We, the undersigned, owners of real estate on Michigan Street, between La Salle:Avenue and Monroe Street on Main Street, between Jefferson.Street and La Salle Avenue , on "Washington Avenue between Vistula Avenue and La'auetta Street and on Jefferson Blvd. between Main Street and Vistula Avenue in the City of South Bend,. You are hereby requested to remove from in front of my propert y at the street number below indicated, your iron span pole that now holds your span :'ire, and in olRce of using said iron pole, you are hereby given permission to connect your ppan wire to my building at the same place, provided you do neat mechanical work-in connecting same to the said building, and pay for all costs of connecting same, and all costs of , maintaining same, And further, this agreement is made on condition that said span pole will be removed and said attachment made to my said building on or before December lstt, 1917. This consent is given with the understanding that said Railway C omnany will assume liability for accidents and for damage to said building, which` are caused by said attachment, if such damage is caused vy the Chicago, South Bend ,& Northern Indiana railway Company This consent is given in consideration for the removal of trolley poles . from the street in front of the property of the undersigned. Fish, President of the Studeabker Vehicle Company granting permission to Chicago, South Bend & Northern= Indla.na Ty. .Company to attach trolley wires to their -building on Michigan Street. The same was read and placed on file. C ommunicat ions from Alex Lippman refusing to sign agreements received read and placed on file. Del C. Leer appeared before the Board and took up the matter of Widening of Leer Street also the paving of se.id street. the Board instructed Mr. Leer to File written petitions for the same. Mr. Beyler"and W. W. Sibley appeared before the Board and presented bill -tor placing extension of serer tap into 122 South Michigan Street on account of sewer tap not extending to curb. the Board ordered the clerk to send'said bi1.1 for the sum of $31.30 to J. H— Cahill, Contractor on the Michigan Street trunk sewer for settiement with W. W. Si blew Company. `2 3 Board met in regular session at 7:45 P.M. All members present. Hearing had. on Improvement 4esolut ion No. 482 'for Pa vement on Portage Court from Portage Avenue to Ashland Avenue, In the City of South Bend, Indiana."' - upon said hearing no remonstrators appe�7-.ared and no written remora- stra.nce was filed. And the Board being fully advised in thA premises, decides that the benefits to propertyliable to be assessed for said improvements are --equal to the estimated cost of the same, as reported by the.City Civil Engineer, end the-reupon• takes final act ton on said resolution as Originally adopted, and the same is hereby in all things ratified, confirmed and approved. Resolved further, that'notices be published on the 15th. day of December 1916 and on the 22nd, day of ➢eiember 1916 in a ne:�spaper of general circulation in said city, stating that this Board will receive bids for the construction of said improvements to 10:00 A.k. on the 2nd. day of January 1917. The Board reserves the right to reject any and all bids. Mr. Samuel Perley and Mr. I. D4. VanGorder appeared in interest of above pavement and stated that they wanted anconcrete pavement. Hearing had on assessment roll and final estimate for Pipf sewer on ,f,_f,iston Street from Studeabker Street to point 70 feet west of the west line of Walnut Street,under Improvement resolution No. 438. In the City of South Bend, Indiana. In the above matter a remonstrator appeared but no written remonstrance was filed. The Board therefore find that the property assessed in said rollsfiled , November 14th. ,1916 is 1-bnef itted in the amount of assessments as shown on said rolls, and thm Board -further find that the assessment rolls filed November 14th. ,1916 and the fini1, estimate allowed November 14ta.,1915 should be and the same are hereby inall things ratified, condirmed and approved. Hearing had on assessment roll and final estimate for cement sidewalk on west side of Kemble Avenue from Olive Street to Ewing Avenue under Improvement resolution No. 460. In the City of .South Bend, Indiana. In the above matter no remonstrators appeared and no remonstrance was filed. The Board therefore find that the property assessed in said rolls filed November 14th.,1916 is benefittad in the amount of assessments as shown on said rolls and the Board further find that the assessment r.oll filed November 14th.,1916 and the final estimate allowed November 14th.01916 should be and the same is hereby in all things ratified, confirmed and approved. Attorney Otis Romine and Dr. La Pierre appeared before tee Board in regard to the petition on file for the Opening of William Street from Colfax Avenue to Lincoln Way West. The Board ordered tixat a resolution be drawn up and set for hearing for the Opening of William Street from Colfax Avenue to Navarre Street, The Board ordered that the Following letter be sent to all public ut it it ies in the City of South Bend, To Public Utilities of the City of South Send, Ind. ifou are hereby notified that -it is the request of the Board of Public Works that the downtown district b e cleaned up of wires crossing this streets, ,,,-Complaints are being received because of this condition. We hope that this Will be attended to on or before February lat., 1917. BY ORDER OF THE BOARD OF PUBLIC WORKS. Mr..Irwin W. Jackson, President of the Board of Park Commissioners appeared. before the Board and request permission to close Ewing A venue at point where "toboggan crosses said street from Rum Village. the following resolution was adopted and the Clerk instructed .to send copy of same to Board of Park Commissioners. 324 RESOLUT ION. RESOLVED, That upon request of the Park Board to close Ewingg '< Avenue at the intersection of Kemble Avenue on -afternoons for the purpose of coasting the same was granted in the place designated from 1:00 P.U. until 11-:00 P.U. ..6solved further tisit the Park Board through their Pies ident I. W. .Jaekeon agrees to guard the traffic and. to place an enclosure across the stroetduring coasting hours and at nights to place red lights thereon. The city engineer filed the following reports. 30ard of ''ublic Works, South Bend, Indiana. Dear Sirs: In checking the amount of excavation in the cleaning of McCartney v/ Creek, we find that there was ^onsiderable more dirt excavated than called for by the original estimate of 676 cu. yds., The total amount excavated by Ur: -Slot was 1564.6 cu. yds. This excess was due partly to an error in the original calculations of 168 cu. yda. and partly to the fact that between the time that the original levels were taken and the time that the work was actually started there was a large amount of material de -posited in the creek. This was particularlyt3he case in the neighborhood of the South Bend Brewery. Respectfully submitted, FREDERICK J. ANDERSON_ City Engineer. Dear Sir : - With reference to the assessment roll for water -connections on Michigan Street from La Salle Avenue to South Street.- I beg to report that we have cgecked these taps to the best of our ability but due to the fact that there are rot - stop boxes for all of the taps we are not certain as to the covreetness of the assessment roll. i rr. - Burke submitted a report on the work done by him, and .this was referred to the Water Department. This report has returned by the Water Department with the stateir•.ent that it was correct, and the assessment roll wes_ made out according .to the report. Respectfully submitted, PPEDER I CK J .
