Board ordered clerk to send following communication to the South Bend Home Tele-ohoneCompany. We wish to call your attention to Resolution adopted,by the Board of Public Works August 19th. ,1916 a copy of which was sent to you. We must insist that v this work be done end that it will be unnecessary to call your attention to this again. Board requested City Attorney to draw up new contract for cluster lights in busin'ss distrdet. The Board finds that assessment of damage allowed Frank Radick on Lot 1 Ganiel Gise 's Add it ion for the widening of Webster Street and Indiana Avenue was v an error and should be75.00 instead of $200.00 and the City .Engineer• is hereby instructed to f ile co^rected assessment roll. The matter of track separation -Resolution 2`o. 2 was deferred until 5:00 P.M. this 22nd. day of November 1916. LOCAL SEXIER SEWER IMPRO iIEXENT RES OLliT ION. NO. 483. Resolved by the Board of Public t'orks of the City of South Bend, County of St. Joseph, State of Indiana, that the construction of a local sewer, intended and adapted only for local use by the property holders whose property abuts thereon, and not intended or a.da:ped for receiving sewerage from collateral drains, be and the same is, hereby ordered in and along Carroll Street, Fellows- Street, Marietta Street and Rush Street as follows,to-wit: Beginning at the intersect ion of the center line of Haney Avenue and Carroll Street; thence south along the center line of Carroll Street to a point 213 feet south of the south line of Haney Avenue with a 10 inch vitrified pipe sewer. Also. Beg inning at t,_;e intersection of the center line of Haney 4venue and Fellov+is Street thence south along the center line of fellows Street to a point 213 feel, south of the south line of Haney Avenue with a 10 inch vitrified pipe sewer. Al&o;» Beginning at the intersection of tha center line of Haney Avenue and Rush Street; thence south along the center line of Rush Street to the f irs t a -ley south of Haney Avenue with a 10 inch v itr if ied pipe sewer. Also:- Beginning at the intersection of the center line of. Haney Avenue and Rush Street; thence north along the center line of Rush Street to a point 21-4 feet north of the north ling of Haney Avenue with a 10 inch vitrified pipe sewer, Also:- Beginning at theintersection of the center line of Haney Avenue and Marietta Street; thence north along the center line of, Marietta Street to a point 233feet north -of the north line of Haney Avenue with a 10 inch vitrified pipe sewer. Also; Beginning at the intersection of the center line of Haney Avenue ­.nd Marietta Street; thence southto a point 213 feet south of the ilouth line of Haney Avenue with a 10 in h vitrified pipe sewer. Together with the necessary manholes, inlets, conduits and house connections to the curb line along the line of said improvement. All as shown on the plans and in accordance with the profiles detail drawings and specif icat ions on f ile in the off ice of the Department of Public Works of the City of South Ber= Inddsaa. and said sewer, with all its appurtenances shall be constructed in accordance with the profile and specifications now on file in the office f the Department of Public Works of said City, the cost of said improve- ment shall be apportioned against and paid by the property holders :whose property abuts thereon, nd upon the City of South Bend if the City is benef itted by said public itmprovement, all according to the method and manner provided for in Act of the General assembly of the State of Indiana, entitled " An Act Concerning Municipal Corporations," Approved March 6,1905. Assessments, if deferred, are to be paid in ten equal annual installments, wih interest at the rate of Six per cent ;per annum. A bond or bonds shall be issued to the contractor in payment for such work,, unless the property oimers pay said assessments -bef ore said Board of bonds are issued. Under no circumstances shall the City of South Bend be or be hecld responsible for any sum or suss due from said property owner or ovrners for said work, or for the collection of same, or for the payment of any bond or bonds, certificate or cert if icates, issued to said cdntra;ctor in payment for such work .except for such moneys as shall have been actually received by the City from the assessments for such improvement, or such moneys as said. City is by said above entitled Act required to pay. All proceedings had and work done in the making of said Improvement, assessment of property, collections of assessments and issuance of bonds therefor, shall be as provided for in said above entitled Act. Notice of this resolution shall be published on the ?4th. day of November 1910'. and on the 1st. day of Ueeenber 1915. in.the South Bend Daily Tribune. This Board will. give a hearing on this resolution at its office in the City Hall on the 19th. day, of December 1916. at 7:45 P.M. ` Adopted this 22r=n.d day of November 1916.
