Bids were received, opened and read for the Resurfacing of La Porte
Avenue from Washington Avenue to Linden Avenue. The same were referred to the
City Engineer for tabulation- td•be reported at 7:45 P.M. this 318t. -day of Oct.1916.
Deferred hearing had on. Trask Separation Resolution No. 2 for track sopa.rat in
of the New York Central Railroad_ Company in this City In the above matter
ttorney Hubbell and Engineer H. L. Rpinsagen appeared representing the New
ork Central Railroad Company. Attorney Chester Crumpacker representing the Grand
Trunk Railroad Company and F. I Hardy, Ngr. of the Chicago, South Bend & Northenm
Railways.: Company. The Board after due consideration -decided to defer the adoption
of said resolution until Tuesday November 14th.91916. at 10:00 A.M.
Communication received from Chicago, South Bend & Northean Indiana Fy.
Company in regard to grades for track elevation.
Attorney Moon appeared before the Board and °requested that alley between
Main Street and Michigan Street from Indiana Avenue to lot. alley south be opened
UP, The Board ordered that the assessment roll in this matter re assessed, filed
and set for hearing in accordance with new property li6t to be filed.
Contract and bond for the pipe sewer on Miner Street from Notre Dame
Avenue to North St Peter Street signed by L. H. Webster was approved by the
Board.
Contract and bond for pipe sewer on Dale Avenue from Dubail Avenue to
Indiana Avenue signed by L. H. Webster was approved by the Board,
Finanical report of the Board to October=°lst., 1.;'16. was filed with the
Beard.
Complaint about pole in way of garage at res,r of 116 South William St.
was reported on as follows by the Pole and Wire Inspector. This is a Central Union
✓ Telephone Company pole and should be resett on the property line to the north about
three feet. Also to notify company to stencil pole. The Board approved of said
report.
Complaint about pole at northeast corner of garage at rear of 315 W.
Navarre Street. The pole and wire inspector reported as follows on the same,

pole and should be removed to open the driveway to the g &ra.ge. The Board approved
of said report.

Board met in regular session At 7:45 P.M. All members present.
j Mr. F. I. Hardy, Mgr. of the Chicago, South Bend & Northean Indiana
Ry. Company met with the Board and discussed ':the number`df-feet of clearance necessary
at Chapin Street inA-,!�ded in 0 obvat fon of New York Central Tr*ck�. at that point, by their
company, also the -clearance at other streets were discussed. —
p Mr. Hardy advised
the Board that he would take thds matter np•�with his a-Gtorney and report to the Board
later.
Ur. D. C. Layton, Street Commissioner had the matter up with the Board
of p$umbers cutting into streets without permits. The Board advised that this matter
be taken ul:x with the City Engineer. .
Mayor F. W. Keller met with the Board and the natter of placing cluster
lights in the downtown business streets was discussed. The Beard decided to take
this matter up with Mr. F. A. Bryan of the Indiana & Michigan Electric Company in regard
to prices.
Petition received for vacation of alley running from Howard Street in
northwesterly direction along west side of Michigan Central Railroad right of way to
Leeper Avenue. The same wus read and referred to the City Engineer for investigation.
Concerning the improvement of the roadway of La Porte Avenue from
Washington Avenue to Linden Avenue by resurfacing with Asphalt, Asphaltic Concrete,
Bithulithic, or Brick in pursuance. to Resolution No. 475 this being the day for receiving
and opening of bids, the Board at 10:00 A.M. publicly opened, and considered all bids.
And thereupon, the Board designated Sheet Asphalt as the kind of pavement
with which said street is to be improved with and .f ixes the llth. day of November 1916
at 10:00 A.Y. as the time when petitions must be filed, and the Board hereby-con-
tin.uesthis matter until the 14th. day of November 1916, at 10:00 A.M. and all bids :were
referred to the City Engineer for tabulation and he kas reported the lowest and best bid
On the day above named the Board will either pass on petitions let said contract, or
reject all bids.-

Resolv::d by the Board of Public Works of the City of South Bend, County
Of St. Joseph, State of Indiana, That the construct ion of a local serer, intended in
and adopted only far local use by the pr operty holders whose property abuts thereon,
dnd not intended or adapted for receiving sewerage from collateral drains, be and the
same is, hereby ordered in and along Portage Court from Portage Avenue to the first
alley easterly from Portage Avenue as follows, to -wit: -
Beginning at the intersection of the center line of Portage Avenue and
Portage Court; th,nee easterly along the center line of Portage Court to the first 14
foot alley easterly from Portage Avenue with an 8 inch vitrified pipe sewer. Together
with -the •necessary manholes, inlets, conduits and house connections to the curb line
along the line of said improvement. All' as shown bn the plans and in accordance with
profiles, detail drawings and s pee if icat ions on file in the office of the Department of
Public Works of the Ciuy of South Bend, Indiana, and said sewer, with all its appurtenances
shall be constructed in accordance with 'the prof iles and specifications now on file in the
office of the Department of Public Works of said City. The cst of said improvement shall
ne apportioned against and paid by the property holders whose property abuts thereon, and
upon the City of South Bend, if the City is benefitted by said improvement, all accord-
ing to the method and manner provided for in Act of the General Assembly of the State of
Indiana, entitled,, " An Act Concerning Municipal Corporations," auproved March 6,1905.
Assessments, if deferred, are to be paid in ten equal annual installments, with interest
at the rate of Sixper cent per.�annum. A bond or bonds shall be issued to the contractor
in payment for duck work, unless the property owners pay said assessments, before said
bond or bonds are issued. Under no circumstances shall the City of South Bend be or be held
responsible for any sum or sums due from said property owner or owners for said work, or
for the collection of same, or for the payment of any bond or bonds, certificate or certiw
issued to said contractor in payment for such work, except for suc1, moneys as shall have
been actually received by the City from the assessments for such idrovement, or such moneys
as shall have been actually received by the City from the assessments for such
improvement, or such moneys as said City is by said above entitled Apt required
to pay. All proceedings had, and work done in the making of said improvement,
assessment of property, collections of assessments and issuance of bonds therefor,
shall be as provided for -in said above entitled Act. ,
Property owners signed waiver waiving all publ icat ions of resolution
and notice of bids.
This Board will r,aceivw bids for the construction of the above mentied
sewer up to 10:00 A.M. November 7th. ,1916. in accordance with waiver signed.
The Board reserves the right to reject any and all bids.

MREAS, the Board of Public Works of the City of South Bend, Indiana
did, on the 313t. day of October 1916 adopt a preliminary resolution for the improve-
ment of Portage Court from Portage Avenue to°132 feet east on Portage Court, in the
City of South Bend, Indiana, by construct ien of a sewer, Also the construction of
the necessary manholes, and inlets, water inlets conduits and resetting of all man --
holes and inlets to the proper grade. All as shown on the plans, and in accordance
with the profiles, detail drawings andspec if icat ions on file in the off ice of the
Department of Public Works.,
And Whereas, we, the undersigned, are the only persons owning
property on said street to be improved, and that we alone are affected°in any way
by said proposed improvement. That we are the sole owners of the separate parcels
of land bordering upon said street proposed to be improved.
Therefore, in consideration that said Board of Public Works proceed
to improve said street as proposed in said resolution, and for the further purpose of
saving time and exense we, the undersigned, do hereby waive all objections and
defense to any defect in said proceedings, and to any violation in procedure -for the
improvement of streets as fixed by Section 8710 of Burns Revised Stautues of 1914. We
further waive any and all objections to the fact that no advertisement for hearing
was published as required by law, and thtt no notices were sailed to the owners of
property and that no hearing was had by said Board.
> We also consent that said Board shall proceed to let the contra.et
for doing said work in the following manner: -
That they shall notify by mail re-
sponsible contractors in the City of South Bend, Indiana, of said work to be done
under said resolution, and that they shall receive bids from said contractors for
the doiaig of said work, and they shall let the contract for the doing of said work
to the lowest resDonsible bidder. :And we waive any objection to the action of said
Board in letting said contrcact-in a -form and manner other than provided by s-aid
Section 8710.
And we further consent that the cost of doing said work shall be
assessed against the different parcels of real estate owned by us as provided by
Sections 871096711,8714,8715,8716,871798718 of Burns Revised Statutes of 1914.
And we further agree that notice given us by mail shall be sufficent
notice of the hearing upon the assessment made for said improvement.
