Street from Jefferson Blvd. to Mishawaka Avenue and Mishawaka Avenue from . Eddy Street to center of Nineteenth Street, under Improvemnt Resolution Nov 417 received up to 10:00 A.M. Saturday June 3rd. 19169 and the Board finds that no petitions for another kind of material for pavement other than the kind designated by the Board in the preliminary order made May 23rd. 1916 was filed. In regard to the awc_rding of the contra ct for the pavemer t of the above mentioned street the Board after due consideration decided to defer the making; of said final award until *T45 P.M. this 6th. day of June 1916, Mrs. :Kroll appeared before the Beard in regard to the location of a sewer tap on Sample Street in front of her praperty. Upon said hearing no remonstrators appeared rand no remonstrances were Piled. And the Board being fully advised in the premises, de c des that the benefits to property liable to be assessed for said improvements are equal to the estimated cost of the sane, as reported by the City Civil Engineer, and the reuphn takes final action on said resolution us originally adopted, and the same is hereby in all things ratfied, confirmed and approved. Resolved further, that notices be published on the 9th. day of June 1916 and on the 16th. day of June 1916 in a newspaper of general circulation in said City, stating that this Board will receive bids for the construction of said improvements, up to 10:00 A.M. on the 27th. day of June 1916. Heating Company, a corporation, as principal, and Massachusetts Bonding and insurance Company, a cor- portion established under the laws of the Commonwealth of Massachusetts and having its principal office in Boston the said Common Wealth as surety, are held and bound to the City of South Bend, Indiana, in the sum of FIVE TITOUSAIND ($5,000.00)Dollars, for the payment of which, well and truly to be made, we jointly and severally bind our- selves by these presents. The condition of the above obligation is such t tlat, whereas, on the ei gth day of Novembe r,1915, the City of South •Bend, India a. by its Board of Public Works,, entered into a contract with }.he said St. Joseph Heating Company, which con- tract was ratified December 13th., 1915 by Ordinance No. 1815 , duly adopted by the Common Council of said City, by the terms of which contract certain rights and privelege were granted to said St. Joseph Heating Company, to construct, lay, operate, and maintain a heating system in the City of South Bend, Indiana. That said contract and Ordinance is hereby referred to and made a part of tads agreement as effectu dlly as is copied herein in full; and, whereas, the said St. Joseph Heating Company is about to commence the construction of said system, THEREFORE, If the said St. Joseph Heating Company shall faithfully comply with said contract as above referred to, and fulfill all the conditions and stipulations therein contained, according to the true intent and makinFT thereof in all respects; then this obligation shall be void; otherwise to remein in -full force and v!rtue in law. And in the event that the said city shall in any way corsent to the alteration of said contract in any respect, such alteration shall not in any way operate to release the surety on tnis bond. Bond and contract for the paving of Indiana Avenue from Kemble Avenue to Prairie Avenue with Asphaltic Concrete signed by W . B. Brady Construction Company as principal and The Aetna Accident & Liability Company as sureties wes approved by the Board. A venue ,. this pole'should be removed to the east about six foot or more, &nd the Indiana and Mich. Elea. Brady Construction Company with Trinidad Lake Sheet Asphalt, and the following resolution was signed, by Mr. Rice and Mr. Weber. Mr. E. M. miorrts, declining to sign the same. Brady Construction Company is the lowest and best bidder for the kind of pavement heretofore adopted by the Board, and the Board find that said W. B. Brady Construction Vo. is the lowest and best bidder and hereby lets the contract for said improvement to him,) and orders that said impmvement be made with Trinidad- Lake Sheet Asphalt and all proceedings heretofore had in this matter are hereby confirmed and ratified.
