Hastings appeared before the Board and presented plat, of Shively Addition. No. action tt�ken. Mr.. tam.-N. Bergen appeared before the Board and filed petition for -)ipe sewer on East Miner Street from Notre Dame Avenue to St. Peter Street, also -filed waiver for the same us follows:- Board ordered resolution prepared., so same could be adopted to day. . W A I V E R South Bend, Indiana October 18,1016. TO THE BOARD OF -PUBLIC WORKS SOUTH BEND INDIANA. - WHEREAS, the Board of Public Works of the City of South Bend, Indiana, aid,.on the 18th. day of October 1916 adopt a preliminary resolution for the improvement of East diner Street from North St. Peter Street to North Notre Dame Avenue,'in the City of South Bend, Indiana, by construction of a sewer, also the -construction of the necessary°manholes, and inlets, water inlets, conduits and resetting of all manholes and inlets to the proper grade, All as shown on the plant, and in accordance with the profiles, detail drawings, and specifications on file in - the off Ice of the Department of ;Public Works. And whereas, we, the undersigned, are the only persons owning property on said street to be improved, and that we alone are affected in any way by said proposed improvement. That we are the sole owners of the separate parcels of land bordering upon said street proposed to be imnrved. Therefore, in consider at ion bilat said Board of Public Works pro- ceed to improve said street as proposed in said resolution W and for the further purpose of saving time andpex ense, we, the undersigned, do hereby waive all ob- jections and defense to any defect in said proceedings, and to any violation in procedure for the improvement of streets as fixed by Section 8710 of Burns' revised Statutes of 1914. We further waive any and all objections to the fact that neadveftisement for hearing was published as required by law, and that no notices were mailed to the owners -of property and that no hearing was had by said Board. We also consent that said Board shall proceed to let the contract for doing said work in the following manner:- That they shall notify by mail responsible contractors in the City of South Ben-d, Indiana, of said work to be done under said resolution, and that they shall receive bids from said contractors for -the doing of said work, and they sall let the contract for the doing of said work to the lowest responsible bidder. And we -waive any objection to the action of said Board in letting said contract in a form and manner other than provided by said Seet'ion 8710. And we further consent that the cost of doing said work shall be assessed against the different parcels of real estate owned by us as provided by Sections 871098711,8714987159871698717 087189 of Burns' Revised Statutes of 1914. And we further agree that notices given us by mail shall be sufficient notice of the hearing upon hhe assessments made for said improvement. Resolved by the Board of Public Works of this City .of South Bend, County of St. JosepU, State of Indiana, That the construction of a local sewer, - ,intended and adapted only for local use by the property holders whose property abuts thereon, and not intended or adapted for receiving sewerage from collateral drains, be and the same is, hereby ordered in and along Miner Street from Notre Dame Avenue to St. Peter Street, as follows, to -wit: - Beginning at the intersection of tha center line of Notre Dame Avenue and Miner Street; thence west, along the center line of Miner Street to St. Peter Street with a 10 inch vitrified pipe sewer. Together with, the necessary manholes, inlets, conduits, and house connections to the curb line along the line of said -improvement. All as shown on the plane, and in accordance with the profiles, detail drawings and specifications on -file in the Office of the Department of Public Works of the City of South Bend, Indiana, and said sewer, with all its appurtenances shall be constructed in accordance w ith the prof ile. abs spec if icat ions now on f il.9 in the off ice of The Department of Public Perks of said. City. The cost of said improvement shall be apportioned against and paid by the property holders whose property abuts thereon, and upon the City of South Bend, if the City, is bene iftted by said improvement,. all according to the method and manner provided for in Act of the General. Assembly of the State of Ind iana,,. entitled " An ;3Act Concerning Municipal Corporations, " a-9proved March 6,1905 Assessments , if deferred, are to be paid in ten equal annual installments with interest at the rate of Six per cent per annum, A bond or"bonds shall be issued to the contractor in payment for such work, unleks the property owners pay said assessments before said bond or bonds are issued. under. no circumstances shall the City of South Bend be or be held responsible for any sum or sums due from said property owner or owners for said work, or for the collection of the same, or f or the payment. of any bond or bonds, cert if icate` or ° bellt'if icates, issued to 'said contractor 'f in payment for such work, except fo such moneys as shall have been actually received by the- C°ity fr cam .she assessments for such improvement, . or such moneys as said City is by said above entitled Act required to pay. All proceedings had,, and work done in the making of said improvement, assessment of property, collection of assessments and issuance of bonds therefor, shall be as provided for in -said above entitlbddAct. Notice of this resolution not published as waiver was signed on same. Ttis Board will receive bads on the same October 24th.,1916. at 10:00 A .M. as per waiver signed by property owners.
