Bids were received, o,oened and read for pipe sewer on Miami Street from Fox Street to Ewing Avenue, also bid received for grade, curb and walk-on Ninth St. from Pleasant St. to St. Josebh River. The same were all referred to the City Engineer f or tabulation. This being the date set fzr deferred hearing on Track Separation Res - solution No. 2 for elevation of New York Central.Ry. Company tracks in this City from Chapin Street to Michigan Street. Hearing e ont inued until Tuesday September 12th. 1916 at 10: 00 A.M. The Chicago, South Bend & North ern Indiana, Railway Company was ordered to be made parties of this rroceedings, and a c apy1-of`Resolution No. 2 w�.s ordered served today giving them a ten (10) days notice. Attorny Samuel Darker appeared for the Vandalia Railroad Company and stated that said company agree uo sever their connections with the New York Central Railroad Company, but work was to continue along, until that time. Johnson representing the Studebaker Corporation appeared before the Board and presented the following communication: Honorable Board of Public Works South Bend, Indiana. Gentlemen:- We are going to erect a building at'the northeast corner of Lafayette and South Streets. We are desirous of laying a steam pipe from our office building to said property for -heating this building and would likea permit to lay it in the alley that runs north and south between Main and Lafayette Streets. It will also be necessary for us to cross South Street between Main and Lafayette. Rankert, Pesident of the Western Construction Co. requested that the said company be givdn an extension of time of Sixty (60) days on their Contract for the pavement on Michigan Street from La Salle Avenue to South St. under Improvement Resolution No. 415. The granting. of said extension held up until 7: 45 P.M. this 29th. day of August 19105 . Clerk instructed to write a letter to Geo. Hoffman Company requesting that they appeare at the Board meeting Tuesday September 5th. ,1915. at 1000 A.M. Petition for a pipe sewer on Dale Avenue from Indiana Ave. to Dubail Ave. received and read and placed on file. The following letter, was rec&ided read and placed on file. Board of Public Works South Bend, Indiana. Gentlemen: - I am sending you under separate cover sketch showing location of gas mains services and stubs on Michigan Street between La Salle Street and South Street. We expect to have all the work done south of Jefferson Blvd, by Tuesday night of next week. We will rush the work between Jefferson Blvd. and La Salle Ave. and can assure you we will get our work done and keep out of the way of the, paving contractor. We expected to get our part of the work done long ago but have been held up by the contractor installing steam lines wid by the scarity of labor. Further in order to protect ourselves against leaks it is necessary for us to complete our work, last, Any little settlement or damage to our pipes will cause leaks which will cause trouble ifto matter how small. A gas leak will not take up like a water leak and is mush more `seriour than a steam leak. Any settlement in our mains will cause traps which gradually fill up with condemnsation and finally shut off the flow of gas. We are trying to do our work in such manner as to absolutely prevent any, trouble for a good• many years to come. Mr. Andersoh ha's been on our heels continually and we have promised him to complete our work so as not to interfere'with the paving and I can assure you we will keep our promise. Yours very truly, Manager. City Engineer reported on the condition of Leeper Avenue Pavement at corner of Howard Street in regard to A. G. Mattes momplaint about the same. And the same was read and placed on file. Engineer reported that the bump in pavement on Indiana Ave. has been repaired. Street Oemmissioner reported sidewalk defective on Walnut Street at corner of Washington Avenue and the same belongs to J. Seeberger. The Board ordered that a thirty(30) day notice be sent to repair or construct a new walk. Street Commissioner made report that walk at 502 E. La Salle Avenue is sunken down and holds water and should be mired at once. Wrr.. N. Bergan owner was ordered notified to repair or construct a sidewalk hitt',bove number within thirty (30) days. In the City of South Mend, Indiana. In the above matter a remonstrator appeared but no written remor,_strance was filed. The Board therefore find that the property assessed in said rolls filed August 15th. 1916 is benefitted in the amount of assessments as shown on said rolls, and the Board further find that the assessment roll filed August 15th. ,1916 and the final estimate allowed August 15th. ,1916 should be and the same are hereby in all things ratified, c onf firmed and a. ppr oved , Hearing on assessment roll and final estimate for Asphaltic Concrete pavement on Indiana Avenue from Kemb.le Avenue to Prairie Avenue under Ima_ r ovement Resolution No. 421. In the City of South Bend, Indiana. In the above matter no remonstrators appeared and no remonstrance was filed. The Board therefore find that the property assessed in said rolls filed August 15th. ,1916. is benefitted in the amount -of assessments as shown on said rolls, and the Board further find that the assessment roll filed August 15th.,1916. and the f ina estimate allowed August 15th. ,1916. should be and the same is hereby in all things ratified, confirmed and approved. In the City of South Bend, Indiana. In the above matter a remonstrator appaaed and remonstrated about condition of pavement, but no written remonstrance was filed. The Board deferred said hearing until Tuesday September 5th. ,1916. at 7:45 P.M. Contractor ordered to make the necessary repairs and to report the same to the Board on the above improvement. Mr. H. Harter appeared before the Board and presented a plat of Harter Heights first Addition to the City of South Bend, Ind. The Same was approved by the Board. Invoice of inspection of 38,000 sq. yds. of Asphaltic Concrete pavement on Indiana Avenue Contract with the W. B. Dear Sir : I have had a number of conferences with Mr. Daicey of the home Teleb_hnne Company since the meeting last Tuesday and it seems to me that this trouble is due to a misunderstanding all around. The facts as I recall them I believe -show.. that the Home Telephone Company acted in good faith in putting down the lead conduit which caused this controversy to arise. After the Board had had the evening meeting last summer and it was decided that all the corxaanies having wires should make arrangements to comply with the underground Ordin9.nce the directors f the Home Telephone Company had a meeting and the matter was discussed to place our wires in lead conduits and Mr. Daicey and I were to take the matter up and get the Board's approval of that method of construction. 1.1r. Daicey and I cameto a meting of the Board one morning and we brought -with us s mples of lead conduit that 7ve wanted to use and we told the Board the manner in -which we proposed t.o do work. There was no absolute refusal on the part of the Board to allow us to do the work in that way nor was permission given. As I recall that meeting we discussed whether or not this was good construction and the question came up as to what other_ engineers in the country thought of it and we agreed to take the matter up and get their opinions and submit them to the Board. We did this and submitted the letters received to the Board for their consideration. We also, discussed other phases of the Ordinance at that time and .vere going to avail ourselves of the right given under Ordinance 1044 of making application to the City Council and asking them to approve of the change L1, 238 6 Of course, under the ordinance the recommendation should have come from the Board of Public Works but you will recall your Board were not inclined to go to the City Council with this recommendation. We took the matter ue with the City attorney as to the best method to pursue, whether to ask a neTrr ordin nce or an amendment, of the -present one, We also took- the matter up with the Mayor and. he advised that we make no effort at that time to amend the ordinance and that he would take the matter up with the Board. We have been under the im ression Tb.a,t the �Iayy or had had a con- ference with your Board end you had reached an understanding. We proceed-:d f.°ith the work and a City Inspector was present while the work was being done. When we had practically completed the work of laying the lead conduit this arrest was made. The ?lorre Telephone Company has acted in good faith end has made every possible effort to com-)ly with this ordia,nanee. Before the end of this month we will have done practically sixteen thousand feet of underground this summer and with the exception of P. very few pieces we have completer complied with the ordinance. We have furnished to Mr. Beaning a blue print showing the amount of work we nave done and the amount of work we have ,yet to do. When he saw the blue print he was supprised at the amount of work we had done this summer also at the small amount of work there was yet to do. Under all the circumstances we -feel that the proceedings against the foreman in charge of the work should be dropped and wish to state at this time that we will go ahead with the work and attempt to complete what there is to do. We will Dlace our wires in the fiber or vitrified conduits as the Board requests until there has been smme;amendment or change In the ordinance on the part of the Common Council. The Board of Public W(,rks, South Bend, Indiana. Dear Sirs: - wish bo submit the following report in regard to the work' that is being done on Michigan St. Bttwe'en La; Salle Ave. and South St. T^_e'Nbrthern Indiana Ry. Co. -commenced work on the street on August 25th . and are taking up the brick in the tracks acid are getting ready to lay the new ties and steel. The Contractor for the peving has completed the constructiong of the combination curb and gutter on both sides of Michigan St. from South 8-t. to Division St. and on the east of Michigan St. from Division St. to Wayne St. He is at present working on the curb between Wgyneand Jefferson St. The Contractor stattod grading this morning, and expects to be -able to start ..the concrete work the first of next week. HOME TELE�'HOYF COMPANY The Home Telephone Company have a line of conduit on Michigan St. from La Salle Ave. to Orpheum alley. Mr. Daicey stated that this was in good condition and that all of their patrons were taken care of from the alleys. Central Union Telephone Co. The Central Union Telephone Company have a line of conduits from La Salle Avenue to center St. This line was built new last year and is in good condition. This company also takes care of its patrons from the alleys. Mr. Bonds stated that they had two lines of conduit crossing the sewer trench thp.t needed some reair and :would take care of it immediately. . Tuesdav Au;p,,ut 29th..1915. Continued. TEE INDIANA ' MICHTGN ELEC. COMANY. Messrs. Bryan amd Kennedy both assured rne about two weeks ago that all of their work or, Michigan St. was taken care of. Since that time they have discovered that some of their conduits crossing the sewer trench needed repairs, and. they are working on these at present. They have their work taken care of as far as Wayne Street and are now working between Wayne Street end Kefferson Blvd. For the location and number o services see attachd blue print. TH: ST. JOSEPH HEATT_NG CO. The mains and services of this company have been installed as shown on the accompanying blue print. THE NORTHERN INDIANA GAS AND ELECTRIC CO. This Company still has some service connectins north of Wayne St. to repair, and are working on them steadily. The accompanying blue print shows the services that have been put in and renf,ired. there there are no services shown the; have no record but will file the location of them as shun as they can be located. WATER DEPARTMENT. Mr. Toyn.e has informed me that he has a number of manholes yet to build around valves in the street. Mr. Burke will have all of the water taps in by the end of next week. There are still about ten -property owners who have not agreed to allww the Traction company to attached their span wires to their buildings. Mr. Brandon is going away and has turned the list over to Mr. Chard. I have arranged with the contractor on the curb to lave out a section where ever there is a #ole. TPEE WESTERN UNION AND GRAND TRUNK R . R . These two companies have wires crossing Michigan St. at Division St. but to date have ignored the orders: of the Board of .Public `forks to place them underground. If the Board intends to com-;,kl these companies to go underground they should put 1 their conduits ahead of the paving. TFE NO-'1HERN INDIANA RY. CO. This company operates overhead telephone lines across Michigan St. and like the two companies mentioned above have made no move to comply with the underground Ordinance. In conclusion will state tht I have notified the variouscompantes that it the desire of the Board that all of the unfinished work in the streets shall be completed b,3fore the week of the lair, and that if this is not possible, that the trenches be filled and no excavations made during that week.
