Hearing had on Improvement Resolution No. 452 for pavement of first alley west of Lafayette Blvd. from Marion Street to Navarre Street, In the Ci, of South Bend, Indiana. Upon said hearing no remonstrators appeared and no written remora strance was filed. And the Board being fully advised in the premises, decides that the benefits to property liable to be assessed for said improvements are equal to the estimated cost of the same, as reported by the City Civil Engineer, and there- upon takes final action on said resolution as originally adopted, and the same is hereby in all things ratified, confirmed and approved. Resolved further, th t notices be published on the 13th. day.of July 1916) and on the 10th. dy of July 1916 in a newspaper of general circulation in said City, stating that this Board will receive -bids for the construction of said improvement up to 10:00 A.M. on the 1st. day of August 1916. The Board reserves the right to reject any and all bids. In the City of South Bend, Indiana. Upon said hearing remonstrators appeared and a written remonstrance was filed. The Board being fully. advised in the premises decides that the same should be modified as follows: Pipe sewer on Orchard Street from Scott Street to Kendall Street and on Kendall Street from 1st. alley north of Orchard Street to point 80 feet north of Dunham Street, and that the benefits to property liable to be assessed for said improvements are equal to the estimated cost of the same, as reported br the City Civil Engineer, and thereti on takes final action on said resolution as modified, and the same is hereby in all things ratified, confirmed and aproved. Resolved further, that notices bepublished on the 13th. day of July 1916 and on the 20th. day of July 1916 in a newspaper of general circulation in said. The Board reserves the right to reject any or all bids. 193 Hearing had on Reolution NO. 453 for sidewalk on west side of Oakland Street from Mishawaka Avenue to Ruskin Street, In the City of South Bnd, Indiana, Upon said hearing remonstrators a >peared and a written remonstrance was filed. The Board being fully advised in the premises, decided to continued this matter 'until Tuesday July 25th.,1916 at 7:45 P.M. Hearing given on Condemnation Resolution No. 44 for appropriating a strip of land for the opening of an alley between Notre Dame Avenue and St. Peter Street from Corby Street to Lot 23 in Sorin's 2nd. 4ddition , in the City of South Bend,Indiana. In the above matter no written remonstrance was filed, but a remonstrator -appeared. The Board after due consideration decided to defer all action on said resolution until Tuesday July 25th.,1916 at 7:45 P.M. Mr. W. G. Crab ill, attorney for the Grand Trunk Ry. Company and asked farthe Board's approval of a blue print of a railway bridge to replace old bridge at St. Louis Street in this City and the same was approved as follows: New bridge to replace old bridge and for single trackpurposes only. Solid water proof floor City Contractor H. N. Barnes ordered to put in extensions in at A lle3l Street and Portage Avenue. Petition requesting that the electric light on W. Dunham Street west of Chapin Street be moved from the present post to the 1st. post west from there. The same was ordered. - The following report was received, read and placed on file, _ To the Honorable Board of Public Works, South Bend, Indiana. Gentlemen: - In regard to the attached petition for sidewalk and curb on Wilber Street I beg to report that I have investigated the matter,and recommend that the petition be not granted as there are no signers north of the C.I.&S Tracks. The greater portion of the street lies north of the tracks and runs through un—platted territory. Respectfully submitted, Frederick J. Anderson, City Engineer. Excavation bond for the sum of One Thousand ($ 1,000.00)Dollars signed by Arthur V. Meyers as principal and Massachusetts Bonding and Insrance Company as sureties was a proved by the Board. Communication received from 'H.'A. Pershing, in regard to sidewalk on west side of Oakland Street from Mishawaka Avenue to Ruskin Street. The same was read and placed on file. Communication from the Northern Indiana Ry. Company acknowledging letter .ordering pole moved in alley just east of 1915 West Washington Avenue. The same was read and placed on file. Petition received read and placed on file for a light on Kinyon Street from Blaine Avenue to Portage Avenue. Bona and contract for asphaltic concrete pavement on 1st. alley west of Lafayette Street from Colfax Avenue to La Salle Avenue under Improvement Resolution No. 431. was approved by the Board. ( signed by C. H. De Frees) Bond and contract signed by H. N. Banes for grade, curb, walk and gravel roadway on Indiana Avenue from Prairie Avenue to Walnut Street Was approved by the Board. Pwtitions received for oiling of Lincoln Highway west from the vast line ,of Olive Street northwesterly to the trolley line crossing said street to gravel pit. The same referred to the City Attorney for a report as to what can be done. Petition for two applications of road oil on Michigan Street from Ewing Avenue to approximately 300 feet south of Dunmoyer Avenue. Same referred to City Attorney for a report. 11 Mr. F. J. Anderson City Engineer reported as follows on deed referred to him July 5th.,1916. A CONTRACT BETWEEN THE CITY OF SOUTH BEND BEND,INDIANA BY AND THROUGH ITS BOARD OF PUBLIC WORKS AND 'iHE ST. JOSEPH HEATING COMPANY. WHEREAS, on the 8th. day of November, 1915 the City of South Bend, by and through its Board of Public Works, made and entered into a certain contract and agreement with the St. Joseph Heating Company, a corporation duly orgalized under the laws of the State of Indiana, with its mains and prinicipal offices and place of business in the City of South Bend, which said contract was thereafter ratified, confirmed and approved by the Common Council of the City of -South Bend, by Ordinance duly passed numbered 1815 under the terms and conditions of which said contract, the said St. Jose h Heating Company was authorized and empowered to use and occupy a certain portion of the streets, alleys end public places of the City of South Bend, named, designated and set out in said Ordinances, AND `WHEREAS, the said -St. Joseph Heating Company desires to extend its said right, authority and grant to occupy other streets, alleys and publieptaees than those named in said contract of November 8th., 1915. . AND WHEREAS, the said City of South Bend desires to grant unto the said St. Joseph Heating Company further right, power and authority to occupy other streets, alleys rid public c laes, than those named and designated in said contract of November 8th. ,aforesaid, ana believes it to be for the best interests of the City of South Bend, and the citizens thereof, to extend said right, privileges and authority to occupy other streets, alleys and public places. SECTION b. NOW THEREFORE, in condideration of the mutual benefits to be derived by each if the parties hereto by the execution of this contract nd the construction of a steam heating system by the St. Joseph Heating Company in, along and upon the streets, alleys and public places herein designated, it is agreed that to said St. Joseph Heating Company shall be, nd is hereby authorized and empowered, and consent, permission acid authority is hereby granted by the City of South Bend to the said St. Joseph Heating Company, for and during the -oer iod of thirty (30) years from the 8th. day of November,1915 to enter into, along and upon the following streets , alleys and public places in the City of South Bend and there to construct, lay, maintain and separate pipe or pipes, fix - tures, cut-offs, m-nholes, appliances and all necesasy appurtenances for furhisning and conveying steam for heating and other purposes as the said company may elect to and for the use of its several patrons and customers situated and locatedaiong and adjacent to the streets, alleys and public places hereinafter described, and to transport, conduct and _convey steam by, and through said system for such purposes as the said Company may elect nd to furnish and provide said customers with steam for the purposes aforesaid, said streets, alleys and public places to be occupied being particularly described, as follows, to -wit:- Beginning at a point in the intersection of Michigan Street and Washington Avenue, here the line of said St.JHseph Heating Company ends, so that connection may be made with said line to extend the same south upon Michigan Street; and runni ng thence south on Michigan Street to the point of intersection of the alley running east and west, between Jefferson Street and Wayne Street, which said alley -s near hhe center of said block. Beginning also at uhe intersection of Michigan Street and Colfax Avenue and extending north on Michigan Street to the center of La Salle Avenue. Beginning also at the intersection of Main Street and Washington Avenue and running east on Washington Avenue to the intersection of Michigan Street and Washington Avenue. Beginning also at the intersection of Michigan Street and the alley run - ning east and west between Jefferson Street and Wayne Street, and extending south on Michigan Street one hundred and twenty five (125) feet south of the intersection of Wayne and Michigan Streets. Beginning also At the intersection of Washington Avenue and Main Street thence running south on Main Street to Jefferson Boulevard thence running west on Jefferson Boulevard to the intersection of the alley running north and south betwee n Main Streets and Lafayette Street, thence running north on said a -ley to Washington Avenue, all of said rights at said intersection points hereby granted, being so extended that connection may be made by the pipes of said Company. SECTION 11. That all of uhe terms and ,orditions convenants and agree- ments set out in certain contract executed between the parties hereto on this 8th. day of November 1915, shall be inluded in this contract and shall apply thereto the same as though expressly written, and this contract shall be considered and constitute a part of said con- tract of uhe 8th. day of November,1915. .f IN WITNESS WHEREOF, the said City of South Bend has caused its name to be signed hereto, by the members of the Beard of Public Works of said City as such Board, and the St. Joseph Heating Company has caused its name to be signed and affixed hereto by its president and secretary duly authorized s'o to do, and has affixed the seal of said corporation hereto this 12th. day of June 1916. Resolved by he Board of Public Works of the City of South Bend, St. Joseph Nounty, State of Indiana, that it is desired and deemed necessary to improve Ninth Street from Pleasant Street to the St. Joseph River as follows, to -wit:- By constructing cement walk and cement curb on both sides of said Ninth Street from Pleasant Street to the St. Joseph River. all as shown on the plans and in accordance with the profiles, detail drawings and specifications on file in the Office of the Department of Public Works of the City of South Bend, Indiana, The cost of said improvement, inluding the cost of street and alley inter- sections , shall be assessed upon the real estate abutting on said Ninth Street all according to the method and manner provided for in an Act of the General Assembly of the State of Indiana, entitled AAn Act Concerning Municipal Corporations a proved March 6,19059, and in accordance with and pursuant to the.provisions of all amendatory and supplemental acts thereto, pasxed by the General Assembly of the State of Indiana. Assessments, if deferred, are to be paid in ten equal annual installements, with interests at the rate of Six per cent per annum. A Bond or bonds shall be issued to the contrator in payment of such work, unless the property o�Tners pay said assessment before said bond or bomds are issued Under no circumstances shall the City of South Bend, be, or be held, responsible for any sum or sums due from said property owner or ownera for said work or for the collection of the same, or for the payment of any bond bonds, certificate or certificates, issued to said contractor in payment for such work , except for such moenys as shall gave been actually received by the City from the assess- ments for suchimprovemnts orsuch moneys as said City is by said above entitled Act required to pay.
