Board met in regular session a+4 7 45.T.M.-Mr.'John B `Weber absent.
Fearing had on Improvement Resolution No. 462 for cement walk �:nd
curb on Ninth Street from Pleasant Street to the St. Joseph River, In the City
tf South Bend, Indiana.
U15on said hearing no remonstrators appeared and no remonstrances
were filed. And the Board being fully advised in the premises-, decides that the
benefits to property liable to be assessed for said improvments are equal to
the estimated cost of the same, as reported by the City Civil Engineer, and
thereupon. takes final action on said resolution as originally adopted, and the
same is hereby in all things ratified, confirmed and approved.
Resolved further, that notices be published on the 4th. day of August
1916 and or, the llth. day of August 1916 in a newspaper of general circulation
in said. City, stating that this Board will reeeive bids for the construction
of said improvements up at to 10:00 A.M. on the 22nd. day of August.1916
The Board reserves the right to reject any and all bids.
Petition for concrete pavement on Euclid Avenue from La Porte Avenue
to Walnut Street was filed with the Board. Resolution ordered prepared.
Petition filed for a trunk sewer, pavement and water on Division
Street from Olive Street to Meade Street with a lateral sewer and from Meade St.
to Chicago Street with a trunk sewer. The Board placed the same on file until
Spring 19179 at which time the same would be given consideration.
Petition for a water main on West Monroe Street from Olive Street to
Meade Street. The same was referred to the City Water Department for investiga-
tion.
Mr. E. W. Lindsey Foreman of underground work for the Central Union
Telephone Company with Mr. T. H. Beaning, Pole and Wire Inspector appeared before
the Board and discussed underground work for their company in this city.
The Board instructed the Clerk to notify the Street Commissioner
to open William Street between Colfax Avenue and La Salle Avenue.
The following resolution was approved by the Board.
R E S 0 L U T I 0 N.
v WHEREAS, there are now existing sewer connections on South Michigan
Street between Monroe Street and South Street which are not sufficient depth
to take care of the floor drainage of buildings that might be erected thereon.
BE IT RESOLVED by the Board of Public Works it is hereby ordered in
that all property owErs having such sewer connections shall have them lowered
so that their depth shall be not less than Ten (10t) feet deep from the top
of the curb.
It is further resolved by the Board. of Public Works that said work
shall be finished and completed within Ter_ (10) days.
It is further Resolved that the Board of Public Works will refuse to
grant any property ower the privilege of cutting into said pavement after the
pavement is constructed during a period of Five (5) years.
The Clerk is instructed to send a copy of this resolution to each
and every property owner who have sewer connections Ten (101) feet from the top
of the curb.

Macadam pavement on Bartlett Street from St. Joseph Street to Riverside Drive, under
Improvement Resolution No. 401. In the City of South Bend, Indiana.
Resolved , that notices as to the amounts of assessments be published

stating that this Board will give a .hearing on the amount of such assessments at its
office in the City Hall on the 29th. day of August 1916 at %: 45 P.M.

acceed and approved and the final estimate thereon Allowed. Notice of this resolution
shall be published on the 14th. day of August 1916 in the -ouch Bend Daily Tribune
stating that this Board will give a hearing on the acceptance of such work at its
off ice in the City Hall on the 29th. day of August 1916 at 7:45 P.M.

Bond and contract for pipe sewer on Orchard Street findmKendall Street

Bond and contract for pipe sewer on Donald Street from Michigan Street
to Main Street sined by L. H. Webster was approved by the Board.
Contract for water connections on Jaquith Court from Prairie Avenue
to Chapin Street signed by Thomas Williams was approved by the Board,
Bond and contract for pavement on Jaqutih Court from Prairied Avenue
to Chapin Street signed by H. N. Barnes, was approved by the Board:

Communication received from E. W. Lindsey Foreman of the Central Union
Telephone Company in regard to underground work. Same read and placed on file .
Communication from E. T. Bonds Mgr. Central Union Tel. Company in
regard to the laying of underground conduit, the same wqs read and placed on file.
Contract for cleaning and deepening of McCartney Creek from La Salle
Lake to Vassar Avenue, the same was awarded to H . J. Slot.
The Board ordered that Frank P. Nicely be botified to construct cement
t---sidewalk in front of his property on E. Madison Street in front of Paper Mills on
south side from the Race Bridge to Emerick Street, and the Clerk was instructed to
send a thirty day notice on the same.

✓ BF IT RESOLVED BY THE BOARD OF PUBLIC WORKS OF THE CITY OF SOUTH BEND,
ST. JOSEPH COUNTY, STATE OF INDIANA, that it is desired and deemed necessary to
improve Euclid Avenue from La Porte Avenue to Walnut Street as follows, to -wit: -
By grading and pattng the roadway, also grading and paving the roadway
of all intersecting and entering streets and alloys not already paved lying within
said portion of said Euclid Avenue not included in the roadway. To be improved with
Asphalt, Asphaltic Concrete, Brick or Bithulithic laid on a five (5) inch Portland
cement.concrete foundation. Or with Brick laid on a Six (6) inch rolled gravel
foundation. Placing the necessary marginal cement curb, curbing the roadway with
cement curb where same.is not already constructed. Also the construction of the
necessary storm water inlets and conduits , All as shown on the plans and in accord-
ance with the profiles, detail drawings and specifications on file in the office of
the Department of Public Works of the City of South Bend, Indiana.
The cost of the improvement, herein provided for, except street and
alley intersections, shall be paid by special assessment to be levied u:)on the
oroperty.specially'benefitted, to the amouht that the same may be legally assessed
therefor, in accordance with an Act of the General Assembly of the State of Indiana,
entitled " An Act Concerning Municipal Corporations,* a proved March 6,1005, and in
accordance with and pursuant to the provisions of all acts amendatory and supplemental
thereto.
The cost of all street and alley intersections, inc1_uding one-half of
the width of the improvement opposite street and alleys which run into, but do not --
cross said. roadway herein proposed to be improved and that portion of such street
or alley abutting upon the property belonging to said City , or upon property not
subject to such assessment, shall be paid by the City in.caeh out of its gener�l fund,
if able to do so, or from a fund created by a special assessment to be levied under
the provisions of Section 108 of the above entitled Act.
Assessments of ten dollars and more against each lot, if deferred,
are to be paid in ten equal annual installments, with interest at the rate of Six
per cent per annum. A bomd o bonds will be issued to the contractor to the amount
of such deferred assessments in pro rata payment for such improvement.
Under no circumstances shall the City of South Bend be, or be held
responsible for any sum or sums due from said property owner or owners for said work
or for the collection of the same, or for the payment of any bond, bonds, certi-
ficate or certificates, issued to said contractor in payment for such work, except for
such moneys as shall have actually been received by the City from the assessments for
such improvement, or such moneys as said City is by said entitled Act ad amendments
and supplements thereto required to pay. All pxoceedigs had, and work done in the
making of said improvement, assessment of property collection of assessments and
issuance of bonds therefor, shall be as provided for in said above entitled Act
and Acts amendatory thereof and supplemental thereto.
BE IT FURTHER RESOLVED, That the Board of Public Works fix the
5th. day of September 1916 at the hour of 7:45 P.M. at the office of the Board of
Public Works, of this City, as the time and place for the public consideration
of said proposed improvement, at which said Board of Public Works will hear all
persons interested, or wh6sh -oroperty is liable to be assessed for said improvement,
and will decide whether the benefits to the property liable to oe assessed for said
improvement will equal -the estimated cost thereof.
BE IT FURTHER RESOLVED, That notices of the time ad.dplace
of such public consideration be published and mailed in the manner provided by law,
Notice of this resolution shall be published on the loth. day of August 1916
and on the 17th. day of August 1916. in the South BendDaily Tribune.
