Fetition for pipe sewer on Bowman Street from Miami street to Marine Street received and referred to the City Civil Engineer'for investigation. Boad and contract for pipe sewer on Indiana Avenue from Prairie Avenue to Kemble Avenue under Improvement Resolution No. 420. sigi-led by L. H. Webster was approved by the Board. In regard to complaint about pole in way of entrance to residence at 1305 Leepe r Avenue, the South Bend Home Tel. ComparW is ordered to move the pole tO the north about 30 'Peet and place it inside of the curb. Permission granted the American Telephne and Telegraph Company to replace pole number (43) with a five foot taller pole to get above the trees and to replace pole number (45) with.a 55 ft. pole and move same 16 feet north on east side of Leeper Avenue. Concerning the improvement of the ^oadway of Keasey Street from Michigan Street to Carroll Street in pursuance to resolution No. 407 the Board finds tilat no petition has be filed with said Board by a,m majority in number of the fr«-eholders residing on said street to be improved requesting that it be improved with a differeNt kind of pavement then the kind heretofore adopted by the Board in its preliminary order; and the City Engineer reports that W. B. Brady Construction Co. is the lowest and best bidder for the kind of pavement heretofore adopted by the Board, and the Board find that said W. B. Brady Construction Co. is the lowest and best bidder and hereby lets'the constract for said improvement to him, and orders that sAid improvement be made with Trinidad Lake Asphaltic Concrete f-nd all proceedings heretofore had in this matter are hereby conr-irmed and ratified. Be It Resolved by the Board of Public Works of the Cityirf South Bend, -St. Joseph County, State of Indians,, that it is desired and deemed necessary to improve Donald Street from MiclAgan Street to Main Street as follows, to -wit: - By grading said street from property Nine to property line, by paving; the roadway fron curb line to curt line with gravel three (3) inches in. depth; by curbing the roQ.dway with cement curb and by constructing a cement sidewalk five (5) Peet wide on both sides of said street. All as shown on the plans and in accordance with the prdfiles., detail drawinj: s and speci- 'ications on file in the 0-�fice of the Department of Public Works of. the City of South Bend, Tndiana, The cost of the improvement herein provided for except street and alley inter- sections, shall be paid by ppeeial assessment to be levied upon the property specially benefitted, to the amount that the sane may be legally assessed therefor, in accord- ance with an Act of the General Assembly of the State of-1ndia:na, entitled " An Act Concerning Municipal Corporations," approved March 6,1905, and in accordance witi! and pursuant to the proisions of all acts amendatory and suppleme�al thereto. The cost of all street and alley intersections, including one-half of.the width of the imprrovement. opposite street and alleys which run into , but do not crozs said roadway herei n purposed to be improved and that portio n of suca street or alley abutting upon property belonging to said City, or upon property: not subject to such assessment, shall be paid by the City in cash out of its general fund, if able to do soy or froms a fund, created by €: special assessment to be levied under the provi- sions of Section 1.05 of the above entitled Act. Assessments of ten dollars and more against each lot, if deferred, are to be paid in ten equal annual installments, with interest at the rate of Six per cent per annum. A bond or bonds will be issued to the contractor to the amount. of such deferred assessments in pro rates payment for sue. improvement. Resolved by the Board of Public Works of the City of South Bend, Indiana: -- That it is deemed necessary that the grade crossings of the tracks of the New York Central Railroad Company, formerly the Lake Shore & Mi chigan Southern Railroad Company, a steam railroad, at the intersection of said tracks with Michigan Street, Bronson Street, Main Street, Lafayette Street, Prairie Avenue, Scott Street and Chapin Street, all in the City of South Bend, Indiana,, be altered by elevating the said tracks at said. inter- sections. And that the change in ;. rade of said several intersecting streets, and the amounts in feet oL' the clearance at each intersection between tie surface of each of such streets as proposed by such new grade, and the bottom of Vue superstructure work over the same, shall be as follovg'- 1. At the intersection of Michigan Street and the tracks of said Railroad the, surface of said street shall be . depressed five fleet below the top of .the Highest rail of tine tracks at the intersection as now raintained; clearance shall be sixteen (16) feet be- tween the surface of the street as fixed above, and the bottom of the superstructure work over said street; the grade of the approoch of s id street on the north shall 'be uniform trade from the south line of South Street to the north line of the superstructure over said street, and the grade of the approach on the south shall be ascendUng grade of two and one- half (2--1/2) feet to each one hundred (100) feet frcan the south line of the superstructure. 2. At the intersection of Bronson Street and the tracks of said Railroad which street intersects them at the same point that MicjUgan Street does, the depression and the clearance shall be the same a.sis provided in No. One above for Michigan Street: the grade of the approaches of said street shall be an ascending grade of three (3) feet to each one hundred (100) feet each'way east and west from the east and west line of the super-i structure over said street respectively. 3. At the intersection of Main Street and the tracks of said Railroad the surface of said street snail be depressed one and six -tenths (1.6) feet below the top oQ the highest rail of the tracks at said intersection as now maintained: clearance shall be twelve L nd one-half (12-1/2) feet between the surface of the street .a.s fixed above and the superstructure work over Faid street; the grade of the approach. of .aid strut on the north small be level from ti'� north line of the superstructure until it intersects the present street grade, and on the south the grade shall be an ascending grade of fomr-tenths (4/10) foot to each one hundred (100) feet from the south line of the superstructure. 4. At the intersection of Lafayette Street and the tracks of said rail- road, the surface of said street shall be depressed one and one -tenth (1-1/10) feet below the top of the highest rail of the tracks at said intersection as now maintained; clearance shall be twelve and one-half (12-1/2) Peet between the surface of the street as fixed above and the superstructure work over said street; the grade of the approach of said street north from the north line of the superstructure -shell be a straight line until it inter- sects the present grade at the south line of South Street, and the grade of the approach south from the south line of the superstructure shall be an ascending grade of one and twenty-five-hundreths (1.25) feet to each one hundred (100) feet. 5. At the intersection of Prairie Avenue and the tracks of said Railroad the surface of said street shall be depressedone and one-half (1-1/2) feet below the top of the hi highest rail of the tracks at said intersection as now maintained; clearance shall be twelve and one-half (12-1/2) feet between the surface of the street as fixed above and the super- structure work over said street; the grade of the approach of said street on the north shall be level from the north line of the superstructure until it intersects the present grade on Taylor Street, end the grade of the approach on the south shall be level from the south line of t ne superstructure until it intersects the present grade on Prairie Average. 6. (5) feet below the top of the highest rail of the tracks at said intersection as now maintained; clearance shall be sixteen (16) feet between the surface of the street as fixed above and the superstructure work over said street; the grade of the approach of said street on the north shall be an � ,' ascending grade of two and one half (2-1/2) feet to each one hund1,e.d .(100) feet from the north line of the superstructure until it intersects the present grade, and on the south the grade shall be an ascending grade of three (3) feet to each one hundred (100 ) feet from the south lirie of the superstructure until it intersects the present grade. The grade of Dunn Street, waieh intersects Chapin Street at a• point immedi- ately north of the tracks of said Railroad, shall be changed, and the grade from the east line of Chapin Street shall be an ascending grade of three (3) feet to each one hundred (100) feet until it intersects the present grade of Dunn Street. In the above matter no remonstrators appeared and no remonstrance was filed. The Board therefore find that the property assessed in said roll filed May 2nd.1916 is benefitted in the amount of assessments as shown on said rolls' and the Board further find 'that the assessment roll -filed May Pnd.1916 and the final estimate allowed Flay 2nd.191.6 should be and the same are hereby in P l l things ratified' confirmed and approved.
