gas, : or - out of the amount due his or his assigns upan the completion of the work, so much as may be necessary to pay all laborers or material men.. for amounts due them for work done or materials used or furnished to be used in the performance of this contract and the doing of said work, and the county treasuuer, acting as City treasurer, may retain stoney collected from property, owners assessed for said improvement too pay such debts or until the contractor shows that they have been paid or satisfied. The Contractor agrees to remove all rubbish, earth, and unused material in the streets or sides thereof upon the empletion #f the improvement ar the repairing thereof. The work of, making -such improvement shall be completed according too the terms of this,contract on or before the day of 1917 unless the time for the cemp.letion eof the same shall be extended in writing by the. Board of Public Works. And it is agreed that any such extension of time, or any alteration of this contract or #f i manner or method of doing such work shall in no way affect the duties, obl igat ions or 'Liabilities of the contractor or his sureties. It is agreed that the contractor shall not assign this contract, or sub -let the work or any part thereof to be done hereunder, tithout the written consent of the Board of Public Works. - • �ht °is further •agreed and stipulated that the contractor shall give to residents *of said -city °and county preference in the employment °of all labor -nec- essary in'the performance of this contract, and failing to do so, shall forfdit to the City the sum of ten dollars for each failure to observe this stipulation, And upon the performance of all the terms and cond it ions of this con- tract, and things to be done and performened by,said contractor the said city agrees to cause the cost of doing such work to be assessed, collected and paid to said contractor' in the manner fixed by the statute governing the making of -such improvements. a L. 371 To each of the conditions and stipllations of this eontr,act, including all and singular the prov is ions and terms of the plans, profiles, specifications, and resolution aforesaid,, the undersigned binds himself or itself, and therespect ive successor or assigns of such parties. KNOW ALL NEN BY THESE PRESENTS, That we HOBAN & ROACH of the County Of St. Joseph, State of Ind Tana,, aspr inc1pal and American Surety Company of New York, of the County*of Kings, and State of New York as sureties, are held and firmly bound to the City of South Bend, Indiana, the sum of Three hundred and forty (340: 00 )Dollars for the payment of which, well' and truly made, we jointly and severally bind ourselves, our heirs, executors, adminstrators and assigns, firmly by these presents. In the event the said City shall extend the time tor the c omplet ion of said work, such extens io shall not in any way release the sureties on this bond. ° This shall be a construction bond;, and the sureties on the same shall not be held responsible for the maintenance and repair of the improvement after Lit has been accepted by the second party, but such sureties shall be held responsible for the faith-� ful oompliance' with all --other conditions, stipulations and requirements covered by or set out in the' contract.. President. 37'l Board met in regular session at 7:45 P.M. All members present. Hearing had on assessment roll and final estimate for Asphalt pavement on Michigan Street from La Salle Avenue toSouthStreet under Improvement Resolution No 415. In the` City of South Bend, Indiana. In the above matter no remonstrators appeared( a few property owners attended said hearing) and no written remonstrance was filed. The Board therefore find that the property assessed in said rolls -filed January 24th.,1917 is bene- f itted in the amount of assessments as shown on said rolls, and the Board further find that the assessment rolls filed January 24th. ,1917 and the f inAl estimate allowed January 24th.,1917 should be and the same are hereby in all things rati- fied, confirmed and approved. The Board ordered that the City Controller be notified to hold out of funds owing The Western Construction Company, contractors on said improvement, the sum of Five hundred ($500.00)Dollars until further order from the Board. Clerk instructed to send copy of said order to Controller maintenance agreement of the Burrough'w Adding:ltachine Co. for care of adding machine. in Cif Engineer's office for ensuing year submitted to the Board, name was not agreed to by the Boardip mdnthly report of the 'Building Department for the month of Ranuary 1917 signed by C.
