All new business tkken up at .this meeting as July 4th.., legal holiday
fell on Tuesday regular Board meeting day.
Hearing given on Vacation Resolution No. 29 for the purpose of vacating
the following described property to-wtt:- Vacation of 4 ft. of Ginz Avenue from Washln-gten
Averue to Colfax Avenue, In the City of South Bend, Indiana.
In the above matter a remonstrator appeared and a wtitten remonstrance
was filed. The Board after due consideration decided ,to defer all -actin n on said
resolution until Wednesday July 12th.11916 at 10:00 A.M.
In regard to complaint aP out pole in alley at rear of '1815 W. Washington
Avenue, the pole and wire inspector made the following report, and the same was approved
by t, he Boa rd.
Indiana, & Mi-ehi gan Elea. Co. pole No. 3640 and Nhicago, South Bdnd &
Northern Indiana Ry. Company pole. Remove this pole as it is in the driveway. Move, pole to
west about 5feet inside' of new curb.
Petition- for vacation of Victoria Street from the right of way of the
Vandalia R. R. Co. to the first alley west of Lafayette Street, also parts of alleys
was filed and read and.the Board referred the same to the City Civil Engineer for investi-
gation and a report.
Mr. Hubbell Attorney for the New York Central Ry. Company and engineers
for the same appeared before the Board and discussed trakk elevation in this City.
The Board agreed to meet with these representatives of the New York Central at 9:30 A.M.
Thursday July 6th.,1916 in the office of the Board.

Indiana Avenue from Kemble Avenue to Prairie Avenue under Improvement Resolution No 420.
In the City of South Bend, Indiana.
Resolved, that notices as to the amounts of assessments as required by
statute be published on the Sth. day of July 1916 and on the l5th. day of July 1916 in the
South Bend Daily Tribune, stating that this Board will give a hearing on the amount of
such assessments at its office in the City Hall on the 25th-. day of July 1916 at 7:45 P.M.
Resolved further , that the entire work under the above contracts be accepted
and approved and the final estimated thereon allowed. Notice of this resolution shall be
published on the Sth. day of July 1916 and on the 15th. day of July 1916 in the South Bend
Daily Tribune, stating that this Board will give ahearing on the acceptance of such work at
its office in the City Hall on the 25th. day of July 1916 at 7:45 P.M.

Street from Lincoln Way East to Dayton Street, under Improvement Resolution No. 414.
In the City of South Bend, Indiana.
Resolved, that n6bices as to the amounts of assessments as required by

in the South Bend Daily Tribune, Stating that this Board will give a hearing on the
amount of such assessments at its office in the City Hall on the 25th. day of July

Concerning the improvement of the roadway. of 1st. alley west of
La-fayette Street from Colfax Avenue to La Salle Avenue in pursuance to Resolution No
431.th.e Board finds that no petition has been filed with said Board by a majority
in number of the freeholders residing on said street to be improved requesting that
it be improved with a different kind of pavement than the kind heretofore adopted
by the Board in its preliminary order; and the City Engineer reports that C. H.
De Frees is the lowest and best bidder for the kind of pavement heretofore adopted by
the Board, and the Board find that said C. H. De gees is the lowest and best bidder
and hereby lets thde egntract f r said improvement t hhijn and ordgrs that aid
dmproveme t be made with Asphaltic Concrete Tr n daod La �) and a proceedings heretofe
had in this natter are hereby confirmed and ratified.

SIDEWALK IMPROVEUENT RESOLUTION NO. 461.
Resolved by the Beard of Public Work - of the sty of South -Bend, St.
Joseph County, State of Indiana, That it is deemed necessary: to improve Washington
'Avenue from Sunnyside Avenue to Jacob Street as follows, t-o-wit:
By constructing cement
curb and cement sidewalk on both ides of said Washington Avenue from Sunayside Ave.
to Jacob Street. All as shorn on the plans and in accordance wit the profiles, detail
drawingg and specifications on file in the office of the' Department of Public Works,
of the City of South Bend, Indiana, in accordance with the profile, details, drawings
and 'specifications on file in the office of the Department of the Board of Public W
Works of said City, and such improvement is now ordered.
The cost of said improvement, including the cost of street and alley
intersections, shall be assessed upon the real estate abutting on said Washington.
Avenue all according to the method and manner provided for in an Act of the General
Assembly of the State of Indiana, entitled "An Act Concerning Municipal Corp-- rations,"
approved March 6,1905, and in accordance wit and pursuant to the .provisions of all
amendatory and supplemental acts theretot pa sed by the General Assembly of the State
of Indiana. Assessments, if defered, F-re to be padd in ten equal annual installments
with interest at the rate of Six per cents per arum. A bond or bo ds shall be issued
to the contractor in payment .of such work, unle s the property owners pay said assess—
ments before said bond or bonds &re .issued. Under no circumstances shall the City of
South Bend be, or be held responsible For any sum or sums due from said property
owner or owners for said work or for the collection of the same, or for the payment
of any bond, bonds, certificate or certificates, issued to said contractor in payment
for such work, except for such moneys as shall have been actually received by the City
from the assessments for such improvement, or such moneys as said City is by said
above entitled Act required to pay. All proceedings had, and work done in the making
