Rice absent first half -of session Bids were received, opened and read fIr sidewalk, curb grading and gravel pavement on Logan Street from Leland Avenue to Scott Streets Bids were received opened and reach for grade, curb and walk on svth side of Ewing Avenue from Michigan Street to Carrolll Street, All referred to the. -City Civil Engineer for tabulation to be reported back May 23rd.,1.916 at 7:45 P.M. Concerning the improvement of they roadway of Eddy Street -from Je :ferson Blvd. to Mishawaka Avenue and Mishawaka Avenue from Eddy Street to bente.r :of Nineteenth Street with Asphalt, Asphaltic Concrete, Bithulithic, or brick in pursuance to Resoution No. 417, this being the day set for making the preliminary award desi,�;nating kind of pavement, the Board at 10:00 A.M. Tuesday May 16th,,1916 publicly opened read and considered all bids, and then continued their meeting to May 17th.91916 at 10:00 A.M. and then continued their meeting until May 23rd.1916 at 10:00 A.M, .Now on last named date the Board des ignated ' Sheet Asphalt as the kind with which said street is to be improved and fixes the 3rd. day of June 1916 at 10:00 A.M. as the time %ten petitions for changing the kind of pavement must be filed, and the Board hereby coninues this matter until the 3rd. day of June 1916 at 10:00 A.Y. The same was ordered referred to the City Enginer for a resolution . Contract for grading and gravel pavement on Pokgaon Street from Tecumseh Avenue to Michigan Central Ry. Company right of war awarded to H. L.. Davis: Bids were received opened and read for furnishings of the Park Board office and Bld.;. Department. The same were ordered tabulated and to be taken up Wednesday May Alth,1,1916. at 10:00 A.M. Communication received .;.'ror, the Clerk of the Board of Safety with Letter from Chief- Kerr attached, in regard to repa`.rs for the Leeper Park Boat House. The same was referred to the City Civil Engineer for investigation to be reported on at next Tuesday Or Wednesday morning at 10:00 A.M. May 30th. or 31st.19164 Certificate that Bond of Lut--er and Mcgrath of South Bend, Ind"-&na for One Thousand Dollars is continued, signed by the United States Fidelity & Guaranty Co. as surety, was riled by the Boara. Coaicerning the improvement of tPe roadway of Indiana Avenue fro: Prairie Avenue to Kemble Avenue in pursuance to re ti olut ion No. the Board find3 that no petition has been filed with said Board by a majority in nu;rber of the freeholders residing on said street to be improved requesting that it be improved with a different kind of pave- ment. +.1.qr t!ie kind heretofore adopted by the Bos.rd in its preliminary order; and the City,Engineer reports that W. B. Brady Const. Company is the lowest and best bidder for the kind of pavement heretofore adopted by the Board, and the Board find t:.hat said W. B. Brady Construction Company is the lowest ai.? best bidder and hereby lets the contract for said improvement to them, and orders that said improvement be made with Trinidad Lake Asphaltic Concrete and all proceedings heretofore had in this matter are hereby confirmed and ratified. Be it Resolved by the Board of Public Works of the Citc,,, of South B nd, St. Joseph County, .State of Indana, that it is desiree and deemed necessary to improve the First alley west of Main Street from Monroe" Street to South Street as follows, to -wit: - By grading and paving the roadway, also by grading and paving the roadways of all intersecting and entering streets and alleys lying within the property lines of sc.id alley west of Fain Street not in- cluded in the roadway; by paving said roadways with either asphalt, asphaltic concrete, Bitulithic, or brick laid on a five (5) inch port land cement concrete foundation, or with Brick laid on a six (6) inch rolled gravel foundation, or by the constructing a portland cement concrete pavement seven (7) inches in Beth; by= placing the necessary marginal cement curb; by placing all manholes and inlets to the propert grade; and the construction of the necessary storm water inlets and conduits; all as shown on the plans and in accordance with the profiles, detail drawings and specifications an file in the office . of the Department of Public 'forks of the City of South Bend, Indiana. A The cost of the improvment herein provided for, except street and alley intr- sectionso shall be paid by special assessment to be lev=.ed upon, the property specially benefitted, to the amount that the same may be legally assessed therefor, in accordance with An Act of the Genera:_ Assembly of the State of Indiana, entitled " An Act Concerning Muni- cipal Corporations, " approved March 63,1905p and in accordance with and °pursuan-la to the provisions of all sots amendatory and � suppleme{ tal thereto. The cost of all street and alley intersections, including one-half of the width of the improvement opposite street and- alleys which run into, but do not cross F so id roadway herein proposed to be improved nd that portion of such street or alley abutting upon patpgerty belonging to said city, or upon prop,- rty not subject to such assessment, shall be paid by the City in cash out of its general funds if able to do so, or from a fund created by a special asse sment to be levied under the provisions of Section 108 of the above entitled Act. Asse sments of ten dollars and more against each lot, if deferred, are to be paid in ten equal annual installments, with interest at the rate of Six per cent per annum. A bond or bonds °111 be issued to. the contractor to the amount of such deferred assessments in pro rata payment for such improvement. Under no circumstances shall the City of South Bend be, or be held responsible for any sum or rims due from said property owner or owners for said work, or for the collection of the same, or for the payment of any bond, bonds, certificate or certificates, issuedto said contractor in payment for such works except for such moneys as shall have actually been received bybthe City from the assessments for such improvement, or such moneys as said City is by said entitled Act and amendments and supplements thereto required to pay.
