Board net in regular. session at 10:00 A.M. Mr.A. H. Rice absent.
✓ Bids were received, opened and read for Grade, curb walk on Ninth
Street from Pleasant Street to the St. Joseh River. Same referred to the City
Engineer for -tabulation.
'The Clerk was instructed to refer the matter of moving the turn
- table of the Michigan Central Ry. Company on Cedar. St. and also the flooringr of
the viaduct over Leeper Avenue to the City Attorney for action.
Mr. Vernon C. Hastings appeared before the Board and presented a
proposed plat of the Shively estates along Ewing, Avenue and Calvert Street. No
action taken.
Clerk instructed to write to Mr. C. N. Chubb, Mgr. of the Northern
Indiana Gas & Elec. Company and state that the Board expects to pave Eddy Street
r/ and Mishawaka Avenue early in the Spring of 1917 and will insist that all under-
ground work must be done this Fall, if for any reason that they cannot do this
work this Fall to let the Board know at once.

Joseph River signed by De Pea--e & Coussens was approved by the Board.
Bond and contract for pine sewer on Tecumseh Avenue from Pokagon
Street to a point 15 feet north of the south line of lot 375 Hillcrest Addition,
signed by De Pea,,e & Coussens, was approved by the Board.
Bond and contract for sidewalk on west ide of Kemble Avenue from
/ 01:iver Street to Ewing Avenue signed by C. L. Headley and approved by the Board.

Hearing had on assessment roll and final estimate for Bituminous and Glutrin
Filled Macadam Pavement on Beeper Avenue from Howard Street to Angella Avenue., under
Improvement Resolution No. 405. In the City of South Bend, Indiana.
In the above.matter remonstrators appeared and written remonstrances were_;
.filed. Attorney V. Jon--3 of Howell Tones and Devine appeared ndpresenting property
ovr�ers on said Street and objected to defQtve conditions of curb,�.walk and pavement
on Leener Avenue from the Mfichigan Central viaduct to Angella Avenue. Mr. Adoph Mattes
appeared and remonstrated,: -about defective sidewalk also tar being on sidewalk. Attorney
G. A. Farabaugh appeared and remonstrated a,gaifttsaid improvement. The Board after due
c ons 'derat ion�decided to c ontinue_:.sa�id hear ing until Tuesday September 26th. ,1915. at
7:45 '.M. They also informed said remonstrators that they would inspect the .said
Leeper Avenue improvement before that time.
The Board ordered that Mr. D. C. Layton, Street Commissioner be notified
to repair intersection at the corner of Leeper Avenue and I?oiard Street, also to remove
dirt left on pavement on Leeper Avenue also in gutters.
H. N. Barnes, Contractor on Leeper Avenue improvement appeared and explained
about pavement.
Communications from the darter Realty Company addressed to Mr. Sam. Leeper,
was filed with the Board. Telegram from A, J. Hammond remonstrating Against assessment
f iled.
Haaring had on assessment roll and final estimate for Pipe sewer on Bowman
Street from Miami Street to East line of South East Addition, under Improvement Resolution
No. 449. In the City of South Bend, Indiana.
In the above matter remonstrators appea red but no written remonstrance
ryas filed. The Board after due consideration decided to defer said hearing until
Tuesday September 26th.91916. at 7:45 P.M. The Board informed the remonstrators
that they would inspect said street before Tuesday Set. 26th.,1916.

of assessments as shown on said rolls, and the Board further find that the assessment
rolls filed August 29th . ,1916 and the final estimate allowed August 29th. ,1�16 should be
and the same is hereby in all things ratified, confirmed and approved.
Councilman Seifert appeared before the Board_ in regard to lying a
water main on St. Peter Street end so as to relieve the the Condit ion now existing there.
The Board by unaimmous cop -sent ordered that the Pittsburgh Testing
Comoany be employed to inspect the As' phtalt work on :Michigan Street, this City. City
En6ineer instructed to notify the above mentioned company of the same.

Street from High Street to Carroll Street The same was read and referred to the City

Hearing had on Improvement Resolution No. '71 for sidewalk on
Lincoln Way West from -Fremont Street to West line of Kensington Addition, under
In -the City of South Bend, Indiana.
Upon said hearing no remonstrators appeared and no remLonstr nces
were filed. And the Beard bei" fully advised in the premises, decides that the
benefits to property liable to be assessed for said imr_rovements are equal to
the estimated cost of the same, as reorted by t'!e City Civil Engineer, and thereupon
takes final action or, said resolution as originally adopted, and the same is hereby
in all - things ratified, confirmed and aproved.
Resolved further, that notices be published on the 26th. day of
September 1916 and on the 3rd. day of October 1916, in a _ne ,lsn.aper of general
circulation in said City, stating that this.Board will receive bids for the con-
struction of said improvements up to 10:00 A.M. on the loth. day of October 1916

Resolved by the Board of Public Works of the City of South Bend, St.
St. County, State of Ind iana . That the construction of a local sewer , intnded amid adapted
only for local Rse by the property holders, whose property abuts thereon, and not intended
or adapted for receiving sewerage from collateral drains, be and the same is hereby rdered
in and along Foster Street from Howard Streetto St. Vincent Street, as follows, to -wit: -
Beginning at the intersection of the center line of Howard Street and
Foster Street; thence no-,th along the center line of Foster Street to St. Vincent Street
--ith a 10 inbh vitrified pipe sewer. Together with the necessary manholes, inlets,
conduits and 'house connections to the curb line along the line of said improvement. All as
sh�,�n on the -olans- and in accordance with the profiles, detail drawings and specifications
on file in the office of the department of Public Works of the City of South Bend, Indiana,
a:nd said sewer, with all its appurtenances shall b, constructed inaccocrdance with the

City. The cost of said improvement shall be aportioned'against and paid by the property

Gneral Assembly of the State of Indiana,, entitled " An Act Concerning Municipal Corporations,"

ments, with interest at the rate of Six er cent per annum. A bond or bonds shall be issued
to the contractor in payment for such work, unless the property owners pay said assessments
before said bond or bonds are issued. Under no ci.rcum;tances shall the City of South Bend
be or be held res ons ible for any sum or s -as due f _,om property property o7mer or owners for
said work, or for the collection of came, or for the payment ftr of any bond or bonds,
