Bids were received openf:d a.nd read for Pavement on Indiana Avenue from Prairie Avenue to Kemble Avenue, under Improvement Resolution No. 421. Sams referred to the City Engineer for tabulation to be reported back at 7:45 P.M. Bids were received, opened and read for pipe sewer on Indiana Avenue from Kemble Avenue to Prairie Avenue, under Improvement Resolution No. 420. Referred to to the City Civil Engineer for tabulation to be reported back at 7:45 P.M. Mr. W. Ripple of the Geo. Cutter Company with Atty. A. G. Graham appeared r before the Board At their request in regard to the vacation of tracks off of Division Street, and alleys. The Board took this -matter under advisement. Mr. Thoms.s Berkely appeared before the Board in regard to putting in water tap on Michigan Street. This matter was referred to the City Water Department for inve sit gat ion. Mr., Joseph Krill appeared before the Board in regard to the opening and improving of Washington Avenue., The Board instructed Mr. Krill to present a petition for this improvement and the same would be given consideration. Mr. C. W. Copp of the Civic Federation appeared before the Board in regard to the improvement of Ewing Avenues, along Run Village The Board agreed to go out ✓ over said street and look the same over. Atty. Meyers representing the Chicago Lake Shore and South Bend Raillvay Company appeared before the Board and presented contracts in regard to the hauling of freight in to the City over La Salle Avenue and the placing of a f reight house, Mr. . Marvin Ort appeared before the Board and preseeted a remonstrance signed by prppervy owners on La Salle Avaue this City iu%nstrating against the hauling of freight trains through west La Salle Avenue and over said Company's eight of way on said nest La Sa le Avenue. In the matter of .rht Odeferred hearing on Grade, curb sidewalk and gravel - pavement on Elmer Street from Mayr's Michig,n Avenue Addition to Keller Street, under Impoeve— ment Resolution No. 423, the Board Navin { said matter under advisement find that the resolution should be and the same is hereby and in all things rescinded. Mr. Charles Weidle r appeared before the Board and requested that Donald Street between ,Michigan Street and Main Street be improved by grading and grave tlpavement, The City Engineer was instructed to prepare a resolution for the same. In the matter of the deferred hearing on curb and walk on south side of Broadway- between Main Street ad Franklin Street, under Improvement Resolution No. 371 The Board having said matter un der advisement find that the resolution should be and the same is hereby and in all things rescinded. Hearing given on roll showing awards of damages and assessments of benefits in the matter of Vacation Resolution No. 27 adopted March 4th.1916. In the above matter no remonstrators appeared and no remonstrance vrt s filed. The Board therefore declare that the roll riled Xpril 25th.,1916. Petition received for pipe Newer on Calvert Street and Kline Street from Vernon Street to Lincoln Highway E. The s<,me was referred to the City Engineer for investigation* Petition for estblishing a grade on alley north of Lincoln Way nest from Wood Street to alley east of Wood Street." Petition received for pipe serer on Calvert Street from Miami Street to Lerr Street. The same was referred to the City Engineer for investigation. Petition received for pavement on alley west of Main Street from Monroe Street to alley south of Monroe Street. Resolution ordered according to Engineerfs re commer dr t ions. Estimated cost of the grade, curb and walk and gravel pavement on Indiana Avenue from Prairie Avenue to Walnut Street at.....03,500.00 The following grades were approved by the Board. Grade on alley North of Lincoln Way West From 'Mood ,Street to the first alley east -,-of Wood Street. Grade on Logan Street from Leand Avenue to Scott Street. Grade on second alley W. of Lafayette Street. Contract signed by Win. H. Burke for ®eater connections on Niles Avenue ,- was approved by the Board. Contract signed by Thomas Williams for water .connections on Indiana Avenue was approved by the Board. Contract forthe pipe sewer on Indiana. Avenue from Kembie Avenue to Prairie Avenue awarded to L. H. Webster. Concerning tr a improvement of -the roadway of Indiana Avenue from Kemb le ✓ Avenue to Prairie Avenue with Asphalt, Asphaltic Concrete, Bithulithic, or Brick ,in pursuance to resolution No. 421 this being the day set for preliminary award designating the kind of pavement,, the Board at 10:00 A.M. Tuesday May 9t h ,1926 ,publicly opened and considered all bids. And thereupon the Board desit-hated Asphaltic Concrete as the kind of pavement with which said street is to be improved and fixes the 22_nd. day of May 1916 at 10:00 A.L.as the time when petitions for chaging the kind of pavement must be filed,, and the Board hereby' continues this matter until the 2.3rd . day of May 1916 at 10:00 A.M. and all bids are hereby referred to the City Engineer for tabulation and report as to the lowest and best bid. Company pole on property line at 2012 Linden Avenue, the Pole aa. Wire inspector reports as follow' This is a Home Tel. Company pole and stands on tre property line and s1liould be trenched out about a foot s0 the owner can build a fence. The Board approved of the Pole and Wire Inspector's report. In regard to complaint filed by Councilman Goebel of brick walk at 1013 and 1015 Fisher Street, the Street Commissioner reports as follows : The brick walk is 2 inches lower grade than the adjoining cement walk, but is smooth. The Board placed thison file. The engineer filed the estimated cost of pavement improvement on t -ie alley North of Ls. Salle Avenue from Michigan Street to Main Street and the alley west of Michigan Street from La Salle Avenue to Madison Street at.....$2,302.00 The Engineer filed ,the estimated. cost of the pipe sewer improver.;ent in Bowman Street from Miami Street to High. Dear Sirs: - In regard to t-le a-ttacked petition for a pavement on Francis Street, I recommend that .it be placed on file to be considered next year. Resolved by the Board of Public Works of the City of South Bend, St. Joseph County, State of Indiana, That i.tnis deemed necessary to Improve' the south side of Calvert Street from Chapin Street to Franklin Street as follows, to -wit By • con- structing a cement sidewalk five (5) feet in width on the south side of said Calvert Street from Chapin Street to Franklin Street. All as shovn on the plans, and in accord- ance with the profiles, detail drawings and speci,fi cations on file in the office of the Department of Public Works of the City of South Bend, Ind is, m in accordance with the profile, detail drarrvings, ,specifications on file in the o-,rice of the Department of the Board of Public works of said City; knd such improvement is now ordered. The cost of said improvement, including the cost of street and alley inter- sections,, shall be assessed upon. the .real estate abutting on said South side of Calvert Street all according to themethod an ma,ner provided for in an Act of the General Assembly of the State of India':a, entitled " An Act Concerning Municipal Corporation , approved March 6,1905, and in accordance with and pursuant to the provisions of all amendatory and supplemental acts thereto, passed by the General Assembly of the State of Indiana. Be It Resolved by the Board of Public Works of the City of South Bend, St. Joseph County, State of Indiana, that it is desired and deemed necessary to improve Morris Street from Prairie Avenue to Rwing Avenue as follows, to-igtt By grading said street from ` property line to property line; by paving the roadway T'rom curb line to curb line with gravel three (3) inches in depth; by curbing the roadway with cement curb where sage'; is �-not already constructed and by bo' nstructing a cement sidewalk five (5) feet in width on the east side of said Dorris Street. All as shown on the plans and in accordance with the profiles, detail drawings and specifications on file in the Office of the Dppartment of Public Works of the City of South Bend, I°1diana. The cost of the improvement herein provided f'or, except street and alley intersections, shall be paid by special assessment to be levied upon the property specially benefitted , tontiie amount that the same may be legally assessed therefor, in accordance with an Act of tfte. General Assembly of the State of Indiana, entitled " An Act Concernigg :Municipal Q,orporations,O approved 1Wrch 621905, and in accordance Ath and pursuant to the provisions of all acts amendatory and supplemental thereto. The cost of all street and alley intersections, including one --half of the width of the improvement opposite street and alleys whicii run into, but do not cro: s said roadway, herein proposed to t)e improved and that portion 'of such street or a_. ley arutting upon property belonging to said City, or upon property not, subject to such assessment, sha..-1 be paid by the City in cash out of its general fund, if able to do so, or from a fund created by a special assessment to be levied under the provisions of Section 10E of the above Entitled Act. Assessments of ten dollars and more against each lot, it deferred, are to he paid in- ten equal annual installments, with interest at the rate of Six per cent per annum. A bond or bonds will be issued to -the contractor to the, amount of such deferred assessments in pro rata payment for such improvements Under no etrcumstances shall the City of South Bend be, or be held resoni- responsible for any sum or sums due frorn said property owner or or.n.e.rs for said, work, or for the collection of the same, or for the payment of any bond, bonds, certificate or certificates issued to said contractor in payment for such work, except for such moneys as shall have actually been received ruy the City from the assessments for such improvement, or such moneys as said City is by said entitled Act and amendments and supplemnts thereto required to pay. All proceedings had, and work done in the making of said improvement, assessment of property collection of assessments and issuance of bonds therefor, shall be as provided for in said above entitled Act, and Acts amesidatvyy thereof and supp;emental thereto. BE IT FURTRER RESOLVED , That the Board of Public Works fix the 6th. day of June,A.D. 1916 at the hour of 7:45 P.M. at the office of the Board of Public Works, of this City, at the time and place for the public consideration of said proposed improvement: at which said Board of Public works will hear all persons interested, or whose property is liable to be assed for said improvement, and will decide whether the benefits to the property liable to be assessed for said improvement will equal the estimated cost thereof. Be It Further Resolved, that notice of the time and place of such public consideratio n be publi hed � and mailed -in -the -,manner provided by law.
