HomeMy WebLinkAbout08/22/1916 Board of Public Works Minutes (2)229 Board met in regular session at 11:00 A.M. Mr. A.H. Rice absent. Attorney W. E. Dinnen representing the South Bend Home Teltephone Co. appeared before the Board in regard to the laying of underground conduit. The Board instructed Attorney Dinenn that the South Bend Home Teleo7 one Company would have to place underground conduit according to Ordinance pertaining to same. At request of Atty. Dinenn thds matter was deferred two weeks. Board instructed Atty. Dinen to take the matter of having case set in Court for Wednesday August 23rd. 1916 up with City Attorney Seebirt tid have it postponed two weeks. Mr. Walter Muesse l appeared before the Board and requested that a, light be placed on Elwood Avenue in front of Brewery, also a water main on Elwood Avenue for Fire protection etc., The Board informed Mr. Muessel the question ,of placing a light ig®uld be investigate soon and the matter of the water -main was referred to the Water Department. Mr. R . L. Re insagen, Asst . Pr in. Engineer of the New York Central Ry. Company appeared before the Board and discussed Track separation in this City. Plat of John Prast's Sub Addition was approved by the Board. Division of Lot 13 Kunstman and Meyers President. Board met in regular session at 7:45 P.M. Mr. A. H. Rice .absent. HeArin.g had on Improvement Resolution No. 466 for Pavement on Lindsey Street from Portage Avenue to Blaine Avenue, In the City of South Bernal, Indiana. In the above matter remonstrators appeared and remonstrances was filed. The Board having said mauler under advisement find that the remonstrance filed this 22nd. day of August 1916 should be sustained and that the resolution should be and the same is hereby and in all things rescinded. Nost remonstrance was against pavement going in before a proper sewer was placed on Lindsey Street.) Hearing had on Improvement Resolution No. 463 for Resurfacing of La Porte Avenue from Washington Avenue to the north line of Lindsen Avenue, In the City of South Bend, Indiana. Upon said hearing remonstrators appeared and , a written remonstrance was filed. And the Board being fully advised in the premises, decides that the benefits to property liable to be assessed for said improvements are equal to the estimated cost of the same, as reported by the City Civil Engineer, and thereupon takes final action on said 'resolution as orginally adopted; and the same is hereby in all things ratified, c ondftrated and a ppr oved . Resolved further, that notices be published on the 24th. day of August 1916 and on the 31st . day of August 1916 in a news naner of general circulation in said City-, stating that this Board will receive bids for the construction of said improvements up to 10:00 A.M. on the 12th. day of September 1916. The Board reserves the right to regetct any and all bids. Hearing had on Improvement Resolution No. 464- for pipe sewers on Rush Milton Fellow Columbia Carroll Streets, Benton Court and St. Joseph Street from Calvert Street to St. Joseph. Street, in the City of South Bend, Indiana. Upon said hearing no remonstrators appeared and no remonstrances were filed. Upon sad hearing no remonstrators app eared and no remonstrances were f iled . And the Board be ing fully adv ised in the premises, dec ides that the bene- fits to pr opertyliable to be assessed for said improvements are equal to the estimated cost of the same, as reported by the City Civil Engineer, and thereupon takes final action on said resolution as orgihally adopted, and the same is hereby in all things ratified, c onf irmed and approved. Hearing had on Improvement Resolution No. 467 for Gravel pavement, curb and walk on Dubail Avenue from Leer Street to Marine Street, in the City of South Bend, Indiana. A remonstrator appeared and remonstrated against improvement going in this year. After due onsiderat ion the. Board defer all action until Tuesday March 1916 at 7:45 P.M. (Clerk instructed to send cards in time for hearing) �2j `3 %2' Hearing given on Vacation Resolution No. 30 for the purpose of vacating Street and alleys in the Stiover-Longley Addition, In the City of South Bend, Indiana. • In the above matter no remonstrators appreard and no :written remon- strance was filed, and the Board therefore sustain all former action taken and declare the above described property in all thingd vacated and this resolution in all things ratified, confirmed and approved. Resolved further that the City Engineer be instructed to prepare a roll showing awards of damages and assessments of benefits to all parties and properties interested in the above matter. Mr. H. J. Slot contractor on contract for cleaning and deepening Me Cartney Creek appeared before the Board and stated that there was more yards of excavation in said contract for above improvement that what he bid on. City Engineer for instructed to investigate this matter. Partial estimate allowed C. H. De Frees on lst. alley West of Lafayette Street from Colfax Avenue to La Salle Avenue Asphalt Pavisment for ....... $'736.80 Partial estimate allowed C. H. De Frees for brick pavement improvement on 1st. alley west of Michigan Street from La Salle Avenue to Madison Street°and lst. alley north of La Salle Avenue between Michigan St. and Main Street for the amount of ... ..................................................$1037.00 Clerk instructed to write to the Michigan Central Ry. Company and state that the time had now -expired for the changing of the turn table on Cedar Street as per arrangement with the Board. Alsot to notify thmmto put the viaduct in safe condition over Leeper Avenue, as since the constrpction of sidewalks under the same said openings are very dangerous. This work to be dome at once. Clerk instructed to send bill for the amount of Twenty Two ($22.00$ to Stephenson Underwear Mills for theeost of putting vacation Resolution No. 29 through for printing, advertising and miscell, neous ex)ense. City Engineer peesented to the Board,report of inspectors on Asbhaltic Concrete work on Indiana Avenue. Same read and placed on. file. Communication received from Deahl & Hammerschmidt attorneys for Mrs. Adele Bickford in regard to water taps on Michigan Street. The same was read and placed on file. Petition for pavement nn first alley west of..Michigan Street between Madison Streeu and Marion Street was received by the Board read and placed on file. Petition filed.with the Board for the opening of William Street from Colfax Avenue duo north to Michigan Avenue; also to open a street from Marion Street north to the intersection or point of intersection of Navarre Street and Portage Avenue. Same placed on file no action taken. Communication received from Dr. Charles Bosenbury, Secy. of the Health Board in regard to insanitary condition of sewer at the south end og Leeper Bridge. The same was read and placed on file. The Street Commissioner has been instructed to lower this sewer outlet. The following communication was received, read and plp-ced on file. To the Board of Public Works, of the City of South Bend , Indiana:- - As President of the Indiana Northern Railway and of the Oliver Chilled Plow Works, I respectfully remonstrate against the adoption. v of the plan now before your• honrrable body for track elevation in this eitym so far as it affects the copporat:ions above named. The plan, if carried out as indicated, will damage .our property at and near Chapin Street, will effectually cut off oureonnections with the New York Central Railroad and the Grand Trunk Railway, cause a loss generally to out business that I do not consider warranted by the necessities of the case. Bond and contract for water connections on Eddy Street , and Mishawaka Ave. from Jeffers on Blvd. to Nineteenth Street signed by Chas. M. Oberlein was a! -proved by the ' t Board. The Board ordered bids received on grade, curb and walk,on Washington Avenue from Sunnys ide Avenue to Jacob Street rejected and readvertised, also b6ds on sidewalk on west side of Kemble Avenue, Same to be advertised August 24th: 1915. and August 31st . 19105. to be received up to 10: 00 A .M. Septemb r 12th. ,1916. The Board reserves the right to reject any and all b ids . Permiss ion. was granted the Central Union -Telephone Company to build manholes and install underground conduit in various streets in the City. SIDEWALK IMPROVEi NT RESOLUTION NO. 471. Resolved by the Board of Public Works of the City of South Bend, St. Joseph County, State of Indiana, That it is deemed necessary to improve the north side of Lincoln Way West from Fremont Street tb the west line of Kensington Street as follows, to -wit:-- By constructing a cement sidewalk five (5) feet in width on the netrth side of Lincoln Way West from Fremont Street to the west lire of Kensington Addition. All as shown on the plans and in accordance with the profiles, detail drawings and specifications on file in the offdee of the Department of Public Works of the City of South Bend, Indiana, in accordance with the profile, details, drawings nd specifications on file in the office of the Department of the Board of Public Works of said City, and such improvement is now ordered. The cost of said improvement, including the cost of street ruid alley intersections, shall be assessed u-on the real estate abutting on said north side of Lincoln Way West all according to the method & d manner provided for in an Act of the General Assembly of the State of Indiana, entitled " An Act Concerning municpal Corporations," approved March 6,1905, and in accordance with and pursuant to the provisions of all amendatory and supp1bhieht&1' acts thereto,' passed by the General Assembly of the State of Indiana. Assessments, if deferred, are to be paid in ten equal annual installments with interest at the rate of Six per cent per annum. A bond or bonds shall be issued to the c ontract'or in payment of such work, unless theproperty owners pay said assessment before said Bond or bonds are issued. Under no circumstances_, shall the City of ,South Bend, be, or be held responsible for any sum or sums due from said property owner or owners for said work or for the collection of the same, or for the payment for such work, except for such moneys as shall have been actually recived by the City from the assessments for such improvement, or such moneys as said City is '-y said above entitled Act required to pay. All proceedings had, and work done in the making of said improvement, assessment of pro- perty, collection of assessments and issuance of bonds therefor, shall_ b� as n_rovided for in said above entitled Act and amendments thereto. Notice of this resolution shall be published on the 24th. day of August 1910 And on the 31st. day of August 1915 in the South Bend Daily Tribune, This Board will give a hearing on this resolution at its office in the City Hall on the 19th. day of September 1915 at 7:45 P.M.
