Complaints received about dead poles in the 700 block W. Wayne
Street ownwd by the .S outh Bend Home Tel. Company. The same were ordered removed
as this is in the underground district.
Complaint about two Indiana & Michigan Elec. Co. poles on W. Wayne St.
which should be removed at once as same are in the underground district.

LOCAL PIPE SEWER. IMPROVEMENT RESOLUTION NO. 465.
Resolved by the Board of Public Works of the City of South Bend,
Nounty of St. Joseph, State of Indiana, That th constructio n of a- local sewer, intended
and _adapted only for local yse by the property holders whose property abuts thereon, and
not intended and adapted for receiving sewerage from collateral drains, be and the same is,
hereby ordered in and along Tecumseh Avenue from Pokagon Street to a point 15 feet north of
the s outh a line of lot 375 Hillcrest Addition as follows, towit: -�
Beginning at the Intersec-
tion of the center Pokagon Street and Tecumseh Avenue; thence northwesterly along
Tecumseh Avenue to a point 15 feet north of the south line of lot 375 in Hillcrest Addition
Together with the necessary manholes, inlets, conduits and house connections to the curb
line along the line of said improvement, All as shown on the plans and in accordance with
the profiles, detail drawings .and specifications on file in the office of the Department
of Public Works of the City of South Bend, Indiana, and said sewer,with all its appurtenances
shall be constructed in accordance with the profile and specifications now on file in the
Office of the Department of Public Works of. said City. The cost of said improvement shall
be apportioned against and paid by the property holders whose property abuts thereon, and
upon the City of South Bend if the City is benefitted by said improvement, all according
to the method and manner provided for in Act of the General Assembly of the State of Indiana
entitled (O "Ab Act Concernng Municipal Corporations," approved March 6,1905. Assessments
if deferred, are to be paid in ten equal annual installments, with Interest at the rate
of Six per cent per annum! A Bn3ffdobr bonds shall be issued to the Contractor in payment for
such work, unless the property owners pay said assessments before said Bond or bonds are
issued. Under no etreumstances shall the City of South Bend be or be held responsible
for any sum or sums due from said property owneer or owners for said work, or for the
collection of same, or for the payment of any bond or bonds, certificate or certificates

been actually received by the City from the assessments for such improvement, or such
moneys as said City is by said above entitled Act required to pay. All proceedings
had, and work done in the making of said improvement, assessment kf property
collections of assessments and issuance of bonds therefor, shall be as provided for
in said above entitled Act.
Notice of this resolution shall be published on the 28th. day of
July 1916 and on the 4th. day of August 1916 in the South Bend Daily Tribune. This
Board will give a hearing on this resolution at its office in the City Hall on the
22hd. day of August 1916 at 7:45 P.M.

Board met in regular session at 7:45 P.M. All members present.
In the matter of the deferred hearing 'on sidewalk 6mprovement on the
west side of Oakland Street from Mishawaka Avenue to Ruskin Street, under Improvement
Resolution No. 453, remonstrators appeared further written remonstrance was
filed. Attorney F. E. Lambert appeared before the Board in the interest of the
remonstrators and objected to said improvement. The Board having said matter under
advisement find that the remonstrance filed July llth. ,191e'. and July 25th. ,1916.
should be sustained and that the resolution should be and the same is hereby and in all
things rescinded. p
Hearing had on assessment roll and final estimate for pipe sewer on
Caroline Street from Southerly line of Lincoln Way East to center line of Dayton Street
Under Improvement Res oliation No. 414. In the City of South Bend, Indiana.
In the above matter a remonstrators a peared but no written remonstrance
was filed. The Board therefore find that the property assessed in said rolls filed
July 5th.,19166. is benef itted in the amount df assessments as shown on said rolls, and the
Board further find that the assessment roll filed July 5th.,1916 and the final estimate
allowed July 5th.,1916.'should be and the same are hereby in all things ratified, .confirmed
and approved.

1916 and is benefitted in the amount of assess wens as shown on said rolls , and the Board

approved.
Hearing given on Condemnation Reolution No. 44 for the purpose of appropriat
a strip of land for the opening of an alley from Corby Street to Lot 23 in Sorin s 2nd.
Addition. In the City of South Bend, Indiana.
In the above matter a remonstrator appeared but no written remonstrance
was filed. The Board after uue consideriTecided to tak-final action on said resolution
by modifying said resolution by cutting off the following described property( thence
southerly parallel to and 172 feet west of the westerly line of Notre Dame Avenue to the
south line of lot 19 in said Addition 14.56 feet; thence southerly parallel to and 186.56
feet west of the westerly line of Notre Dame Avenue to the south line of lot 20 in Sorin's
Second Addition; thence east on the south line of said lot 20, Fourteen and fifty six
hundreths !(14.56) feet to a point 172 feet west of the westerly line of Notre Dame Avenue,
(The above strip being 14.56 feet off of lot belonging to Honer and Price. Said alley
to be 14 foot straight thru. A nd the Board confirms with above modification all former
action taken -on the same.
The Board therefore declares the above property in all Vhings con—
demned and appropriated for public use, the Board now orders that a list or roll be prepared of
all the owners or holders or property and of valuable interests therein sought to be
taken or to be injuriously affected, which list or roll shall also describe the property
benefically affected.
Petitions received for light on Carroll and E. Donald Street, also one
on Roquet ground at Shetterly Park. Same read and placed on file,
The contract for printing of five hundred improvement contracts and bonds
was awareed to L. P. Hardy, for uhe amount of ..... $12.50
Communication received from the Park Commissioner extending their thanks
to the Board for the furnishing o?their office in the City Hall Same placed on file,
The Board instructed the Clerk to call up the matter of moving the
Michigan Central Turn table, on Cedar Street in a month or Tuesday August 22nd. 1916.

Petition for grade, curb walk and grgvel pavement on Dubail Avenue from
South Marine Street to Leeer Street. The same was referred to the City Engineer for
investigation.
,i Councilman Seifert with Mr. W. D. Teetp e of the Building Department
appeared before the Board in regard to the Geo. T. cutter romrany building
without a permit also in public property, located at east side of St. Peter"
Street south of Division Street, The Board ordered that this matter be
.referred to the City Attorney and the City Engineer to investigate whether this
was public property and if so to start proceedings to vacate the same.
Attorney Thos. Slick with Mr. Odell of the International Rubber Corporati
tion in regard to vacation of street and alleys in the Stover Longley Addition,
The Board ordered a resolution on the same.
VACATION RESOLUTION N0.30.1916.
Resolved by the Board of Public Works of the City of South Bend,
Indiana, That it is desirable to vacate the following Street and alleys in Stover
Longly Addition to the City of South Bend, Indiana; more specifically described as
follows: Beginning at the southwest corner of Lot 4 in Stover-Longley Addition
to South Bend, Indiana; thence east to the south east corner of lot 8 in said
Addition; thence south 14 feet to the north east corner of lot 47 in said Addition
thence south 14 feet to the north east corner of lot 47 in said Addition; thence
west to the northwest corner of lot 29 in said 'Addition; thence north 14 feet to the
place of beginning. Also beginning at the northeast corner of lot 28 in Stover-
Longley Addition to South Bend, Indiana; thence south to the southeast corner of lot
40 in said Addition; thence east 14 feet to the south west corner of lot 48 in
said Addition; thence north to the north west corner of lot 47 in said Addition;
thence west 14 feet to the place of beginning so beginning at the southwest

STREET OR ALLEY IMPROVEMENT RESOLUTION NO. 463.
Be It Resolved By the Board of Public Works of the City of South Bend, St. Joseph
County, State of Indiana, That it is desired and deemed necessary to improve La Porte
Avenue from Washington Avenue to the north line of Linden Avenue as follows, to -wit: -
By resurfacing the roadway from curb line to curb line and the roadways of
the intersecting; and entering streets and a legs, lying with in said portion of said
en PerteiAvenn.e.:,n,ot included in the toadway, with Sheet Asphalt, or Asphaltic Concrete
laid on the present brick surface, In places where the present brick surface has not
the proper cross section and grade, or where there are holes or other irregularities,
it s ba ll be brought to the or oper grade by the use of concrete. Placing the necessary
marginal cement curbm curbing the roadway with cement curb where same is not already
constructed. Also the construction of, the necessary storm water inlets and conduits.
AM as shown on the plans, and in accordance with the profiles, detail drawings and
specifications on file in the Office of the Department of Public Works of the City of
South Bend, Indiana.The cost of the improvement herein provided for , except - street";
and al -ley intersections; shall be paid by secial assessment to be levied upon the
pr oerty s pee is lly benef itted, t o the amount that the same may be legally assessed
theref or, in acc ordance with Aar Act of the General Assembly of the State of Indiana,
entitled " An Act Concerning Municipal Corporations," a proved March 6,1905, and in
accordance with and pursuant to the provisions of all acts amendatory and supplemental
thereto.
The cost of all street and alley intersections, including one-half of
the width of the improvement opposite stL°eet and a legs which run into, but do not
cross said roadway herein proposed t oo be im roved and that portion of such street
or alley abutting upon property belonging to said City , or upon property not subject
to such assessment, shall be paid by the City in cash out of its general fund, if
able to do so, or from a fund created by a special assessment to be levied under the
provisions of Seaton 108 of the above entitled Act.
,ssessments of ten dollars and more against each lot, id deferred, are
to oa paia ._ . ten equal annual installments, with interest at the rate of Six per oent
per annum. A bond or bonds will be issued to the contractor to the amount of such
deferred assessments in pro rata payment for such improvement.
Under no circumstances shall the City of South Bend be, or be held respa
responsible for any sum or sums due from said property owner or owners for said work
or f or the c ollect ion of the same, or f or the payment of any bond, bonds, certifi-
cate or cert if icates , iss ued t o sa id c ontract or in payment f or such work, except for
s uc h moneys as said City is by said entitled Act and amendments and supplements thereb
req aired to pay. All proceedings has, and work done in the making of said impr ovemen�

be as provided for in said above entitled Act, and Acts amendatory thereof and supple

Resolved by the Board of Public Works of the City of South Bend, County
of St. Joseph, State of Indiana, That the construction of a local sewer, intended
and adapted only for local use by the property holders whose property abuts there
on, and not intended or adapted for receiving sewerage from collateral drainsgi
be and the same is, hereby ordered in and along Rush Street, Milton Street,
Fe -flows - Street, Columbia Street, Carroll Street . Benton Court, and St.
Joseph Street as follows, to -wit:- Beginning at the intersection of the center of
Calvert Street and Rush Street; thenee north on the center line of Rush Street
to the center line of Milton Street with a 15 inch vitrified pipe sewer; thence
west on the center line of Milton Street to the center of Fellows Street with a
15 inch vitrified pipe sewer; thence south 35j feet with a 15 inch vitrified
pipe sewer; thence west on the center line of Milton Street to the center of
Benton Court with a 12 inch vitrified pipe sewer; thence still west along the
center line of Milton Street to the center of St. Joseph Street with a 12 ixich
vitrified pipe sewer; thence north along the center of St. Joseph Street to a
point 100 feet south of the south line of Dayton Street with a 10 inch vitrified
