This being the date set for the hearing on Resolution No. 2 for Track Se aration of the New York Central Railway Company between Michigan Street and Chapin Street in this City. All companies that were notified were represented and remonstrances. were filed as follows: New York Central Ry. Company by Van Fleet Hubbell and Dinnen, their Attorneys . Grand Trunk Western Ry Company by Anders on,Parker Crabill and Crumpacker their attorneys, Vanda lia Ry. Company by Anderson, Parker Crab ill and Crumpacker, their Attorneys 4 Mr . L"`>,R.-�.Ma rt in, appeared for the Oliver Chill Plow Company and requested that a continuance be granted until J. D. Oliver was in the City, Also Mr.0 'C,Moon of the New York Central Ry. Compan�r was present at this hearing. The Board decided to deferr this hearing until Tuesday August 29th.,1916. at 10:00 A.M. &Others present at said hearing, were, E. H. Hearing given on roll showing iwards of damages and assessments of benefits th the matter of Vacation Resolution No. 29 for the vacation of four(4) feet of Ginz Avenue from Washington Avenue to Colfax Avenue, In the City of South Bend, Indiana. In the above matter no remonstrators appeared and no written remor'stra- tra.nce was filed' Th a Bord t:{:refore declare the roll filed July 25th. 1916 (benefits and damages being equal) in all things ratified, -confirmed and approved and all action under said resolution is hereby concluded. Councilman Herman H. Lang appeared before the Board and discussed ✓ e the matter of raise in salary for the Cemetery Sexton, No action taken. . The following resolution was adopted and the Clerk instructed to send a copyof same to the South Bend Home Telephone Company. RES0LUT10N. r WHEREAS, the South Bend Home Telephone Company has a line of poles and ✓ Nires on Mishawaka Avenue between Sixth Street and Nineteenth Street and whereas a contract has been let for the paving of said street providing for a combination curb and walk it is necessary that said pole line be moved from their present location. THEREFORE, Be it ordered that said pole line be moved north to thelst. alley and right of way heretofore provided between Sixth Street and Nineteenth Street and that this change be made within Sixty (60) days. Communication received from G. A. Harrop requesting that the City sub -merge the outlet of the sewer under beeper Street Bridge. The Board ordered that the Street Department should do this work. Excavation Bond for One TAousand Dollars signed by Birdsell Mfg. Company was approved bVthe Board, Grade on Wall Street approved by the Board. Bond and contract for pipe sewer on Marine Street from Indiana Avenue to Calvert Street signed by Staples & hckerman was approved by the Board. Bond and contract for clearing and deepening of McCartney Creek from La Salle Lake to 300 feet north of the center of Vassar Avenue signed by H. J. Slot was approved by the Board. Bond and contract for concrete pavement on lst. alley west of Lafayette Street from Marion Street to Navarre Street signed by Hoban & Roach was approved by the Board. Estimated cost ff Lindsey Street pavement from Portage Avenue to Blaine Avenue was filed at ................... ................$ 209500.00 Estimated cost of La Porte Avenue resurfacing pavement from00 Washington Avenue to the north line of Linden Avenue at......... v Tuesdav August 15th..1916. In the City of South Bend, Indiana. Resolved, that notices as to the amounts of assessments be published for six consecutive days in the South Bend Daily Tribune, commencing on the 21st . day of August 1916 stating that this Board will give a hearing on theamount of such assessments at its office in the City Hall on the 29th. day of August 1916. at 7:45 P.M. Resolved further, that the entire work under the above contract be accepted and approved and the final estimate thereon allowed. Notice.. of this resolution shall be publi:,hed on the 21st. day of August 1916 In the South Bend Daily Tribune, stating that this Board will give a hearing on the acceptance of such work at its office in the City Hall on the 29th. day of August 1916. at 7:45 P.M: Engineer filed assessment roll andfinal estimate for Asphai►tice Con- crete pavement on Keasey Street from Michigan Street to Carroll Street, under Improvement Resolution No. 407. in the City of South Bend, Indiana. Resolved, that nbt ices as to the amounts of assessments be published for six consecutive days in the South Bend Daily Tribne, commencing on the 21st .. day of August 1916 stating that this Board will ;give a hearing on the amount of such assessment at its office in the City Hall on the 29th day of August 1916 at 7:45 P.M. Resolved further, That the entire work under the above contract be accepted and approved and the final estimate thereon allowed . LOCAL SEWER IMPROVEMENT RESOLUTION NO. 470. Resolved by the Board of Pu blic Works of the City of South Bend, County of St. Joseph .State of Indiana, That the construction of a local sewer, intended and adapted only for local use by the property holders whose property abuts thereon, and not intended or ada ted for receiving sewerage from collateral drains, be and the same is, hereby ordered in and aing Chestnut Street from Jefferson Boulevard to the Lake Shore and Michigan Southern Railway as follows, to -wit: - Beginning at the center line of Chestnut Street and Jefferson -:Boulevard; thence south along the center line of Chestnut Street to the center of Napier Street with a 12 inch vitrified pipe sewer; thence still south along the center of Chestnut Street to the Lake Shore and Michigan Southern Railway with a 10 inch -vitrified pipe sewer. Together with the necessary manholes, inlet , conduits, and house connections to the curb line of said improvements. All as shown on the plans and in accordance with the profiles, detail drawings and specifications on file in the office of the Department of Public Works of the City of South Bend, Indiana. and said sewett, with all appurtenances shall be c ntructed in accordance with the profiles and specifications now on file in the offce of the Department of Public Works of said City. The cost of said .improvement shall be apportioned against and paid by.the property holders whose property abuts thereon, and upon the City of South Bend if the City is benefited by said improvement, all according to the method ad manner provided fbr in Act of the General Assembly .of the State of Indiana, entitled, " An Act Concerning Municipal Corpor- ations," approved March 6,1905. Assessments, if deferred are to be paid in ten equal annual installments, with interest at the rate of Six per cente per annum. A bond or bonds shall be issued to the contractor in payment for such work, unless the property owners pay said assessments before said bond or :bonds are issued. Under no circumstances shall the City of South Bend be or be held responsible for any sum or sums due from said prp- party owner or owners for said work, or for the collection of same, or for the payment of any bond. or bore=.^ , c.'•'': a_¢' :Fate or certificates, issued to said contractor 2Zts 16. Continued. in payment for such work, except for such moneys as shall have been actually received by the City from'the assessments for such improvment, or such moneys as said City is by said above entitled Act required to pay. All proceedings had, and work done in the making of said improvement, assessment of property, collec- tions of assessments and issuance of bonds therefor, shall be as provided for i" said above entitled Act. Notice of this resolution shall be publishedon the 18th. day of August 1916 and on the 25th. day of August 1916 in the South Bend Daily.Tribune. Mgr. of the Chicago, South Bend & Northern Indiana Railway Company appeared before the Board at thetrrequest. The Board ordered Mr. Hardy to re -pair all his street car tracks in the ity. Also requested to get s s Chis rails ready on Mishawaka A venue and Eddy Street. He agreed to move the iron poles from Michigan Street to Mishawaka Avenue in River Park, and to attach the span wires to the buildings in conformity to the contract signed by property owners on said street. Mr. Charles Weidler appeared before the Board in regard to a sewer The Board ordered that two 100 C. P. Incandescent light be placed on the Roquet grounds on Riverside Drive temporarily. President.
