Bids we_r,.e received opened and read on the following improvements.
Pipe sewer on Donald Street, Pipe sewer on Marine Street, Pipe sewer
--on Orchard Street and Kendall. Avenue, also pavement on alley west of Lafayette
Street between Marion St. and Navarre St. Same referred to the City Engineer
f or tabulation.
This being the date set. for tb.� deferred hearing on Resolution for
Track Sepdration No. 1 for the elevation of: -,track;; of tide New York Central Ry. Compay
between Chapin Street and Michigan Street this City. In the above matter Attorneys
Van Fleet and Hubbell and Engineer R..C. Reinsagen appeared representing the
New York Central Ry. Company. The Board after cue consideration decided to rescind
this resolution and the City Attorney and City Engineer were requested to prepare
a new resolution making all effected parties and all Ether Railroad Companies
affected parties of -the new resolution. The Board ordered that the same be
prepared immediately and served and the hearing set for Tuesday August 15.th.,1916.
at 10:00 A.M.
Mr. E. T. Bonds, Mgr. of the Central Union Telehone Company appeared
before the Board and complained of the SuAh. Bend Home Telephone Company using
cable in the ground without the necessary conduit. The Board took the above
matter under advisement.
Mr. Thomas H. Beaning, Pole and Wire Inspector was ordered by the Board
to investigate the South Bend Home Telephone underground work, and if they were
✓ laying cable without conduit, they shoula be notified co stop work until further
orders from the Board.
Clerk instructed to write to.E. W. Lindsey, Foreman of undergroundwork
for the.Central Union Telephone Company and request that they take care of the
underground work in the underground district first as this will enable the City
to take.care of its work along with their work.
Partial estimate allowed H. L. Davis on Morris Street, grade, curb, walk
and gravel pavement 8nr the amount of................................. .$420.42
Petition for pipe sewer received on Foster Street from Howard Street to
St. Vincent Street. The same was referred to the City Engineer.
Petition received for the opening of Pokagon Street across the right
of way of the Michigan Central Ry. Company and the Southern Michigan Ry. C•ompany.

The City Engineer filed the estimated cost of cement sidewalk
1/ improvement on the west side of Kemble Avenue from Oliver Street to Ewing Avenue

The City`Engineer filed the estimated cost of the Ninth Street
cement sidewalk.and cement curb improvement from Pleasant Street to St. Joseph

points, also sewer and water on said street. The Board instructed these property
owners uo file a petition for sewer and water.

RESOLUTION NO. 2. FOR TRACK SEPARATION.
Resolved by the Board of Public Works of the City of South Bend,
Indiana: -
That it is deemed necessary that the grade crossings of the tracks
of the New York Central Railroad Company, formerly the Lake Shore & Michigan
Southern Railroad Company, a steam railroad, at the intersection of said traciks'>
with Michigan Street, Bronson Street, Main Street, Lafayette Street, Prairie Avenue,
Scott Street and Chapin Street, all in the'City of South Bend, Indiana, be altered
by elevating the said tracks at said intersections. And that the change in grade
of said several intersecting streets, and the amount in feet of the clearance at
each intersection between the surfaxe of each of such streets as proposed by such
new grade, and the bottom of the superstructure work over the same, shall be as
follows: -
1. At the intersection of Michigan Street and the tracks of said '
Railroad, the surface of said street shall be depressed six feet below the top of
the highest rail of the tracks at the intersection as .now maintained;. clearance
shall be sixteen (16) feet between t'ie surface of the street as fixed abovem and. the
bottom of the superstructure work over said street; the grade of the approach of
said street on the north shall be a uniform grade•from the south line of South
Street to the north line of the superstructure over said street, and the grade of
the approach on the south shall be an ascending grade of two and one-half (2--)
feet to each one hundred (100) feet from the south line of the superstructure.
2. At the intersection of Bronson Street and the tracks of said
Railroad, which street intersects them at the same point that Michigan Street does,
the depression and the clearance shall be the same as is provided in No. One above
for Michigan Street; the grade of the approaches of said street be an ascending
grade of three (3) feet to each one Hundred.(100) feet each way east and 'west from
the east and west lines of the superstructures over said street respectively.
3. At the intersection of Main Street and the tracks of said railroad
the surface of said street shall be depressed two and six -tenths (2.6) feet below
the top of the highest rail of the tracks at said intersection as now maintained;
clearance shall be twelve and one-half (12-2) feet between the -surface of the -street
as fixed above and the superstructure work over said street; the grade oaf the
approach of said street on 'the north shall be level from the north line of the
superstructure until its intersects the present street grade, and on the south
the -grade shall be a uniform grade from the south line of the superstructure to the
present Crade at.the north line of Bronson Street.

4. At the intersection of Lafayette Street and the tracks of said
Railroad, the surface of said street shall be depressed two and one tenth (2.1) f6et
below the top of the highest rail of the tracks at said intersection as now maintaind
clearance shall be.twelve -,nd one half(l*) feet between the surface of the streets s
as fixed above and the superstructure work over said street; the grade of the approach
of said street north from the north line of the superstructure shall be a straight
line until it interoects the present grade at the south line of South Street, and the
grade of the approach s outh fr om the s outh line of the superstructure shall be .a
straight line until it intersects the present grade at Bronson Street.
5. At the intersection of Prairie Avenue and the tracks of said
Railroad the surface of said street shall be depressed two and one half(2-2) feet
below the top of the highest rail of the tracks at said intersection as now maintained;
clearance shall be twelve and one-half (122) feet between the surface of the street as
f axed above and the superstructure work over said street; the grade of the approach
of said street on the north shall be a straight line from the north line of the. super--
strucutre until it intersects the present grade at the north line of South Street; and
the grade of the approach on the.,south shall be an ascending grade of six -tenths (.6)
of a f oot for each 100 feet from the south line of the superstructure until it inter-
sects the present grade on Prairie Avenue.
6. At the intersection of Scott Street and the tracks of said Railroad
the surface of said street shall be depressed two and twenty 41hree one hundredths
(2.23) feet below the top of the highest rail of the tracks at said intersection as
now maintained; clearance shall be twelve and one-half (12-1) feet between the surface of
the street as fixed above and the superstructztire work over said street; the grade of
the approach of said street on the north shall be level from the north line of the super-
structure until it intersects the present grade on Scott S Street, and the grade of the
approach on the south from the south line of the superstrucuture shall be a level grade
until it intersectd the present grade on Scott Street.,
%, At the intersection of Chapin Street and the tracks of said railroad
the surface of said street shall be depressed six (6) feet below the top of the highest
rail of the tracks at said intersection as now maintained; c learar�- shall be ixteen f
(16) feet between the surface of the street as fixed above); and the superstructure work
over said street; the grade of the approach of said street on the"north shall be an
ascending grade `of two and one half (2-2) feet to each one hundred (100) feet from the
north line of the superstruettt�.re until it interests the present grade, and on the south
the grade shall be an ascending grade -f .,— ! one half (21-) feet to each one hundred
(100) feet from the south line of the superstructure until ii intersects the present
grade.
S. The grade of Dunn Street, which intersects Chapin Street at a point
immediately north of the tracks of said railroad, shall be changed, and the grade from
the east line of Chapin Street shall be an ascending grade of three (3) feet to each
one hundred (100) feet until it intersects the present grade of Dunn Street.
That said improvement, shall be made and paid for according tothe
method and manner provided for in an Act of the General Assembly of Indiana of 1911,Page
314.
That said improvement will affect the tracks of other companies, whose
tracks intersect or connect with the tracks of the New York Central Railroad Company at
points where the tracks of the last named c or:!oany will be changed or elevated, and that
said other companies are named as follows; -
Grand Trunk Western Railway Company
Vandalia Railroad Company,
Indiana Northern Railway Company,
Oliver Chilled Plow Company,
Studebbker Corporation.
And it is further resolved and ordered that the 15th. day of August,
1916, at Nine (9) o'clock A.M. be fixed as the time when said Railroad Companies or other
Companies, or any of them may appear and file a remonstrance as to said proposed changes
of jrades , or amounts of clearance , at which time this Board will have a hearing upon
this Resolution and will approve change or modify hhe same.
And it is further ordered that a copy of this resolution shall be served
at least ten days before the time of said hearing, upon some resident officer or agent
of this f ollo*ing named companies:-
