Resolved by the Board of Public Works of the City of South Bend, County of St. Joseph, State of Indiana. That the construction of a local sewer, intended and adapted only for local use by the property holders whose property abuts thereon and not intended or adapted for receiving sewerage from collateral drains, b.e and the same is, hereby ordered in and along Dale Avenue from Indiana Avenue to Dubail Avenue, as follows, to -wit: - Beginning at the intersection of the center lin of Dubail Avenue ad Dale Avenue; thence north on the center line of Dale Avenue to a point 50 feet south of the :youth fine of.Indiana Avenue with a 10 inch vitrified pipe sewer. Together with the necessary manholes, inlets, conduits and house connections to the curb line along the line of said improvement. All as on the plans and in accordance with the profiles, detail drawings and speci- fications on file in the office of the Department f Public Works of the City of South Bend, Indiana, The cost of said improvement shall be apportioned against cnd paid by the -property holders whose property abuts thereon, and upon the City of South Bend if the City is bent efitted by said improvement, all according to the method and manner provided for in Act of the General Assembly of the State of Indiana, entitled " An Act Concerning Municipal Corporations, " approved March 6,1905. Assessments, if deferred, are to be paid in ten equal annual installments with interest at the rate oT' Six per cent per annum. A bond or bonds shall be issued to the contractor in payment for such work, unless the property owners pay said assessments before said bond or bonds are issued. Under no circumstances shall the City of South Bend be or be held responsible for any sum or sume due from said property owner or owners for said work, or for the collection of same, or for the payment of any bonds or bonds, certificate or certificates, issued to said contractor inpayment for such work, except for such moneys as shall have been actually received by the City from the assessments for such improvn_ent, or such moneys as shall%city is by said above entitled .Act rewired to pay. All proceed- ings and wok done inthe making of said improvement, assessment of property collections of assessments and issuance of bonds therefor, shall b e as provided for in said above ei-�titled Act. Notice of this resolution shall be published on the 7th. day of September 191-6. and on the 14th. day of September 1916 in the South Bend Daily Tribune. This Board will give a hearing on this resolution at its office in the City Hall on the 3rd. day of October 1916 at 7:4`5 'P.M - Adopted this 6th. day of September 1915. E. RESOLUTION OF THE BOARD OF PUBLIC WORKS NO. 473. On motion duly made and seconded, the follo,ving pret:,mble and resolutions were unanimously ad opted:- �HI, S, This Board did on the Sth. day of August 1916 deem it expedient and of ;,ublic utility to permanently improve Euclid Avenue between La Porte Avenue and Walnut Street, by paving the roadway of the same, and did on said date pass and adopt a resolution a ut h or i;z ing said permanent imrr ov e me nt , and Whereas the City Engineer has prepared and fled with this Board a report ,huffing the number and location, as well as the materidl to be used and the manner of laying the same, of the service pipes, mains, conduits , laterals and connections which are, or will be, necessary to accommodate the abutting property owners with gas, water, heat, steam or any other product for which any person, firm or corporation has been granted a frarchise for supplying the citizens of the City of South Bend, Indiana, which report is on file in the office of the Board. BE IT RESOLVED, That said report of said City Engineer be and is hereby adopted, And be it further Resolved, That it is contemplated by this Board to improve Euclid Avenue from La Porte Avenue to Walnut Street all in said City ,.of South Bend, by construction of pa vement , and that it is, and is hereby so declared, necessary for the Northern Indiana Gas and Electric Company, which has, and operates under a franchise from said City to supply gas to the citizens of said City, to provided and install mains, laterals, service pipes and connections for gas in said part of said street, of the description, location and number set forth in said re ort of said City Engineer, which mains, service pipes and connections are hereby declared necessary for the immediate use of said Company in supplying gas to the o�rners of property abutting upon said part of said street. On motion duly made, nd seconded, the folloir_g preamble and resolu- tions were unanimously edopted:-- Whereas, This Board did on the 25th. day of July 1916 deem it expedient and of public utility to permanently imrove La 'Porte Avenue between Washington Avenue and the north line of Linden Avenue, by paving the roadway of the same, and did on the said date pass and adopt a resolution authorizing said permanent improvement, and WHEREAS, The City Engineer has prepared and filed with this Board a report showing the number and location, as well as the material to be used and the manner of laying the same,: -of the service pipes, mains, conduits laterals and connection which are, or will be, necessary to accommodate the abutting property owners with gas, :eater, heat , steam or any other product for which any person, firm or corporation has been granted a, franchise for su plying`•the citizens of the City of South Bend, Indiana, which report is on file in the office of the Board of Public Works.
