Stull appeared before the Board in regard to the paving of ..SttLil Street from Michigan Street to Franklin Street. The Board informed Mrs. Stull that a sewer would have to be installed in a part of this street before pavement could be put in. Petition for a''water main on Lincoln flay 'hest novth on Olive Street to Elwood Avenue was received by the Board and referred to the Water Works departnent. Cont racto y s bond for the sun of One Thousand Dollars ($1,000.00)Dollars was approved by the Board and signed by Geo. W. Bennett The following partial estimated wAs appoved. To the Hon. Grade approved on Jaquith Court from Chpoin Street to .Prairie Avenue$ also the ist. alley west of Lafayette Street from. ftvarre Street to Madison St. Concerning the improvement of the roadway of lst. alley west of Michigan Street from La Salle,Avenue to 'Kgdison Street also lste alley north of La Salle Avenue from Michigan Street to Maid Street in pursuance to resolution No. 440.the Board finds that no petitions has been filed with said Board by a majority in.number of the free - .holders residing on said street to be improved requesting that it be .improved with a different kind of pavement than the kind heretofore adopted by the Board in its pre- liminary order and the City Engineer reports that C. H. De Frees is the lowest and best bidder and hereby lets the contract for skid improvement to him, end orders that said improvement be made with Veedersburg Poston Block and all proceedings here- tofore had in this matter are hereby, confirmed and ratified. Locker in regard to notice seat them about sand on the sidewalk on Frances Street, in which theybrequest the City to clean off this sand and charge it t o , them. The Board has ordered that notices of such awards of dams:ges and assess- ments of benefits be served according to law, and that a hearing be given on same P.M on August lat. , '1916. at 7: 45 at the office of the Board in the City Hall for the purpose of hearing or receiving objections of any .person or persons .interested .in said matter. President. 16. Board met in _regular session at 7:45 P.M. All members present. Attorney Romig and Jas. A. Judie appeared before the Board and presented plat of Springbrook acres , after some discussion the same was approved by the Board.. Deferred hearing had on sidewalk and garb on south side of Calvert Street from Chapin Street to Franklin Street, under Improvement' Res 0llation No. 443. In the City of South Bend, Indiana. In the above matter Attoxmey Shively and Mr. Fulk appeared representing the Shively interests and objected to the putting in of t-rds sidewalk and curb, but no further written remonstrance was riled. The Board after due considerate on decided to defer same hearing; until Tuesday A, -gust ist.,1916. at 7:45 P.M. Property owners from Chapin Street appearedbefore the Board in regard to having Chapin Street widened .on the east side from Sherrill Street to Ewing Avenue. Hr. D. M. Shively agreed to dedicate the land for the widening of said street if property owners would agreed to drop the improvement resolution for sidewalk and curb on south side of Calvert Street. The saute was agreeable with property owners on Chapin Street°, and Mr. D. M. Shively agreed to bring deeds „in of `dedication of land for such widening :within a month from t his date. Petition received for a sidewalk and curb on Wilber Street from Lincoln Way West to Elwood Avenue. The same was referred to the City Engineer for investigation. The Board ordered that a resolution be prepared on petition for sidewalk and curb on -Ninth Street from Pleasant Street to the River. In regard to the paving of Jaquith Court from Chapin Street to Prairie Avenue the Board ordered that the bids received June 13th.91916. should be and are hereby ,rescinded, and the Clerk was instructed to advertise. for bids as follows.: Resolved that notices be published on the 28th. day of Jun 1910 and July 5th.3,1916. in .a newspaper pf general circulation in said City, stating that this Board will receive bids for the construction of said improvements up to 10:00 A.M. on the 18th. day of July 1916: The Board reserves the right to reject any .and all bids. In the City of South Bend, Indiana. Resolved, that notices as' to the amou ts' of assessments be published for six consecative days in the South Bend Daily Tribune, contending on the loth. day of July 1916 stating that this Board will give a hearing on the amount of such assessments at its office in the City Hall on the 18th. day of July 1916 at 7:45 P.M. Resolved further that the entire work under the above contract be accepted and approved and the final estimate4 thereola alloyed. Notice of this resolution shall be published on the loth. day of July 1916 in the South Bend Daily Tribume, stating that t is Board will give a hearing. ^n the acceptance of such work at its office in the City Mall on the 18th. day of July `-1916 at 7:45 P.M - Contract and bold for the construction Bf a pipe sewer on Bowman Street from High Street to Miami Street, under Improvement Resolution No. 437 signed by Staples and Ackerman and approved by the Board. Contrast for the construction of curb walk and grading and gravel pavement on Morris Street from Prairie Avenue to Ewing Avenue was awarded to H. L. Davis, for the sum of 1,534.05. Permission was granted to the Central Union Telephone Company to place poles at various places in River Park streets also streets in the south part of the city. J SIDEWALK MUPROMEST RESOLUTION N0. 460. Resolved by the Board of Public Works of the City of South Bend, St. Joseph County, State of Indiana, That it is deemed necessary to improve the west side of Kemble Avenue fran Oliver Street to Ewing Avenue as follows, to -wit: - By constructing a cement sidewalk fiv a (5) feet in width on the west side of said Kemble Avenue from Oliver Street to Ewing Avenue. All as sHow.n on the pland and'in accordance -with th the profiles, detail drawings and specifications on file in the office of the Depart- ment of Public Works of the City of South Bead, Indiana in accordance with the profile, details, drawings and specifications on file in the office of the Department of the Board of Public Works of said City and such improvement is now ordered. The cost of said i mprovement, including the cost of street and alley inter- sections, shall be assessed upon the real estate abutting on said west side of Kerible Avenue all according to the method and manner provided for in are Act of the General Assembly of the State of Indiana, entitled, " An Act Concerning Municipal Corporations, approved March 6,1905, and in accordance with and pursuant to the provisions of all amendato W and supplemental acts thereto, passed by the general assmbly of the State of Indiana. Assessments, if deferred, are to be paid in ten equal annual instaalments, with interest at the rate of Six per cent per antrum. A bond or bonds -shall be issued t the contractor In payment of such work, unless the pretty owners pay said assessment before said bond or bonds are issued. Under no circumstances shall the City of South Bead, be, or be held responsible for any sum or sums, due from said property owner or o e rs for said work, or for the c olle et ion of the same, or for the payment of any bond, bonds, certificate or certificates, issued to said contractor in payment for such work, ex cept fornsuch moseys as shall have been actually received by the City from the assessments for' such improvement, or such moneys as , said City is by said above entitled Act required to pay. All proceedings had, and work done in the making of said improvement, assessment of property, collection of assessments and issuance of bonds therefor, shall be sg provided for in said above entitled Act and amend- ments theretoo- Not ice of this resolution shall be published on the Sth, day of ffuly 1916 and on the 15th. day of July 1916 in the South Bend Deily Tribune.
