Company. The Board adopted modified Resolution No. 2 in present formwith certain
exceptions and the City Attorney was directed to modify said resolution in
accordance with the instructions�of the Board. This mg.tter deferred until
5:00 R. U. this 27th. day of November 1916. ,
The following contract was signed by the Board and referred to the
Common Counc it f or rat if ica.t ion,.
WHEREAS, the. City of South Bend desires to cruse to be established
end installed and placed in operation a lighting system, and
MEREAS, it is desired on the part .of the said City of South Bend for
economic reasons, to light said territory by the system known as the Five Lamp
Post Lighting System,." and
WHEREAS, the Indiana and Michigan Electric Company is a. public
utility, owning and operating a system for the manufacture, distribution end sale
of electricial current for heat, , light and pourer purposes in the City- of South Bend,
andos the only utility so engaged therein and desires to sell elect-ricial current
to said City and to establish an ornamental lighting system in the territory here-
inafter defined..
NOW, THEREFORE, in consideration of the covenants herein made by and
between each of the .parties hereto, it is agreed by and between the said City of
South Bend, party of the first part, and the Indiana and Michigan Electric Company,
party of the second part, that the said party of the second part shall use that part

equipped, the same as h-reinafter described, in the lighting of said streets and
shall extend an ornamental lighting system in, along and upon the following streets,
nd within the following territory in the City of South Bend, County of St.
Hnon Main Street,from La, Salle Avenue to Wayne Street; upon Vicl igan
Street from La Salle Avenue to Monroe Street; upon Mayne Street from }Jain Street
to St. Joseiah.Street; upon Jefferson Boulevard from the alley Between Lafayette
ar.d Ms,i; Streets east to St. Joseph Street; Washin.gtoa Street from the alley between
Lafayette and Main StreeitsEast td Michigan Street; Colfax Avenue from Main Stree o
to mielligax itrelt ; and two -lamp poster sba1L be• installed on the north side of
La Salle °Street on Ma- in Streets and also on MichiganStreet.
It is further agreed that the party of the second part shall remove
the present are lamps now in use in such a part of said territory above described
as rapidly as is consistent with the progress .of the work and replace the same with
said ornamental lamps.' Each and all of said lamp posts of said system shall be
Installed at the locations approximately as designated upon a blue print -attached
hereto, marked "Exhibit A." and igadk'a part hereof. The top lamp in each :post shall
be a one hundred (100) candle power lamp, or its equivalent and the other lamps on
each post shall be a sixty candle .power tungsten lamp, or their equivalent; and said
top lamp shall burn each and ever night during the year, 3from dusk to dawn, or.
approximately four thousand (4000� hours of service and the four lower Lamps on -each
post shall burn from dusk until midnight, or approximately two thousand (P000) hours
of service per year.
Aad the party of the second part further agrees that it will place
and install two hundred fifty (250) candle power lamps on the top of the posts, similie
to these which are now on Lafayette and Division Streets, at the dead ends of
Jefferson and St. Joseph Streets, Wayne and St. Joseph Streets, and Monroo and
Michigan Streets, where there are but two lamps at such intersections; Provided, howeve'
however, that if said installation at said dead ends should in the judgement of
the Board of Public Works be insufficient to light said iatorsectious, then said
Board may elect to have two more cluster l*ghts of the same kind as described in the
last preceding paragraph placed and installed across the street at each or amy of
said deed ends, which shall be done by the party of the second part after being
.-notified as to do, and the same shall be maintained for the same price as heroin

And the said party of_ the first part does hereby promise and agree to gay
to the party of the second part the sum of Ferty-five ($45..00) Dollars per post per
year, d iv ided into twelve (12) equal installments, payable monthly and at the same time
that other bills for lighting service is paid by the `panty of the first part:to said
party of the second part upon the presentation` of a bill. for the same by°the said second
party.
This contract shall be in, full force and effect from and after its: approval
by ordinance by the Common Couxc'il of said City, and from. the date of said approval until
the first ,day of January ,1925,
IN WITNESS WHEREOF, the said City of South Bend does hereby execute this
contract by and through its Board. of Public, Works, and the Indiana & Michigan Electric
Company does hereby affix the corporate seal of said norporatien and execute'said con-
tract by and through its president, and attest the same by
Secretary of said corporat ion , in duplicate this 27th. day of November
1916.

Mr. J. Ehrke and Mr. Saunders representatives of the Grand Trunk
Western Railway Company appeared before the Board and requested permission to
c/ place temporary rails on Division Street 'until spring of 1917- The Board granted
the followings
permission given Grand Trunk western railway C aay-tv install new
rails on Division -Street this City. Replace old planks wlthrnew:.,plank .at important
crossings. Said work to be temporary. Permanent 'work to be done in Spring of 1917
New ties and new balast work and -new plank to be put in good condition at said time..
Work to be. finished and completed to conform with established street grade and to be
fully completed not later than June`lst., 19170

MODIFIED RESOLUTION NO. L,FOR TRACK SEPARATION,
WHEREAS, on the dayof xa e ' 916, the Board of Public Works of
the City of South Bend, Ind-iana, adopted Resolution -No. 2'for the separation of the
tracks o.f,the'New.York Central Railroad Company where the same.interseet certain
streets in said City; the said Board caused notice.of the Ipendency of said reaolu-
tion to be served upon the following named railroad etndother companies:-
New York Central Railroad Company,.Grand-Trunk Western 4ailway Company
Vandall _Railroad Company,. Indiana Northern Railway Company, Oliver Chilled Plow
Company,:Stud:ebaker Corporation, and Chicago , South Bend &Northern Indiana
Railway Company.
ghat after the representatives; agents and attorneys of said com-
panies, the Board does hereby modify said resolution No. 2 to read as follows: -
WHEREAS, it is deemed necessary for the public good that the grades
of certain streets in the City o" - South Bend, Indiana, where the same intersect
thetracks of.the railroad companies hereinafter named,.be changed and altered., and
that the grades of the tracks of said railroad companies be altered and changed;
NOW,.THEREFORE, be it resolved by the Board of Public Works of the City
of South Bend, Indiana:
that thegrade crossings of the tracks of the New work Central Railroad
Company, formerly the Lake Shore & Michigan Southern Railroad Company, a steam
railroad-, at the intersection of said tracks with Michigan Street-, Bronson Street,
Main Street, Lafayette Street; Prairie Avenue, Scott Street, and Chapin Street, all
in the City of South Bend, Indiana, be altered by elevating the said tracks at said
intersections. And that the change in grade of said several street intersecting
said railway, and of certain streets and alleys intersecting daid streets .and other
railway tracks," and the amount in feet of the clearance of the superstructure over
the above named streets shall be as follows:

1. At the intersection of Michigan Street and the tracks of said railroad,
the surface of said street shall be depressed six feet below the top of the highest
rail of the tracks -at the intersection ,as now maintained; clearance shall be sixteen
(16) feet between the surface of the street as fixed above and the bottom of :the
superstructure work over said street; the grade of the'approach-of said street on the
north shall be a; straight line ' from the north line of the superstructure until it inter-
sects the present street grade at the south line of South Street; and the grade of the
approach on the south shall be an ascending grade from the south line of;Bronsonc
Street of two and one-half (21) feet to each one hundred .(100) feet.

2 At the intersection of Bronson Street and the tracks of said railroad,
(which street intersects them at the same point that Michigan Street does) the turface
of said street'shall be depressed six (6) feet below the top of the highest rail of the
tracks of said intersection as now maintained; the clearnnce shall -be twelve and one-
half (1*) feet between the surface of the street as fixed above and the bottom of the
superstructure work over said street; the grade of the approaches of said street shall
be ascending grades of three (3) feet to e4ch one hundred (100) feet each way" east and
west from the east and west line of the superstructure over said street.
3. At the intersection of Main Street and the tracks of said roll,road the
surface of said street shall be depressed two and six -tenths (2.6) feet below the top of
the gighest rail of the tracks of said intersection as now maintained; .clearance shall be
twelve and one-half (14-) feet -between the surface of the street as fixed above the the
superstructure work over said street; the grade of the approach of said street north -from
the north line of the superstructure shall be a straight line until it intersects the
present street grade at the south line of South Street, and on the south the grade shall
be a straight line from the south line of -the -superstructure until it intersects the
present street grade at the north line of Bronson Street. --
4. At the intersection of Lafayette Street and the tracks of said Railroad
the surface of said street shall be depressed two and one-tenth(2.1) feet below the top
of the highest rail of the tracks of said intersection -as now maintained; clearance shall
be twelve add one-half (1 1) feet between the surface of the street as fixed above and
the superstructure over said street; the grade of the approach of said street north and
from the north' 1 ine of the superseture shall be a straight line until it intersects
the present street grade at the south line of South Street, and the grade of the approach
south from the south line of the superstructure shall be a straight - 1 ine until it inter-
secte.the present street grade at Bronson Street.
5. At the intersection of Prairie Avenue and the tracks of said railroad
the surface of said street shall be depressed six (6) feet and nine (9) inches below
the top of the highest rail of the track leading to the studebbker Plant where same
r---in.tersects the center Line of said Pra it ie Avenue at the elevation now maintained-,
11 clearance shall be twelve and one- half (12-�) feet between the a' irface of the 6treet
as f ixed-above and the superstructure of tracks leading to the team yard and Studebaker
plant; the grade of the approach of said street. north frail the north line of the su'per-
structure carrying tracks to the team yard and the Studebaker plant -shall be an ascending
grade of three (3) feet to each one hundred (100) feet; the grade of the approach south
from the south line of the superstructure shall be an ascending grade of three (3) feet
to each one hundred (100) feet.
6. At the intersection of Scott Street and the tracks of said railroad the
surface of said street shall be depressed three (3) feet below the top of the highest
rail of thetracks at said intersection as now maintained; clearance shall be twelve
and one-half (1*) feet between. the surface bf the street as fixed above and the super-
structure over said street; the grade of the.approach.of said street north from the
north line of the superstructure shall be a:stralght line until it intersects the
present grade on.Scott Street at the south line of Dunn Street, and the grade of the
approach from the south line of the superstructure shall be a straight line until it
intersects the present grade of Scott Street at the north line of Ford Street.
7. At the intersection of Chapin Street and the tracks of said railroad
the -surface of said street shall be depressed seven (7) feet two inches below:the top
of the highest rail of the tracks at said intersection as now maintained;' clearance shall
be fifteen feet two inches between the surface of the street as fixed above and the super-
structure over said street; the grade of Said street under the superstructure, and for
twenty-seven and one.*hlaf (24-) feet each side thereof shall be level; the grade of the
approach of said street north shall be an ascending grade of two and one-half (*I feet
to each one hundred (100) feet beginning at a point twenty-seven and one half (27-) feet
horth of the north line of the superstructure until it intersects the present street
grade; and on the south the grade shall be an ascending grade of two and one-half:(2*)
feet to each one hundred (100) feet beginning 27� feet south of the south line of the
superstructure until it intersects the present grade.
8, The grade of Dunn Street, which intersects Chapin Street -'at a
point immediately north of `the tracks of said railroad, shall be changed, and the
grade east from the east line of Chapin Street as established at No. 7 above shall
be an ascending grade of three (3) feet to each one hundred (100) ` feet until -"it
Intersects the present grade of Dunn Street:
9. The grade of the first alley north of Ford Street, which alley
intersects .Chapin .Street and' Scott -Streets, shall be changed, and the grade of said
alley east from the east line of Chapin Street as established at -No. 7 above, shall
be an ascending grade of ,three (3) feet to each. one hundred (100) feet until it
intersects the present grade of said alley; and the grade of said alley west of the
west line of, ' ScettStreet, as 'established; at No. 6 above, shall be an `ascending
grade of thre (3)-feet to each one hundred (100) feet until it intersects the
present grade- of .said alley,
10. the grade of the first alley north of Dunn Street which alley
intersects Chapin Street shall:.be-,changed, .and the,grade.east from the east line of
Chapin Street as established at No. 7 above, shall be an ascending grade of three
(3) feet to each one hundred (100) feet until it intersects the present grade of
said alley:
ll. The grade of South Street which intersects Scott Street and.Prairie
Avenue shall be changed, and the grade.of said South_St`reet -east-from the east line
.of Scott Street as established at No, 6 above shall be an ascending' grade : of three
(3), feet -to each one hundred (100) feet until it intersects the present- grade df
South Street; and the grades of= said South Street east and west ,frsaz Prairie Avenue,
as established at No 5 above* shall be ascending grades of three (3) feet to each
one hundred (100) feet each war east and west, until they intersect the present,
grades fi South'Street.
12. The grade of. ayler Street which intersects Prairie Avenue, -shall
be,,,,changed, beginning at the grade of said. Prairie Avenue, as established a.t Ne.
above, there shall be an ascendi g grade north of three (3) feet to each one
hundred (100) feet{ until At intersects the present grade :of said street,
13., the grade of the first alley south of South Street, which alley
interIseats both Michigan and Main Streets,, shall be changed both east aid -Vest
from Michigan Street, as established in No. 1 above, and east from Vain 0treet and
as edtablIshed- at No. 3 above, by ascending grades of three (3) feet to each one
hundred (ICO) feet each way east and west until -said grades intersect the present
grades of said alley.
14. The grade df the first alley east -of Michigan Street extend n;g
north from Bronson Street shall be changed, beginning at the north line of Bronson
Street, as established at No. 2 above, there shall be an ascending. grade -.-of three
(3) feet to each one hundred (100) feet until it intersects the present grade of
said alley.
15. the grade of Fellows Street, where the same intersects the tracks
of -said New York Central _Railroad Company, shall be raised five and six -tenths
(5,.6) feet above the top of the highest rail of said tracks as now maintainid.0 and
the tracks of said company across said street shall be raised to conform to`the
grade of said street when changed as provided herein. And the grade of Fellows
Street from the northerly rail shall be a descending grade of five (5) faet ;to= each
one hundred (100) feet until it intersects the present street grade; and the grade
of said street south -of the southerly rail shall be a straight line from said rail
until it intersects the present street grade at the north line of Sample,Street_..
And the grade of Tutt Street which intersects said Fellows Street shall be raised
at the west line of Fellows Street, so as to conform to the grade of Fellows Street
as above established, and the grade of said Tutt Street shell be a descending
grade of five (5) feet to each one hundred (100) feet unil it intersects.the present
street grade.
16. The grade of Sample Street, where the same intersects the tracks
of said New York. Central Railroad Company,. shall be raised four and two -tenths
(4.2) feet above the top of the highest rail of said tracks as now:maintained,.&nd
the tracks of said company -across said street shall be raised to conform to the
grade of said street when changed as provided herein.- And the grade of said Sample.
Street west of the westerly rail shall be a descending grade of four (4) feet to
each one hundred (100) feet until tt intersects the present street grade, and the
grade of said street east of the.easterly rail shall be a descending grade -of.
three and one-half (3�1) feet to each one hundred (100) feet until it intersects the
present street grade.

1?. the grade pf Rush Street, where the same intersects the tracks of the
New York Central Railroad Company, shall be raised three and eight -tenths (3.8) feet
above the top of the highest rail of s €i id tracks as. now maintained, and the tracks
of said company across said street shall be raised 'to conform to the grade. of said
street when changed as prrvlded- herein.' And the grade of .said street south of the
southerly rail shall be andescending grade. of five (5) feet to ,ach _one hundred., (100) feet
until it intersects the present street gradet and the grade of said street north of the
northerly rail -shall be a straight line from said rail until it intersects the grads
of Sample Street as established in No..16 above. And the grade of Rush Street_ north of
Sample Street shall be changed so as to conform .to the grade of. ,Sam�Ple. Street as fixed
in No. 16 above, and descending at the rate of Five (5_) feet to each,one hundred (100)
feet until it intersects the present street grade. And the grade of the first alley
east of Rush Street and intersecting Sample Street, 811a11 be -changed so as to conform
with,the grade of Sample Street as herein f ixed and djescond i3ig at the rate of f`ivei
(5) feet to each one hundred feet until it intersects the present alley grade. And the
grade .of Angle Street, which intersects both Sample Street and Rush Streets shall be
changed so that it

at the rats of Sic (6) feet -to each one hundred (100) feet until it intersects the
present streat grade.and (2) it shall be changed so as to conform to the Rush Street
grade and thence- descend at the rate of Six (6) feet to -each hues hundred (100) feet
until it intersects the present street grade. And the grade of the first alley south
of Sample Street, which intersects Rush. Street on the west side, shall be changed so as to
conform to the grade of Rush Street as established at No. 17 above and thence descend
at the rate of five (5) feet to each. one hundred (100) feet until it intersects the
present alley grade.
18. The grade of Ohio Street, where the same intersects the.tracks of
New YorkCentral Railroad Company shall be raised two and six -tenths (2.6) feet above
the top of the highest, rail as now maintained, and the tracks of said company across
said street shall be raised to c onf orm to the grader of said street when altered as
pr ov ided herein., And the grade of said street from the westerly and easterly rails
shall be descending grades of five (5) feet to each one ,hundred (100) feet until
said grades intersect the present street grades.
19. The grade of iiarieptta Street, where the -same intersects the tracks
of the New York Central Railroad Company, shall be raised two and three -tenths (2.3),
to e t above the top of the highest rail of said tracks as now maintained,, and the tracks
of saki company across said street shall be raised to conform to the grade of said
street when changed as provided herein. And the grade of said street from the northerly
and southerlyrails of said railroad shall be descending grades of five (5) feet to each
one hundred (100) feet until said grades -intersect-the present street grades. Add the
grade of tha alley adjacent to the south side of the right of way- of said railroad -
company and intersecting lobar ietta Street, shall be changed so as to c onfopm, to the grade
of Marietta Street, and then descend at ,the rate of five (5) feet to each one hundred
(100) feet until it intersects the present alley grade; and the grade of the alley :south
of Ohio Street and intersecting the west side of Marietta Street shall, be changed so
as to c onf orm to the grade of Mar iitta Street and then descend at .the rate of five . (5)
feet to each one hundred (100) feet until it intersects the present alley grade..
20. The grade of High Street, where the same intersects the tracks of
the New York Central Ra ilr oad Company, shall be raised seven -tenths (.%) f a foot
above the top of the highest rail of said tracks as now ma inta ined, and the tracks of
said company across said street shall be raised to conform to the -grade of said street
wher. changed as provided herein. And the grades of sadd streets. from the northerly and
s outher ly rails of said rdilr oad shall be descending grades at the rate. of five (5 )
feet to each one hundred (100) feet until they intersect the present street grade,
21. The grade of Arnold Street where the same intersects the tracks of
the New .,ork Central Raiload Company shall be raised four and eight -tenths (4.8)' feet
above the top of the highest rail of said tracks as now maintained; and the grade of
Arnold Street, where the same intersects the tracks of the Grand Trunk Western Railway
Company shall be raised f-ive and six -tenths (5.6) feet above the top of the. highest
rail of said tracks as now ma inta ined; and the grade of Arnold Street where the same
intersects the tracks of the New York Central Railroad Company, formerly the Chicago,
Indiana & Southern Railroad Company, shall be raised not to exceed six (6) feet above
the top of the highest rail -of said trucks as now maintained; and the grade of said street,
where it intersects the switch track of the New York Central Railroad Company leading
into the Oliver Chilled Plow Works shall be raised not to exceed six (6) feet above the
top of the highest rail of said switch track as now maintained, and the tracks of all
said companies .across said streets at said point shall be raised to conform to -the
grade of said street at said several points when changed as provided herein... The grade of
said street north from the northerly rail of the tracks of the New vork Central Railroad
Company shall be a descending grade of five (5) feet to each one hundred (100) feet until
it intersects the present street grade, and the grade of said street south shall be a
descending grade from the southerly rail of the last above mentioned railroad, to a point
mielwag between said rail and the northerly rail of the rdilroa.d of the Grand,trunk
Western Railway Company, which point shall be three and thre&Mtenths (3.3) feet higher
than the present high rail of the New York Central Railroad; and the grade from said last
,above mentioned point shall be ail ascending grade to the northerly rail of the railroad
of the Grand -+runk Western Railway Company, and from the southerly rail of the last
above mentioned railway company, the grade of said street, shall be a straight line to the

northerly rail of the tracks of the New York Central Railroad Company, formerly
the Chicago, Indiana ,& Southern Railroad Company; and the Grade of said street .from
the last" above mentioned -point shall be a straight line .to the northerly rail of the
switch track of the New York Centratil Railroad Company ,leading. into the Oliver Chilled
Plow Works; and the grade of said street from the, southerly rail of the last Move
mentioned track shall be a descending grade of ..ive feet to each one hundred feet
until it intersects' the present' street grade. The grade of Hancock Street. which
intersects Arnold Street on the east side shal be raised so as to conform to the
grade of Arhold Street; anal -then descend at the rate of five (5) feet to each one
hundred (100) feet until it intersects the present street grade. And. the grade of -
Huron Street which intersects Arnold Street on the west side shall be changed'so as
to conform to the grade of. Arnold Street, and then descend at the rate -of -five
(5.) feet to each one hundred; (.100)`, feet until it -intersects the present street
grade..
22. The grade of Division Street, where the same intersects the tracks of
the New York Central Railroad Company, shall be raised two and, one-half (2J) feet
above 'the top. of the 'highest rail of .said tracks as now maintained; and the tracks
of said edmpany across said street .shall. be. raised to conform to the grade of said
street when changed as provided herein. And the grade of said street from the
easterly and westerly rails of said tracks. shall respectively be descending grades
of give (5) feet to each one hundred (100) feet, until they intersect .the present
street gredeso And the grade of Walnut Street, which intersects Division Street,
shall, . on each side of said Division Street be made o -conform with Division Street,
and shall descend at the rate of five (5) feet to each one hundred. .(100) feet, until
said grades intersect the present street grade.
23 • The grade -Of Cherry Street, where the same intersects the tracks of
the New York Central Railroad Company, shall beraised six-tenth(,6) of afoot above
the top -of the highest rail of said tracks asnow maintained. And the tracks of said
company as now --:maintained shall be made to conform to the grade of said street
when changed as provided herein. And the grades of said street on each side of
said tracks shall be descending grades at the` rate f five (5) feet to each -'one
hundred feet from the northerly and southerly rails.
24. The Tracks of the Grand Trunk Western Railway Company, and of the
New York Central Railaead Company shall be raised five and one-half (5 s) feet above
the top of the. rails of the crossing frogs as now'maintained at said crossing; and
the tracks of said railways shall be raised to conform to the grade of saidinter-
section point when changed as provided herein,
25. The grade of Division Street shall be changed beglunA g at a point
one hundred (100) feet east of the east line of Pine Street, and thence ascending
six -tenths (. 6) of a foott in each one hundred (100) feet to the west line of
Laurel'Street, at which point the raise in the grade of Laurel Street shall not
exceed two `and nine-tenthsl2.9) feet above the- present grade of the tracks of the
Grand Trunk Western Railway Company. 'And the grade of Division Street from the
last above mentioned point shall 'be a descending grade of three (3) feet in each
one hundred (100) feet, un'til it intersects the present street grade of Division
Street vest of Laurel Street,and the grade of Laurel Street shall be changed
so as to conform to the grade of Division Street, $nd on each side of said
Division Street shall be descending grades of three feet in each one hundred (100)
feet, until they intersect the present grade of Laurel Street. The grade of Pine
Street, which intersects Division Street and the tracks of the Grand Trunk Western
Railway Company shall be changed so as to conform to the grade of Division Street
as herein established, and shall descend from eathh side thereof at the rate of five
(5) feet in each one hundred (100) feet, until it intersects the present street
grade.
26, The grade of Walnut Street, where the same intersects the tracks of th
the Grand 'Trunk Western Mailway Company shall be raised eight -tenths (.e) of a foot
above the top of the highest rail of said tracks as now maintained, and the tracks
of said company across said street shall be raised to conform to the grade of said
street when changed as provided.herein. And the grades of said Walnut Street north
and south respectively from the northerly and southerly rails of said tracks shall
be descending grades at the rate of five (5)feet in each one hundred (100) feet.
27. That the tracks of the different hailroads herein referred to shall
be raised .so as to conform to the different street grades, as herein fixed.

.26. That all.streets over which the tracks of -the New York Central
Railroad Company are required by this resolution to be raised or eleveated, shall have
the full imount of the clearance as provided for in this resolution for each of said
streets for. the full width beneath the superstructure, and that in changIng froifi the
level grades to ascending grades, proper allowance dhall be .made for suitable vertical
curves, but at Uichigan Street the vertical curves shall not extend under the sup'erstrVeture
nor at Chapin Street shall the vertical curves extend.under,or wft.hix twenty-seven
one bald (2 feet of the superstructure. In changing from ascending grades to present
streei grades proper allowances shall be made for suitable vertical leurves,. In making
proper allowance . for suitable vertical,curvos at-kichigan and Cj'Spin Streets, no grade
shall be made more than teo and one-half feet -to each one hundr&d'(100) feet6
29. And the tracks of the Vandalis Railroad Com5any, Indiana Northern
Railway Company, Oliver Chilled. ' Plow Company, and Sttudeabkor-Corpora'tion,,,whose tracks
intersect or connect with the tracktof the New York Central Railroad Companyt if Said
companies or any of them.shill- desire tq,.keep and maintain said connections shall be
raised so as to conform to the gr,,q.d-es of said New York Central Railroad Company as herein
established and made propercannections with the same.
.50., And the swid city by,q_."nd through its Board of,Public Works and Common
Council reserves- the right to change the elevation off the tracks of the New York Central
Railroad Company at their intersection with Chapin Street,. and to increase the clearnac*
at said point, at such time as the elevation of the tracks of said railroad shall be
extended westerly from thapoint now designated as the western -most point of such ele-
vation.
That said improvement shall be made and paid for see ording to the method
and manner provided for in an Act of the General Assembly of Indiana of'1911,Pago.314,
of any other law applicable thereto.
And be it further resolved* that this resolution as above modified -be,
and is hereby in all things apprved and confirmed, and that it is hereby ordered Uat
this r esolution be referred to the Common Council of the City of South Bend, Indiana
for its consideration and approval.
