City Attorney Eli.. F. Seebirt appeared before the Board and discussed
track elevation resolutions No. 2.
Attorney Crumpacker rppresentaing J. M. Studeabker appeared before the
Board in regard to the widening of Eddy Street and Mishawp.ka Avenue, and requested
permission of.the Board to have the judgement in regard to the above matter set aside
in the Circuit Court, or that the Board have the same.done. The Board informed Mr.,
Crumpacker to find out how much is wanted for the additonal land and report to them at
meeting to be held at 7:45 P.M. this 14th. day of November 1916.
Petition for the opening of William Street from Colfax Avenue to Lincoln -
Way West was discussed by the Board and the Clerk was instructed to send out the
letters to the following property owners abutting William St. alley, requesting them'
to come to meeting to be held Tuesday[ November 21st. ,1916. at 7:45 P.M. in regard to
the opening of William Street. ,

Hearing had on assessment roll and final estimate for Pipe sewer
on Boman Street from High Street to Miami Street under Improvement Resolution No.
437. In the City of South Bend, Indiana.
In the above matter no remonstrators appeared and no remonstrances
mere filed. The Board therefore find that the property assessed in said rolls
filed October 17th.,1916 is benefitted in the amount of assessments• as shown
or. said rolls , and the Board further finds that the assessment rolls filed October
17th. ,1Q16 and the final estimate allowed October 174,h. ,1916. ' should be and the
same are hereby in all things ratified, confirmed and approved.
Hearing on assessment roll and final estimate for Pipe sewer on
Donald Street from Michigan Street to Main Street, under Improvement Resolution

In the above matter a remonstrator appeared but no written remonstrance
was filed. The Board therefore find that the property assessed in said rolls
filed October 24th.,1916 is benefitted in the amount of assessments as shown on
said rolls, and the Board further find that the assessment roll filed October 24th.
1916 and the final estimate allowed October 24th.,1916. should be and the same is
hereby in all things ratified, confirmed and approved.
Hearing had assessment roll and final estimate for Grade and gravel
pavement on Morris Street and Cement walk and curb on east side of Morris Street
from Prairie Avenue to Ewing Avenue under Improvement Resolution No. 444. In the
City of South Bend, Indiana.
In the above matter no remonstrators appeared and no remonstrances
were filed. The Board therefore find that, the property assessed in said rolls
filed October 24th. ,1f�16. is benefitted in the amount of assessments as shown
on said rolls, and the Board further find that the assessment rolls filed October
24th.,1916 and the final estimate allowed October 24th.,1916 should be and the same
is hereby in all things ratified, confirmed and approved.
Hearing had on Condemnation Resolution No. 45 for the Opening of
Pokagon Street across the Michigan :Air Line Railroad and Southern Michigan
Railway Companyts right of ways, in the City of South Bend, Indiana.
In the above matter no remonstrators appeared and no remonstrances
were filed. .hereupon, being fully advised in the matter the Board takes final
action on said resolution, confirming without modification,all former action_ taken
on the same.
The Board therefore declares the a ;ove -property in all things con-
demned and appropri ated for public use, the Board now orders that a list or roll
be prepared of all theowners or holders of property and of valuable interests
therein sought to be taken or to He injuriously affected, which list or roll shall
also describe the property beneifieally affected.
Hearing given on Vacation Resolution No. 31 for the Vacation of
Part of U&4 son •7treet or. East side of Bast Race, in, the City of South Bend,

In the above matter remonstrators appeared but no further remonstrances
were filed. The Board therefore sustain all former action taken and declare
theabove described property in all things vacated and this resolution in all
things ratified, c onf irmed and approved.
Resolved further, that the City Civil Engineer be instructed to
prepare a roll showing awards of damages and assessments Of benefits to all
parties and properties interested in the above matter.
In the above matter a committee from the Chamber of Commerce , repre-
sented by D. L. Guilfoyle,&C. C. Ranch appeared before the Board in the interest
of the La Salle Paper Company petitioners for - above vacation of part of Madison
Street. A number of resident property owners of Madison Street appeared and
remonstrated against said vacation. Attorney S. Parker of Anderson Parker,
Crabill and Crumpacker appeared and represented C. Nicily of the La Salle Paper
Company.

STREET OR ALLEY IMPROVEk%NT RESOLUTION NO. 482.
Be It Resolved by the Board of Public Works of the City of South Bend,
St. Joseph County, State of Indiana, that it I# desired and. deemed necessary to
improve Portage Court from Portage,Avenue'to'Ashland Avenue as follows,to-wit:
By grading and paving the roadway, also grading and paving the roadways of
all intersecting and entering streets and alleys lying within the,property lines of
said Portage Court not included in the roadways; by paving. said roadways with -either
asphalt , asphaltic concrete, Bithulithic or brick laid nn a five(5) inch po.rtland
cement concrete foundation, or with Brick laid on a Six inch rolled gravel foundation
or by constructing a Portland Cement Concrete pavement seven (7) inches in depth; by
placing the necessary marginal cement curb; by placing all manholes and inlets to
the proper grade; and the construction af' +l-.- necessary storm water inlets and con-
duits All as shown on the plans and in accordance with the profiles, detail drawingg
and specifications on file iii the office of the Department of Public Works of the
City of South Bend, Indiana,
The cost of the improvement herein provided for, except street and alley
intersections, shall be paid by special assessment to be levied upon the property
specially benefitted, to the amounts that the same may be legally assessed therefor,
in accordance with An Act of the Geneeral Assembly of the State of Indiana, entitled
"'An Act Concerning Municipal Corporations, ap-ooved.March 6,1905, and in accordance
with and pursuant to the provisions of all acts amendatory and supplemental thereto.
The cost of all street and alley intersections, including one-half of the
width of the improvement opposite street and alleus which run into, but do not cross
said roadway herein proposed,to be improved and that portion of such street or alley
abutting upon porperty belonging to said City, or upon property not subject to such
assessment, shall be paid by the City in cash but of its general fund, if able to
do so, or from a fund created by a special assessment to be levied under the pro-
visions of Section 108 of the above entitled Abt.
Assessment of ten dollars and more against each lot, if deferred, are to
be paid in ten equal annual installments, with interest at the rate of Si A per cent
per annum. A bond or bonds will j)e issued to the contractor to the amount of such
deferred assessments in pro rat& payment for such improvement. °
Under no circumstances shall the City of South Bend be, or be held
responsible for any sum or sums due from said property owner or owners for said work
or for the collection of the same., or for the payment of any bond, bonds, certificate
or certificates, issued to said contractor in payment for such work, except for such
moneys as shall have actually been received by the City from the assessments for such
improvement, or such moneys as said City is by entitled Act and amendments and
supplements thereto required to pay. All proceedings had, and work done in the
making of of said improvement, assessment of propertyn collection of assessments a.nd
issuance of bonds therefor, shall be as provided for in said above entitlted Act, and
Acts amendatory thereof 'and supplemntal thereto.
BE IT FURTHER RESOLVED, That the Board of -Public Works fix the 12th.
day of December 1916. at the hour of 7:45 P.M. at the office of the Board of Public
Works, of this City, as the time and place of the public consideration of said
proposed improvement, at which said Board of Public Works will hear ahl persons in-
terested, or whose property is liable to be assessed for said improvement, and will
decide whether the benefits to the roperty liable to be assessed for said Improve -
will equal the estimated cost thereof.
Be It Further Resolved, that notice of the time and place of such
public consideration be published and mailed in the mariner provided by law. Notice
of this resolution shall be published on. the 16th. day of November 1916. and on the
23rd. day of November 1116. in the South Bend Daily Tribune.

Resolved by the Board of Public Flocks of the City of South Bend,. Indiana;.
That the following described property be appropriated for the use of said City: Beginning
on the west line of Notre Damn Avenue at a point 11.87 feet south of the southeast
corner of lot 13 in Coquillard's Second Addition; thence north westerly on a straight

Beginning at the intersection of the northerly side of the St.
Joseph River and the first alley west of St. Louis Boulevard produced south; thence
north along the first alley west of St. Louis Boulevard to a point 66 feet north of the
north lint of Jefferson Boulevard; thence east parallel to and 66 feet north of the
north line of Jefferson Boulevard to a point 400 feet east of the ,east line of Eddy$
Street ; thence south to the northerly side of the St. Joseph River; thence down stream
with the northerly and easterly side of said river and the meanderings thereof to the
place of beginning.
The purpose of such appropriation is for the opening of highway..
Notice of this resolution shall be published on the 21st. day of November
1916 and on the 28th. day of November 10,16 in the South Bend Daily Tribune._
This Board, at ita office- in the City Hall on the 19th. day of ))ecember
1916 at 7:45 P.M. will hear and receive_°remonstrances from all persons interested in or
affected by these proceedings.

As per ordar of the Board of Tuesday October 31st. ,1916. the following
roll was filed.
The City Engineer submitted the list of property owners in the matter
of the a ppr opr iat ion of certain property under Condemnation Resolution No. 24
for the opening of alley west of Michigan Street from Indiana Avenue to a point 567.81
feet south, In the City of South Bend, as per resolution on Page 569, Record 2 adopted
November 2nd.1906. which list includes the names of the owners and holders of prperty
and of interests therein sought to be taken or benefically or injuriously affected, and the
description of the several pieces of property hhieh is affected by said appropriation pro-.

Thereupon the Board proceeded to award the damages sustained and to assess
the benefits accruing to each piece of property upon said list.
It was thereupon, upon motion duly made and seconded and unanimously
adopted, resolved that said list, together with the amounts of benefits and damages and net
benefits and net damages therein get forth aj to the several parcels of land be adopted and
that the respective amount of benefits contained in said list be and are hereby assessed
aginst the several tracts of land as specifically set forth in said list, and that the
respective amounts of damages contained in the said list be and are hereby awarded to the
several tracts ,f land as. spec if ically set forth in said list, and that the mettbenef its or
net damages, as the case may be as to the respective tracts of land, contained in said list
are hereby awarded or assessed, as the case may be as to the said several tracts of land.
The Board hereby further sets off the benefits add damages each against
the other where hoth benefits and damages are assessed,,agaenst the same piece of property,
tract of land or interest, and hereby fixes said respective net benefits as the amount that
shall be paid by the respective owners as benefits, and. further hereby fixes the respective
net damage .as,to the several tracts as the amount that shall be paid to the ownerd of

Thereupon, up motion duly mAde and seconded and unanimously adopted
the 26th. day of December 1916 at 7:45 P.M. was fixed as the day on which this Board
will receive or hear remonstrances from persons with regard to the amount of their
respective awards or assessments,.and the Clcrk of this Board was instructed to
repave and cause to be duly end legally given, notifies to the owners of each
�aroel of property, showing the amount of the assessments or award, with a.
description of the property affected, a,nd the date of said hearing.
